- A Chicago police officer accused of killing two Cicero men in a Thanksgiving Day auto accident was indicted on charges of reckless homicide and drunk driving, authorities said Tuesday.
Officer John Ardelean, 34, faces two counts of reckless homicide and four counts of aggravated DUI, according to a news release from the Cook County state's attorney's office.
Let's get this straight - the Crook County State's Attorney just released an asshole who murdered two people, one of who was a decorated Chicago Police Detective, because there were "problems" with the evidence and interviews. This involved witnesses recanting testimony. To date, the only person charged is the girlfriend of the primary suspect for witness intimidation when she and another girl beat a cooperating individual. This asshole is now suing the Department.
Now we have the Crook County State's Attorney office indicting an officer on solely political considerations when no evidence exists to support the charges filed. The basis for the aggravated DUI is an Administratively Ordered breath test, which is inadmissible in a court of law (read Garrity law). The two counts of reckless homicide are equally inane as the investigation revealed that the deceased persons were (A) both highly intoxicated and (B) at fault for the accident. Reckless homicide does not include a "psychic" provision where Ardelean was required to predict a pair of drunks would drive into his path at a high rate of speed.
If the Department exempts who were on scene disregarded their own General Orders regarding some unknown timeliness of the sobriety testing, then shame on them and seek sanctions or restitution in the Civil Courts. Ardelean complied with all legal obligations under Illinois law and all Department orders. Believe it or not, Law Enforcement Officers have rights under Illinois Law and under Court rulings - we are still citizens though we are treated much worse than that.
Remember the NPR interview J-Fed did where he called us "insignificant"? J-Fed cited this case specifically and noted that the Department was going after Ardelean administratively. This criminal case is purely driven by the Machine to remove an issue from the republican candidate (who is also calling for prosecution of police officers in violation of existing statute).

Tony Peraica caused this to happen. Tony Peraica is no friend of the police and wanted the CR# list of 662 officers names made public. I have heard him on radio interviews where he slams the CPD and states that when he is the CCSA that he will aggressively charge officers.

Unfortunately, it appears that we cook county citizens only have two choices in the Cook County State's Attorney's contest: Alvarez, a daley machine loyalist and Peraica, the Republican Party's Pit Bull.
Whatever one may think about what Peraica's been saying in public, or even what he actually believes, to elect another machine democrat to this office is not the answer to this problem of politically motivated prosecutions or the lack of prosecutorial cahones exhibited by the failure to prosecute.
In no way diminishing or dismissing the dishonesty of these new, politically motivated charges, or the apparent lack of integrity displayed by Peraica in his political campaigning, the only choice in this election is Peraica, if for no other reason than that he's not a machine democrat.
There will be enough mindless democrats voting for Alvarez, along with those Hispanics who primarily vote according to race, to require every voter not in the above categories to vote for Peraica, if he's going to have a chance of winning.
And a Peraica victory is exactly what the democratic machine doesn't want.

I feel that this case was indicted solely to appease the Hispanic community for the November General Elections, which includes the election of the Cook County States Attorney's Office.
The SAO doesn't care if this case ever goes to trial or if they lose it. The only important fact was that this case be indicted prior to the elections to avoid a backlash from the Hispanic voters.
You can personally thank the Democratic candidate Anita Alvarez for this indictment.

In interesting bit of investigative reporting, though one which will NEVER be undertaken in this town, would be to investigate the number of payouts to criminals vs. the number of convictions for crimes in the County of Crook. We are all too familiar with the jackpot justice in the city and county, but are the citizens whose taxes are going through the roof? Do they know what really happens to the offenders when they are victimized?
When you have ghetto "nurses" disarming police officers and then bringing suit agains the city, thugs claiming (often falsely) brutality and paid to just go away, and on the flip side cops being crucified just because they happen to work in law enforcement, you have a system turned upside down.
How many payouts have there been in the city and the county and why? Who approves the payouts and why? Are there issues with which law firms handle the cases (kickbacks) and what are their relationships with those who hold the purse strings? What is the rate of incarceration for felony crimes or violent crimes with victims seeking justice and why?
I worked for a municipality which hid the payouts and used legal tricks like clauses of nondisclosure to hide how much was billed to the people for legal screwups (and there were plenty.)
How many hundreds of millions of dollars are going to street thugs in this sanctuary city that is crying broke and trying to attract the Olympics? Do you believe that this could be an election issue?
Lets name a few of the more popular ones that we know about and maybe someone will pick up the ball and run with it.

The Constitution requires that the offender have the opportunity to confront witnesses against him. The State bringing our the witnesses prior statements that the officer did, in fact kill, Detective Robert Soto and his female partner, in an effort to get a conviction, could not be done according to our hearsay laws. You cannot use the hunk of shit witnesses prior testimony to prove the case. You can only do so if they had made these statements in a court where they had been cross examined. Even if they had made them to a grand jury you could not use them to prove the case. You could only use them to impeach their testimony. But you can't bring out their statments that shithead killed Det. Soto to PROVE that he killed Det. Soto.
I don't think the state has any evidence to bring to the table.
The state has no option here. It's not the cops fault either. We can only work with what were givien. We can work our asses off to get statements from 'friends' of the offender, but when these witnesses recant, or fail to show up at court at all, we are screwed.

You as a citizen, which JA is, has a right to refuse conduct a breath test. The only way to prove he was drunk was to draw his blood. I have been a die hard Republican from birth but I am embarrassed that the best candidate we can put forward is Peraica. I know Anita personally from her days prosecuting gangs and she has my vote. She is one of the only Dems that would ever get my vote.
You are completely wrong about her being a Daley person, in fact look at the last vote: she was NOT endorsed by Daley or any of his chronies, I believe that endorsement went to Larry Suffredin.
I don't have much respect for Tony Peraica. This past May he was present at the Cook County Police Memorial in Cermak Park, Lyons. They have been seeking donations for the past several years but fell behind because CPD grabbed up most of the big business sponsors. Anyway, Peraica got up to give a speech, he more or less was pushing his pet project, the Youth Water Park that cost the County $4.5 million. What did they give toward the County Memorial - Zero. All monies being collected for the memorial are strickly donations. If you see them collecting, please donate as all CPD officers names will be one the monument and all officers who lost their lives while serving in this County. Peraika, KMA - typical fake politician.

My thought too. At first I was on SCC's side, angered by the false comparison of the ASA's failing to cahrge one weak case, and going forward with another weak case. However, due to my ability to think, I soon realized that in the killing of Det. Soto the state really has no evidence to bring forward.
The DUI case has weak evidence ... but it IS evidence. The Det. Soto case is different.
Let's judge on a case-by-case basis here.
No, the ASA is NOT OUR FRIEND. But these cases are apples and oranges. AND I am angered by the states charge of RECKLESS HOMICIDE. In fact, I am Irate about it. The DUI ...well, it's weak, but it is NOT AN UNFAIR CHARGE the way I understand it. I could be wrong and I am certainly not out to get anyone here. And I do understand that the Mexicans were both drunk and were at fault in that they did not stop at the sign and all the cop did was drive straight down Damen when these "victims" drunkenly shot out in front of them.
There are some questions I have about the DUI but I will not bring them out on a public board read by the media.

The States Atorneys can get an indictment against a potatoe. We know the system IS screwed up. They won't dare bring a P.O.s case in front of a judge for PC, because they know they have nothing, as this case proved. IF IT AIN'T RIGHT LETS INDICT, I HAVE ALSO SEEN MILANS BALLS ON THE BACK OF A MILK CARTON, "MISSING SINCE BIRTH".
What a waste of time and taxpayer money to further pursue this case. Once again the officer is paraded through the media circus to pile on further stress to himself, his family, friends and co-workers for a tragedy that rarely, if ever, has been fully reported. Media reports continually omit mentioning the facts against the deceased driver and his unlawful actions which caused the crash to begin with. This should blow over quickly, however the detrimental effects will be very long lasting.
Incidents like these should serve as a reminder that we are often all we have for each other and it’s in all of our best interests to stick together and not be beaten down.

How do you know he was "drunk"? Was he at fault for the accident? The investigation at the scene ruled he was not the cause of the accident. He was indicted because of a video? Where are the witnesses to the accident? He was charged and a judge ruled no probable cause. You mean that a video determines probable cause? What were the BAC's of the other two drivers? Where is the law and rights for the officer? This is 100% political!!!

Nothing with this accident could be done administratively UNTIL the criminal portion of the case is OVER, you cannot be forced to blow under the GO's and a direct order until the detectives are FINISHED with the criminal investigation, which explains the delay!
Unfortunately, when the video surfaced on all the local news outlets, the States Attorneys office as well as the 019th District looked like they were covering for the guy. It doesnt matter that the 2 mutts may have been gangbangers or not, they showed video of the coppper drinking shots in the bar which contradicted the story that he was drinking seltzer or whatever. Ummm...liberal! First off...there's no proof he was intoxicated. But, i guess you are a master at evaluating BAC levels months later by reading a newspaper. Second, the dead guys were drunk and blew a stop sign at the intersection, causing the accident. No dispute from anyone. Once agsin, because the "newspapers" say he killed them, does not make it true.
Also, witnesses in the Soto case recanted their stories due to intimidation by the gang the offender was affiliated with. They had evidence and released him.
First case, no evidence (sip your latte) as stated by a judge that you elected at his probable cause hearing...prosecute
Second case, evidence exists (sip) according to a state's attorney you elected...released.
Hopefully, I was able to educate you on the meaning of corollation. Go back to your liberal college professor and ask for your money back.

From what I understand, the off duty officer did not cause the accident. The two dead guys hit him. Even if the officer was blind drunk he was not the at fault driver. There is no cover up here, this is politics plain and simple.
There was an officer killed a year ago around 67th & Cicero. I think his last name was Hart. There were eyewitnesses in that case who I heard saw two cars racing on Cicero and struck Hart's car killing him. One of the drivers was cited for DUI. I heard the state would not approve Reckless Homicide charges against the driver because Hart was drinking. Sounds the same here, but not when it's a cop. Cop killed by drunk driver when cop drinking, no charges. Sounds like double standard.
The only way to get peace of mind is to move to a strong GOP state.

City hall is trying to tell bars when they can serve alcohol based on a sporting event. Mayor Dick shut down half of the bars in the city when he got into office and destroying the essence of neighborhoods and communities, forcing people to drive elsewhere to socialize.

If someone knows first hand any different, please correct me, but I was under the understanding that the driver of the other vehicle was the cause of the accident, and the other driver was well over the legal limit. In other words, the so called victims, were at fault. If this is true, this is definately a witch hunt to screw policemen. In any other case, the vehicle in the wrong, and the driver, are the state's main concern.
I also have to comment on the paragraph in which SCC states that if the exempts at the scene violated general orders in regards to securing the BAC in a timely fashion, they should be dealt with civily. Unfortunately, you can't win. If the exempts demanded BAC at the scene, every PO in the city would be calling him/her a JO. I am confused by the expectations of some department members.

Get your facts straight before you spout off, especially here. He got into his car, was involved in a traffic crash that was determined to be THE OTHER PARTY'S FAULT... not his. The driver as well as passenger of the other vehicle (may they rest in peace) were both far over the legal limit. This man did not kill two people, these people died in a traffic crash caused by the driver of THEIR vehicle.

If you were accurate then you'd be right..However, you are wrong. The officer was not the at fault vehicle. One of the dead guys disregarded a traffic control device thus slamming into the side of the officer's vehicle and at a very high rate of speed. This program has opportunities to work the Chicago Marathon on 12 Oct 08 and Sunday Parkways on 05 Oct 08 and 26 Oct 08.
This program has been limited to D-1 pay grades only. Any member who would have had the ability to bid for and be available to work one or all of the above opportunities and was excluded due to his/her pay grade should file a grievance under Article 16 and related articles. The body of the grievance should read: Grievant was denied the opportunity to participate in the Special Events Overtime Initiative on ( list date(s) ) due to the fact that grievant was in a ( list pay grade) status. Grievant wishes to recover all monies lost due to this exclusion and have the contract made whole.

In that case everyone in that bar caught on video drinking can be charged with a DUI without blowing on a machine. City Police Mourn Loss Of 4th Officer In Year
PHILADELPHIA -- A Philadelphia police officer was shot and killed Tuesday while pursuing an armed suspect, the fourth officer killed in the line of fire in less than a year, police said.

I was a bartender for years. I use to give water shots to people who did not want to have the shots. Some people insist on buying you/customer a shot. I can tell you I probably gave out water every Friday night!!!

The reason Ofc. Ardelean got four counts is because per dead guy, he got two counts, one for driving under the influence, causing death or great bodily harm, and presumably, one for driving under the influence (possibly) with a BAC over .08...which from the news reports show that he couldn't have done...unless there's something we don't know...or the SA's office believes they can use testimony from scientists to extrapolate backwards his BAC at the time of the accident.
And still the administration can't get it through there thick fucken heads why moral is so fucken bad !!!!!!!!!!!!!!!!
