FOID Cards

  • All members should be aware that, effective January 1, 2009, the Department intends to take disciplinary action against members who do not possess valid FOID cards. All members who do not possess valid cards should apply prior to the January 1st date. Members should keep a copy of the application with them and present it when requested until they receive their new card.
Rumor says the thinking behind this is that as a sworn peace officer on-duty, you are not required by law to have an FOID card on your person.

Off-duty, however, you are subject to different rules and must have a valid FOID on you if you are carrying.

Check your cards. We don't know if the State Police send out the renewal reminders like they used to, but better safe than sorry.

If an on duty Officer does not require an FOID Card but an off duty does, that must mean that I'm not the Police when I'm off duty, right? That must mean that I'm not subject to any of the Rules and Regualtions of the Chicago Police Department when I'm off duty, right? Because off duty, I'm no longer considered a Police Officer, right? And what if I don't carry off duty? Why do I need an FOID Card?
This could only happen in Chicago. Another ruling plucked out of thin air by a brain dead command staff.

State law was changed a couple of years ago. When off duty, YOU MUST have a valid FOID card. If you leave the gun in your locker while not at work you are exempt. On your way to or from work/ court however, you are considered off duty until you arrive/ and once you exit the building therefore are required to be in possession of an FOID card. That goes for any firearms in the home also.

Now you tell me. I just sent my application to renew my FOID card last week (my current card expires in February). I did renew my DL last week.

A quick note to everyone. I also went to buy my plate sticker when I renewed my DL. I was not allowed to buy my sticker until 2009. I have to have a 2009 check of my emissions as my SUV is older than 2006. Don't waste your time trying to get your sticker without a brand new emisions test.

If you get psyched, for any reason, the state pulls your FOID card. When you get cleared, and it can be in a month, six months, whatever, the state does NOT re-issue your FOID. When called on this the State Police pointed out that you are not required to have an FOID card to be the police. You can appeal the revocation, but there is no guarantee that they will renew your card. Even after a couple of years in appeal. What you can do is ride it out five years after the psych and then reapply. So I'm not sure what the department is up to. Beyond violating state law.

Upon retirement I had to re-register the one gun that I am keeping in the city and I will have to do so every year until I die. This same gun was registered upon purchase 35 years ago and then again 26 years ago when photos were added to the registration.

Can anyone explain why it needs to be re-registered every year now that I am retired? They even use the same registration number and they don't charge for the registration. Just another way to jam coppers and retirees.

So, let me get this straight.

If you a suffering from depression, and you do the right thing, which is to seek help rather than commit suicide, and the state yanks your foid, the city will then punish you by terminating your employement?

What the hell kind of message is that sending? We would rather that you die than do something constructive?

Don't we, as a profession, have enough trouble with suicide as it is? Do they really want people to think, at a time when thinking is difficult, that if you go to a hospital and get help you will lose your job. Good incentive for staying alive.

Who the hell makes these decisions down at 35th Street? Clearly they have no idea what actually goes on in the life of policemen.

Is this for real? I ask this because, as a cop in TN, I can't imagine any jurisdiction being so assinine. What will be next? Making you lock your sidearm up at the precinct when you go off-shift?

Also, along the same vein about assinine laws, do you guys really have to take everyone you use chemical agent on to the hospital to get checked out?

We recently had a Chicago native, who had moved down here, to decide to start blaring his music to the point that all the windows in the apartment building were rattling. When an officer was called and finally got him to the door, he started yelling that no one could make him turn his music down and he slammed the door in the face of the officer. He was greatly surprised when the door got kicked in and began to struggle when the officer started to lock him up for disorderly conduct. He took a snoot full of pepper spray and got cuffed, in a very non-friendly way.

After being hauled down to the station, his momma shows up and starts with her, "I know the law. Did you take him to the hospital to get checked out." She was told, "No, we don't do that." Then she started up with the,"Well, in Chicago, they have...." She was cut off and it was pointed out that we weren't in Chicago, or even in Illinois, so we didn't go by Illinois law.

I'll just say that if these are laws where you have to police, I really have sympathy for the frustration all of you must feel.

Doesn't it stand to reason that if we can't trust someone with a gun we can't trust them in our police force?

Why force cops to get a FOID (for that matter, why any of us, but I digress)? Why would people ineligible to have a FOID be allowed to police the rest of us?

Not being critical of cops here.

The Department can and most likely will change the General Orders to require an FOID card. Why? Because they can. They can always be more restrictive than state law on some things. After being hauled down to the station, his momma shows up and starts with her, "I know the law. Did you take him to the hospital to get checked out." She was told, "No, we don't do that." Then she started up with the,"Well, in Chicago, they have...." She was cut off and it was pointed out that we weren't in Chicago, or even in Illinois, so we didn't go by Illinois law

No we don't have to get them checked out thats another ghetto rat baby breeder that thinks they know the law .

(430 ILCS 65/2)
Firearm Owner's Identification Card required; exceptions.
(c) The provisions of this Section ....blah blah blah... while engaged in the operation of their official duties.

Again... WHILE ENGAGED IN THE OPERATION OF THEIR OFFICIAL DUTIES!!

When you are off, you ARE NOT engaged in official duties. Skip the 24/7 stuff. Going to court counts, but driniking at Duggans doesnt. If you OWN a gun, you need one. Last I checked, we all own (at least) one. Stop whining and learn the law. The law does apply to peace officers and the law applies to CPD too!

Happy Xmas

If you get psyched, for any reason, the state pulls your FOID card. When you get cleared, and it can be in a month, six months, whatever, the state does NOT re-issue your FOID. When called on this the State Police pointed out that you are not required to have an FOID card to be the police. You can appeal the revocation, but there is no guarantee that they will renew your card.
--------
You're not completely right. If you are hospitalized in a psych ward you can lose it..Not just for being "psyched" by the department...

Back in the mid 1980's the Department tried to require FOID cards.

It was pointed out that the state law then, as now, does not require us to have one.

It was pointed out under the "First Issue" clause of the contract, the city was required to pay for it.

That was the end of it.

Is this for real? I ask this because, as a cop in TN, I can't imagine any jurisdiction being so assinine. What will be next? Making you lock your sidearm up at the precinct when you go off-shift?
_____________________________
Yeah, it's for real, but it's not the law. It's more dumb, restrictive rules put on us because of our Department's knee-jerk overreaction to lawsuits.

Typical bullshit talking cop. Your FOID is ONLY pulled if you enter a mental health facility for treatment. Not for alcohol rehab, AA, or just a plain psyche while seeing a doctor. You are also separately notified of this upon admission and you must sign a form noting that you have been advised your FOID will be rescinded pending appeal. I know cause it happened to me. If you are a copper it doesn't take much to get your FOID back, just a letter from your shrink stating you are not a harm to yourself or others. Stop spreading bullshit.

The only bullshit talking cop here is YOU. This exact situation happened to a guy who used to work for me and he is STILL waiting for the State to release his card, DESPITE providing that letter from the shrink.

Just because something went one way for you, doesn't mean it goes that way for everyone. IF you're really the police, you should know that better than anyone and not be slinging insults at your fellow p.o.

It is not required that they go, but most take em, we are required if we taser them, but not mace.. I personally like to give them water a bottle of water because that is not enough to flush it out, only aggravate it...

[...]I'll just say that if these are laws where you have to police, I really have sympathy for the frustration all of you must feel.

Brother, that ain't the half of it.
This fucked up liberal city, ties our hands then scratch their heads when crime increases.

Hopefully your elected officials don't pay off laws suits like winning lottery tickets. Also, I hope your juries don't put up with the B.S. that people like, "mama" claim.

Unfortunately, I police in Memphis, TN. My city/county seem to be like two sides of the same coin with yours.

We both have Democrats running things. We both have Mayors who think that they are God's gift to us. In both cities, we have constant scandals involving friends and associates of our elected officials. We both have administrations that would rather throw a little money at the latest thug making a false accusation against an officer rather than take 'em into court. Hell, even our departments are almost twins concerning nitwits in charge that are universally hated by the rank and file. We also have our hands tied like you. We do seem to have a few things better, in that we don't have any "merit" promotions and we seem, from my reading, to have better equipment.

is the cpd going to change state law before they enact this new rule. it has never been a requirement for a peace officer to have a foid card.

12/23/2008 12:33:00 AM

there are many things for which you can be gigged that are more restrictive than state law

For example its not against state law to show up late for roll call or not to show up at all

But you can suffer administrative penalties for doing either

Hit the link. Fill in the blanks. Print. It's as easy as wearing pants.

Also, along the same vein about assinine laws, do you guys really have to take everyone you use chemical agent on to the hospital to get checked out?

Yes this is true or have paramedic check them on scene. We have stupid laws, stupid policies, stupid rules and stupid BOSSES/LEADERS.

Upon retirement I had to re-register the one gun that I am keeping in the city and I will have to do so every year until I die.
. . . . . . .

SOLUTION: Get the hell OUT of the city.
I'm counting the years and minutes until I get out of this shit here in Norwood Park.

To the TN copper,i know you have better equipment than Shitago because your equipment supplier is not a Daley (our sitting mayor, and i do mean sitting Mayor, because that's all he do is sit on his 270 lbs ass) connected insider who buys the most outdated equipment he can find then double/triple the price back to the city in a no-bid contract ok'd by the Mayor.
