Uh...What the Hell?

  • A relative of a 5-year-old who drowned last summer after falling off a rock ledge at Jackson Park Harbor sued Chicago police, alleging that an officer prevented bystanders from trying to rescue the boy.

    The lawsuit, filed Monday in Cook County Circuit Court, contended that the officer threatened to arrest bystanders who were "suitably qualified" to attempt a rescue of Ronald Evans Jr. in July. If the good Samaritans had been allowed to enter Lake Michigan, "they could and would have rescued" the boy, the suit said.

    The lawsuit acknowledged that police officers are required by law to prevent any unauthorized person from entering water to prevent a drowning. But the suit alleged that the officer's actions caused Ronald's death by denying the child his right to life guaranteed by the Constitution.

So by following the laws, rules, and ordinances, an officer is named in this suit? Regardless of the outcome, the officer is going to forever second guessed and his credibility will be impugned should he ever be sued in another matter. Where is the parental responsibility? Anyone? Anyone? Bueller?

And Shortshanks will payout again. Without a doubt. It's not his money, so what does he care?

and if the officer let people in the water in a rescue attempt and they drowned he would have been at fault also. you can't win, which is why the daily paper and a nice quiet corner of a parking lot never seemed more attractive while on "patrol".

OK, what a stupid law to begin with. How many cops even know the existence of that law. ( I guess the ones studying to be a sgt., perhaps)

Would any cop actually try to enforce that law?

Unless being physically restrained, someone telling me it is against the law, would not stop me from trying to rescue someone, that I thought I could help.

Sorry....this copper must be an idiot.If I'm on the scene where a 5 year old is drowning and someone is trying to rescue him,I'm wishing them the best of luck and will do anything I can to help(I'm not that great of a swimmer,less so in full uniform).The thought of threatening would be rescuers with arrest sounds like a joke,except some kid drowned.Can't wait till this genius in blue gets promoted.........

SCC, believe it or not, there is relevant case law. Take a read of Ross v. US. It's a 1990 case in Illinois where upon appeal the court ruled that the officer deprived the individual who drowned of their right to life by not allowing others to jump in even though the officer would have violated the law by doing so. So, basically, damned if you do and damned if you don't. Your screwed either way.
Makes me wonder why I took this job?????

People are always looking for the big payout even if it means using a dead child to do it. They'll be vultures waiting for that big check and they'll spend like there's no tomorrow and that child will have been LONG forgotten.

People like that make me sick. Why are they parents NEVER to blame? It's always someone else. The lazy, lying, manipulating bastards need to start owning up to their responsibilities and and placing blame where it really belongs - on themselves.

This evening, 01 Dec 2008, @ approx 1950 HRS on Zone 2 (019/023)a male voice was heard on the radio calling out a 10-1. The officer could be heard gasping for air, as if he was in the fight of his life. Squad did there best to obtain an address. At first, it sounded as if the officer was at 2900 S. Stewart. Then the voice could be heard asking for an ambulance at 209 S. Throop. Finally, an open key indicated that the officer, BT 2612, was part of an exercise being conducted at the academy and was on the wrong zone. My point is this, the GPS in the vehicles are an absolute waste of money. They were installed to make The King's men some money and assist in the discipline of officers. THEY WERE NOT INSTALLED FOR OFFICER SAFETY REASONS. Had they been, they would be attached to the radio so that OEMC could locate an officer. Had this been an actual emergency, and the GPS was inbedded in the radio, OEMC could have located the officer in seconds. Instead Zone 2 is notifying Zone 5 and all CW frequecies in an attept to locate this officer. This was valueable time that was lost had this been an actual 10-1. Possible the difference between life or death. Stay safe. St. Jude pray for us.

May I say I do have personal knowledge of this case. The 5 year old was present at a lake front BBQ without either one of his parents. He was taken there by a neighbor who also has a child about the same age. There were over 20 adults at this lakefront BBQ which included alcoholic beverages. There was also over a dozen tender age kids at this party. All on the edge of the lake. The death of this child is strictly due to the adults present at this party failing to watch these children and especially the deceased 5 year old. There isn't many cases where I shed some tears as I lay down to sleep at night after work. This case I most certainly did. He was a beautiful little boy. At the hospital he appeared like he was sleeping. I had so many mixed thoughts as to what he might of became or was he better off in the hands of the lord than the situation he was in with where he lived and how he lived. Either way, from all accounts, the child instantly was pulled under the water by the undertow at that location. Firefighter divers jumped from a helicopter into Lake Michigan within a few minutes of the call. And even expert divers with all their gear took over 20 minutes to find this child under the water. To blame the police is totally ridiculous.

This really is sad. I just watched this morning on WGN 9 news the mother of the goof that is being charged with the murder of Jennifer Hudson's family screaming in her ghetto tone, "Iz lettin the the City of Chicago and Stroger know...get my check ready! Iz seen Bently now I'll be driving Bently!" These lawsuits are have gotten out of hand.

Probably has someone inside Dept of Revenue. Did you check registration?

I surely wouldn't wait a month between tickets. One a day, like the vitamins. There is something about a daily parking ticket that seems to bring compliance sooner than one ticket a month.

But since that can't be, at the least the parent should investigated for neglect.

Officer do not second guess yourself. That is all lawyers do, is second guess others actions. Most could not survive outside of a court room or office. When the going gets tough, lawyers ask for a recess. A lawyers toughest decision of the day is where to eat lunch.

Just to be the devil's advocate here is my question for you....if you let say 5-6 people jump in after the kid to try and save him and 3 are caught in an undertow and 1 gets hypothermia then what? Are you jumping in to rescue them all? You can't win here. I would imagine everyone thinks they can swim well when they think a kid is drowning. But what if they can't? This officer did the right thing, this was a no win sitch.

William Balfour has a conviction for ATTEMPTED murder which means she raised a son who failed at what he tried to do or else her angel would be a murderer. Secondly, this woman has no sympathy at all for the family, she's just worried about hitting the ghetto lottery.

Personally, I don't feel sorry for Hudson's dead drug-dealing brother or momma who looked the other way while this was going on, but the 7 year old had no say in the matter. The disturbing part is the fact that we deal with people everyday like momma Balfour: people who are so removed from morals and society that they could care less about a dead child, be it their own or someone else's. All that is important is getting their's without earning a penny of it. If you have to have to break the law to do it, that's fine. If you have to punch the cop who is there to restore order to society, that's fine, punch them and sue. If you have to use a dead child as a pawn for the big payday, that's ok. Just don't make them work a job and give free handouts, that's real talk in momma Balfour's world.

Oh man, what did your neighbor did to you that you hate him/her so much and had your buddy wrote him/her parking tickets? And if you're a Police Officer, you know that you can get your buddy in trouble for writing "bogus" (out of District, location, time, etc.) parking ticket. Maybe that's why there were dismissed.

I was there after the drowning and there is no way anybody could have jumped in and saved this boy. There is at least and eight foot wall that falls straight down. It is a wall where the boats are docked and leave the harbor. The water is at least 12ft deep. Shaved is right, the professional divers had a hard time locating the boy.

The people at this family BBQ did not properly supervise the children. One lady said she saw the boy playing on a tricyle near the edge. She then heard people yelling and when she turned around the boy was gone and the tricycle was still there. Call me crazy but if I saw a little boy riding a bike near this area, I would have him moved him away. This was a tragedy that could have been avoided by responcible adults. The police officer who told people not to jump in actually saved lives that day.

This is a tough one to call. I certainly would not second guess anyone. I would not what to have been the officer in that situation.
Problem is, the lives of some of those would be rescuers, could have been lost. That often happens.
In regards to Law Suits. The Chicago Reader, has a excellent article, in this weeks Reader.

I think if I was the guy being told to let a child drown, I might have ignored the police orders and let him arrest me after the fact.

But, there is no context to the story, so its possible there is more to it than just a cop making an idiotic enforcement decision as it appears.

the truth is this child (RIP) was standing by the water, two women (no relation to the child) notified the police that the child was there one second and when they both looked away the child was gone. mind you that no one saw the child fall in, but the police not taking any chances notified supervisors, marine, fire everyone. this is one of the worst lawsuits ever brought forth. its one thing to jump in dangerous waters when you see a child fall in, but when no one is sure much tougher call! as far as this lawyer, rot in hell you piece of shit!!!

It doesn't say the gov't has an affirmative duty to protect your life, but it does say we get due process if the gov't takes your life.

I'm NOT saying the officer took anyone's life here. I'm just pointing out that the 'right to life' thing does exist.

And this case can't even be fairly discussed on this thread because #1 we don't have all the facts and #2 the lawyers will lie cheat and twist the truth to win their case.

But I will say this, if the law has been interpreted to disallow a citizen to jump into Jackson harbor to save the life of a drowning 5 year old, then that law is indeed unconstitutional, and immoral and tragic to boot.

And to the poster who stated that the cop did not know about the existence of the law, I agree 100%. Most likely, if this did go down like th scumbag maggot lawyers are portraying it, then the cop was most likely just looking out for the best interests of the guys who were going to jump in. He probably didn't want mass drownings. There's no fucking way a cop - or anybody - is going to let a kid drown if he sees a way to avoid it. No fucking way.

And I think the cop might have told people not to jump in, but if they really wanted to jump in they would have, no matter what the cop said. Now they are cowardly saying that they feared arrest? Nonsense. These scumbag cowards never wanted to jump in to begin with. False heroes they are.

But back to the original point. If that law is on the books it would seem to be unconstitutional.

I had another one written. After a month or so, a new sticker magically appeared on the bitch's windshield. I then went online to see how she paid the two tickets and they both had been dismissed. How the fuck did she get away with it? What happened to our 'desperate for money' city'? Assholes

Oh man, what did your neighbor did to you that you hate him/her so much and had your buddy wrote him/her parking tickets? And if you're a Police Officer, you know that you can get your buddy in trouble for writing "bogus" (out of District, location, time, etc.) parking ticket. Maybe that's why there were dismissed.

( he is not CPD so I will let your imagination run wild) He is the typical wife beater whose wife still defends him and is hated by everybody on the block. He gets drunk and yells at the neighbors and drives drunk. A total loudmouth who I know for a fact is hated by his fellow workers. The only reason I don't beef on him is because he has young children and to have their father lose his job or take time would hurt them. Also I have never beefed on another city worker in over 20 yrs but he may be the first.

When I came back to work she still had no sticker

But she had my autograph on a ticket under her wiper

The next day another ticket

Then she got the sticker.

That was put in place to protect all people from having their life taken from them without due process of law. Im sure the officer there was trying to keep the situation under control the best way he/she could. I would think that one victim in the water would be enough. The issue here is whether the officer did anything wrong or malicious. I choose to believe he/she did the best they could under the circumstances and the lawyers are trolling. It is disgusting and should be thrown out of court.

I'll try to be nicer, even though I seriously hate people. How you all deal with the public on a daily basis is beyond me. There are way too many idiots in the world and I just don't have the patience for them.
