Questionable Endorsement

From an e-mail, a regular reader points out that in the newsletter, the FOP endorses Dan Gallagher for Circuit Court Judge.

We know that the FOP tends to endorse any candidate that shows up for the meeting, but if our e-mailer isn't mistaken, Gallagher was the public defender who succeeded in getting off the shooter of a Chicago Police Officer in the Rockwell Gardens complex. Gallagher spent his time in Judge Evelyn Clay's courtroom belittling and attacking the investigating detectives claiming that the confession given by his piece of shit client was (surprise surprise!) coerced.

Anyone from FOP want to explain this endorsement? Because we are kind of steaming right now that someone who spent time defending this asshole and attacking our detectives with baseless accusations somehow got endorsed in our names.

The FOP endorsement process is big b.s. Donahue decides who to pick and then the board goes along. Donahue is looking for a job after he leaves FOP. Rumor has it Donahue wants to be a lobbyist.

Wow. If this is true about the endorsement....it shows the FOP is not in the know. But then again we are talking about the FOP. I get this feeling that a lot of what the FOP has told me in the past is a lot of lip service anyway. Clueless people just trying to make you go away by giving you a little bit of advice, or some half-ass attempt of righting a wrong. You feel me? For instance, the behaviorial program that many officers were put on. Whatever happened with that???? Some officers got an apology in writing from the CPD. That was it. What did the FOP do for the officers that received the apology? What recourse was enacted for the INNOCENT officers that were raked over the coals. Those physicals and psychological tests that HAD to be done on the officers time. Where was the lawsuit??? Did anyone ever collect any monetary settlement from anyone? Just like 9-11, there are officers out here that aren't forgetting about that behaviorial program that was akin to something like Nazism. So these endorsements that are made by the FOP is NOT the word of God.

I suspect it is because there are 2lawyers named Dan Gallagher. The one running for judge is a public defender who was assigned to Judge Clay's courtroom as set out in SCC's article. The other Dan Gallagher is an attorney who has a long history of representing police officers and is presently representing police officers in more than 50 cases in state and federal court.
FOP may have been misled as to which Dan Gallagher was the candidate for judge. The one who is defending police officers is NOT the one running for judge.

You want to talk about a conflict of interest?? I was attending my regular traffic key and seen the unthinkable. OUR FOP attorney Tom Needham was representing a civilian who struck a POs vehicle on the way to work causing personal injury. Several times during the trial , Needham asked the officer about his employment (district, duty hours ,etc). POS!

If I remember correctly, Dan was an older-than-usual ASA in Felony Review, then in someone's courtroom, then a trial assistant in Felony Review, then fired from the SA's office (alcohol-related), thereafter working for the other side with the PD's office. I remember Dan as a good guy who knew the score. He drove an antique, rare Mercedes-Benz convertible and was part of the Jean's crowd.

Well, ALL lawyers and PD's claim confessions were coerced. I believe there was even a formset that the PD's office used for the accusations. It was usually the only defense they had against the atrocity perpetrated by their clients. I never heard of any Detective getting into trouble from the testimony given in motion-to-suppress hearings. This charade was all part of the game. Once in awhile a judge would suppress a confession and a case would fall apart. But most confessions were not suppressed and Bad Guy was convicted. There was even a Catch-22 to it. If the PD's office did not mount a vigorous defense (I suppose accusing the Detectives of coercion was part of that) Bad Guy might win an appeal that he was not represented by adequate counsel. Boy, when you think about it, we have screwed up system.

HOWEVER, there are lawyers who take the charade further, like Jeffrey Haas and the People's Law Office and that whole group from Northwestern U. and file civil suits and whine on TV and in the papers about how their client-dogs were mal-treated. They also go to the G. These are the dog-lawyers who cause misery.

Maybe I'm wrong and suffering from selective memory (you know like you remember the good things from your time in the service and forget KP and shit-burning) and Dan turned into a Bad Guy after being fired from the ASA office, but I remember him as being a pretty decent guy.

I have been on the job for 21 years and have had multiple cases in front of Mr.Gallagher. I have always found him to be fair,and dedicated to simply finding the truth. A defense attorney,especially a Public Defender is usually in a coppers eyes,seen to be the Devil. I have never found that with Mr.Gallagher. As a judge he will be fair/open minded and in the era of the police being prosecuted with malice I'd be very relived to have my case tried in his court room.

Our job is to put people into jail and its the media and PD's job to get them out. ASA's put the makeup on your face and judges get paid extra to manage the circus.

And around and around we go until 20 years goes by and off the merry-go-round you go and on comes someone else.

Your job is to bring law to people who want none of it at the behest of the man they insist on voting for. Nothing more.

FOP sucks! I say we get a clas action law suit against them. I'd like to see everyone get their 2 years of dues back. Two years they failed to negotiate a contract for us.

We pay them to represent our rights, contracts, and salaries to best reflect the cost of living and what is fair and just. They have failed us in that aspect yet continued to cash in on our dues. What the fuck do we pay them for?

It's a business. Nothing more, and without question, nothing less. It's very design is for US! We pay, they play and act as though they are in it for us. I'm no genius but damn, we've been getting the shaft with no sign of a contract in the works. Smoke and mirrors.

The economy sucks and I think the money would come in handy. It might also wake these bums up and make them hungry to do what's right.

I agree about the situation over the BIS that many officers where placed in and they suffered and worried along with their families and asshole FOP did nothing. I contacted them and I was told nothing can be done. These were some of the hardest working officers in the city and not the ones that avoid work at all cost. FOP's a Joke and is not interested in the membership and just themselves. If teamsters came in, I would switch in a second.

Any dealngs I have had with Dan Gallagher in court are to be expected from a. PUBLIC DEFENDER. He has always been more than fair and at times complimentary after the trial. On occasion, seeing him outside of the courtroom he holds no grudges towards us and was a complete gentleman. After years as a P.D.who better than to see threw all the nonsense that bad guys throw out. He'll be getting my vote in Nov.

If you are or were a police officer, this is very hard to watch. It is an example of today's new PC officer, trained to just kiss ass even when faced with death for fear of law suits or reprimand. Notice this cop's last word was "sir".Can you believe that? sir?? talking to that piece of shit under these circumstances? Probably doing what he was trained to do in an academy whose curriculum was formulated by a bunch of neo modern assholes who never worked the streets to see what the real world is really like to, never draw your gun, just show them respect and they will comply, but don’t hurt 'em cuz we don’t want any law suits....sure they will. Of course it is easy for us old timers to say that the cop should have taken charge right off the bat at the first escalation with a good smack up side the head with a baton or slapper followed by cuffs and the first sign of a weapon in this scumbags hand would have been his last act. The asshole should've been dropped right where he stood as soon as the gun came out. If he would have done that instead of worrying about being sued or reprimanded later, but he'd still be alive. Tragic and sad. The blame goes to whoever trained him.

But just the fact that he was a public defender in the past is enough for me. I'm sure many times he knew in his heart these a-holes were guitly yet he still feels the need to try and free them. That very notion is what's wrong with this county. If he's guilty, he's f*cking guilty. Quit trying to get them off on a technicality. Put them away from society and where they belong - in a cage.

Second City Cop. You have our full and undivided attention. What about this site being for police officer information? What did happen to all the officers that were apologized to in a letter from CPD? Was there any monetary settlement or any FOP lawyers working on this case? When the program happened there were a lot of things happening with an underground movement and a lot of phone calls to individual attorneys and lawyers by most of the police officers involved. It was almost pathetic that the cases were not all bundled up in one nice package by the FOP lawyers and a mass lawsuit filed. That was the greatest slap in the face to the officers that the FOP refused to do anything. The PROGRAM prevented officers from any promotion, tainted their resumes, and made them suspect among their co-workers. Sounds like at least some monetary settlement could have been gotten. Lets face it. Some mutt files a lawsuit against the city over some bs and gets thousands of dollars. An officer has no recourse? An officer gets SLANDERED and his/her own union can't do anything? Blood and urine samples taken from officers because the program dictated it. A violation of constitutional rights and the FOP couldn't do anything. Where are the posts on this one SCC? And now a questionable endorsement from FOP? THE WHOLE FOP IS QUESTIONABLE WHEN IT CAN'T EVEN STICK UP AND HELP OUR OWN OFFICERS. FATHER NAGLE ARE YOU LISTENING? I am not sure which Dan Gallagher is running for what, however, the Dan Gallagher that I remember was always pro-police. When he was in Felony Review (1980's era) he had a very high approval rate compared to the other 31 ASA's in that unit. Makes no difference to me since I voted early and voted Republican, as usual.

Generally speaking public defenders make better judges than ASA's.

Judges who were former ASA's look at a case and see all the holes in it.

Judges who were former PD's look at yet another defendant who is lying through their teeth just like all the other defendants he represented in the past.

Judges at 26th street who were former PDs tend to go very light on the drug sentences and very heavy on the violent sentences. Former ASA judges tend to do the reverse.

This video is infuriating to watch. Not only because of the crazed shooter but just watching the Officer waiting until its to late to react. Not only did he not draw his firearm until much to late but he neglected his other tools. OC or the asp/baton could have brought this to an end before firearms even entered the picture. Like the website says, command the individual to do what you want them to do and if they don't you move to the next level. I'll tell you once, maybe twice but after that the kids gloves come off. RIP to the Officer. At least let us learn from his mistakes.

I was in that courtroom during some of those hearings. Watched Gallagher repeatedly accusing Latino detective of calling the defendant racial slurs. Hammered at him over and over, even though he kept denying it. Finally, the detective pointed out that he himself was a minority and had people throw racial slurs at him his whole life and, as a result, never used him. He was so believable, Gallagher was forced to back off. Score one for the good guys!

A defense attorney,especially a Public Defender is usually in a coppers eyes,seen to be the Devil. I have never found that with Mr.Gallagher. As a judge he will be fair/open minded and in the era of the police being prosecuted with malice I'd be very relived to have my case tried in his court room.

I just got a letter from the ILFOP president Ted J. Street asking me to vote for Mike Macellaio in the 36th House district race.

Macellaio is a Madigan hack and police hater.

Street, as you might remember, collaborated with scumbag Paul Halmke of the Brady Campaign in endorsing Tammy Duckworth

Where do we get these clowns?

Hey, I'll explain the edorsement. Gallagher is Irish and the SOB'S at the FOP are Irish. Thats why Gallagher recieved an endorsement. If you are Polish, Italian, Lithuanian, Czech, Norwegian, or belong to any of the other ethnic groups who built America you could cure cancer and still not get endorsed by the FOP. It's been that way since Dineeen headed this venerable Irish drinking fraternity and it remains so today. There is as little credibility in an FOP endorsement as there is in the merit promotions they are afraid to fight-"Daley will be mad at us if we do, shudder!"

You want change? Stop voting for democrats, and most Irish. And call in favors with family and friends so they, too, will vote for conservatives.

Hey SCC is there any chance of getting a list of "SCC Recommended" judges? The opinions of the members of this blog would be greatly appreciated by the civilians who support CPD. Your readership deals with these judges frequently and knows who is good and who needs to go, most civilians have no clue.

An SCC Palm Card would be a good thing!

was never an ASA; he is just another heavy as whale shit irish
door bell ringer who got the nod from Mr. Herbert who iced the deal with Dick(less) Devine and the rest of the short midget's crew to run UNOPPOSED in the Dumbocrrrat primary. He is known as an "in and out" guy at 26th St. He has screwed up assignments for three of the biggest judicial ass clowns (Sacks, Clay and douche bag Nick Ford) by being late and ducking early. Area 4 had a semi real death case with a predator rapist and this guy ducked the trial to campaign. Mark was told to endorse him; so what , he is unopposed and the ONLY way to stop him is in the General Election...but of course you would have to vote REPUBLICAN; so don't worry about it till then and maybe somebody knows who his republican oppostion is. Carry On and worry about each other, not this 'golden child'.

Whoever posted that Macellaio is a policehater does not know what they are talking about. Mike Macellaip is a stand up guy who is friends with many CPD. (perhaps you were confused w/ his uncle). In fact his father in-law Lt. Cushing was one of the bosses ever on this police department. ..real police in 7, 12 and narcotics.
