"One Last Chance" Equals Death

  • Judge Thomas Fecarotta Jr. didn't know if he could believe the teen standing in his courtroom anymore.

He'd given Mathew Nellessen, who was back in court because of a probation violation, chance after chance, and the judge's frustration seemed to be bubbling to the top.

"The public is going to say what is with this crazy judge, he got a kid that he gave a break to," the Cook County Circuit Court judge said at a hearing in March, according to transcripts.

Even Nellessen's public defender and the prosecutor had agreed to four years in prison. But Fecarotta opted to give Nellessen one last chance: He credited the 19-year-old Arlington Heights man with time served, released him from custody and recommitted him to probation.

Less than a month after his release, prosecutors say Nellessen murdered his father.
Not just murdered, but slaughtered him with a baseball bat and a steak knife after making him sign over a check for $100,000 from his retirement funds. How could anyone not see this one coming? And what consequence is laid at the feet of the judge? We don't think he's civilly liable. The state's attorneys? Nope, not them either. The system is broken and no fix is forthcoming.

The father's blood is on that judge's hands. time to make judges accountable for their "judgements". this judge's actions allowed this kid to commit murder.

With that, they should really remove the fucking judge. His judgement seems to be in question. They are there to see that justice is served and the public's safety not compromised because of their bullshit liberal views.

This has to end.

You're right SCC!

The system is broken on so many levels that it's not funny.

At the elite level you have the investment and mortgage banks.

They busted out the real estate market, busted out the job market, busted out the global economy and no-one.... not the president, not the congress, not any of the regulatory agencies, not any one of the politicians have the balls to bring these crooks to justice.

Some people blame the people singing the liar loans for buying things that they could not afford.

However it takes two signatures to make a contract and what's the highly educated bankers that were entrusted by their shareholders to protect their interest excuse?

No-one put a gun to their heads to make these loans.

RICO should be busting every one of them.

First they made the loans. Then they bet against them knowing the people could not pay. Now they are filing fraudulent affidavits with the courts to the tune of at least 10,000 per day.

10,000 felonies per day and they have Washington running cover for them all. Oh you don't like that fake signature. Just give it back and we'll do it over again. WTF is that?

It's NOT RIGHT! It's at every level too. You see, I see it, most all of us see it. How much longer is it going to be allowed to go on?

I'm starting to think that our leaders intentionally let things like the daily city shootings exist in order to create a distraction away from the deals and scams the politicians have going on with the corporations.

The states attorneys too much power and control. Face facts if they were good lawyers they would jobs making a hell of a lot more than what they are being paid. The Cook County States Attorney's Office is filled with political hacks and bottom feeders.

Even the kid's public defender agreed with the ASA to give the kid 4 years. Yet the judge put the little turd back on probation. This one isn't on the SA but clearly on the judge who is sufficiently lacking in judgment to be removed from office. Remember this judge the next time he's up for retention!

This time the judge will really get tough! Murder of his father? Prison time almost certain! 5 years at least! And then double tough we really mean it this time probation! That ought to teach the misbehaver to flaunt all the breaks he was given!

Remember all the "there is no such thing as a bad boy" crap?

Oh yes there is.

When a criminal comes before a judge charged with a crime isn't the judge bound by some type of rules as to how to act?

I mean, the law in Illinois say's that if you get caught with a gun, xxx will happen.... If you get caught with a gun a second time then xxxx will happen.

These are not guidelines that the judges face. These are laws that people voted on and wanted. Judges are what people voted on and wanted.

Why are they allowed to just put someone on probation and then probation on top of probation and then super secret probation. The law on some things are clear. They are not just for "every other judge except me." It is the law and the judges break it every day.

Wouldn't it be nice if we could just apply our work just as a "guideline?" Arrest someone, or not because we decided not to follow the law?

It has to stop but I can't see a solution..... can you?

4/22/2011 12:17:00 AM

Actually they did. The Federal Government, in their rush to make us all equal, made the banks start giving loans to people that were "disadvantaged". The banks took it from there and went nuts and gave them to anybody because they had the Federal Government saying it was OK. Don't look to the Feds to go after anyone.

As far as the judge goes, they are all like that. Let 'em go! It's not their fault! At least this monster killed the man that spawned him and made him in to the piece of shit he was. Bad parenting is behind most of these monsters. Not all, but most. 'The chickens come home to roost'.

ARE YOU KIDDING?

We [police] are held to higher standard. We are held civilly liable. Just ask the States Attorney's office. Yet a judge[s] time after time gave/gives these poor misunderstood bust outs chance after chance and yet they [judges] are never held accountable for their actions.

Come on! Yeah the system is broke. But how can it be fixed. It's hard to tell which is worth keeping around and which should be launched. Just ask the average voter who isn't in court every other week why they voted for judge so and so.

You what would really be funny? Seeing judges and attorney's held liable for a bad decision. Talk about change? I bet the 'SYSTEM' would get a fix or two then.
Maybe then the run to be a Federal Court Judge appointment would be more palatable.

Loyalty has moved from the family to the DVD player. Watch it. Was it Hoffman or Rubin who said "Kill your parents?" Here's the fruition. Time for a lock on the bedroom door and eyes in the back of your head, I guess. They are "re-making the world."

What a bone headed statement. I, being fiscally sound, and knowing my limits , turned down a higher loan amount on my recent home purchase, because i know what I can afford. And NO ONE put a gun to my head to borrow more. It's the consumer who needs to be more RESPONSIBLE for their own actions. Now try to stay on topic.

Lord Of The Flies. You're right; with Dad scared to death of them and Mom on the cell phone, the Hollywood/New York "entertainment" axis is bringing these kids up by mass remote control, via Redbox and Xbox and Iphone and Ipod.

Hiawatha Park and Oriole Park and Norridge and Park Ridge and Berwyn, and the same crowd always outside what I think of as the "Stupid Store" at Harlem/Irving Plaza...it's all Myspace now. Horrible nine-year-olds bellowing like an outraged -- well, man, for God's sake.

"Natural Born Killaz," all of them. It says so on the DVD. Someday they will shave, if they don't get killed pulling a Columbine first. In the meantime, let's go play "Grand Theft Auto."

The social contract has been cancelled when the skull-shirt-and-skateboard bunch is sporting around a fast-moving freight train, grabbing at it as it blurs past, a quarter-million pounds of steel-wheeled instant death per car, and an adult -- tired by now of being cursed at -- simply turns and walks away in disgust.

Got better things to do...

(There are some awfully good kids too. Not easy to do in this environment...impossible with just virtual parents.)

As I recall, isn't that where an off duty Chicago cop was killed when he got into it with a couple of local kids?

I don't remember what the disposition of the case was, I do know the trial was held in the 3rd district courthouse.

One of the defendants attorneys was the former CPD Superintendent, Richard Brezcek.
