Half-Assed Verdict

We're glad for the conviction, but what the hell is this?
  • A Cook County jury Thursday night found a South Side man guilty of aggravated battery with a firearm for shooting and injuring a Chicago Police detective.

But jurors weighing in on Bobby Selvie’s case acquitted him of the more serious charge of attempted murder.

The jury sent at least one note to Judge Timothy J. Joyce that indicated they were “struggling” with whether “shooting a gun at someone means intent to kill.”

Seriously? Can we get a judge to send a copy of the ILCS into the jury room? Jagoff wasn't looking to send flowers to the detective. We can just imagine this defense popping up in courtrooms across Cook County over the next decade.

Hopefully, the judge makes up for the jury's shortcomings by going for the maximum sentence of 60 years.

Eventually the phrase "a reasonable person" will disappear from the language in courts. Intent will become an impossible thing to prove without a confession. Even then it will be difficult. Just because they broke into your house doesn't prove intent to burglarize it. Just because they shot you 10 times doesn't mean they intended to kill you. The list goes on.

Same screwed up verdict came from a Cook County jury last year with the PO that was shot in the neck in 014. That shithead got 50 years I think.

What do these people think the offender is trying to do when they shoot cops from a few feet away???

The only positive is that the sentencing guidelines are almost the same for Agg Batt/PO and Att Murder and its mandatory 85%.

SCC,

This truly is UN-UN-FUCKIN-BELIEVABLE!!!!

How can anyone question when someone points a gun at a person I.e. a police officer...there ONLY intention is to indeed kill the person ( in this case, the detective) ...why else would they do that other than for the mere fact of what the weapon was used for!!

He didn't shoot him cause he loved him!

Stupidity is running rampant in the courtrooms!!

When I think no one can surprise or amaze me anymore....something like this happens.

Except if your a cop.

Regardless of whether he knew he was shooting at an officer, he shot him in the BACK! I could maybe see this verdict if the officer was running towards him, then the shithead could try and garner sympathy by using the excuse "I didn't know who this guy was. I was defending myself".

But shooting a man in the back who is running AWAY from you?

Who out there would venture to guess the out come if it was the detective who had shot the shit head in the back while he was running away from him? HHmmm?

Boy, bitch slap a shackled prisoner and lose 2 years of pay. Then when you have served out your punishment get hamstrung with a civil rights violation and get sent to prison for 3 years.

But shoot a man in the back who happens to be an on duty police officer and suddenly the law gets hazy.

More proof that after 60 or so years of liberal, progressive propaganda supposedly ordinary citizens have had their ideas of right and wrong altered. If you hear the big lie often enough and it is promoted as the right way to think by the media, the federal and state government, people begin to believe it. Does anyone believe that in the '40s or '50s a Cook County jury would send a question to the court asking whether shooting someone with a gun was proof of intenet to kill? The thought processes of citizens have been permanently altered by the constant drip of socialist propaganda. It has in many places throughout this country, where there are large groups of people dependent upon the government dole, become the dominant thought pattern. Look at the OJ Simpson murder trial result. Why are the people of Florida having to watch the prosecution twist itself in a torturous pretel like fashion to prove that Casey Anthony killed her daughter? How can anyone doubt that when a child goes missing and the mother doesn't report it for more than a month, the mother goes out partying and gets a tattoo saying "The Good Life" knowing her baby is missing, and the baby is found dead in a plastic bag 6 blocks from her house that the mother killed the child? Again, 50 or 60 years ago there would be little question about the culpability of such a mother. Now, we have seven or eight week trials where people seriously question her guilt. Our culture has taken a turn for the worse and being a law enforcement officer is a thankless but oh so necessary job. Stay safe and God bless the Thin Blue Line.

Like most of us, this verdict sickens me. The fact that 12 citizens of Cook County believe that the defendant DEFINITELY & BEYOND A REASONABLE DOUBT shot a man, a police officer who made it his life's work to serve & protect these very citizens nonetheless, but perhaps only meant to hurt or wound him, not kill him, is completely insane. It lacks any common sense. The jury is of course rigidly shielded from this animal's previous arrest & conviction history during the course of the trial, but I would love it if it were mandatory for these obviously naive 12 individuals to attend sentencing when the judge will enlighten them as to the complete waste of human existence he (and his savage kin) are. We can only pray at this point that Judge Timothy Joyce shows more wisdom (& zero mercy) in his sentencing decision.

Detective Johnson, Mrs. Johnson, Tom McDonagh: PLEASE keep SCC posted on when we can expect this animal to stand before the judge for sentencing. I want to see the look on Mama Selvie's face when she hears the judge enumerate all the reasons that she has failed society by continuing to breed less than human waste.

To the rest of us: this verdict should mean a zero tolerance on anyone with the last name Selvie, or even associated with these savages.

Ok we all know how bad the Cook County Judicial system is and that we need more Judges that have pro police and law (not ones that interpret the law HOW THEY want to) views. But more importantly have common sense. The 2012 primary elections are up coming and for those that are interested that are CPD or are Law Enforcement now is the time to start planning to run for Cook County Judge. It is foolish to think that it can change overnight but having Law Enforcement on the bench is a big start. New rules have gone into effect for those running for Judge and it will be making things a little harder and costlier for everyone running. But that doesn’t mean one should not make attempts. For those who are interested in running for Cook County Judge can contact me at:
CPDfor2011@yahoo.com
The second issue is to make an attempt to change the 60% for retention Judges. Unfortunately 60% is in the State Constitution and a Citizen State Referendum is needed to change that. The only problem is that over 298,000 signatures are needed to get placed onto the ballot. Now I recall that SCC was a big part in getting things together for a petition drive to reduce the Alderman to 25. Now with the help of some others organizations and State FOP lodge this can work. I would suggest making retention Judges at 70% and that would help clear out a lot of these goofy judges and not make it a lifetime appointment. A little more research must be done but I believe that the referendum can be placed onto the primary election but if not I know that signatures can be gathered 6 months prior to the general election. Of course over 298,000 signatures will be needed as I am sure they will be challenged.

From a retired dinosaur:

This is what happens when the liberal mass media is allowed, without outcry from the police unions or police administration, to continually print that every shooting victim is an honor student or choir boy; when every police officer is castigated in the press for using appropriate force when in the performance of their duties.

This is also what happens when attacks or crimes against police continue without police response - i.e. when a cop gets injured by a criminal in a district, the entire district goes on a rampage of tickets and stops until the offender is in custody. If a ccop gets killed, the city goes on a rampage, etc.

Police are an orange target on a green field. Police don't have any backup, we only have each other.

St. Micheal, protect us.

Stop acting like the defendant in this case won. He was convicted of shooting a police officer and will face a sentence between 15 and 60 years at 85%. He was convicted even though no one saw him shoot; he was excluded from the mixture of DNA on the gun that was used to shoot Pat Johnson; and virtually every witness who testified was impeached in some way.
If you didn't know these facts, its probably because you didn't talk to anyone present at the trial. Every right thinking American should be upset when a gangbanger gets away with shooting a cop. But in this case, lets wait until the jagoff is sentenced before we consider this a win for the gangbangers.
Let's hope the judge gives him the maximum and we can ask him if he feels like a winner when he gets out of prison around 2062.

He can only preside over the trial and instruct the jury on the law. He can't force them to have common sense.
Welcome to Cook County Juries. These are the same people who brought you Blago and Quinn, Daley and Emanuel.

"Joyce sucks. I had him on murder trial before and he found the jagoff not guilty based on the victim not remembering some pre-pubesent mustache."

Hey Sparky, Get a Clue. THis POS knew his only chance was to avoid the Common-sense Judge by chossing to have his case decided by a Cook County Jury--the same people who have been electing Democrats since time immemorial.
Judge Joyce could only referee this one. He couldn't think and vote for the jury too.
When a single finger gets the ID wrong, it's going to be very tough to get a Murder conviction. (your case). (I suspect you meant a witness and not the murder victim)

Amen 7:48:00.
Yes, It should have been Att Murder, but it's a conviction for the shooting in a close case. I was afraid when the jury heard the word "excluded" in the DNA results, the CSI effect would overtake them and all would be lost.
The ASAs did a good job to focus the jury on all the evidentiary ties to the defendant.
Let's hope the Judge gives him what he deserves.
