Offender Charged

Why no Felony Murder?
  • A man has been charged with attacking an off-duty Chicago Police officer whose motorcycle struck his 4-year-old cousin in Maywood Saturday. The officer shot and killed the girl’s father, who also allegedly attacked him following the crash.

    John Passley, of Bellwood, was charged Monday with one count each of aggravated battery to a police officer and aggravated battery on a public way, officials said. He will appear in bond court Tuesday.

    The officer — a 43-year-old, eight-year veteran of the force — was headed home Saturday evening when the incident began, Fraternal Order of Police Spokesman Pat Camden said.

A death in the commission of a felony would seem to fit the charge of Felony Murder, wouldn't it?

An e-mail relates the officer is resting at home but may require surgery to repair damage from the crash and beating.

If you have the money and are ready to pay the high taxes for the least amount of services in the city then yes, those are great areas. Doubt you'll be able to touch Sauganash and Edgebrook though, but give it a look.

those are all great options as long as you can afford it with your family. taxes are higher in those neighborhoods as well as the price/value of homes. there are also some great public schools in those neighborhoods. don't consider the southside as long as you can afford the northside. if you are new on the job i'd imagine you are going to a southside district so all you have to consider would be the lengthy drive to work. it'd be worth it trust me. good luck bud.

Move as far northwest as you can afford. Then, find a job outside the city, preferably the state, using your cpd academy training as a springboard to another department. Henderson, Nevada is one to look into.

In TV news film of this scene, one could see numerous numbered yellow markers near the downed motorcycle on First Avenue.

It appears as though (I wasn't there) this officer about emptied his pistol magazine in a desperate fight for his life -- stunned, badly injured, alone, outnumbered, attacked from in front and from behind, in danger of losing his weapon, at night, bright lights from passing vehicles making even his vision more difficult.

Whether one shot or a dozen were fired, it is my personal opinion that the officer did only what he was forced to do.

My point -- the law allowing all involved in an attack like this to be charged with murder is good and proper and should be used here.

No matter what the circumstances or how justified, skilled, and well-trained the officer is, there is an inherent risk to the public in discharging a firearm in any populated area.

Aside from this risk, logic would say that there was an additional hazard created by motorists stopping, swerving to avoid the incident, etc.

THIS IS AS BAD AS ANYTHING GETS. Right in the middle of a busy street. Other innocent people could have been injured or killed in this senseless assault.

I would urge that the charges on the second offender be upgraded in this case.

My condolences to the officer, I have the upmost respect for the job you officers face daily. I have a off topic question though... I understand there is a blade length limit of 2.5" on knives carried on a citizen. And mace of any kind is illegal. In your professional opinion, how strictly is this enforced? I have a fixed blade knife with a 3.25" blade that has a plastic sheath with a whistle built into it, and is worn by a lanyard around the neck, while I'd definitely use the whistle first, if the knife was implemented in self defense would charges be brought for use/possession of a illegal weapon? I want to abide to the letter of the law, but fear simply possession of this blade on my person could be trouble for me. I'm a s/w professional female and have already been mugged since I moved into the wicker park/ bucktown area 6 months ago. I've given up yoga for judo lessons. Any opinions or advise would be greatly appreciated. I am in no way a vigilante, just want some kind of visual deterrent from attack. My prayers are with all of you guys on the street. And I hope you take care of yourselves first, I can take care of myself ...if allowed.

Forget Jefferson Park. Even though most is ok, but
Edison Pk. & Norwood Pk south ends are seeing a collapse and an increase is Sect. 8. along with scattered foreclosures which are being grabbed by the plague.
Go way north/nw on these 2 neighborhoods.
Sauganash & Edgebrook, albeit way on the high end of the price and r.e. taxes spectrum, are best for longevity.
Look for deals in these 4, even a smaller expandable house. Prices are at their lowest now, With your step raises in the coming years it becomes more affordable.
Drive around at night (9-11pm) any area you choose. And look at who's out & the kind of cars that don't move in the morning to go to work. (dubs,tints,lots of ft.end dui damage).
Don't forget to drop a couple bucks into Def Comp.
30 years? I remember a lot of 025 had nice neighborhoods back then. (montclare,galewood,hermosa,belmont hts,cragin)
The way the city hands out money to the deadbeats, Herb Dilla or some other Elgin family may be your neighbor soon.

Go to Edgebrook if you can afford it. It actually looks like a suburb.

A friend of mine is a Park Ridge cop and they are having a problem with Kings doing dope burglaries on Canfield.

Other people are also objectified like this. Thus the total disregard for life at any level. You will get spit all over, get scratched by dirty fingernails, catch an elbow in the face, get stepped on -- and that's just being near them.

I would say it is a primal, incoherent rage against the incomprehensible demands of a complex, rectilinear, highly technical environment not of their own making, except that they are even more out-of-touch in a quiet rural setting.

You are seeing people who genuinely can't tolerate being inside their own skin -- they just can't stand being with themselves in their own container. You can see them shrinking away from their own clothes -- it's like they are lost inside, projecting this tensed-up thing like they can't even stand the touch of the fabric. It is a trip.

Whatever is found in a library or a museum or a cathedral or a beautiful tea garden with the gravel raked just so, all this is the exact opposite.

...but you know what really blows me? The same people who are incapable of holding any employment because of their infantile, explosive tempers, the same people who destroy any environment they are placed in, are able to cope with sophisticated equipment to be able to TAKE VIDEOS OF EVERYTHING AND PUT THEM UP ON THE WEB.

So they can get arrested.

They can't spell, but they can do this. I just heard one, someone tied three dogs to the RR tracks, waited, and videoed the result. They treat other people no differently.

I think we both got our psychology majors from the ones hanging out bus windows making guttural sounds and giving us the finger...no psych like street psych!

I transplanted from the South Side years ago. Sauganash and Edgebrook were out of my league financially. These two would be your best bet, if you can afford them. Edison Park is a fairly safe bet for the long run. Norwood Park would be next.

There are problems coming from the east and south in Jefferson Park. I do not recommend this area for the long haul. There are more renters in Jefferson Park, some are section 8, and I'm seeing more goofs walking around in their ass pants. There is tagging by the Latin Kings in the area. Portage Park is having problems with these mutts too.

Get as far north and west as you can afford.

Just wanted to sincerely thank everyone who took the time to write about the neighborhoods up north. It's a big decision financially and a place to put down roots is something I don't take lightly. Grew up in a greats safe neighborhood and most of my friends today are still guys I grew up with. I want my kids to have that same experience. I never thought of the renting idea. That is very interesting and very possible. You guys are great and I thank you for sharing your knowledge with me.

I always read here how many "rental apartments with section 8" there are in that area. You could have fooled me. From what I saw, an awful lot of multi-unit apartments were converted to condo back during the real estate frenzy, Me And My Brother From Poland Overnight Realty, anyone who could scam a bank loan was flippin.

So where are all the problems -- third-party rented-out condo units? Up in the many three-flats?

Yes someone mentioned gang tags in Natoma/Higgins area; not so long ago some s__t came up from 025, take-off of a dealer right around there, believe arrests resulted.

Montrose/Austin now -- tags "CPDK 16 DIST K."

Oh -- don't let name fool you. "Latin Kings" are not necessarily "Latin" or "Hispanic." Not at all.

A. Goes without saying don't be weaving home through an alley singing loudly at 4 AM. While it is your absolute right to do so, it's just not safe. "Professional victims" give the police far too much business.

One of your best defenses is Situational Awareness. Look around you very actively, move aggressively, use the whole width of the street. Don't let muggers feel you out -- "Is you OK?" -- or guilt-trip you -- "I know you worried about a black person." (These things were said to me. Just actual quotes -- they have some elaborate opening acts.)

"She be crossin' the street cause she see me!" The guilt trip again. They really work that one.

Rejoinder -- "YOU GOT THAT RIGHT!"

Everyone bouncin around the south and west sides is looking behind them and behind them and behind them and behind them, eighteen times per block, both for the police and for the character they owe money to. Some just walk backwards half the time. You can do the same.

Get "vigilante" word out of head, that is just a psychological smear of "self-defense." Also "Neanderthal," "Wild West," etc. -- there are some very destructive people re-writing the modern lexicon. The guilt trip again.

Best "visual deterrent" is to project a competent, alert attitude.

No wristwatch? No pretext to ask for time. No rectangular shape in breast pocket? No pretext to ask for cigarette. I accidentally put a SHINY ball-point pen in my (plain shirt) pocket the other day, and I swear to God in three seconds it's "Lemme see yo ink pin." Know this insulting, dehumanizing fact and know it well -- you are OBJECTIFIED. You are seen as a DISPENSER. You are just a candy machine, and they will tug on every knob to see if something comes out for them. Eliminate pretexts insofar as possible.

"Visual deterrent" doesn't work against the truly violent on a mission. No rules, do anything you have to do, use anything you can get your hands on, make as much of an uproar as possible.

The judo sounds fine. Anything to get past the artificial "overcivilized" condition and learn to hit people again when necessary.

Heard an old African proverb, "If someone strikes you and you do not return the blow, you will always be cursed by it." I think there's a lot to that.
