No Bail for Bangers

An interesting approach:
  • Chicago Police Supt. Garry McCarthy has found a new way to keep gang members off their street corners.

    Keep them locked up until they pay up.

    On July 17, the department stopped releasing gang members from police stations on no-cash bonds for misdemeanor arrests. And if they can’t make their often-low bond amount, they have to wait to go to court.

    That means sitting behind bars — sometimes at the Cook County Jail — for up to 48 hours at times.

We aren't sure how prevalent I-bonds are in other jurisdictions, but the complaint is a valid one that misdemeanor and MCC arrests often beat the officers out of the station once their prints clear. We can recall a few instances in our careers where we actually arrested some asshole twice in one night, usually after they returned to the scene of the original arrest to pick up where they left off.

If nothing else, making the arrestee pay out-of-pocket makes them more likely to appear in court to try to get even a portion of their cash back. If McCarthy want to really keep these goofs off the street, see if the Chief Judge will double or triple the bond amounts. Once they know they're going to be sitting in County for a few days unless they come up with $300, we might actually see some changes.

Maybe we could do our Doctoral Thesis on the Impact of Economic Disincentives Upon Criminal Behavior.

Back when I was a young P.O. filled with piss and vinegar, after locking some jagoff up on the 1st watch, I'd have to go to Branch court first thing in the morning. The Court Sergeant Would peruse everything and try to find something to fuck you over with.

But you'd sit in the front row, wait till they called your jagoff and they would hold him at the door to the courtroom from the bull pen. the Corp. counsel would cry out "Motion city non-suit" and it was over. You submitted your slip for 3 hours Comp Time and you left.

There was no I-bond. If your guy's prints cleared and he didn't put up the cash bond, he went to court in the morning.

And if you, the arresting officer, didn't appear, you got deviated. Ha!

After check off, you went across the street to the gin mil, had your thirst quenched and strolled back over to court. I forgot to mention, court was on the 2nd floor of the district station.

I Bonds appeared around the time they had to start paying you for court.

Do we pay $150/day per person to keep someone locked up on a misdemeanor or do we use that money to hire more cops??

Meanwhile there's no end, not even a mention of the crime culture via illegal immigration that will replace the ones you lock up by several multiples.

We call it using the crisis. Lock up ten, wave 100 more across the border.

Wouldn't this appear as "profiling" on the departments side? I mean if Joe Shmoe can get an I-Bond, then why can't Pooky, Dooky and Mooky? This sounds to me like we would be showing one group certain treatment due to being affiliated with a gang. and being in a gang is not illegal

O.T. New Time Due Restriction Policy

Well the city will continue to fuck with us again and again. Why? Well most of us still behave like sheep. For example: A p.o. in my district was denied time off to spend with his family. On top of that he planned a camping trip with his kids and took 4 days off. At the last minute he was denied those four days off. The boss joked you can take time off in the middle of January. It's "just too crazy on the streets right now".

Despite all of that, every single day he comes in with at least one CB#, 5 parkers, 5 to 8 movers, 5 contact cards, 5 blue cards and 1 to 3 curfews. While most guys go to the hole after three hours, he will work his butt off for the entire tour.

Ladies and gentleman in our district and in our watch we have people like the above p.o. I described. As long as we do so much for so little (or nothing) in return the city will continue to diminish our benefits. Benefits that we rightfully earn by the way. Not given.

In the end honestly we can blame the city as much as we want. But in the end, we have no one to blame but ourselves.

how about automatic impoundment of vehicles w/ suspended or no driver's license and no insurance. That will get more than half the gang-bangers and illegals off the streets. Make them pay to get their wheels back. You will see a dramatic increase of the decrease of those late-night drive-by porch shootings.

This may be a measure by McNobond to counteract the arrival of the new cannabis ticketing fiasco.  As much as we make fun of and criticize the officers who are making those "one bag" arrests, those who are arrested with those one bags are generally complete pieces of shit.  By making those arrests the officers took 'Joe Shithead' out of the game for at least a few hours. Whereas now as long as you ain't carrying 3 nickels or 6 pennies worth of weight you are free to terrorize the community, (until the name check comes back saying you can no longer ANOV him) and at the very least be able to occupy more space on the corners where an errant round might strike you driving up the already infamous murder rate.

The problem will be from people who claim to have 'nufin to do wif no gangs.

Back when Cook County Jail population was right around 5,000 (1976-68) there were people in there for lack of $25 for bond for traffic offenses. Now the CCJ population is double, 300,000 or more fewer residents of the city, no traffic offenses except felony's and I-Bonds are rampant.

Deny I-Bonds to everyone except solid citizens. Don't try to identify gang bangers, identify solid citizens instead. Arrest record? Fuck you, you sit.

In a Perfect non-Political world this would be a great idea. However and unfortunately, in Shitcago, Crook County everything is based on Race and Politics. So, at some point the President of the Cook County Government, a police hating racist will complain that this policy impacts unfairly upon minorities who are poor and unable to post bonds. Then, she will order them released upon arrival, and probably give them CTA fare to get home. At which time on their way home they will mug, beat or rape some innocent CTA passenger. Sorry to seem cynical, but I have been on the job long enough to see these possibilities.

Like they do with repeat offenders (aggressive homeless types with hundreds of arrests---they have multiple open cases and ASA shitcans them all at first date -or once pinched on warrant after missing first date---)

Totally agree with post of stopping and impounding vehicles. This should be a regular program around the city where you are stopped and checked at moving check points. Hundreds of unlicensed , uninsured drivers and vehicles would be taken off the street and who knows how many guns and drugs would be taken off the street. I have been the victim of 7 hit and run accidents while my vehicle has been parked over the last 10 years . All too common to see people looking at their wrecked parked car Sat and Sun mornings around the city,

one thing is assured:

there shall be many warrant hits after prints clear rather than the usual letting them out before the true identies are known.

Get the jails ready!

this is common knowledge... the next thing that shall happen is dropping this "new" policy because it's too expensive to keep them in jail.

I bonds and paying people for court do not have a connection. The federal courts and law suits for holding people who are not a flight risk pushed the city to give just about everyone I bonds. I say bring back the bonds men and bonding companies, something that was around when I came on the job in 68. At least you will have someone looking for bond jumpers. There was and I am sure now, way too many people who give phony addresses and phony names. They do not appear in court and there is no way to find them and no one looking for them.McCarthy is doig the right thing.

And whose job is it to actually determine arrestee gang affiliation? Arresting officer? Desk personnel? WC before approving arrest?

This is gonna cost more in the long run and get the arresting coppers jammed up. Same goes for whoevers name is on the court transmittals sending the goofs to court. Same goes for the lockup people who processed dude. Same goes for the WC who did the final approval, but I don't give a shit about them.

I don't know if it's still the law but it used to be that only a judge could grant additional I-Bonds if you were currently on an I-Bond. A lot of suburban depts enforced that rule all the time to pookie's surprise but Chicago gave them away like balloons at Bud Billiken. Fuck them! Let pookie put up the cash or sit in jail!

The conditions in Cook County Jail do not differ materially from daily life outside the jail for many people.

There is a TV blaring constantly, and lots of people. Some eating, some fighting, some playing cards, and all yelling constantly. Hair care a constant, ceaseless group picking, braiding, unbraiding.

You can't punish someone who doesn't notice much difference in the first place.

This is very hard for most normals to grasp but it's true.

Yup - read the fine print on an I-bond sometime. Can't get another one until the last one you got was disposed of in court. Our desk writes VOBB's all the time - send em to court.

However, the denying of an I bond and sending to court while a gang banger is another problem. I believe there is a IL supreme court rule that kind of says you have to give someone an I bond if they can't pay. Maybe a counselor can chime in.
