Expensive Oops

We don't know what to say here:
  • When Chicago police broke into his Austin home with guns drawn and a search warrant, Markee Cooper Sr., a cop himself, and his family could only look on as drawers and closets were searched for crack cocaine based on an alleged informant's tip.

    On Friday, a federal jury awarded Cooper and his family $565,000 in damages after finding one officer at fault for a falsified warrant and two others responsible for the illegal 2007 search.

  • The city of Chicago will have to pay $450,000 in compensatory damages awarded by the seven-woman, three-man jury, said Cooper's attorney, Brendan Shiller. The jury also assessed punitive damages against three of five officers — money they will be responsible for paying, Shiller said.

    Officer Sean Dailey, who testified that he secured the warrant based on information from an informant named "Lamar" who told him crack was being sold out of the second-floor apartment in the Cooper's building, was assessed by far the most — $100,000. Sgt. Salvatore Reina was found liable for $10,000 and former Lt. Dennis Ross for $5,000.

Attorney Brendan Shiller? Son of Helen?

An allegedly "fake" informant giving up an undercover cop's house as a stash house. An informant no one appears to have any knowledge of.

Sean Dailey quit the job after that DUI incident where he called in a fake bar fight and took off in Niles,Il. Sean now owns and runs Moe Daileys Pub on NW Highway in Edison Park.

Now that the trial is over, I would really like to know the truth on this one. How do you continue to search an officers house without thinking you may have bad info. We all have had bad Search warrants and when you do, you try to limit the chance of any headaches later. But to continue searching with the officer, wife and kids watching I just think is horrible! And correct me if I'm wrong it was a negative search warrant! If you ask me there was some poor judgement on all involved with this case

Actually, we're fortunate as a city that the settlement wasn't more expensive than it was. Piss poor documentation of the 'information' by the affiant
officer, probably next to no verification of the facts
by the Lt., which is a shame, because Dennis Ross
was a decent boss when he was still on the job.
Too bad Ross got left holding the bag for $5 grand,
but at least the bite wasn't too severe on his end.
This is a wake up call for those who operate on the
fringes when writing up these 'John Doe' warrants.
Do your homework, make sure everything in your
complaint is verifiable. And an even bigger
wake-up call is in this for SUPERVISORS. Don't
accept anyone's word that everything in the
search warrant affidavit is the truth, do some
preliminary investigation of your own before
signing them. Rarely does a WC or tact Lt. ask
any questions about a search warrant before
signing them. Don't be complacent.

Too bad about Lt. Ross being told to come up with 5K. A prince of a guy who worked his ass off and loved the job so much he had to be forced to retire. They don't make them like him anymore. I remember when he was being considered for the spot of Commander of 017. Of course he didn't get it. No clout and way too much common sense and street smarts. He's a prime example of what's wrong with this job insofar as who is getting made exempt, who is not and why.

No surprise to anyone who's spent time in Narcotics. Can't tell you how many warrants are secured based on bullshit/iffy information. The pressure to produce warrants is high in that unit. So guys take chances to get their numbers. PO's become personal friends with their ci's, which causes them to take the ci's word at face value. One sunday morning, we hit a house based on info gained from a team member's ci (snitch). Around 0500, we kick the door in. Know what we found? An elderly couple, sitting at the dinner table, reading the bible, preparing for church that morning. When Sarge and the PO WTF'd the snitch, the snitch admitted he'd gotten the info from some crackhead and had never verified it himself. What was even more fucked up was that the PO continued using that snitch. Something about Homan Square...once guys get there, they'll do almost anything, including take career threatening chances to stay there.

Yes that is Brendan Shiller, son of Helen Shiller. He makes a living suing the police. If you live in or near his mother's ward, which means you are in near constant danger, you should ask your alderperson how she feels about this clear conflict of interest. She has the best interests of the City in mind while her son reaches into the coffers with both hands to take as many taxpayer dollars as possible.

This guy used to stand with his hat on at check off when he just made Lt. What a stroke, he would sit there in the office and do his assignments from Lewis University to try to look legit but told the guys no studying on company time. If you are a working police officer which most of you people aren't you know negative search warrants happen. We felt horrible that this happened but by no way did we lie about anything on this case. Case law stated we did nothing wrong but liberal fucking jury fell for all their lies and that's why we lost the case. Say what u wanna say about Dailey but he did every thing correct but just got really bad info from an informant who was extremely reliable on 4 separate events

I certainly can see why Dailey was clobbered by the jury and I have no sympathy for him. However, the sergeant and lieutanent being faulted as supervisors, I just do not see. The warrant was approved by the ASA and a judge. If Daily made up the informant that is his problem. How would the supervisors know this? Dailey claimed that this informant who he only knew by first name gave him other tips that led to arrests. I wonder if he produced these other arrests in court // Other warrants?

Remember the F/4 copper from 012 that got got caught on controlled buys by cpd/ feds last year and hit a sgt. Shit happens. We all make mistakes but after you found out he was the police then the search should be off. This officer had pictures with mayor Daley and several department awards hanging up in his living room. All officers who entered could see them but they continued to search the house and put the officer on the floor. I also would've sued.

I was there on that search warrant, we did not search the residence, we even fixed the door, and the target did use that address, cooper used the race card in court. It is very to be a Monday nite quarterback

When I was in my 20's I told this one to a wise man. He told me...."there's always time."

At 41 I now now what he meant. If you don't think there's enough time then don't act on the information.

Interesting take on this. Maybe you'd feel differently if some of your fellow officers, who "had your back", kicked in your door and continued searching for drugs after you identified yourself. You'd probably wonder, if it was your house, why the hell nobody bothered checking to see who the hell lived there in the first place? How hard could that be? A little extra time checking the "facts" (especially when the involve the famous Mr. "BS" Dailey)would go a long way to help us watching each others backs, for sure. If in doubt, remember the Golden Rule, and you won't go wrong.

When I first came on this job, coppers respected one another. You may not have liked the person, but you had each others back because each other is ALL you had. Over the last decade, that's all gone "out the window." We're divided by race, by age, by gender, by unit, and by seniority. The only people benefiting by our lack of unity is The Mayor and the big bosses. I worked for Dennis Ross for 6 years. Dennis was and IS a great guy to work for. He was out there during Obamas election night and took care of business. Never was he an arrogant prick, like so many others. Very approachable too. Sorry you felt that way about Dennis.

There used to be time to verify information but now if you receive information, and it's running past the tour, some pussy bosses don't want to pay you overtime for the research. That's why I stopped doing search warrants!!! Fuck these bosses, they want their cake and eat it too.
Not sure if this is a j doe or CI??? But it's bullshit that they only knew the informants first name. Especially if they used him on four separate warrants. If its a CI warrant you have time to verify... CI is usually not in custody. Where a j.doe may be going to the county and you only have him for a short time to get it signed by the judge. Once you get it signed you could still sit on it and at least watch the house. What happened to some old fashioned surveillance.
Also, pos are not educated in search warrants. I learned how to do a search warrant from a guy who has three years more than I do, and he learned that way too. There's no education or training in this shit! Sometimes it's the blind leading the blind. In the past I would just go with what j. Doe said, but now there s no way!!! Fuck these bosses who pressure you for search warrants!!! As long as your making your arrests (for your court time) they won't fuck with you. When you're in a unit or tact team it always comes down to your HEADS. Yes they ll bitch for more contact cards, dispersals, search warrants, etc but as long as you get your heads, you'll be all good. The only reason I'm locking up shitheads is for court time!!!! Yes it's all about the OT! If they want to limit extension of tour, or they won't let us change our hours, to do our homework on these search warrants Fuck them!!! Not risking my job for a gang team, tact team, or narcotic team spot!!!! Sorry, I went on a tangent!!

Just do the job the right way. If you don't have PC for a warrant, don't lie and make it up. If you don't have PC for an arrest, don't lie and make it up. Don't do drop cases if the shit-head didn't really drop the dope.

Between surveillance cameras, intersection cameras, red light cameras, hidden cameras, camera phones, GPS in phones, body-worn cameras that look like pens that you can buy for $50, body-worn cameras that look like buttons on shirts, micro-voice recorders, etc, etc, just do your job by the book. You want to be aggressive? Fine, but follow the rules. You can do it, it's called being professional and being better, and smarter than the shit-heads you are going after.

Act like a fool and get hit with punitive damages. Or worse, commit a crime, get indicted and become a convicted felon. Prosecutors drool over foolish, unlawful behavior.

We need an IQ. test. The race card trumped a valid warrant supported by probable cause? It is extremely hard to invalidate a search warrant. And probably the only way to get to punitive damages is to prove that the officers acted under the color of law (this means that there was something incredibly shady going on).
This makes you wonder what some officers are doing out there.

well first of all i have to say especially because i wasnt there and dont know all the facts BUT lets face it it was probably wrong on both ends but lets face it some police on this job are out there doing dirty shit, for example a very few steal, sell drugs, give there felon family members and friends information regarding police info etc, etc.... so the fact that they were even given this police officers house seems alil suspect and seems like there could of been something shady going on out of his house, who knows maybe the P.O. had a son or a brother-in law that was living there that could of been doing dirt or it may as well been a bad decesion by the officers executing warrant BUT to say the officers are automaticaaly at fault is totally bullshit.... i mean how could WE as coppers who see the one sided BS media bias stories not actually think that the officers may have hit the right house and could possibly had good info, i would hope that both parties were wrong BUT in my short 6yrs on this job plus an entire family who is or has been on the job ive seen and heard of alot worse situations that officers have put themselves in so lets just keep the shit talkn unless anyone has ACTUAL info insteada just talkn shit.....

I was there on that search warrant, we did not search the residence, we even fixed the door, and the target did use that address, cooper used the race card in court. Right, the warrant was done without being signed by the WC. Ross tried to get him to sign after the fact and he refused. It is in the depostions tough guy. That is why it cost him 5K.

The fact that you treated the officer the way you did is why those goofs had to pay. How long did the officer, his wife and their children have to sit on the couch waiting for a drug dog to sniff the house.

Don't let the facts get in the way of the truth.

Of course they don't put in the news how they discovered holes in Cooper's story. They actually had proof that he was lying. They only paid him so they wouldn't appear to be racist. That's why they're appealing it because they actually have grounds to do so. All I've ever heard is how great of an officer Ross was and how everyone absolutely loved him. He would still be an officer today if he hadn't aged out. Over 40 years on the job people...they don't make them like him anymore.
