Expensive Oops
When Chicago police broke into his Austin home with guns drawn and a search warrant, Markee Cooper Sr., a cop himself, and his family could only look on as drawers and closets were searched for crack cocaine based on an alleged informant's tip.
On Friday, a federal jury awarded Cooper and his family $565,000 in damages after finding one officer at fault for a falsified warrant and two others responsible for the illegal 2007 search.
The city of Chicago will have to pay $450,000 in compensatory damages awarded by the seven-woman, three-man jury, said Cooper's attorney, Brendan Shiller. The jury also assessed punitive damages against three of five officers — money they will be responsible for paying, Shiller said.
Officer Sean Dailey, who testified that he secured the warrant based on information from an informant named "Lamar" who told him crack was being sold out of the second-floor apartment in the Cooper's building, was assessed by far the most — $100,000. Sgt. Salvatore Reina was found liable for $10,000 and former Lt. Dennis Ross for $5,000.
Attorney Brendan Shiller? Son of Helen?
An allegedly "fake" informant giving up an undercover cop's house as a stash house. An informant no one appears to have any knowledge of.

Good reason to use extreme caution. The courts are making the officers come up with a portion of the award.
Sean Dailey quit the job after that DUI incident where he called in a fake bar fight and took off in Niles,Il. Sean now owns and runs Moe Daileys Pub on NW Highway in Edison Park.
When you have CLOUT nothing happens to you.
Is this the Sean Dailey of niles pd fame?
If some knucklehead PO's break my door down I to would be suing. Do some research before you take an informats word alone.
Are the prices going up at Moe's now?
Sean daily who left before he gOT fired , for making falae 10-1 call in Niles to get out of a DUI ? That sean a daily ?
Nothing at all.
you believing the jury now?
Why wasn't/isn't Sean Dailey charged with Official Misconduct or Perjury?
IAD covered this one up for the CLOUTED pukes. It only cost us a cool $600K plus another $300K in attorney's costs.

A fictional john doe? Not at CPD....oh the humanity!!!!!!
Let's see, a lieutenant trying to impress his boss, a sergeant trying to impress his lieutenant and a P.O. trying to impress his sergeant. All of this to keep wearing jeans?
The war on drugs is lost! Go lock up some goof for simple battery, or uuw with a knife. But looking for a dime bag on a warrant...
Hate to say it, but let them pay. How would you feel if someone violated your home on bullshit information?
Stop making drug arrests already. You see the handwriting on the wall with the weed bullshit. Fuck these people.
Now that the trial is over, I would really like to know the truth on this one. How do you continue to search an officers house without thinking you may have bad info. We all have had bad Search warrants and when you do, you try to limit the chance of any headaches later. But to continue searching with the officer, wife and kids watching I just think is horrible! And correct me if I'm wrong it was a negative search warrant! If you ask me there was some poor judgement on all involved with this case
Actually, we're fortunate as a city that the settlement wasn't more expensive than it was. Piss poor documentation of the 'information' by the affiant
officer, probably next to no verification of the facts
by the Lt., which is a shame, because Dennis Ross
was a decent boss when he was still on the job.
Too bad Ross got left holding the bag for $5 grand,
but at least the bite wasn't too severe on his end.
This is a wake up call for those who operate on the
fringes when writing up these 'John Doe' warrants.
Do your homework, make sure everything in your
complaint is verifiable. And an even bigger
wake-up call is in this for SUPERVISORS. Don't
accept anyone's word that everything in the
search warrant affidavit is the truth, do some
preliminary investigation of your own before
signing them. Rarely does a WC or tact Lt. ask
any questions about a search warrant before
signing them. Don't be complacent.
Too bad about Lt. Ross being told to come up with 5K. A prince of a guy who worked his ass off and loved the job so much he had to be forced to retire. They don't make them like him anymore. I remember when he was being considered for the spot of Commander of 017. Of course he didn't get it. No clout and way too much common sense and street smarts. He's a prime example of what's wrong with this job insofar as who is getting made exempt, who is not and why.
Sean Dailey. You are an asshole of the highest degree. Your Dad is turning in his grave, of that I'm sure. All because he produced an asshole like you.
No surprise to anyone who's spent time in Narcotics. Can't tell you how many warrants are secured based on bullshit/iffy information. The pressure to produce warrants is high in that unit. So guys take chances to get their numbers. PO's become personal friends with their ci's, which causes them to take the ci's word at face value. One sunday morning, we hit a house based on info gained from a team member's ci (snitch). Around 0500, we kick the door in. Know what we found? An elderly couple, sitting at the dinner table, reading the bible, preparing for church that morning. When Sarge and the PO WTF'd the snitch, the snitch admitted he'd gotten the info from some crackhead and had never verified it himself. What was even more fucked up was that the PO continued using that snitch. Something about Homan Square...once guys get there, they'll do almost anything, including take career threatening chances to stay there.
Are these the same idiots coppers from seven that hit the wrong house last year and wanted to lock up gramma for a bag of weed. But instead of apologizing and thanking their Sgt and Lt for saving their sorry asses came on this blog taking shit. They must be on the watch now .
I hope Seanie boy sells alot of chicken wings at his new pub. He owes big money to the plaintiff.
Yes that is Brendan Shiller, son of Helen Shiller. He makes a living suing the police. If you live in or near his mother's ward, which means you are in near constant danger, you should ask your alderperson how she feels about this clear conflict of interest. She has the best interests of the City in mind while her son reaches into the coffers with both hands to take as many taxpayer dollars as possible.
The search should have stopped as soon as the resident identified himself as a police officer. This hot shot copper believed a hype over a copper and continued the search.
If some knucklehead PO's break my door down I to would be suing. Do some research before you take an informats word alone.
8/11/2012 12:55:00 AM
You are a fucking goof and I hope I would never have to work with you. This is sad, I know Dailey can be a goof, but when I came on the job we did not sue each other and we stuck together. This job sucks and sadly so do most of the whining coppers on it, I am so glad I am on the down slide here as far as time left goes. It sure is a sad day when we are suing each other instead of having each other's backs.
Dumb asses.
Moe Dailey's will now be call Mo' Cooper's.
Crack will be sold out of the back (or so a CI tells me)
Markee Cooper Sr., a cop himself, and his family NOW OWN A VERY NICE BAR/EATERY IN EDISON PARK!!!
Original suit was tossed until sean dailey kept getting involved in off duty nonsense, the plaintiff's attorney got it re-instated based on his behavior. He just screwed a Sgt and Lt who ALWAYS took care of patrolmen
good job you drunk irish fool
try not to get punched by a whitegirl again for making racist commenst about inter-racial marriages, youre lucky the 260 lbs muscle bound MMA fighter husband laughed at you instead of ripping your arms off
Just another 025th District fool who shows up to Roll Call with blackeyes
are the prices at Moe's going up......they are already high and the food sux!
CLOUT? Wtf are you talking about? If this guy had so much clout the city would have settled and he wouldn't be on the line for 100k!
Why wasn't/isn't Sean Dailey charged with Official Misconduct or Perjury?
IAD covered this one up for the CLOUTED pukes. It only cost us a cool $600K plus another $300K in attorney's costs.

According to the article, He's shelling out a few bucks from his OWN pocket. I dont think his CLOUT is going to cover that tab.
Sean Dailey quit the job after that DUI incident where he called in a fake bar fight and took off in Niles,Il. Sean now owns and runs Moe Daileys Pub on NW Highway in Edison Park.

I think it says he has to pay 100K. Time to use that optical insurance.
What about the judge who approved the warrant with 'sketchy details'?
For you hard-chargers who think you'll be rewarded for your 'amazing' skills and get a merit promotion, let this be a lesson to you.
Become a member of the KMA club even if you don't have the time--we'll consider you 'associate' members.
Think, think, think, before you do anything! And especially think even more if you're on the borderline.
Be careful out there. Nobody has your back except you. Never forget that.
Seriously, was it worth fighting a losing battle against drugs that the US gov't doesn't give a f*ck about? Did you change anything? Did you make a difference? Don't think so.
I'm sorry for the officer's plight. I'll donate to a fund for them. But use this as the biggest learning lesson of all.
The damages against the city and the officers should have been much higher.
This SW bullshit has been going on for way too long. CPD doesn't know how to properly write or execute warrants. They never did.
The cops who executed the warrant are lucky they're not dead.
Lt Dennis Ross? You mean merit promoted twice, Lt. Ross? You mean Lt. Dennis Ross, the best cop on the job, just ask him he'll tell you so. This guy used to stand with his hat on at check off when he just made Lt. What a stroke, he would sit there in the office and do his assignments from Lewis University to try to look legit but told the guys no studying on company time. Ahhhh, Dennis Ross......you are ot missed......
Fuck all you people we had a valid informant which pointed And.gave us this search warrant. If you are a working police officer which most of you people aren't you know negative search warrants happen. We felt horrible that this happened but by no way did we lie about anything on this case. Case law stated we did nothing wrong but liberal fucking jury fell for all their lies and that's why we lost the case. Say what u wanna say about Dailey but he did every thing correct but just got really bad info from an informant who was extremely reliable on 4 separate events
You can thank Mike McCotter for this.....
Sean Dailey did not quit. he says his back hurts so much that he is putting in for disability on the pension's dime.
Yet, morons still come in with revenue for this unholy city.
Irish clout, nothing to see here move along.
Let's see, Sean's father was a Commander. And Schiller's mother was that POS Aldercreature Helen who never really raised the kid in the City. Chicago Royalty, with the Peasants paying the bills! Oh, I almost forgot, Lt. Dennis Ross now retired, was married and divorced from an Alderman's daughter.
Yes it's the same Sean Dailey. A real disgrace to our department
His daddy Mo was the commander of 012. Not his first incident. Couldn't happen to a nicer guy.
If some clowns tried to break down my door I would'nt be asking who they were, it would'nt be pretty. A real tradedy can happen if these guys don't do their homework on these warrants.Their lucky this p/o held fire, today you don't know who is trying to get in . More observation andcaution should be used before we start blasting each other.Be careful out there.
Never worked with this guy, however everyone that has said he is a clown...anyone? Verdict...Clown
Knew his father... stand up guy and good boss.
I certainly can see why Dailey was clobbered by the jury and I have no sympathy for him. However, the sergeant and lieutanent being faulted as supervisors, I just do not see. The warrant was approved by the ASA and a judge. If Daily made up the informant that is his problem. How would the supervisors know this? Dailey claimed that this informant who he only knew by first name gave him other tips that led to arrests. I wonder if he produced these other arrests in court // Other warrants?
His dad was a big boss MO dailey! That says why he didnt get charged . He would have skated on this one had it not been for the niles thing. Others have hung for much less and are fired or taking major time for sw or consent to search things. A couple of tact teams are going thru this or about to head to the board (002 and 020).
No worries, get well soon officer
Stupid fuck gave us all a bad name with Niles and everyone, another jackass who abused the badge and should never have been the police. Fucking Stroke, Glad your gone
You wanna talk.about having each others backs, did daily have the coppers back when he ripped through his house in front of his family? I don't thisI so. Sean daily was a hot shot who fucked up. He should have apologized and left.
You all act like there aren't any dirty coppers out there. Sometimes there's not enough time to verify info. Remember the F/4 copper from 012 that got got caught on controlled buys by cpd/ feds last year and hit a sgt. Shit happens. The plaintiff deserves money but punitive damages should've been taken off the table.

WHAT!!!!!!!!!!!!!!!!!!
@8/11/2012 08:47:00 AM
"when I came on the job we did not sue each other..."
When I came on the job WE DIDN'T SEARCH EACH OTHER'S FUCKING HOUSES.
Yeah, yeah, yeah. I get that he didn't know when he hit the door, but he continued to search AFTER learning of the error.
Too many people I know had to make statements at OPS because of his constant bullshit. Fitting he showed up to work with black eyes because he constantly gave them to the whole fucking department.
Good riddance
Mo Dailey? How do you buy a ski lodge on a policeman's salary? That MO? AKA as I don't steal no Mo Dailey. Little Tommy Byrne, Mo's good friend took care of Mo's kid. The apple doesn't fall far from the tree. Mo was a vicious alcoholic who was widely hated. A former bodyguard for Richard the First with heavy Teamster clout, he was forced to retire over disclosure of his ownership of Nordic Mountain Ski Resort with Terry Creamer, a Chicago Police Officer who was convicted of selling heroin. That is how you buy a ski lodge on a policeman's salary.
This fucking prick better not receive a disability pension. He should have been fired years ago for all of his shenanigans.
Our pension will be completely insolvent in 8 years and this bustout has the audacity to milk it for a disability. WTF Shields, stop this Clout BS!
How was he not fired for all the criminal acts he committed as a copper?
Many PO's have been fired for far, far, far less. Another example of the two-tier system of discipline on the CPD and another reason nobody with a brain wants anything to do with this job and it's crooked politics and criminal coverups.
We all make mistakes but after you found out he was the police then the search should be off. This officer had pictures with mayor Daley and several department awards hanging up in his living room. All officers who entered could see them but they continued to search the house and put the officer on the floor. I also would've sued.
Wow, people could've easily been killed.
Markee,I am so glad this situation is all over.I hope you and your family have some peace now. Much love from a fellow Honor Guard member.
I was there on that search warrant, we did not search the residence, we even fixed the door, and the target did use that address, cooper used the race card in court. It is very to be a Monday nite quarterback
Before u judge someone read police officer cooper and chief patterson depositions, then the truth will come out
Real nice, a search warrant on a coppers house. Times have changed. Back in the day, that would never have happened regardless of your race, color or religion.
Sometimes there's not enough time to verify info.....
When I was in my 20's I told this one to a wise man. He told me...."there's always time."
At 41 I now now what he meant. If you don't think there's enough time then don't act on the information.
everyone bashing the affiant, ever wonder why a CI picked this house? maybe it wasn't an oops. ive caught CI's in lies before and they always have a reason why they picked a certain house for a bullshit warrant.

Interesting take on this. Maybe you'd feel differently if some of your fellow officers, who "had your back", kicked in your door and continued searching for drugs after you identified yourself. You'd probably wonder, if it was your house, why the hell nobody bothered checking to see who the hell lived there in the first place? How hard could that be? A little extra time checking the "facts" (especially when the involve the famous Mr. "BS" Dailey)would go a long way to help us watching each others backs, for sure. If in doubt, remember the Golden Rule, and you won't go wrong.
Where does the supposed "victim" work??
When I first came on this job, coppers respected one another. You may not have liked the person, but you had each others back because each other is ALL you had. Over the last decade, that's all gone "out the window." We're divided by race, by age, by gender, by unit, and by seniority. The only people benefiting by our lack of unity is The Mayor and the big bosses. Ben Franklin said after the signing of the Declaration of Independance; "Gentlemen,we must all hang together, or assuredly, we shall all hang seperately." Food for thought.
What's fuckup is that the P.O. did not do his homework! That's the price you pay.
For the P.O's that said there's not enough time to verify the info then don't do it.

No, its YOU who is the GOOF! This guy is the prime fucking example of WHY this job is fucked up in the first place.
You're right, we didnt go suing eachother. Thats because THIS shit didnt go on!
Sean D what a turd. And the fools of police will still go and patronize his place what a crock. Talk about having no pride he shits on the star, shits on his fellow officers and some fuck tards are going to wait in line for warm beer and food poisioning from this creep. We have no pride as a department this is just a glaring example.

I worked for Dennis Ross for 6 years. Dennis was and IS a great guy to work for. He was out there during Obamas election night and took care of business. Never was he an arrogant prick, like so many others. Very approachable too. Sorry you felt that way about Dennis.

Are you F'in kidding? This isnt a case of some argument in a tavern or in the station. SD home invaded a fellow PO and terrorized his family. THINK before you jump!!! But Im not on board for punitive!! Ive been hit punitively, it isnt a good feeling...

So...let me get this straight...if this were you sitting at home with your wife and kids minding your own business never having done anything wrong and your door gets kicked in by the police, you identify yourdelf as a police officer and they continue to tear your house up looking for drugs that were never there, causing your family to be terrieifed and confused...you would stand by the police officers who did it to you and not be upset....I think you are a fucking liar!!!

"Let's see, a lieutenant trying to impress his boss, a sergeant trying to impress his lieutenant and a P.O. trying to impress his sergeant. All of this to keep wearing jeans?"
Yep, and look who got hit with the biggest judgment.
Be careful, boys & girls. Nobody ever thinks this kind of thing will happen to them. I'm quite sure the officer didn't say, "I'm gonna do this warrant today and it's gonna cost me down the line!"
Nobody ever thinks it will happen to them.
It's just not worth it anymore.
You all can fight bad guys with guns and knives and come out victorious, but most of the real dangers of the job come from inside the building and in court.
Be careful.
rb
Bullshit like this is why city cops have such a bad reputation with the public. What if the guy thought it was a robbery or gang hit and tried to defend himself? Hell, what if he wasn't a cop and was just some random innocent schlub an asshole CI accidentally-on-purposed for cheap thrills?
Search warrants are serious stuff, always do your homework.
There used to be time to verify information but now if you receive information, and it's running past the tour, some pussy bosses don't want to pay you overtime for the research. That's why I stopped doing search warrants!!! Fuck these bosses, they want their cake and eat it too.
Not sure if this is a j doe or CI??? But it's bullshit that they only knew the informants first name. Especially if they used him on four separate warrants. If its a CI warrant you have time to verify... CI is usually not in custody. Where a j.doe may be going to the county and you only have him for a short time to get it signed by the judge. Once you get it signed you could still sit on it and at least watch the house. What happened to some old fashioned surveillance.
Also, pos are not educated in search warrants. I learned how to do a search warrant from a guy who has three years more than I do, and he learned that way too. There's no education or training in this shit! Sometimes it's the blind leading the blind. In the past I would just go with what j. Doe said, but now there s no way!!! Fuck these bosses who pressure you for search warrants!!! As long as your making your arrests (for your court time) they won't fuck with you. When you're in a unit or tact team it always comes down to your HEADS. Yes they ll bitch for more contact cards, dispersals, search warrants, etc but as long as you get your heads, you'll be all good. The only reason I'm locking up shitheads is for court time!!!! Yes it's all about the OT! If they want to limit extension of tour, or they won't let us change our hours, to do our homework on these search warrants Fuck them!!! Not risking my job for a gang team, tact team, or narcotic team spot!!!! Sorry, I went on a tangent!!
I don't know if Terry and Bob Creamer are related, but that is a great question.
12:15 PM: Hit it on the head! "Do Nothing and you do nothing wrong"!---- A 26Yr Veteran.
Terry and Bob Creamer? Oh we got to find that out. That is an outstanding question.
Just do the job the right way. If you don't have PC for a warrant, don't lie and make it up. If you don't have PC for an arrest, don't lie and make it up. Don't do drop cases if the shit-head didn't really drop the dope.
Between surveillance cameras, intersection cameras, red light cameras, hidden cameras, camera phones, GPS in phones, body-worn cameras that look like pens that you can buy for $50, body-worn cameras that look like buttons on shirts, micro-voice recorders, etc, etc, just do your job by the book. You want to be aggressive? Fine, but follow the rules. You can do it, it's called being professional and being better, and smarter than the shit-heads you are going after.
Act like a fool and get hit with punitive damages. Or worse, commit a crime, get indicted and become a convicted felon. Prosecutors drool over foolish, unlawful behavior.

Question to ANY and ALL police officers >
Has it really come down to this > These MANY 'mistakes' of 'wrong' addresses or 'wrong' info and a SWAT team blasts into my house slammin' me against a wall and ripping my house apart ?
If this is the norm, then this is NOT America anymore but has instead become USSR under Stalin / Lenin. TERRIFYING. Someone PLEASE respond

________________________________
We need an IQ. test. The race card trumped a valid warrant supported by probable cause? It is extremely hard to invalidate a search warrant. And probably the only way to get to punitive damages is to prove that the officers acted under the color of law (this means that there was something incredibly shady going on).
This makes you wonder what some officers are doing out there.
Sean calls it his ma's bar. i can only assume its because he cant legally own it. mabye somthing to do with disability pention bullshit. or mabye because hes still getting a paycheck from the pd. this just all seems fishy to me. my friend who is a girl said she got slipped somthing in her drink at modaileys. she also said the only drinks she got where purchased and handed to her by sean himself. i for one will not be visiting that place ever again. when i was there i was bought a drink by an older man who identified himself as a police officer, when i laughed and said yea right he pulled the butt of a gun out of his pocket and laughed.
well first of all i have to say especially because i wasnt there and dont know all the facts BUT lets face it it was probably wrong on both ends but lets face it some police on this job are out there doing dirty shit, for example a very few steal, sell drugs, give there felon family members and friends information regarding police info etc, etc.... so the fact that they were even given this police officers house seems alil suspect and seems like there could of been something shady going on out of his house, who knows maybe the P.O. had a son or a brother-in law that was living there that could of been doing dirt or it may as well been a bad decesion by the officers executing warrant BUT to say the officers are automaticaaly at fault is totally bullshit.... i mean how could WE as coppers who see the one sided BS media bias stories not actually think that the officers may have hit the right house and could possibly had good info, i would hope that both parties were wrong BUT in my short 6yrs on this job plus an entire family who is or has been on the job ive seen and heard of alot worse situations that officers have put themselves in so lets just keep the shit talkn unless anyone has ACTUAL info insteada just talkn shit.....
I was there on that search warrant, we did not search the residence, we even fixed the door, and the target did use that address, cooper used the race card in court. It is very to be a Monday nite quarterback-You can't even write on the blog correctly I could imagine what the warrant looked like???

Purely out of curiosity, I held my breath while reading your comment.
Haven't felt so light-headed since getting my first blow job.
Thanks.
I highly doubt that Sean is putting date rape drugs in drinks at his bar. I do believe that he is a goof with way to much Clout though. He did getaway with things that anyone else would have been terminated for, for years. If he receives a disability pension from the CPD the shit is going to hit the fan.
Which is why ANY time I get info from an informant I ALWAYS confirm before taking any action to prevent shit like this from happening.....All these years and haven't had any shit go South.

Sometimes there's not enough time to verify info.....
When I was in my 20's I told this one to a wise man. He told me...."there's always time."
At 41 I now now what he meant. If you don't think there's enough time then don't act on the information.

"Terry Creamer, a Chicago Police Officer who was convicted of selling heroin."

Any relation to the "Creamer"-- convicted felon, tax evasion I seem to remember -- married to Cong. Jan Schakowsky?
8/12/2012 11:25:00 AM
Yep, one and the same. Married to the progressive communist herself. Birds of a feather......

Terry and Bob Creamer? Oh we got to find that out. That is an outstanding question.

Yes. Google it. Married to libturd Schakowsky. Same turd that crashed the Pres bash and caused all the brouhaha!!!
Right, the warrant was done without being signed by the WC. Ross tried to get him to sign after the fact and he refused. It is in the depostions tough guy. That is why it cost him 5K.
The fact that you treated the officer the way you did is why those goofs had to pay. How long did the officer, his wife and their children have to sit on the couch waiting for a drug dog to sniff the house.
Don't let the facts get in the way of the truth.

By your own words, the officers did something wrong.

AND the best part is that none of you tough guys are saying. Dailey took the 5th and didn't testify. He left everyone holding the bag.

If they did not verify the information because there was no time, then that weakens the argument for probable cause.

What is a negative search warrant?

Shocking!! He was, is and always will be a complete piece of shit. We will be reading about him again real soon, especially now that he's off the job.
Of course they don't put in the news how they discovered holes in Cooper's story. They actually had proof that he was lying. They only paid him so they wouldn't appear to be racist. That's why they're appealing it because they actually have grounds to do so. All I've ever heard is how great of an officer Ross was and how everyone absolutely loved him. He would still be an officer today if he hadn't aged out. Over 40 years on the job people...they don't make them like him anymore.
