Bill Daley Misses the Point

  • Gubernatorial hopeful Bill Daley says Governor Quinn should make some changes before he signs the bill allowing the carrying of concealed weapons in Illinois, reports WBBM [...].

    As Governor Quinn nears the deadline for deciding what do to with the concealed-carry bill, Bill Daley is saying that the Governor should do more than just fix his signature.
Evidently, Bill doesn't understand the words "court order." As in Illinois is under a court ordered deadline to pass something that will pass muster. If Illinois fails to do so, the court will probably impose rules regarding concealed carry. And Quinn can only sign or refuse to sign the bill before him - he can't arbitrarily add language or conditions to a piece of legislation.

Then there's this:
  • “I would hope that he would mandatorily veto this so that some of the weaknesses in that bill can be improved upon and we can comply with the court order because we are the only state without a concealed carry bill. But at the same time, I think the Governor ought to put in there that there needs to be background checks and that limit the size of magazines for some of these weapons that are really designed for military use and not for either hunting or sport shooting,” said Daley.
The Second Amendment has absolutely nothing to do with hunting or sport shooting. Never has, never will. Just about everyone who has ever read the Constitution or perused the Founders' writings knows this...only those with agendas attempt to insert hunting and sports shooting into a document that was written to limit the scope of government in personal liberties.

This gun control opinion comes from a guy who had the good fortune of being protected by Chicago's finest for over twenty years while his old man was mayor. Wise Up Voters...this State and City is stealing money from us every single day, in every single way...count the folks you know who have left this state for a better life-style in the past 10 years...bet you'll be surprised. We continually pay more for everything and end up the worst state in every category. Went to upper Michigan this weekend..for example: the average cost per gallon of gasoline equaled $3.59, cost for the same time period and for the same gas equaled $4.41 in Illinois.....Wake up folks, No Madigans, no Daleys, no more dynasties in Illinois...Keep your money for you and your family and wake up before its really too late..we're close to that point...

I heard that interview. No tough questions from WBBM's Craig Dellimore and no tough follow up questions.

Daley talked about the evils of electing a Madigan as Governor and as Speaker of the House, talking about how bad it is to have a family run dynasty like that,.

Imagine a Daley complaining about a political family dynasty. I almost broke the radio.

Daley of all people must NOT be elected! I would vote for Quinn again before a member of the Daley Crime Family.

I hope a real good republican is on the ballot. Oh dear god, a daley as governor. That would be it, I would have to move. A trailer park in Arkansas would be OK.

Heard him on "At Issue" on WBBM radio Sunday morning. Came in at a question asking him about how he felt about voters not wanting to vote for him just because of his last name...or that his brother and father have reputations that don't sit well with some voters.

His response was measured. I truly don't think he knows or cares about the hatred people have for the Daley name.

Just A Citizen says: I am in a quandry over why and how this is the only state that decided the 2nd Amendment does not apply. Does this mean we can expect other amendments to go down the drain? "Mandatorily veto"? The word is "amendatory veto" -- as in, you veto the bill and *amend* it with your own language. And yes SCC, unlike federal, here in Illinois the governor does have an amendatory veto by law, but the CCW bill passed with veto proof majorities, and neither Cullerton nor Madigan are going to allow Quinn to peel off any of their votes, so the point is moot. Quinn tried a big old gun ban amendatory veto (on a bill completely unrelated to guns) in December right after Sandy Hook, basically outlawing and confiscating everything except Biden shotguns and .22 revolvers, and it failed.

Here is the ugly reality that nobody in the Police Community wants to discuss: The American Revolution was carried out and the Constitution was written by people who overthrew their government. The Constitution exists to Protect Us from Government Abuse. The ownership of firearms is in the Constitution so that the public may if necessary carry out opposition to the Government. As Police Officers we find ourselves in a difficult position because WE are part of that government and those weapons could be used against US. And that raises the issue of, would we side with the Government or with the People? We all took an oath to defend the Constitutions of the U.S. and Illinois against enemies be they foreign or domestic. Domestic means an oppressive government with a dictator or Fuhrer. At what point do we choose sides? We are living in a very complex time in history and we may soon have to make unpleasant choices.

The court has already ruled and issued a mandate. The mandate has been stayed to allow the state time to change its laws if it so chooses.

The court has no authority at all to set any rules for concealed or unconcealed carry.

What it did was rule that several specific parts of the UUW act are unconstitutional as written and those few parts cannot be enforced anymore.

The people involved have done a good job of misleading the public and the press that the court ordered some kind of license to carry law be enacted, but no such order was or can be entered. The court just has no authority to do that.

only 720 ILCS 5/24-1(a)(4), 720 ILCS 5/24-1(a)(10), and 720 ILCS 5/24-1.6(a) are at issue because those are the only things the law suits challenged.

my guess would be if there is no change in the law the court finds acceptable the district court will just enter an order enjoining the state from enforcing those provisions.

Hey bill, my 3-Ar's, 1-AK, 1-SKS, 1-M1 Garand, and 1-M1 carbine are all used for sport shooting. In 31 years of gun ownership I've never killed or injured anyone with my weapons. It's called responsible gun ownership. Which to your dismay is allowed by the Constitution.

You're incorrect on that, SCC. Illinois has amendatory veto, which allows Quinn to do exactly that. If he does, it goes back to the legislature for a vote. If half agree with his changes, they're law. If 3/5 disagree, the original is law. If neither of those occur, the bill dies.

There is a process called amendatory veto, which he can do just that. Remove parts, add parts, or rewrite the whole thing, which he has done before. Hopefully the legislature will overrule him if he does though.

Comrade Jan "The Red" Schakowsky and her flacks on the City Council of the Peoples' Republic of Evanston are preparing to enact an ordinance banning assault weapons to undermine gun owners rights in advance of the perceived passage of some form of concealed carry. Many weapons, including those purchased legally (can you say EX POST FACTO LAWS are unconstitutional? I knew you could) are going to be outlawed as criminal contraband if the ordinance passes tonight -- meeting scheduled to coincide with the NHL Stanley Cup finals.

It does not matter that the lawsuit, Wilson v. Cook County, is still alive and kicking, Evanston wants and needs to be politically correct even if it costs the taxpayers for attorneys' fees and costs.

The Evanston Socialists refuse to acknowledge that much of the violence and gun crimes committed in the city are confined to two outstanding Democratic Wards centered around the high school and that none of the shooters have FOID cards.

In Oklahoma we have "shall issue" handgun licenses with either concealed carry or open carry at the licensee's discretion. And there is a nice three bedroom, two bath, two car garage, all brick house available in my neighborhood for less than $150,000.00. We are not in the city limits either so we can shoot off fireworks in the front or back yard.

Sec. 24-1.6. Aggravated unlawful use of a weapon.
(a) A person commits the offense of aggravated unlawful use of a weapon when he or she knowingly:
(1) Carries on or about his or her person or in any vehicle or concealed on or about his or her person except when on his or her land or in his or her abode, legal dwelling, or fixed place of business, or on the land or in the legal dwelling of another person as an invitee with that person's permission, any pistol, revolver, stun gun or taser or other firearm; or
(2) Carries or possesses on or about his or her person, upon any public street, alley, or other public lands within the corporate limits of a city, village or incorporated town, except when an invitee thereon or therein, for the purpose of the display of such weapon or the lawful commerce in weapons, or except when on his or her own land or in his or her own abode, legal dwelling, or fixed place of business, or on the land or in the legal dwelling of another person as an invitee with that person's permission, any pistol, revolver, stun gun or taser or other firearm; and
(3) One of the following factors is present:
(A) the firearm possessed was uncased, loaded and immediately accessible at the time of the offense; or
(B) the firearm possessed was uncased, unloaded and the ammunition for the weapon was immediately accessible at the time of the offense; or
(C) the person possessing the firearm has not been issued a currently valid Firearm Owner's Identification Card; or
(D) the person possessing the weapon was previously adjudicated a delinquent minor under the Juvenile Court Act of 1987 for an act that if committed by an adult would be a felony; or
(E) the person possessing the weapon was engaged in a misdemeanor violation of the Cannabis Control Act, in a misdemeanor violation of the Illinois Controlled Substances Act, or in a misdemeanor violation of the Methamphetamine Control and Community Protection Act; or
(F) (blank); or
(G) the person possessing the weapon had a order of protection issued against him or her within the previous 2 years; or
(H) the person possessing the weapon was engaged in the commission or attempted commission of a misdemeanor involving the use or threat of violence against the person or property of another; or
(I) the person possessing the weapon was under 21 years of age and in possession of a handgun as defined in Section 24-3, unless the person under 21 is engaged in lawful activities under the Wildlife Code or described in subsection 24-2(b)(1), (b)(3), or 24-2(f)."

Just from reading these three sections that seem to be under court order, concealed or open carry of handguns on your person on in your vehicle would be legal after the time limit runs out. Period.

If I'm wrong, please explain how.

You need BIG money to run in Illinois and I for one don't want to see any career political hack - from EITHER party getting in again.

Time to vote a different strategy. This isn't your grandfather's state of Illinois anymore. Land of real opportunity and hard work leading to promotions? Meritocracy has been melted down to slimy cloutocracy.

Vote for someone who hasn't been tainted by 20+ years of political horse-trading and mutual back-slapping.

Jan didn't bother to mention that Evanston Township High School has shootings almost as frequently as Englewood. And Skokie is running a close second, with a shooting just a block away from Niles North High School. We have no reason to believe that those shootings were caused by lawfully owned and possessed firearms. And guess what else? That Socialist agenda bullshit against "assault weapons" just passed in Highland Park.
