Judges Ignore the Law

  • Denzel Simons, 19, a first-time felon, stood before Cook County Circuit Judge Diane Cannon facing six to 30 years in prison for robbing a man at his Southwest Side home.

    There was no way he was supposed to get boot camp — a break reserved for young, nonviolent offenders. His victim was against it. He’d lost his wallet, with $290 inside, and took a beating from Simons’ partner in crime, who pistol-whipped him.

    What’s more, Illinois law explicitly ruled out a boot camp sentence. Boot camp or probation aren’t options for armed robbers like Simons. It’s too serious of a crime.

    But in a decision repeated again and again in recent years by Cook County judges, Cannon ignored the law. She gave Simons boot camp anyway.
Can you guess what happened?
  • Less than two years after he was sent to the four-month boot camp program, Simons was charged with murdering Kermit Delashment II, a 21-year-old college student with big dreams.

    Delashment’s death was the 500th killing of 2008 in Chicago.
And guess what the judge's reply was when confronted with the fact that a criminal she was required to send to prison was instead out committing murder?
  • In an interview, the judge acknowledged: “I am sure I have given sentences that were not the letter of the law.”

    “You got me,” she said.
Wow. Just wow. A dead man on her watch, under her gavel and all she can say is "You got me." Not only that, she gave a dozen other robbers the same break, consciously disregarding the sentencing requirements in Illinois law.

Here's the other judges pointed out in Frank Main's article:
  • The other judges at the time who sent defendants to boot camp for armed robbery were Evelyn Clay, Lon Shultz and Marcus Salone. None returned calls seeking comment.

    Chief Cook County Judge Timothy Evans would not comment.
There are hundreds of these cases where judges are disregarding sentencing requirements for forcible felonies and sending ineligible felons to boot camp. Hundreds. And they're out there committing crimes to this very day.

Nice job Frank Main - good to see you can actually do the job when the spirit moves you. Now how about something on the parolees committing robberies, rapes and murders and the complete failure of the Illinois justice system that is needlessly abetting the killing and maiming innocents?

It's about time this has come to light... These judges who have blatantly ignored the law should be held accountably both criminally and civilly. Persecute a few of these judges who think they are God and watch how fast the system gets whipped into shape.

The time has come for this AND it will get the publicity it should - maybe not in the slanted Chicago Press, but I guarantee it will get published.

This is very much needed and believe me, many who vote would use this as a guide.

I once wrote a paper on how judges should be held responsible for poor decisions. The professor said judges are not held accountable to the people, but only to the law. In cook county - judges have too much discretion.

...but if you are a legit citizen with no record that violates a minor technicality of the CCW law, you WILL serve years of prison time.

This is nothing new. This is the reason why violent crime is out of control. The predators know that there are no consequences for the acts. Put them away for a few years and the word will get out and it will calm down.

But Preckwinkle doesn't want too many people of color in prison. Doesn't care if the end up in the ER or the morgue.

And couldn't give a sh!t less about white victims.

This list of judges needs to be printed/posted for the week before the next election in all media formats possible. I always vote "no" on all judges, but the average voter either votes according to ethnic heritages or they don't vote on them at all.

This is why I VOTE NO to 90% of judges. I only vote yes when I know that take their punishments seriously. But VOTE NO for MOST of them, and tell your friends and family. Get some new judges in there who want to punish guilty offenders or is this just Candy Land Cook County, oh but, wait it is. Rapists and Murderers are treated like gold in Chicago. At least the French government is looking out for their people and telling them not to come here.

Only thing we can do is vote these judges out on the next election. Those judges "appointed" by the county should be dismissed by the Chief Judge. Don't wait around for that to happen. All of these judges are "clout babies" with deep political connections. Too bad for the young victim here.

Yeah she once cut a car burglar loose on me after I on-viewed him burglarizing a pickup and coming out putting on the victim's army jacket with the victim's name on it. Bad guy also took other proceeds. Watching all this from covert car, it was a dead bang case. She said it was a good arrest but we jumped the gun taking him into custody before we had the victim! Guess we should have done a contact card and let off. walk away with victim's property! Multi convicted offender vs. defender of our country. Bad guy walks. These judges need legal action taken against them. They make the laws and sentences subjective with no consequences. Interpretation of the law by these political hacks is ridiculous. If CPD has to enforce by elements of crimes, why don't judges have to convict and subsequently sentence in accordance to laws. Yeah, I know, they're afraid of the appeals process. They're afraid of their clout and votes. Where's the appeals process for the victims? TV judges have more common sense. This city, county and state stink to high heaven! Sorry for the long rant. It's late and I did not have my medicinal bottle of pinot noir tonight.

What I don't understand is why they rule " finding of no probable cause" when there is probable cause. For instance when probable cause it a traffic violation, the judge will throw out the case but transfer the tickets. How can you rule no probable cause but in the same breath transfer my probable cause for the stop to another court for prosecution. I don't like the no probable cause ruling in these cases because I feel it opens us up to litigation. Isn't there another option for these judges to rule?

This Nation has become too forgiving, not just with criminals, but with bad behavior in general. Somebody does something bad? Hold it against them. Make them pay. There has to be consequences. Without them, laws mean nothing. They are unenforceable and we the law abiding become easy prey.

they have bosses who should be reviewing these things. one would think the CCSA would object if an inappropriately low sentence was given.

there have been judges who have issued orders to expunge criminal records that exceed their statutory authority to do so.

Hey SCC, that was a great article by Frank Main. You know Frank could have made it more interesting if he asked the judge:

"Hey Judge, what the robbery victim was a white guy from Winnetka? Would the offender qualified for boot camp?"

Let me tell you SCC, her answer wouldn't be "you got me." Everybody in law enforcement knows if its a rich white victim getting robbed, instead of a black guy, the offender ain't getting Tom Dart's Boot Camp. He's going to the Shit House. Probably for quite a while.

Regarding the judge's comment, "You got me", that translates to:

"I don't give a fuck. The robbery victim was black. Who gives a shit, anyway?"

FRANK MAIN, this the white elephant in the room. If Pookie or Ray-Ray rob a wealthy white guy in Lincoln Park, they're going o the Shit House. The rob some black guy. They get boot camp. Just ask the judge.

Goggle "Judge Diane Cannon"

This judge has been shown to be total softball in several article. One noted case is where she wanted to lock up a court room observer for four months for whispering in her court room. Another case is during a jury recess she spoke in open court to a relative a defendant and acuused the defendant of shooting up the neighborhood. the case went to a federal appeal cort and had to retried. Only in Cook County can someone be that goofy and out of control and still have a job.

Wow! Lil' Mikey Shields would make a great judge. He too ignores the rules and does whatever he wants. The members at the last fop meeting sent him a strong message when a motion was made, voted on, and overwhelmingly passed to reinstate Dougherty. Lil' Mikey has apparently pulled a Bill Nolan and now decided the motion was out of order after the fact. This little fuck does whatever he wants regardless of what the memberships wants or needs.

Judge Diane Cannon isn't liked by individuals on both sides of the judicial fence. Seems the appellate court has reversed many of her decisions. Most for being overly zealous in remanding defendants to prison guilty or not.

Being a judge in Cook County is very close to a lifetime appointment. No matter how stupid or incompetent the really bad judges are almost never voted for non-retention. In the past 30 years I can recall only one judge to be bounced by the voters.

In 1986 Judge Lawrence Passarella acquitted an offender who beat a Chicago Police Officer near to death and also beat her partner. He admitted as much. After a three hour trial the judge turned off the court microphone, ruled not-guilty and got up and walked out.

There was enough of an uproar that the judge was not retained. He was the only one I recall so the chance of any other judge being voted out is slim and none.

Over 70% of registered voters stay at home on election day. They couldn't care less how they are raped by the political class here. They like being screwed repeatedly so don't get yourself in a fluster about voting any judge out, no matter how bad. It just will not happen.

Cannon was a prosecutor and was police friendly. Not sure if that changed over the years...but this article was definitely a hit piece on her. Salone, Let em go Leo Holt, Lampkin, and many others are bigger offenders of letting criminals off or giving them light sentences. Not a peep out of Preckwinkle when this shit happens. She wants minorities out of jail every other day. I wish I could move out of this state. The liberals are giving away everything to shitheads. I was in 015 and 011 yesterday. It is sickening the massive amounts of teenagers and young men hanging out on corners on every block. They don't want jobs. THey are leeching off of us and have no fear of going to prison for long periods of time..because they won't. These Democrats are under order to throw cases out and not send mutts to prison.

Well according to Toni Preckwinkle there are too many people of brown and black color in jail so I am guessing this is what she is referring to by not locking them all up (at least the bad ones). Why have mandatory minimum sentencing guidelines if these crack pot judges are going to just do their own thing? I see there is no accountability of judges. I advise all my civilian friends to arm themselves and I am a very strong advocate for CCW in Illinois and especially Chicago. Arm yourselves my fellow Chicagoans and don't rely upon CPD or Preckwinkle's court system to lock people up who belong locked up.

So there you have it. A sitting Cook County Judge admitting -- and pretty fricken smugly if you ask me -- that she ignores the Illinois Laws that she's charged with following. Those same laws that are in place in order for innocent victims of VIOLENT CRIME to get some sort of JUSTICE for being preyed upon, and also so society in general can be kept somewhat safer from the feral animals who roam our streets.

It'd be bad enough if the idiocy ended there with the judges. But nope, not in Cook-fucking-County, Illinois. That'd be waaaay to easy, we're the Ron Popeil of STOO-PID...There's Moooore!

Judges and prosecutors have immunity. Police do not. No probably cause is an easy and lazy way to dispatch the case, and throw it in the lap of the police.

In Cook County, all cocaine and heroin possession cases of a gram or less are booted due to no probable cause. All of them, unless they are part of something else. The ASA told me my first time to get used to it. She said the judge would find no PC, he did, and adios case. I didn't take it personally, I just stopped making arrests for small amounts of dope, all went in the toilet. So that, in effect, legalizes possession of small amounts and makes fools of the police.

Last Christmas Eve, Chicago Magazine ran a piece on their website about how difficult it is to "vote out" a Cook County judge:

"In fact, county residents voted to retain every single one of the 57 candidates on November’s circuit court ballot- including four judges deemed 'not qualified' by most bar associations. This happens in nearly every judicial election around here: Since 1990, the retention rate has been 100 percent."

This has been going on in Cook county for years. I remember years ago Judge Strayhorn sentenced a man to a low amount of years (cant remember exact amount) when by law he was supposed to be sentenced to mandatory life. The state sends it to the appellate court , who orders Strayhorn to sentence the man to life. Strayhorn lets him go, saying I'm the judge I decide not the legislature. The released dude goes up to Wisconsin and kills aguy. The guy is caught again and brought back to Illinois . Again after appellate court action , Strayhorn finally sentences the criminal to life . After a life was lost.

How ironic, go to traffic court and see decent hard working people get hammered by judges for minor traffic bullshit and it they plead guilty or are found guilty they are assessed an additional $174.00 court cost fee on top of their fine. Red light camera or speed cameras no boot camp, reduced fine, or community service to work off fine. But commit a crime , 99% are found no probable cause and those who are found guilty or plead to a lesser charge were are their court cost fee and public defender fee?

What I don't understand is why they rule " finding of no probable cause" when there is probable cause. For instance when probable cause it a traffic violation, the judge will throw out the case but transfer the tickets. How can you rule no probable cause but in the same breath transfer my probable cause for the stop to another court for prosecution. I don't like the no probable cause ruling in these cases because I feel it opens us up to litigation. Isn't there another option for these judges to rule?

Have you ever talked to an ASA in your life? It does not mean no probable cause for the arrest, it means no PC to go to trial. Also, you can be sued, or open to litigation even if you convict a guy, you can get sued for anything, you need to understand that if you work as a police officer expect to be sued- it's part your job.

SCC please post this. True story. Okay I have a record, owned up to it, and deal with it. Have not been in trouble going 14 years now. But I had a experience from hell 4 years ago involving Judge Clay. Attempting to get a job I had to get my rap sheet. Go to the station on 35th and it is taking a long time to get it back. I look up and 8 armed cops literally jump me and arrest me. One cop in white apologizes and says we are only doing our job. I look at some papers in his hand and it is for probation violation. Once arrested I am taken to the station on 51st. Then I tell the arresting officer that there must be some mistake, I completed my probation successfully, just call my probation officer, now bear in mind I completed it 10 years ago. Still someone must have a record of it. Well they tell me it is not their job, that once I am in County to sort it out. Okay fine, I have done nothing wrong, figure that once there things will sort themselves out Now I am County, going through the bs of being locked up with the real criminals, the overworked public defender who is not even listening to me, I am hoping to simply ask the judge to call the probation department and confirm my story. Negative. The judge gets mad when I start talking. Weird right? Now I am locked up in County, no bond. That was a shock as well. Non-violent offense to begin with, have not been arrested in 10 years, plus felons and real criminals are getting electronic monitoring, what is going on? My first court date scheduled for 3 days. This sucks. But I am not giving up. Now I appear before Judge Clay my original judge. Surely now I can speak and get this cleared up. Nope, she curses me out in court, I am not given a chance to speak. WTF. At this point I am not taking any chances and forced to get a paid attorney to straighten this mess out. But still no bond and from the county only collect calls are made. I am scrambling to think of anyone who can and will accept collect calls. I am locked up for additonal two weeks behind this disaster. Finally with a paid attorney and a family member who can take collect calls we find my original probation officer, he confirms my story. And you want to hear the excuse? Because I had two cases, it was a paperwork glitch. No apologies or anything from Judge Clay. Needless to say, reading how she gives real criminals boot camp and home monitoring I am more than pisses. I was also told there is no lawsuit for my situation. What I will say is the cops who arrested me were cordial, and told me they were just doing their job. They could see in spite of a record my lack of arrests since then. Please post this.

Of course, I remember, I was on the job then. BUT THAT IS THE ONLY ONE! There have been no others! The voters do not care, they sit on their latte sipping hands come election day.

People get on this blog and scream we should vote the judges out. Sounds good except it has happened only once in the past 30 years or so in the Cathy Touhy case. This is due to no one giving a shit enough to be informed about the judges and do what is necessary.

Remember, this is the judiciary that people like Ed Burke and John Daley and the Democratic Central Committee has foisted upon us!

Much easier to vote Ed Burke and John Daley out of office and out of their committeeman spots.

I got news for you. Crime is going down and if it keeps going down then the department will cancel VRI.

Sorry to rain on your parade but VRI will stop sometime in early 2014. Rahm has been trying for some federal money to cover the huge O.T. cost and the Feds turned him down.

Word from downtown is it will stop sometime in March (haven't worked out the exact date) but if history repeats itself, it will be last minute.

Hey, maybe Obama will start visiting more often and they will resurrect that one.

Have you ever talked to an ASA in your life? It does not mean no probable cause for the arrest, it means no PC to go to trial. Also, you can be sued, or open to litigation even if you convict a guy, you can get sued for anything, you need to understand that if you work as a police officer expect to be sued- it's part your job.

Sorry but you are sorely mistaken. When a judge rules no PC he is saying that you had no probable cause to make the arrest and therefore the arrest was not legal, opening YOU up to a lawsuit every time he does so. You are correct that you can be sued for just about anything but these judges ruling no PC on cases where there's clearly PC are giving the lawyers some pretty heavy ammo to file a civil suit against you. And you can bet your ass that the judges won't be questioned or held accountable EVER. Lastly, I don't expect to be sued for doing my job properly nor is it indicated anywhere in our job description that being sued is part of our duties. I find it funny that the judges and state's attorneys are all immune to civil law suits but the police are not. Remember that the next time a State's Attorney tells you to kidnap and hold a witness against their will because they want to talk to them in person. The best thing you can do is protect yourself by not wasting time processing 1 baggers that you know are going to get tossed in court for no PC. How many of those bullshit arrests need to get tossed out every week before officers wake up and get the hint? We definitely have some very dense individuals on this job.

Most of you are probably too young or too old and senile but we did it in the eighties-throwing a judge out with votes-with the "motion mafia" vs Officer Cathy Touhy case. We backed our officer and the judge was gone quickly due to our strength. We can do it to all these pieces of crap judges.

People get on this blog and scream we should vote the judges out. Sounds good except it has happened only once in the past 30 years or so in the Cathy Touhy case. This is due to no one giving a shit enough to be informed about the judges and do what is necessary.

Happened more than once. Judge Jose Vasquez was also voted out on the retention ballot like Passerelli after there was a campaign to remove him. Below is an exert from an article about Daly when he was the ASA

He lambasted Judge Jose Vasquez, labeling one of his decisions as “ridiculous.” When Vasquez came up for retention, he was defeated. Judge Lawrence Passarella was voted out of office after Daley raised Cain about a ruling of his. “Daley engaged in a vendetta,” says one judge. “He was successful.”

There should be a competition for who kills the most citizens via release of murderers, thieves, rapists, etc. Skokie judges have a good chance, Markham close. It's by judge not by total.

I'd bet money you can find each and every one driving illegally at least once a week.

And I'd bet when you pull them over to write the Mover they are going to do something that would get any ordinary citizen into worse trouble if they did it to a Cop doing a 'completely random traffic stop due to the behavior of the driver who was unknown at the time of the stop.'

Teach the Judges they are just like everyone else...not above the law.

Ticket the snot out of them in such a way that one of their peers has no ability to review and dismiss the tickets.

A judge makes a sentencing ruling in flagrant violation of the law and it directly results in a person's death and all the judge has to say is "You got me."???????

WTF. What a POS. That judge is heartless, no conscience bastard. No "I'm sorry" or any expression of shock or remorse for the pain and suffering she caused. Because they don't care. They do what they are told to do. Keep the criminals out on the street.

It is not shocking that she let a criminal back on the street to commit more injury. It is shocking her utter indifference. How can someone, anyone, especially one that is entrusted with a high responsiblity just not care? It is partly because she knows that there will be no consequences. But mainly because she is a heartless, irresponsible POS. She is only a judge because she tows the party line and everyone around her realizes that she is too stupid to be in any law office. Says a lot about whatever law school she went to. But it says more about her character and values, both of which are obviously non-existant.

Although I don't agree with the sentence in this case, I have had nothing but positive interactions with Judge Cannon. She has signed numerous search warrants for me at all hours of the night. She has also been seen at several benefits for officers and has purchased tickets even if she could not make it. She has been extremely cop friendly in the past.

Actually you are only somewhat correct. When a judge rules NO PC they are not ruling that the arrest was illegal. They are ruling there is not enough evidence to "probably" support a finding of beyond a reasonable doubt if the case was to proceed. This is a huge difference from the arrest being ruled on as illegal.

Correct...Sort of.

An Illegal Arrest decision would be a judge making a statement that the Police Department committed a 4th, 5th or 6th Amendment Violation or Miranda Violation, Or even a 9th Amendment Violation.

Lack of PC is just Lack of PC in the Eyes of the Jurist.
PC:: noun:
sufficient reason based upon known facts to believe a crime has been committed or that certain property is connected with a crime. Probable cause must exist for a law enforcement officer to make an arrest without a warrant, search without a warrant, or seize property in the belief the items were evidence of a crime.

Technically, probable cause has to exist prior to arrest, search or seizure.

You are completely wrong. A preliminary or "probable cause" hearing is held for a judge to make a determination as to whether or not an officer actually had probable cause to make an arrest at the time of that arrest. When a judge rules a finding of no probable cause, it means exactly what it sounds like and that is that the officer did not have probable cause to make the arrest, hence the case gets dismissed.
