Contact Card Lawsuit

  • A group of six black men has filed a federal lawsuit against the city of Chicago, Police Supt. Garry McCarthy, and 14 unnamed police officers, alleging so-called “stop and frisk” procedures are unconstitutional.

    Rev. Paul Jakes, a politically active minister, said African Americans in some neighborhoods suffer mistreatment similar to apartheid-era South Africa; as they are stopped and checked for papers, even if they are doing nothing wrong.

    Civil rights attorney Anthony Romanucci has filed a federal lawsuit on behalf of six black men — Darnell Smith, Darren Nathan, Gregory Davis, Jeff Coleman, Phillip Overton, and Marque Ross — challenging the Police Department’s use of “stop and frisk” tactics. The men claim they were stopped and frisked without any probable cause, or reasonable suspicion that a crime had been committed.
It'd be interesting to see the IR numbers of those plaintiffs...and their full records. We're sure the lawyers didn't cherry-pick those with the cleanest records...not at all. And we're sure that every single one of those 250,000 stops resulted in an involuntary detention, a frisking, and whatever other nonsense the attorneys can dream up.

Of course, it wouldn't be a Chicago lawsuit without some statistical nonsense included:
  • The ACLU said African-Americans have been singled out for such searches, and the justification for such stops often fails to meet constitutional standards.

    African-Americans accounted for approximately 72 percent of those stopped, while the city’s population is only 32 percent black, according to the ACLU report. Hispanics and whites made up 17 percent and 9 percent of the stops, respectively, while they make up 29 percent and 32 percent of the population, respectively.

This is going to get interesting all those Compstat meetings where McCarthy screamed about contact cards contact cards contact cards..... His deposition should be amusing.....

The bad thing is the city will cover the bosses it will be the coppers paying the punitive damages especially when you see Officer B did 600 contact cards in a block by block area and they were all male Blacks then Officer A has 900 contacts and they too are all male black......

So the moral of the story is look at these merit lists that were posted these are your exempt bosses leading US astray, don't listen to them if it's wrong or ILLEGAL !!!!!!!

And then you have this...the Supreme Court held Tuesday that a traffic stop can't be prolonged beyond the time that the police need to perform their basic functions. In a 6-3 opinion, the court said that the police can't perform a canine drug-sniff after a ticket has been issued -- even though, a decade ago, it held that a drug sniff that occurs during a lawful stop is perfectly constitutional.

It's interesting to see this post as i also saw bunch of OT comments about it on the 005 LT's fleeing post. G.O. clearly says don't do it for traffic. Also just being in a high crime area is not a crime or justify reasonable suspicion. OT: As for the 2 year "tactical" boys and gals in 003... (assuming the other comments were true in the prior posts) Doing contacts cards is NOT POLICE WORK! Who puts 2 or 3 year newbies on tact anyway? Wonder what they consider police work. How bad is tact in 003 that they allow kids on teams? If this is true we are screwed. Who is teaching them? Are they willing to learn? From what i see in the new cops these days is that they are know it all whining complaining hair gels.

Simple fix, don't stop anyone anymore period! No self initiated actions, just respond to calls. If you try and stop someone and they run, anything that happens to them is on the police. This seems to be the national opinion in all the recent incidents. Let them run, society does not want you to be the real police anymore. Take only the required action nothing more.

Don't let the Dept. pressure you into contact cards especially if your in a unit or on a team. Let the bosses tell you all they want every month contact cards are down, I like my house and taking vacations. Oh and by the way...ask anyone who has been sued in Federal court, Have they ever seen any bosses at their trials for support? Not in my 15 plus years.

prediction: the city will cave on this because...there is no way the city can justify that many stops, frisk or not, based on the CPD requirement that a person be contacted....when they have committed an offense, are about to commit an offense, etc., etc....GMac demanded contact cards (i.e., "we have to put our hands on people") he got his cards (and who knows how many of the cards are real and how many are phony (false names, phony addresses, etc.), and now....."the chickens have come home to roost!"

heard at deposition:
GMac: I never told anyone to increase the number of contact cards!

command staff asked for their information:.....whoosh!, while they run for their cars....

Racial makeup of stop-and-frisks would appear to be almost exactly proportionate to the racial makeup of the shooters/victims out there.

Sensible police work is being done, right in there where all the trouble is. Trying to stop the senseless killing every day and night. Looking for a stolen Cadillac, you don't put a stop on every Volkswagen you see, "just to make it fair."

The shooters bring heat on everyone. You don't like it, stop running around waving your hands, yelling "Black Lives Matter," and drop a dime instead.

Otherwise, the city can just continue to pick up the dead and name parks after them if they're hooked up right.

They are so predictable, 1st the ACLU "manufactures" a bias study that supports their position completing misinterpreting data that they obtain in order to advance their "conclusion" which they have already made their finding to before misconstruing the data.These studies by the way, are always based on argument already made by an ACLU office in Washington DC or NYC, because the Chicago ACLU office usually lacks any creativity in their civil rights proposals or arguments. Once they have their "study" they release the findings (if that's what you would call them) to the media and public. Usually, like this most recent study, not much weight is given to the ACLU's findings and the story fizzes out of the media's attention in less then a news day. Next come the lawsuits, Civil rights plaintiffs attorneys file frivolous lawsuits using the prejudicial "study" as support for their clients, who almost always felons with pages long rap sheets but are inevitably turning their lives around. This is the script time and time again with much of the reports and findings presented by the Chicago ACLU office. So predictable, when is the media gonna wake up?

The problem with looking at their IR sheets is that they will show a thousand arrests, but none to have resulted in convictions. This will work for the plaintiffs, not against them. Their argument will be that they have been hounded and harassed by the police their entire lives, and the low ratio of convictions to arrests only proves it.

This is yet one more way in which the CCSAO's no-charge policies have long consequences.

So CPD stores this contact card information and can show when and where and by whom each one of these "plaintiffs" was inconvenienced by a conversation and safety pat-down and caused to, "suffer mistreatment similar to apartheid-era South Africa."

Let's go back to those spots where the stops took place, almost certainly on the west and south sides at similar times.

If we look around and took a census how many African/American males are in the area as opposed to other races?

Was there violent crimes committed in close proximity to those locations?

Would the Rev. Jakes or any of those ACLU lawyers feel safe in those areas; alone on the street at night and who would they really fear?

What would make them pucker a passing CPD squad or a rolling wreck of a car that slows down and looks them over as it passes by?

This ruling has not changed anything (curtailed what we have always been able to do). The law has always allowed police to use a canine to sniff a vehicle during a lawful stop as long as that sniff has occurred while another officer is issuing the tickets. Once the tickets are issued the driver and vehicle are free to go. The time frame the courts usually cite for the amount it takes to pull over a car to conduct your stop (pull over vehicle, approach, get info, run name, and issue tickets) is 15 minutes. This case , if the ruling would have gone the other way, would have allowed officers to continue to detain a vehicle after the tickets had been issued for a vehicle sniff. If would be helpful in that you pull over a vehicle and the canine unit is not directly behind you at the time you pull over to conduct the sniff. It would extend that time so a canine unit could come to the scene for the sniff.

Sad part is that I am sure none of the "chosen few" who are getting dog know any of this. The canine unit will continue to do "money sniffs" 1 hour after arrests. I have never seen a canine officer once on a traffic stop that this would affect

Although I agree with some of your post, nowhere in the GO clearly stateds you do not do contact cards for a traffic stop. The reason you are doing a legal traffic stop is for an investigatory reason. Failure to stop at stop sign, improper lane change, speeding, etc. If you choose not to issue the violation and give them a warning you complete the contact card.

If you choose not to every write a contact card that is up to you but don't be telling people false information if they wish to write the contact cards according to the way the department has written the order

The sniff is still legal "during" the stop. You can't hold people after the stop is over to wait for canine without reasonable suspicion. If a canine were present earlier on the stop in question, it would have been just fine.

Special Order S04-13-09 IV-B-5 reads as follows; Contact Information Cards will not be completed for persons that are included on any other report utilized by Department members for that incident (e.g., Personal Service Traffic Citation, Administrative Notice of Ordinance Violation, case report or arrest report).
EXCEPTION:
A Contact Information Card may be completed along with an Illinois Traffic Stop Statistical Study - Driver Information Card.

So, if an officer conducts a traffic stop and no other report or citation is written/issued a TSSS (blue card) WILL be completed and a contact card MAY ALSO be completed.

P.S. Please let all the "hair gels" know about this. They might look-up to you and think you are looking out for their best interest instead of being a condescending ass.

Maybe this will put a stop to hearing 1020 2nd watch always saying "I want everyone contact carded within a half a mile of said shooting". All 1020 does is live for contact cards. Anyone who has the displeasure to be under the "Command and Control" of 1020 should be very careful with their narrative on contact cards. R/O was ordered by beat 1020 to contact card every person within sight of said location.

Police can conduct a field interview any time any where. The subject is not detained, frisked or in police custody and free to leave at any time. It's time to bring back the vagrancy law where every individual must be able to identify themselves with photo identification whenever they are outside of their own abode.

Pretty much everyone owns a smartphone, I highly recommend downloading these two following apps:
U.S. Cop
&
Case law

These 2 apps have a lot of useful tools for officers to utilize but importantly it has the laws pertaining to taw enforcement job.They also contain case law with immediate notifications of a change in the law or a new ruling by the U.S. Supreme Court.

It is really amazing to me that so many officers do not have a good grasp of what elements are necessary for probable cause to arrest or the basic laws that pertain to the job. This includes police officers all the way up to the gold stars. There is nothing wrong with admitting you don't know and needing a tool to look it up. For Christ sakes who could memorize all of the laws that are written. For ILCS laws you go to I clear home page, go to bureau sites, go to legal affairs, scroll down to the bottom to ILCS. Another useful website for ILCS complaints and what not,Www.chicagocop.com I'm not going to give the password out over this public blog, ask a veteran officer or stop in and see one of the detectives that are assigned to your district.

What would happen if there was nomo welfare. Everybody on welfare would turn either into a criminal, or a worker. Either way the human element declines on the streets now and with 60% less people mulling around looking for their next opportunity it might start looking like a working class neighborhood, where the only people on the streets are people returning home from or going to work or school. The ACLU is like a dog chasing it's tail. It will never catch it but keeps chasing it. If they put as much effort into getting these same people JOBS and off of welfare they would actually be accomplishing something. I get the part about "don't do anything" because the department, the city, the politicians, and the bosses don't back you, even when you're doing your job.

But for cops to be such quitters because they themselves can't articulate the difference or maybe they don't even know the difference anymore, between a justifiable reason to stop and document the stop...?

If you have been stopping people just to fill out a card, then you don't know your job.

And, yes, you can do a contact card from a traffic stop IF it was a blue TSS card, no citation issued, then you CAN complete the silly card.

This isn't data mining. If we are able to garner useful information after the contact card is generated, good for us.

As for simply stopping blacks for no reason, show me the neighborhood that is quiet, safe, and crime-free at all hours of the day or night, and you will still see contact cards, because you as the officer familiar with your assigned area, know what is and is not out of the ordinary.

As for areas that are "high-crime," it stands to reason that an officer familiar with that area, knows the patterns, conflicts, and behavior of individuals or groups engaged in acts that often lead to crimes related to the lesser things that went unaddressed or unnoticed...

Remember, in spite of all the media misinformation, and lawyers preying on the public trust, there is a reason people want to see you stopping the troublemakers when they are roaming around seeing if the coast is clear, testing your response time, challenging your authority, waiting for an opportunity to commit a crime.

Phat Phil started this nonsense with the numbers game at the so called DOC meetings. Exempts - mostly patrol- would get grilled about low contact numbers and all of that nonsense.
Now some POs will be in federal court unless the city caves. It is a numbers game because most of the bosses are merit, not able to lead and some are not very bright. But will they be held accountable? I doubt it. Stay safe.

I've been retired for some time but wasn't there a BLUE CONTACT CARD that was used when there was a warning issued at traffic stop.

That was part of the problem, not CROSS REFERENCEING, if you had a victim or witness or other citizen contact make a contact card on that. We once picked up a lady and her kids on the street during a hell of a storm and gave them a lift in our non-cage car. They appreciated it and we made contact card explaining it was just a unit of work to justify our time. She appreciated what we did and there was no problem, the card read "Assisted citizen..."

I worked in 016 for a short time, and let me tell you that the people on afternoons are workers. They're almost all good people and they go to all their jobs, and do everything that needs to be done. They are woefully shorthanded there. The day crew has some good people too. Midnights is a different story, but it's midnights. If you're such a super hard charger, bid in there and show them how it's done. That is, if you have the time to get there, which I doubt. 016 was a very pleasant surprise and the 3rd watch people are top notch.

Although I agree with some of your post, nowhere in the GO clearly stateds you do not do contact cards for a traffic stop. The reason you are doing a legal traffic stop is for an investigatory reason. Failure to stop at stop sign, improper lane change, speeding, etc. If you choose not to issue the violation and give them a warning you complete the contact card.

EXCEPTION:
A Contact Information Card may be completed along with an Illinois Traffic Stop Statistical Study - Driver Information Card.

So, if an officer conducts a traffic stop and no other report or citation is written/issued a TSSS (blue card) WILL be completed and a contact card MAY ALSO be completed.

to the off topic comment regarding the Police in 016. A few months ago (I'am a P.O. who does not work in 016 - but lives there) an incident was taking place in front of my house. First, I confronted the individual, then called 911. 2 - 016th P.O.'S in a van quickly arrived and took care of the situation - the way it would be taken care of had this been on the West Side. A BIG THANK YOU TO THEM!

It's not who we stop, it is how we report the stop. We were all taught in the academy that when we stop someone and detain someone that it is a Terry Stop. You have to have probable cause or reasonable suspicion this is what separates us from Nazi Germany and South Africa. People have rights. I feel we as police officers make stops for the right reasons, BUT, we do s shit job filling out the contact cards. We don't explain our actions in the contact cards. The Sgts. kick them back and we complain about this bullshit. Or, they don't read them at all. And, we don't tell people why we stop them, we just tell them to shut up or none of their business. So as usual, WE, police officers screw it up for ourselves. We look to blame everyone else, but we did this. I hope the poor guys named in this suit don't end up having to pay up. They probably did nothing wrong but do a bad job filling out the card and treating the people they stopped "rudely."

OLD School SGT Here. The problem with this department is the micromanaging of the officer on the street. Once you saddle them with contact cards requests ( and yes- you get what you measure-compstat). The officer spends more time looking for contact cards than what they used to do, being the police. In the old days the sgt asked you to handle your beat without interference or bootstrapping you to a box or post shooting mission. The tact teams and citywide units would come in to saturate an area. They turned them into fireman.

I'm newly assigned to 016 and couldn't agree more. I'm doing all I can to boost morale and improve performance but it's an uphill battle. The amount of disgruntled, angry, pissed off, pissed on, mangled troops is sad. 11 P.O's on the medical on first watch alone. There's a problem here and no one seems to care. I do! Just a P.O. but trying to make a difference

Yawwwwnnn. Sorry son. I came to 016 to ease into retirement in the next 2 years. My time of being the police is over. The says of working in 007, 010, 011 and 015 are done and gone. Besides, we live in a nice condo in 012 so the 016 ghetto drama no longer effects me. I retire and my wife and I rent the condo in 012 and off to Florida for retirement we go. My daughter and her husband have been living there for 3 years already it's beautiful. So no thanks. My seniority let me finally get out of the ghetto and into 016 on days... I'll answer my jobs and that's it. Not a single bit more. Enjoy this cesspool of a city

Been living in 016 33 plus years now, for many years I too felt like you do, In the past year or so I have seen more than just a few coppers out here doing work. Considering what they are forced to work with or lack of, I was proud on at least on three occasions to see a quick response,backup and even simple patrol in alleys etc..all watches on 1612. Probably hard all over but there is an obvious effort that I can see. Hang in there, hope it works out for ya.

#1 It's not controversial

#2 it's stop - not frisk, unless you have additional reasonable suspicion, technically, to frisk

I think blacks should really be stopped even more, given their crime rates.

Just answer your calls take the reports. That's all they want you to do anyway. Why do some just putting themselves out there thinking that they are doing any good. You are one of the lucky few. There are many who have not had the luxury of being supported by their supervisors and the department while being investigated. The department is notorious for protecting those officers who are part of the "club", even in instances of blatant misconduct. At the same time, they have suspended and fired others for lesser transgressions because they were not connected. Politics and cronyism have infiltrated everything in this town, so don't be naive enough to think we are all held to the same rules and standards they would like you to believe. I don't think the first poster is bitter or scared, but the truth most often is.

This is why the department is so messed up. People like you can not pick up an order and read it, or they don't have the brains to understand what they are reading.

You are conducting a stop because of a criminal behavior that occurred. That is a stop sign violation, taillight, improper lane change, etc.
If you choose not to write them, which is your choice, you document the stop with a contact card and the reason for the stop (investigation) is the moving violation you are letting them slide on. Now if you are pulling people over without any pc for that stop you are correct, you do not complete a contact card. I hope you are not doing that because that is a whole other legal issue that I don't think you'll understand if you still can not grasp when you do and do not write a contact card.

Statistically, those people (black and white) who have jobs and bills to pay are not roaming the streets (walking to/from home/workplace is not roaming btw) or hanging on the corner.
Those who do not have a job to get up for, or bills to pay, and those receiving state/federal tax subsidized monetary assistance which preclude them from actually having to work, are roaming the streets-- statistically speaking of course.

You're probably right. Maybe 2004-2005??
I think the contact card system was an excellent idea if used the way it was originally intended. It was meant to document those ne'er do wells and those they hang with and where they hang, etc.
But then the department started shoving it down our throats and demanding the cards be written en masse which was the beginning of the problem.
Originally I think it was a good idea.
Demand them, and you're just asking for trouble.

Well, you should have your job performance examined. If, as a police officer you go through 9 hours of driving around in the ghetto you can't justify even one legit investigatory stop then you are either driving around with your eyes closed, not leaving the station for all 9 hours, lazy or inept into finding a potential criminal. You can't find anything? Nothing???? Call it what it is... You're lazy. If you get sued for a legit contact card then so be it. I have absolutely no problem going to federal court to tell the truth about what I saw and did. Too many cowards and lazy mutts on this job. Stop being so terrified of lawsuits. I'm no firecracker of a copper anymore but when on my beat car I see somebody suspicious or up to no good I have no problem stopping them. I also have no problem documenting it. After all, it's our job. If you can't find a single person to stop as a police officer then you don't do your job. Think if you worked at a business and you did absolutely nothing all day. You would be fired in a second. Not us though.. The typical cop thinking of we are so special we don't have to do anything... Call it what it is.. Lazy and self entitled.

I remember one guy on here when SCC first reported on this ACLU none sense over these contact cards a month or so back. Guy commented (in the context it was written, I'm assuming he was surprised) about how he stopped a "professional" looking black male and the man seemed "frustrated" at being stopped and questioned or what ever took place. At no point did the commenter give reason as to why he stopped the black guy, he was to wrapped up in being surprised at the "professional" looking guy was frustrated over being stopped and still upset as he walked away.

Read what the old timers or just coppers who decided to actually get in the know have stated previously on this post a few times. Could save you, and all of our asses.

West dumped the days mission team in 011 for low contact cards. Plus they were too noisy and loud.

I agree with the move. The 1165 team was nothing more than another tact team. I think 011 is good on plain clothes guys. We need more po's manning beat cars.

it might be said that there are two (at least) societies in America, each a subset of the other...one believes in the law, the other lives by their own beliefs....law enforcement can only do so much, and only when supported by the larger, law abiding society...more and larger prisons may not be "the answer", but it may serve to insulate the law abiding from the predator....it's up to the folks who wish to live in a a safe environment....you only have one life, how do want to live it?

WRONG! While blacks comprise about 13% of the U.S. population, the percentage of black serial murderers is actually slightly higher. Generally, the victims are also black, most being females living high-risk lifestyles (prostitution, narcotics addiction, etc.).

For whatever reasons, the mainstream media gives lesser coverage to these serial murders.
