Go Fund Me - Densey Cole
We haven't received an update recently but the GoFundMe page is up, running and beyond the $18,000 the utility bill was in arrears. Densey has popped into the comment section a couple times and hopefully will continue to update as his condition allows.

Hi, Well the Cole's showed up for court in Wheaton, Ill on Wed at 1:30 pm. Densey, Mom, Dad & sister. Also Jim Rose from channel 2 news. Marla Georges did not show up & the next thing we know an attorney for Regency Place Apts. showed up, told the judge that Densey was not present, when Densey verbally announced his presence as requested & we approached the bench with Densey. His name was Mr. Baker & he told the judge that he was contacted by the city to get a continuance till 23 July,so they could have time to negotiate. Negotiate what? Once again not telling us anything. Once again we will be appearing on that date & will update you all through this journey. Please keep spreading the word because it turns out through the years many officers have suffered the wrath of COF & that is so worong on so many levels. They people have wrote me such heartbreaking letters. So we will continue this fight for my son, with him as well as for future officers. The fund is doing great & as you can see the proper amt. of $40K is listed. Bless all of you, take care of #1 (YOU) or else you can't take care of your loved ones. Louise Cole & Family
you guys know that Go Fund me takes 8% of all revenues
I dont like to use it
You are in our prayers, Densey!
Never give up hope. Great job Mr Cole, SCC and all the coppers and their families rallying together here.
There is strength in numbers, and we have numbers.
Good cause.
I still can't believe only less than 300 people have donated.
What if it was you?
Come on, you can spare $20.
Densey, are you gonna make it to the CPD vs CFD Hockey game tomorrow?
The utilities will be covered. The city has paid for everything else.
The question is: did the city pay up like it promised to? Honor the commitment?
Maybe the story needs to be retold on what happened that day. If you can bitch about everything under the sun on this site, then you should be able to help a brother in need. Do the right thing when you're superiors aren't.
This is more than Densey; it's about all of it. Me, you, & our families. Any one of us could get in a jam on the job. It's about making sure the City & FOP keep commitments. No more broken promises like Densey got. We gotta stick together.
I am happy to donate, but approximately 8 percent is taken by Go Fund Me. Wouldn't it be better to set up a fund at a bank or the credit union? Where the hell is the union on this? They sure know how to set up fund raisers for their favorite sons and daughters. I have seen so many police officers in need and FOP did nothing to offer their support.
Officers need to bombard the City of Chicago Department of Finance, FOP, the Chicago Police Department, FOP, and Mayor Rahm Emmanuel. They are treating Densey Cole like a criminal. He can not resume his so much needed Physical Therapy, because the City of Chicago won't pay for it anymore. Is that in retaliation to him going public about the City no longer paying his rent and getting him evicted? This is inhumane. Quadriplegics need Physical Therapy or their muscles will tighten up and form contractures. They have messed with him emotionally all along and now they are messing with him physically. His physical well being is in jeopardy here. This has to stop.
I used to be an Occupational Health nurse, and I know the City of Chicago is exempt from the State of Illinois Workers Comp Laws, BUT, this denial of medical care and all the other stuff, would NEVER ever be allowed.
Complaints to the above mentioned departments and the Mayor need to be made. Densey is trying to fight this battle, THERE IS POWER IN NUMBERS! Please spread the word and show your objection to how he is being treated.
Thank you
Pamela Banno, RN
Hang in there!
NOTE:
Docket says July 22nd, not July 23rd is the next court date.

Did anyone politely contact RMK?

or contact the debt purchaser CAVALRY SPV I LLC?

Note: their PR page, maybe St.Vincent de Paul can broker a solution.
If an reduced "offer in settlement" were made, then more of the funds raised would actually go toward FUTURE expenses.
This looks like one of the city's creditors is seizing the apartment(is this a condo?) for a debt owed.
Don't hold your breath, few of city's other creditors are being paid. And with the city's junk status this will be the first of a long line of creditors.
Look at the two cases that come up on the docket.
This does not seem to be an regular eviction
Cole may be considered a tenant in a foreclosure proceeding... and have rights under that category.
Cole may also have some recourse under the newer debt collection laws.
Cole, the tenant, or a responsible party, does not appear to have been given the proper notices and all. Or else it would have never gotten this far. The debt has been resold at least once.
Hopefully creditors don't touch that GoFundMe collection....As there appears to be a judgment in place.
Messy.
Maybe someone knows foreclosure law or debt settlement law.
Rhetorical Question:
Any citizens out there that just happen to be lawyers that need to do some community service/pro bono work due to some FU?
What to do?
First of all. Show up on the correct day. July 22nd.
If the issue started with the utility bill,
Maybe e-mail one of these two "experts".
They might be able to e-mail a reply.

That would give his family something to work with for the court date on June 22nd.
Can Cole even stay there? Does the property management company want him out?
So, is the real goal here finding him (and his caregiver) a permanent living situation?
Do any *programs* apply where he can move into a new house?

This is all that I've got.
Take what works and leave the rest.
Here is some info out of Washington state that explains a similar situation.

I'm going from the screen shot of the paperwork in this video.

I would like to donate. Is there a way to find out if he has an account at the credit union. This way I could just transfer money directly into his account and nobody takes a fee
Looked at the docket. The closed case says DWP. Some person paid $20 for a summons that never got delivered properly.
DWP = Dismissed with Prejudice ??
That should mean that Densey can't be sued for this bill again. Kind of like "double jeopardy".
Anyone of you charmers that happen to be friendly with any Du Page County clerks, that happen to be out that way, could ask someone during your lunch, of course...to explain these abbreviations.
Part 2)
In all fairness, someone has been paying the light bill for all of these years. Or else Cole would be sitting in the dark right now.
So maybe the management company was the one who paid it. Now they are just trying to get their money back from the city. Seems fair.
How was their corporate office (think ivory tower) to know that a disabled person was actually living in one of their many units?
The city has a lot of money budgeted for "Rents"
How were they to know That this was not an apartment kept for one of the many expensive consultants that the city pays for, or someone's boyfriend/girlfriend?
Sorting through the gobbledygook without having seeing the actual documents, this is not an eviction so much as a "termination on tenancy"
http://www.tenantsunion.org/en/rights/termination-of-tenancy1
A de facto eviction process.

CORRECTION:
I don't see an actual judgment yet.
Looking at the docket info, from either case.
-Not Sure
2 cents:
Before this standoff between Cole and the city over who is going to pay the utilities began, was anything recovered from the other driver's insurance company?
Did Cole sign off of that?
Revisit that.
Form a disability trust for Cole.
There may be better options available, if the money is not in his name.
Hope that this comes together so that he and his kids can be settled into a new place before the school year starts. Good Luck on July 22nd.
Any news?
There is no recent update on the GoFundme page.
Three pages of paperwork are online at the
http://disabledcops.blogspot.com/
Seems to say rent due, not utilities due.

The next court date is on 08-12-2015 at 1:30pm in Wheaton.
Case was continued for status.
There is an "Agreed Order" in place.
There is a balance due of $2.
