Geez...Again with this Crap?

  • Autopsy: Man killed by police in Pilsen was shot in back
Really?
  • A 29-year-old man killed by Chicago Police early Saturday in the Pilsen neighborhood was shot in the back, an autopsy has found.

    The Cook County medical examiner’s office identified him Sunday as Rafael A. Cruz Jr. of the 1900 block of South Jefferson.

    Ogden District Cmdr. Frank Valadez and an officer assigned to the district were on patrol near 23rd and Wood about 1:30 a.m. when they saw someone firing shots from one vehicle into another, according to a statement from the department’s News Affairs office.

    Valadez and the officer pursued the vehicle in their squad car to the intersection of 19th and Ashland, where the vehicle hit several parked cars, according to police.

    They got out of their squad car and moved in to arrest the suspects when the driver “purposefully reversed” the vehicle to hit Valadez and the officer, police said.
He just hit two police officers with his car -a few thousand pounds of blunt object. He might have run them over again if the escape route had a downed officer lying in it. Quite frankly, we don't give a single fuck where the bullet hit him after that, and neither should any other intelligent individual.

For the ignorant Sun Times editors:

The dead asshole seems to have fulfilled sections II-A-1, 2a, 2b, and 2c, thereby justifying his own removal from the shallow end of the gene pool by the officers.

They think it's "unfair" that Policemen CAN shoot
dangerous, multiple count forcible felon in the back.

All it takes to change your mind is chasing some "just finished

Well hey der, has everyone else recovered from Part II of the Chicago Police Lieutenants test yet? I've gotten my second wind, finished a TRR and will share a few thoughts relative to how McPisspot rigged the least challenging test I've ever taken! I don't mean to say I'll be number one on the list; however, I will say I should have spent more time casting to brook trout on a spring creek and less time preparing for the most dumbed down "Part II" I've ever experienced.

Another relevant point to the "shot in the back":

If he was sitting in the vehicle at the time the driver was reversing the vehicle towards the officers, as he obviously was, then OF COURSE he would be shot "in the back". The car was reversing towards the officers, which means his back was generally leading the way towards the officers as the driver put the pedal to the metal.

The weird part would have been if the bullets floated over the car, then dipped and turned around to enter through the windshield and strike him "from the front".

Contrary to popular opinion, OIS do not mimic what you watched on TV while growing up. We do not stand in the middle of the street at High Noon and face our assailants like Marshal Matt Dillon & his Deputy, Festus Hagen. Real OIS are not stationary, unless you were pumping gas like Harris Co TX Deputy Sheriff GoForth this past weekend. The incidents are fluid situations where the officer may encounter a citizen who appears to need help -'such as in Louisiana where a Trooper found a car in a ditch. As the Trooper approached, the motorist fired a shotgun at point blank range.
OIS do not stop when the offender turns and runs away. He could still pose a threat to other citizens. Or as a recent case in Zion IL showed the offender running from an officer -'the videotape did not show that the offender was also running towards another officer. But your coverage kept screaming "youth shoot in back by a white cop." Nor did your coverage mention how the weapon was stolen from a "vendor" who had previously stolen the gun!
We simply do not stop and say "maybe mañana". We are still obligated to pursue the offender.
If you really want to experience some of these scenarios you should participate in a "shoot/don't shoot" training scenario. One of your colleagues did that while observing a suspect with a gun in his waistband and then the "cell phone case" which has a gun butt attached.
Or how about a suspicious youth who abruptly pulls out his wallet with a card that reads "I am a deaf/mute" and you quickly determine "foe" and fire "without the kid firing first." We are not obliged "to take the first shot" before we can fire our weapon - but we do have to make split second decisions which could involve a citizen with a physical or mental disability.
If mope-rah is going to try and turn this latest OIS into a media trial - please get your facts straight!

Thank the Lord that the Dics Used their power to override the State on at least one of the three. Let's see if the States Atty office will nolle pros the case.

For the love of God -- put yourself in those officers' shoes. Just two guys, and all they have is pistols against a hurtling steel object twice the size of a furious Cape Buffalo, but they are sworn to stop this kind of thing, at the risk of their own lives. They are IT in those few seconds.

Try to get the perspective. Read your own story, for starters.

Try a headline like "Police stop crazed gunman."

You try shifting gears like that. It's not like you're sulking because someone said something irritating at the office.

Don't have to love the coppers if you don't want to, but at least try to show a little respect, a little understanding for those who will come running to help you if you need them.

...which is more than that Harris County, Texas deputy got the other night when he was cold-bloodedly, deliberately "shot in the back" while peacefully putting gas in his squad car. Guy had a wife and two kids.

How'd you like a knock on the door like that?

Off topic SCC. In 22nd District Saturday night, a man was pounding his wife in front of his home in Mt Greenwood. An off duty P/O came to her aid. Husband suckerpunched the off duty in his eye. Struggle ensued. He was arrested. Off duty has black eye and other minor injuries. Bad guy used racial slurs towards 22nd police that arrived on scene. He was charged accordingly by Area South. Anyway who is the spineless Lt Ryan in 22 on 2nd watch. He said it should be misdemeanor. Granted the off duty has black eye. The offender's last name is Nelligan. His dad was a Captain and uncle a commander in charge of the gym at 35th & Normal. He retired and drove for 19th ward Jerimiah Joyce. Anyway the offender was charged with a felony at 0730 and missed the bus. Then Lt Ryan made sure a special trip was made to bond court the same day so he wouldn't have to stay in 22 overnight. I guess the 19th ward is more important to Lt Ryan than a police officer who came to the aid of a beaten wife. Anyone have info on this Lt.??

OT: Clark County Nevada just passed a .05% sales tax increase. That's a nickel on a hundred dollars. It's called the "More Cops" tax increase. Las Vegas and surrounding cities (Henderson, NLV, etc.) will all be hiring additional police from the sales tax increase. For Vegas it should fund an additional 150-200 officers or about a 6%-7% increase in manpower. Hard to find anyone who doesn't support this move. Except the meth heads of course.

That brings the sales tax to 8.15% from 8.1%. Chicago....still the highest in the country at 10.25%.

There are people and folks in this modern era

Dear SCC...this is a little off topic. Sorry if this isn't the right place to post it. I'm not a Police Officer, but I am a regular reader of your blog. It's a place that I can come to and trust what I read, unlike most other media. So thank you to you SCC. Law abiding citizens work hard to know the law and operate within its limits. Sometimes, though, when the law is silent on an issue...with that in mind, we engaged internationally recognized firearms and use of force instructor, expert witness on use of force matters and Network Advisory Board member Massad Ayoob in a discussion of verbal warnings within the context of a self-defense incident.

eJournal: Members have asked whether they have any duty to give verbal warnings during use of force in self defense, and how to balance that against any tactical disadvantage suffered by giving away one’s position or other factors like revealing possession of a firearm. It is a difficult question from a legalities viewpoint, because there simply is not statutory law speaking to any such requirement.

Ayoob: I don’t think you are going to find anything in the case law, either, nor in the instructions to the jury. It is going to come under the totality of the circumstances.

Don’t blame me for that buzz phrase–it comes from the courts. The courts judge things within the totality of what the situation was. Even in a non-retreat requirements state, they are going to ask, “Did you keep the ball rolling? Could you have stopped this and choose not to or were too stupid to?”

If it comes out, perhaps, that verbal warnings might have been practical and could have been done in time, it may be an issue. Usually it is not. Usually, once the shooting starts, things have broken so fast that you really can’t find the time to give the guy Hamlet’s soliloquy.

eJournal: Acknowledging that we are not bound by statutory law to give warnings along the lines of, “I’ve got a gun, don’t come any closer,” when you say “it might come up,” in what context would failing to give a warning create problems?

Ayoob: The family of the deceased sues you after you shoot the home invader. We have all seen these families go on TV after a shooting, saying, “My dear Sonny can do no wrong.” “Sonny didn’t have a weapon, they must have planted it on him because police have been planting weapons on Sonny since he was a juvenile,” and “Sonny was just turning his life around before you gunned him down.”

The same people who will say, “Why didn’t you just shoot the gun out of his hand?” or “Why didn’t you shoot him in the leg?” will also say, “Why didn’t you just give him a chance? Why didn’t you warn him?”

The answer, of course, is, “A chance to do what? He was obviously going to kill me, and when that became apparent, no, I didn’t give him another chance to kill me.”

Does this accusation arise during civil litigation?

Ayoob: I think you will see it more in civil than you will in criminal, but it could come up in either one.

eJournal: In any of the cases in which you served as an expert witness, have you had to counter accusations that your client didn’t give the criminal a chance or didn’t warn that he was armed?

Ayoob: Goodness, yes, it came up in 2012, in Tennessee v. Shawn Armstrong. ...

Congratulations lieutenant! How long have you been a sergeant? This is the first Lt test the city has given in eight years and it was probably six years before that one. How many of these Lt. Promotional exams have you taken exactly? I hope you did well, just not as well as me! The guys who thought it was easy, they didn't study hard enough to know their answers were wrong! Please tell me the five licenses you would have checked at the tavern fight, just curious?

If you think you can go to the marine unit without any connections then you are a chump. I remember in 2004 a classmate of mine put his resume together. He is a Navy SEAL. A freaking Navy SEAL. They told him he was not qualified.

You could come straight from Seal Team 6 and personally shot bin Laden but if you don't have a Chinaman forget about it. A fat fuck with clout will be hand processed through but Chris Kyle would be told he isn't qualified. If he were still alive.

One of those with clout was brought in to the Marine Unit, stayed maybe a year and then made sergeant. It was a miracle. Father came from a unit and dad retired with over 6,000 hours on the books. That is three years of sergeant pay. Now son is going in dad's footsteps.

I've gotten my second wind, finished a TRR and will share a few thoughts relative to how McPisspot rigged the least challenging test I've ever taken! I don't mean to say I'll be number one on the list; however, I will say I should have spent more time casting to brook trout on a spring creek and less time preparing for the most dumbed down "Part II" I've ever experienced.

Maybe they dumbed it down for you...since it seems you have taken several Part II's. Retard.

Many citizens are not only behind you, they are frustrated with the LACK of justice coming down on these criminals AND the lack of support for "the cop in the car" by both state AND Federal attorney generals.

With the police being nullified in their jobs by Washington and their lack of pursuing justice on many of these people, do you really think citizens are apathetic or not watching what is happening?

Citizens have been going out buying out gun stores for the last 6 years because they figure the cops "aren't going to get there in time". CCW should be allowed without all the paperwork and added revenue to the state. You pay for your 2nd Amendment Right in this state. WHY? Politicians should then have to pay for their 24/7 guard details.

This country has been put into a state of fear by idiots who should NOT be leaders and the end result is that many people see that law enforcement has turned more into a "revenue generation squad" for most municipalities that have budget shortfalls rather than crime-fighting forces focused on going after real criminals.

Enforcing seat belt laws or baby car seats to collect revenues or setting up red-light cameras to create a new "revenue stream" is not what government leaders should be focused on.

So give the public some credit. We see what's going on and we don't like it any more than you do.

As for criminals, at least in Illinois, we should bring back the death sentence and add more punishments to anyone here illegally. Pass Kate's Law as a start but add a couple more laws (AND ENFORCE THEM) when it comes to ANY illegal doing a crime with a gun. Forget jail time- cut off the whole family from and and all government benefits.

You all better register and vote this time. Trump is right - get all these losers out of office.

This is EXACTLY what is wrong with Chicago and why CPD is a joke. Qualifications mean nothing - clout means everything.

One guy goes through fuckin' Seal Team training (most of you wouldn't last a week- make that a day for some of you) but another's uncle is the Ward Committeeman, so he gets the job. Yeah...that's fair -- IN BIZARRO WORLD.

How can the public respect that type of selection process?

MORE IMPORTANTLY from a liability perspective, how many of these "selections" are actually putting the public in jeopardy because the best are not being selected? Hell, the best aren't even being looked at. There is a liability created by putting in second-rate people in a critical job.

It's not just the Marine Unit either.

"OH, I'm on Chicago SWAT. I'm hot shit." - No, you're someone's nephew or neighbor. Big deal. You ain't Chris Kyle. You're more like Chris Penn (in Reservoir Dogs).

Maybe in the CPD/ City of Chicago hierarchy, the guys on the bottom are impressed (mainly because THEY wish they had the clout) but from the outside looking in?

Rigged in what way? News flash - the Clouted only needed to pass part 1. Part 2 means nothing to those already chosen "Merit" clouted. Part 1 is always "dumbed down" so most will pass. This is first time I saw part 1 have an actual score - instead of a "pass" score. Problem is they don't tell you the minimum passing score BEFORE the test is given. Clouted folks can get a zero on part 2 - and still be merit. Also. Why not dumb it down - they certainly have dumbed down the ranks - Lt's do nothing now - Capt's even less.
