Injunction Denied

  • As promised, here are the results of this morning’s hearing in front of Judge Rita Novak.

    Although Judge Novak denied the Motion for our TRO, she agreed that the Plaintiff-Officers raise a valid issue as to how officers are being promoted in this round. The Judge found that the Plaintiff-Officers will not suffer enough “irreparable harm”; in that any violation that might occur by the Department during this round of promotions can be resolved by the Court without the need for issuing a TRO.

    The Lodge will be moving forward with the Complaint for Declaratory Judgment that remains pending. As part of the Complaint for Declaratory Judgment, the Court could award all back pay, back benefits and seniority to the officers who should have been promoted.
Any way to tighten up the language in the Contract and the processes? Because every time the City decides to make up the rules as they go along, taxpayers get screwed along with the people trying to legitimately get ahead.

How about the next officers in line get paid sergeant's pay and benefits until they are promoted. Then they will not have been harmed because they are white, male or lack clout.

This was proposed and almost done back in the 1980's during the Judge Prentiss Marshal era. The FOP lawyers didn't want to do anything about that because they wouldn't make any money off of that.

I think most of us love Donald Trump and hope he is our next president and undoes the damage of the last eight years. But he should just STFU when it comes to women. For example...

Trump's private jet arrives at Heathrow international Airport and he deplanes and strides to a waiting limousine that drives him to a warm and dignified reception with the Queen.

From there, they are driven in a 1934 Bentley to the edge of central London where they change to a magnificent 17th century carriage hitched to six white horses.

You think it's bad here, up in Lake County all they are obligated to promote in rank order is the guy who scores number one on the list. Everyone after that can be appointed in any order the Sheriff decides. So if you score number 2, you can be passed over by the guy that scored 1000.

I think it's a 65/35 chance FOP will win at arbitration. But the next 13 in rank order will have to wait while the city drags it's feet and uses every legal trick in the book to prolong the decision. Anyone with 25 years or so on the job knows this is the modus operandi of the city. There is nothing the FOP can do to make it go any faster but file motions in a timely fashion in court, start the grievance procedure, and file an unfair labor practice complaint with the State Labor Board.

Let us see if any of these future leaders care about being promoted! All of a sudden guys that have done nothing in the FOP such as vote, go to a meeting or anything else are blowing up the phones at the hall.

May be they should have to put some skin in the game since they will no longer be active members if they are promoted.
What good is the sergeant union if they don't pitch in too.

I hate to say it, but the City may prevail in this one. The language in the Merit clause has that secret word in there...."may" may use merit. Their argument is going to be they didn't use it for the last class, so we promoted this group just to close that promotion round. It's going to be up to the Judge to define what is a promotion round. Even though they never did it this way, doesn't mean they can't. Their argument will be that they "banked" the merit from the previous promotion and used it now. Well see....

The Federal Court approved hiring plan, available here: http://chicagoinspectorgeneral.org/wp-content/uploads/2015/06/CPD-Hiring-Plan.pdf , provides that the Office of the Inspector General for Chicago is required to ensure compliance. When there is not compliance it can suspend the process until resolved. We need them to suspend the process.

We should all go make a complaint about this violation of the hiring process, which can be done at:

This was totally expected. You guys fail to realize this is in our favor. A TRO isn't necessary here because you can make all the officers who got passed over whole by backdating their pay and seniority. It's not irreparable. She pretty much said we have a good beef. Think of it this way. City wants to knock down a building and you say it's a historical landmark. A TRO would be issued because once you knock it down you can't do shit about it afterwards. Same concept but like I said you can make the officers whole just by backdating their seniority and pay. You can't rebuild a historical building. That's irreparable. This isn't a bad thing she's willing to hear arguments and sounds like she thinks what the city did is bullshit.

People, this was theatrics by the FOP to make it look like they are doing something for the membership. Look up (Google) the requirement for a TRO in all FED/STATE courts - "MUST BE IMMEDIATE IRREPAIRABLE HARM". Any affected officer has a remedy through the grievance process & the courts. Both can require the City to adjust seniority & award damages (back pay). STOP letting the FOP fool us with parlor tricks and wasting our money on HACK lawyers. Wake up, are these Merit13 worth the thousands being spent from our dues money or is the FOP using smoke & mirrors to avoid the work they're not doing - OUR PENSIONS.

The Superintendent went against a federally approved court ordered hiring plan that was put in place as part of the Shakman settlement. Same deal with the making "merit" each "round". Unless specifically defined, the city will say "round" means "the entirety that the current Sergeants list exists". NEXT sergeant exam graded and ranked? There begins a new "round".

Ya see how that works? It works to benefit the city, NOT the employees. Just like RDO cancellations for bullshit. Just like the loss of retro pay for a year because of an FOP/City Hall-orchestrated gaffe. Just like the desk sergeant arbitration (anyone affected want to update us all on that?). Just like furlough by watch. Just like the tattoo nonsense. I'm sure you've heard the phrase "you can't fight city hall"? Well, there are just a few examples that immediately come to mind.

And while on the subject, here's a pipe dream that the FOP half-ass entertained last contract negotiations to appease the masses but really had no intention of pursuing...

Let's define "merit" for these illustrious folks that get a bump in rank. Let's itemize their entire careers and related accomplishments to see just what justifies putting them into a leadership role. I'll never respect some 9 year on the job JO with gifted stripes when s/he did buy-busts out of OCD for 6 of those years [example].

I also did two tours in Iraq and Afg.....but what does sitting in a guarded military compound do for me to say I'm now qualified to be a Sgt, Lt or any other high position in the private sector.....NONE! 75% of us were in a combat zone but never seen combat....we sat around fueling vehicles, transporting equipment, playing cards, working out......that's what most of these guys an girls on here claiming to be WAR VETERANS......Please.....u never saw combat!

Remember, this Judge Novak heard this in the Chancery Division, Cook County Circuit Court, IN THE DALEY CENTER. How fair of a shake for you think we will ever get in the damn Daley Center? These judges all stand in front of Ed Burke, John Daley and Mike Madigan and grovel to get slated in front of the Cook County Democratic Central Committee. They owe their jobs to those lousy fucks. The courts allowed the merit promotions to continue because a TRO is issued by a judge to stop irreparable harm. (Such as a building being torn down, the judge will issue a TRO until the matter has a full hearing because once a building is destroyed it can't be rebuilt without significant cost/damages. Same for printing an article, can't take back what is already out there). However, there is no reason to issue a TRO in this case. there are no irreparable damages incurred. Once the FOP files for violation of the contract, the judge/arbitrator will have a chance to hear the facts of the case. Promoting 30 Sgts to supplement the class and fill out the remainder of non-merit Sgts can be done at any time in the future. The seniority dates can be adjusted and back pay will/can be paid, so no reason to stop the promotions.

Again, here's to the above poster** (10/31/2015 03:57:00 PM) who intentionally left out the last paragraph from that article indicating that one of the officers (initially only named) remained on the job and was NOT fined.
He was determined NOT to be involved by the investigating body, the FBI.

Each day I read this blog and wonder about the rank and file. SCC does a great job in letting us know what is going on and what is coming down the road yet we cannot band together as one voice to stop anything. So yeah, we are going to be shit upon time and again. How many of you voted in the last mayoral election? How many of you voted in the FOP elections? Maybe 10-15%! If you don't vote you have no right to bitch. A non-vote is still a vote, you just voted for the status quo. WAKE UP!

Another example of clouted assholes acting like criminals and being protected by top administrators for their close relations with father, grandfather, uncle etc. who also held high ranking positions. A sergeant of police needing "permission" to arrest a fireman for agg batt - outrageous and beyond corrupt. And taxpayers have to payout a million, while this shithead fireman who should have been fired, not only kept his job but was promoted! He gets a punitive judgement for 5K, while he makes six figures/yr, and will collect hundreds of thousands more in retirement pension. Meanwhile, they are handing out suspensions to patrolmen like candy on halloween for reading a report, beards, tats, hats, and dozens more bs. Yeah - like someone pointed out earlier, this is all really fkn legit. What a fkn joke

I am pretty sure you're wrong. It was a court decision based upon an agreement.

Adams v. City of Chicago, 135 F.3d 1150 (1998)
• Although 46% of those who took the Chicago Police Sgt. Test were minorities, only 12% were later eligible for promotion. P’s alleged disparate impact and a violation of Title VII.
• 1993 Sgt’s test (administered in first 3 months of 1994). 3 parts, the third being oral. There was no meritorious whatsoever. 4,700 took parts I (31.8% were black, 10.8% were Hispanic, and 56.4% were white) and II, of which 1,900 went on to part III. But after all three parts were graded, about 88% of those designated to be promoted to sergeant were white and 12% were minority.

• HOW MERIT CAME ABOUT.
• The plaintiffs filed an interlocutory appeal(in regards to a preliminary injunction).. However, during the pendency of this appeal, the City of Chicago initiated a Blue Ribbon Task Force to review the Department's promotion practices. By consent of the parties, argument on this appeal was delayed until the Task Force issued its report. In May 1997, the Task Force issued its report recommending that up to 30% of the Department's promotions to sergeant be made on the basis of "merit." This meant that current sergeants and lieutenants would pick 30% of the police officers that would be promoted to sergeant. However, the report also recommends that the current test continue to be used to assure that sergeants given "merit" promotions meet a minimum level of competence.

The city may prevail on the hiring of the last class straight off the list.

But they cannot promote the all merit class. The language means from 0-30% may be merit, so 70-100% HAS TO BE OFF THE LIST.

Quit complaining, if you got on this job no clout,and not "lucky" your a patrolman for life anything else is a bonus, thats the way it is and always was! I'm the boss respect me! D-1 my career had a few "spots" started D-1 retired recently D-1" did ok, the job pays well just have zero expectations of promotion and you will survive!

TRO is an emergency act. Fop needs to still work on an injunction. In the end I suspect that another 31 people are going to get made with same seniority number. It just begs the question: why does the department do this? Why invite litigation?

My next door neighbor Charlie is a great guy. He has served in Vietnam and frequently shovels the neighbors snow in the winter. He is a solid squared away guy. Although he's not a police officer apparently these are the only qualities that are required to make merit sgt according to numerous posts on here. I'm hoping Mccarthy notices him and makes him a sgt.

Ask yourself this . Out of all the officers on the sos incident in question all were fired or criminally charged except one. Even the idiots on the street can figure out this one when a few are picked off the dope spot and everyone is charged and one guy goes free.

Check the previous promotions to Sergeant. Did they use their entire 30% each time? It should be easy enough to check. FOP? If the ivory tower did not use just one spot for the last 13 times they promoted sergeants, they have it figured we owe them 13 promotions to sergeant. Oddly enough, 13 is the same number of sergeants to merit lieutenant they tried to promote in 4/1995. It was the first time they tried to promote via merit. It was challenged in the courts and, years later, the city prevailed.
