Charges "Unlikely"

  • The stepson of a 55-year-old suspected robber shot dead Saturday night at a Southwest Side store by a customer with a concealed carry license expressed anger, frustration and doubt about the incident Sunday.

    Killed was Reginald Gildersleeve, 55, of the 5000 block of South California Avenue, according to the Cook County medical examiner's office. Gildersleeve was pronounced dead at 7:10 p.m. on the scene in the 2700 block of West 51st Street, according to the medical examiner's office.

    Police had said earlier he'd been shot in the chest.

    Late Sunday, police in a statement said they were wrapping up its investigation and indicated that "charges do not appear likely."
The Tribune story goes out of its way to quote the dead felon's family, publish their outlandish claims about "doubts" and such, but do point out that the deceased was out on bail for other charges. Someone also managed to get the corpse's extensive rap sheet to the media, including a previous robbery.

The comments are another story, with the anti-gun trolls out in force and street-corner lawyers opining on everything. The fact is a felon got caught dirty, got shot legally, and won't be costing taxpayers another dime.

Win, win, win.

14 felony convictions. Including convictions for robbery, attempt robbery, multiple burglaries, pcs, theft. Was out on I bond for a pcs arrest just a week before he tired to commit this robbery while armed with a large black paintball gun. But remember what Preckwinkle says, "low level drug offenders do not belong in jail".

Illinois law also provides that when a civilian is justified in using deadly force during the commission of a forcible felony, no action can be taken against him civilly by any family or the estate. The only people that can get sued when putting down a criminal felon are the police, because of the vile work of the communist law firms in this horrible city.

Any lawyers care to comment? I have often wondered that if a private citizen were forced into a deadly force situation, what duty he has after the shots are fired and the offender is down. We all have a right to remain silent and a right against self-incrimination. I know that means I don't have to talk to the police without first lawyering up. But does one so attacked have a duty toward the offender to call 911, obtain medical help for the offender and to assist the police in their investigation? Do I have a duty to stick around or am I free to go on with my life as if it hadn't been interrupted by the offender?

SCC, I need a big favor from you. At a time when the police seem to be unable to satisfy anyone, I want to give a shout out to all of the officers involved and the Good Samaritan witness in RD#, HY484163. Their prompt and courteous response made a difficult situation more tolerable. I am a long retired P.O. who was assigned to 007th Tact back in the late 80's. The victim in the above case is my daughter and she was attacked near her home on 31 October 2015. Strong arm robbery (don't know if it's still called that). The lady who called the police (her name is Dawn) found the victim's phone on the ground and called the last number dialed on the phone which happens to be my number in Texas. She called and talked to my wife to locate the owner. This occurred minutes after the assault and that is how we were able to let Dawn know that a robbery had taken place. Shout out to the police and Dawn. Please pass this message on to the officers. We have sent our regards to Dawn.

I have read that in situations like this, its not advisable to give statements until speaking with an attorney so at this time, I don't have anything further to say"

... and not a single PO will begrudge you for that, under those circumstances.

While you might have the support of every citizen in Chicago and every Chicago Police Officer on the force, there are troubling political currents in the city and what you say could be perverted at a later point by a prosecutor with an agenda, or in a civil lawsuit.

"I was in fear for my life, I had no choice. I am too stressed to give a statement at this time, I wish to speak with a lawyer".

Answer: I am a retired CCSAO ASA. All murder charges are decided by the Felony Review. Believe it or not, the vast majority are decided on the facts and the law. The standards used up to the time I retired in 2003 was whether the ASA would not be afraid to take the case before a jury. While I prosecuted gun cases in both Cook County and in Will County, I will note that the juries in Cook County were quick to find people with guns guilty. But the case like the one here would result in a not guilty and a waste of time. And those not guilty jury verdicts diminish the CCSAOs' conviction rate.


Question: "I have often wondered that if a private citizen were forced into a deadly force situation, what duty he has after the shots are fired and the offender is down."

Answer: This is a mixed question of law and trial strategy. This exact question was debated by myself, another lawyer/retired police chief on the WIND radio talk show On Target Radio on Sunday nights. I stated an obvious legal conclusion "that one would reduce their civil liability by rendering first aid to the criminal shot". The phones lit up like a Christmas tree in opposition; "he just tried to kill you, you should let him die"; "he might have AIDS"; etc. While every situation has a different legal answer, if it is a clear legal shooting, you will more often than not get out of the police station sooner by giving a frank account of the event without any bravado. But if there is any doubt about the shooting, then the best way to avoid the possibility of doing time is to say once, "I am not answering questions based upon my 5th Amendment Constitutional rights" and thereafter remain mute like you don't understand English.


Question: "Do I have a duty to stick around or am I free to go on with my life as if it hadn't been interrupted by the offender?"

Answer: All citizens have a duty to cooperate with the police. All citizens have a right not to answer questions that may incriminate themselves. Walking away from a justifiable homicide is not a prosecutable crime. But fleeing from the scene of a crime is legally admissible as a consciousness of guilt. Once again if it is a clean shoot, the shooter should stay. If the circumstances are questionable, walking away might be the preferred option. All CCL should have the name and phone number of an experienced criminal lawyer in their pocket who will take a midnight phone call to discuss this very critical question.

Shut up you jerk, you were not there and you dont know what happened. Stick to the facts, Kane has a history of being a jerk and doing stupid shit. Did the girl do anything wrong? Time will tell. Just because he is a great hockey player does not give him the right to do stupid shit. There is nothing in the statute on CCW or Citizens Self defense statutes that obligate any action like when you are involved in motor vehicle crash.

Depending of the situation, remaining at the scene could be dangerous. If you leave, the police will think you are running to hide. And while an active police officer has to talk to investigators a private citizen does not.

George Zimmerman tried to talk his way out of it. Actually did untilSharpton riled up the world over nothing.

As for summoning medical aid? "Gee, I don't seem to have a cell signal. I am going to step around the corner to get a signal....." and keep going may not be a bad plan.

Doubt that just walking away will be welcome option. The police may have a dead body on the street that needs to be explained. Tho dead bodies just lying on the street in Chicago are not an uncommon occurrence.

Am I the only one here that actually wants to know things like what weapon and load did the good guy use? Where and how was he carrying his pistol? Where exactly was the perp shot? Was it immediate incapacitation or did the perp try to fight on? Was the good guy happy with the performance of his weapon, ammo, holster?

These are the things I really want to know. Details, details, details.
