FOP Steps Up to the Phone

Someone (allegedly) called the FOP Wednesday and got this response:
  • I called FOP today and I was asked, "How was I harmed?" The woman on the phone said that Dean is waiting for a call from Office of Legal Affairs. What a joke! More proof that Dean is in-bed with the Dept.
So from this, we can deduce that your private life can be dragged through the mud, your reputation besmirched, your career dead-ended or worse, and then, after the horse is out of the barn, the FOP step in and protect you from harm.

Um, what? We certainly hope this isn't true.

This was the Tribune on Wednesday:
  • Chicago police officers' emails discussing the Laquan McDonald shooting can't be kept secret even though they were transmitted privately, a state official has decreed in what open-records advocates say is a solid step toward transparency on an issue that has roiled Illinois and reached as high as Hillary Clinton's presidential campaign.

    The binding opinion last week by Democratic Attorney General Lisa Madigan follows quickly on a May Cook County Circuit Court ruling that Chicago Mayor Rahm Emanuel's emails about separate issues aren't automatically exempt from disclosure even though sent on private devices.
That's because Rahm was (allegedly) conducting government business on private devices. So was Hillary. That's a no-no. But back to the subject, what e-mails? Who said there was e-mail? What evidence is there that any e-mails were composed, sent, received at all from this scene? Are there affidavits verifying any of these speculations?

If the investigators want to grab all Department generated e-mail, have at it. It's a government site with government addresses saved on a Department server. As far as we're concerned, it's government property. Same thing with in-car camera videos, same thing with body cameras, same thing with GPS - it's government property and the government is entitled to know where and what their property is doing. So is the taxpayer. We came to terms with that long ago. So did the Courts.

This is nothing more than an attempt by CNN among others to locate a "conspiracy" based on no evidence. Fishing.

But a private device? Well, you better have a bit more than "It was on the scene." If we tried this, in Court or in an investigative capacity, we'd have been fired years ago.

We've seen a whole bunch of debate going on the comment sections:
  • It's evidence
Evidence of what? If that's your argument, what's to stop the police from confiscating every cell phone on a scene and inventorying it until such time as it can be unlocked and "evidence" downloaded? We'll bet those pesky cameras everyone is pointing at us will show a lot more "evidence" than we get talking to the "no snitching" members of the "community." The clearance rate might actually go up ten or twenty percent. But it's still fishing.
  • Leave it in your locker
A department locker is government property and they're entitled to search it at any time without reason, cause or a warrant. Look it up. There's tons of precedent. And everyone signed a form when you were given a locker in your Unit
  • They're going to get it anyway
Really? You're going to roll over? Even if you don't have anything substantive on the phone, you're just going to surrender your Rights to some asshole boss demanding your phone? What next, DNA sampling of all officers - after all, you might do something evil in the future, right?

Everyone has their limit, and sorry, but this one is ours. We lost our phone, we left it at home, we don't own one, prove it was on scene, etc. We've got a dozen explanations ready to go. If we contacted a lawyer, priest, doctor or spouse, we're pretty sure that all of that is privileged. How can anyone be sure it stays that way?

What is the ACLU's opinion? We can't even speak to or touch a citizen on the streets without jumping through hoops and documenting it, but Lisa Madigan can create policy out of thin air, based on laws written twenty or thirty years ago and the Department is going to try to stick this on the working copper? Let's see the ACLU attorneys argue for the police for once.

The FOP and PBPA should stop reading the Obama playbook and start leading from the front - this is a serious issue and deserves serious attention and action.

Don't use your phone to contact anyonee in the CPD.

If a call or text or message shows up on anyone's phone from you, they are going to track that fcuking phone down. And if you previously denied having one???

Carry a dumbass retarded throw away duty phone. Use it for anything when on duty. Keep it clean, and tell that asshole with the questionable sense of humor that you will turn his ass in if he even Thinks of sending you any "jokes." Get to be known as that ass that always has to use a payphone or land line. Be known as the klutz that keeps breaking his phone, and that is why you use a cheap phone.

If you have to carry your own personal phone, do not turn it on when in the car and especially not when you are near a crime scene. That phone is for your family only. Not even your old academy buddy should know about it.

What it will take, and it won't be the unions leading the charge, will be a copper refusing to give up his/her phone, even in the face of refusing a direct order and order of the court/contempt of court, to force a search warrant be issued for the phone. The 5A can be cited and the case with the help of a sharp lawyer will drag the issue out, quit possibly to the USSC. In the meantime the job will be in jeopardy, however if the cop wins the legal battle there would be a strong chance of forcing the department rethink the job action initiated by the department for refusing a direct order and return the lost back pay.

What cop will step up to the plate?

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

The question at the center of Ferguson’s follow-up report is what did the police brass in attendance at that meeting do with the information they saw?
Did they read the police reports that clearly contradicted the video? And if they did, what did they do about it?....
McCarthy moved quickly to strip Van Dyke of his police powers and put him on paid desk duty. He also contacted the Independent Police Review Authority, which launched an investigation.
But the inspector general will ask why the officers who allegedly covered for Van Dyke were not disciplined or, at the very least, stripped of their police powers pending a further investigation.
In December, Mayor Rahm Emanuel apologized for the “systematic breakdown” that culminated in the “totally avoidable” police shooting death of McDonald and acknowledged a “code of silence” in the Chicago Police Department....



Wow... well looks like the “original brass” is gone; has the chickens come home to roost? However, McCarthy did take some action, but not enough. And also, I still say, the McCarthy firing not only back fired in Rahm’s face, but that’s when the crime started to go through the roof and still is... He must have been doing something right. This situation is indefensible, whereas, Paul O’Neal had it coming to him.

I still know people that want to sign up for this job. It's fucking insane. I try to tell them the way but it's like trying to reason with a child. I am not giving them my password to my emails, ever. If they want, write a warrant and get the shit the hard way. I wish when I worked I could get warrants approved for the shit we are forced to do, I would've had amazing arrests and OT daily. Unfortunately, we had to follow the law and wouldn't dare ask for approval from a judge by saying "I dunno, I figure there might be drugs in the crib so why not?" Could you imagine? Meanwhile the judge says "yeah, no problem. How about their private email accounts as well? Fuck it, I'll throw it in anyways, have fun fishing!"

Simply expressing concern about something or venting to someone could be taken out of context and cause you all kinds of headaches.

I think this is absolutely the worst time in history to be the police. Don't know what it was like in the 60's....but I'd like to know how this climate of anti-police compares to that.

Get a "911 only" phone to use from the time you leave the house, through work, and then back home. That way if you see or hear something you can fulfill your obligation to take some action. 911 can then transfer your call to anyone that wants notifications.

Oh, I'll step up to that plate. Nobody is taking my personal property and depriving me of its use without a search warrant signed by a judge. A supervisor CANNOT give you a direct order to give up your personal property. Listen new kids, CPD supervisors are not Gods even though a lot of them think they are. You do not have to follow any order that is UNLAWFUL, not job related, or would jeopardize your health and or safety unnecessarily.

The confiscation of phone records goes back several years. I was not even on the actual scene of an in-custody death, but because I was the Sergeant for the involved officers, my personal cell phone records were subpoenaed. The premise being, that they called me immediately after the incident to ask instructions related to the situation. As a society, especially younger officers, we take texting as a form of speaking. Words disappear, or are not remembered precisely, so what we say is often lost. However, Texting is different, because it is retrievable and virtually forever. In the the moments of a high stress situation, we may say things we later regret. The cell phone affords us the opportunity to say things to a loved one, mentor or confident, that we might otherwise not want repeated; and that is a major mistake. The random confiscation of our vary thoughts is an extremely sensitive issue that must not be taken lightly. This is George Orwell on Roids! Enough is Enough, how much more are coppers expected to give up? Meanwhile, Hedge Funds and buddies of the Rahm and Hillary are making tens of millions of dollars and they are beyond the law! Stay Fetal or Perish! Baby"G"

I was told same thing when IAD stripped me and sent me to call back for 2 years.
The city sustained all allegations and terminated me. Wait four months, to get to
police board and after two days of testimony,
Found not guilty of any allegations. Wow.

When I stood in front of Shields and the rest of them at FOP the only question was, How were you
harmed? Stripped, transfered, not eligible to work any overtime, and then terminated which stays
in your work file, and then you have to pay for a competent attorney, since FOP says they are not providing
any legal support.

This was over 7 years ago. Well I retired only to have future employers ask me why I was terminated?
Only to provide future employer a copy of police board ruling only to be turned down for new job.

IPRA and IAD are famous for starting allegations but have no way to stop them when they find evidence that
the allegations are false. And if you think the FOP 7 crew are there to help you, we'll throw that idea
in the can. It does not work here in Chicago.

Now enjoying the summer in Wisconsin and winters in Nevada.

My bill for my attorneys cost $6000.00 out of pocket for a false allegation. So save your money
you young chargers.

Everyone seems to be overlooking the fact that this is a judicial order. Lawyers have been requesting this type of stuff for years but never got it, until now. This is going to be the new normal. The cat is out of the bag, lawyers are going to be requesting cellphones on every case, it's a scare tactic. And stop this nonsense about saying you lost it or don't have a phone, this is an order from a Judge. We're not shitheads, act professional. Get a lawyer and fight this in court.

SCC, another good post. There are tons of suggestions in this and the other posts, but my suggestion would be FIND AN ATTORNEY that you want to handle any incident that may arise later in your career. Once the SHTF (shit hits the fan) you will be in no position to vet attorneys - you want all that handled when you aren't in trouble, so they'll be there when you are.

Jesus, you can't be anywhere without seeing a bunch of cops constantly checking their phones. You're not the President downloading the nuclear codes. You can 8 hrs without the phone. That's what's hurting us; the videos showing a bunch of cops standing around with their phones in their hands.

Any notifications shpuld be done by radio or pax. They can't force you to use your own cell phone. Plus it burns up more city time when you use the pax or city phone. It costs the city $$$$$ especially when you take your time doing it.

Get a burner. Phone companies do store your records but I'm unsure for how long. It's not much info as far as storage space so they could easily hold it for years. A warrant would be needed to retrieve those records. Cheap phones, bogus email and never use it at home.

This is an over reach of privacy, officers are protected just as citizens. Cases where phones are confiscated are as the result of an arrest and may have evidence on it which supports the arrest. They may contain evidence as the result of an ARREST, key word ARREST. To obtain cell phone records through the courts you have to show CAUSE for the particular request of records and not just because someone is there on the scene. You may be able to obtain a blanket request of records if they are city, government used phones but privacy issues still exist with your personal phones. DO NOT give any Supervisor or any department member even if ordered your physical cell phone or password, they MUST obtain a court order (WARRANT). Let them site a direct order, DENY the request and let the union deal with it administratively. Even in an attempt by Attorneys to obtain a court order for cell phone records becomes practically impossible if that phone is in the name of your spouse or someone else. Hey FOP lets subpoena the cell phone records of IPRA to show that they cannot conduct a fair and impartial investigation.

Lesson to learn here folks.
1)Leave your personal shit in your car, not your locker, desk, etc. Do Not bring any personal items into any stations/offices, etc.
2) If, by chance , the courts confiscate your personal items, use this as a tool for your job. Take all phones, cameras, recording devices from all people on the scene of any incident that could become a crime scene or a judicial matter. Be patient and professional, write evidence receipts for all of it and provide a copy to each individual. Do this and see how quick this bs will change.
3) STAY OFF SOCIAL MEDIA!!!

I would like to suggest that all Police Officers download the app for texting. There are several of them, I believe one is called WCKR and the other is SIDELINE. It is basically a texting app that deletes the text after it is read. Very similar to Snapchat. We need to start thinking like criminals when it comes to our own phones, which is pretty sad. SIDELINE also scrambles the telephone numbers making it impossible to know who called. If it is driving DEA and the FBI nuts on their wires then it must be good. Sad times out here people, sad times. Well I was at the luncheon with my brother-in-law. Truth be told Shields got to introduce Clark because he asked him to come and talk. Dean was not booed. Many of the retirees work for the security company Shield's dad started. Very few if any were going to lose their retro check due to Mike Shields. Dean talks to this group at all their luncheons.

Dean had Clark talk to the unit reps at the State Conference a month ago. Shields might have gotten the idea from FOP.

Giving up your actual phone makes no sense. If they want the records they can and will go through the carrier.
If it's your "work phone" you're not lying. Having a cellphone account for personal use is not required by the Dept.
Using common sense when texting, photos and calls during work.
However, NOT getting involved in ghetto bullshit and you won't have to worry about the above suggestions.

As a private investigator I can tell you that recovering deleted text messages can be nearly impossible, especially if you use an app for texting and not text just through your phone. When you delete the app, it deletes the texts from both the sender and the receiver's phone. Right now I have an expert that has been trying to recover just such texts that were deleted through an app. He is having one hell of a time and it is an expensive process. Be smart, use an app for communicating and do not go through your phone provider.

I have been a supervisor for many years and have always told the troops the following about phones; there is no order or directive that states you are required to carry and/or utilize a personal cellular phone for any police business, notifications etc. If there was you would be issued one. To the contrary there is a directive that states you will not use a personal phone while in view of the public. When it comes time for you to make notifications, regardless of the incident, let the dispatcher know that you will make all proper and required notifications as soon as you can get to a telephone. That is how it worked prior to cell phones and that is how it should work now. Stop thinking convenience and start thinking about protecting yourself. You will be at work anyway, bear the heat that some will give you and think. No supervisor should ever tell you to utilize your personal phone while on duty. If a SPAR is obtained for not making timely notifications, fight it. If you work with me I will back you up. If you have worked with me you know who this is. Officers, be safe physically, financially, spiritually.

Get a "911 only" phone to use from the time you leave the house, through work, and then back home. That way if you see or hear something you can fulfill your obligation to take some action. 911 can then transfer your call to anyone that wants notifications.

Besides removing contacts, music and appears, does a full delete (Erase all Data and Contents) on an iPhone erase any/all "sent" or stored hard data? If so, then it makes the internals of the phone virtually eliminated and essentially a new phone. Using a Cloud may be helpful should this method be used.
So anyway, you give them your phone and you won't see it for over a year, do they pay out replace it until then?

This is an over reach of privacy, officers are protected just as citizens. Cases where phones are confiscated are as the result of an arrest and may have evidence on it which supports the arrest. They may contain evidence as the result of an ARREST, key word ARREST. To obtain cell phone records through the courts you have to show CAUSE for the particular request of records and not just because someone is there on the scene. You may be able to obtain a blanket request of records if they are city, government used phones but privacy issues still exist with your personal phones. DO NOT give any Supervisor or any department member even if ordered your physical cell phone or password, they MUST obtain a court order (WARRANT). Let them site a direct order, DENY the request and let the union deal with it administratively. Even in an attempt by Attorneys to obtain a court order for cell phone records becomes practically impossible if that phone is in the name of your spouse or someone else. Hey FOP lets subpoena the cell phone records of IPRA to show that they cannot conduct a fair and impartial investigation.

If that old BS rule about getting a CR number within an hour is still in effect, as I recall the civilian investigators would not take the excuse that you did not have a phone and could not make a call and you were tied up at the crime scene. I know this only applies to supervisors, but they will hammer you with this rule. I am also wondering how the person who was the Chief of Detectives at the time of this incident, Escalante, skated with nothing? Was he not responsible as a chief for making sure the investigation was correct? Is this political? Is he being protected??

Should the union require reimbursement for buying and maintaining one, maybe something like the uniform allowance. Okay Mr. I call bullshit, The Shields case went to trial with Lodge 7, there was no settlement. Actually a jury trial. Mikey lost his whistle blower part of the lawsuit. Dean was on the board in the 90's. He was Bill Nolans hand picked Chairman of the Trustees and Nolan brought him in as a field rep. Kinda like a merit promotion.

They have controlled the FOP for many years except the Donahue years.
Angelo Jr. And Shields were not on the job at all under John Dineen nor Bill Nolan Presidencies. Nor may they have been under the first years of the Donahue term. But why like facts get into the way of your post.

Nolan and Dean have controlled the board for years not Shields. Nolan was on the board during Dineen's terms, he was president for 9 years and immediate president for 9 years. Now he sits on the board illegally under Dean in a position he's not entitled to be in and Dineen is being paid as parliamentarian ($600 per month) by Dean. Never in FOP history has the parliamentarian been paid.

There was no illegal raises under Donahue because if there was charges would have been brought up on Donahue and treasurer John Capperelli. Capperelli was treasurer then and he is treasurer today.

Those are the facts my brother and I should know because I have had a seat at this show going back to John Dineen.

The Ford foundation no longer owns any Ford stock or has anything to do with the automaker.

It is a charitable by trust started by Henry and Edsel Ford who both would turn over in their graves if they knew what their money was being used for.

It clearly states the Ford Foundation is an independent organization and the last member of the (Henry and Edsel) Ford families left the board of the foundation in 1976, FORTY YEARS AGO.

It has nothing to do with the auto company anymore. Nothing.

These "foundations" have little in common with their old founders. Ford was a right winger. Businessmen USED to be conservative, America First people. Now these foundations are run by left wingers that have little interest in business and a whole bunch in "social justice". we are truly fucked, the universities turn our these nincompoops by the hundreds of thousands and they are convinced that for some reason, no matter where you're from, no matter how much you hate everyone but you and yours, you're entitled to be here because we're all from immigrants. You dummies didn't notice that from the 1920's to 1965, the US had very few immigrants because we needed to Americanize the damn Europeans that came here and we didn't allow much immigration because of that. The population here grows by around a million per year and it ain't us having those kids, it's foreigners coming here with their whole families. One landscaper arrives and once he's here, his 15 relatives with no money, no education, poor health and no prospects show up on our doorstep and we have to support them.

And good old Ted Kennedy helped pass immigration reform and "claimed" that it would not change the ethnic make up of the US. Well folks, white will be a plurality in 2040. In 75 years from 92% of the population to 49%. Well, it's OK... No it's not. Look at the rest of the world. Look how "people that are different" from the majority are treated. At least here we are trying to be better at inclusion and you're not getting your hand chopped off because you're a different religion or tribe. What in the fuck are we thinking? The rest of the world, outside of the West is a shit hole of violence and poverty. And you want that here?
