Cell Phone Judicial Order

You know how the bosses are screaming for all the shooting information from a scene? The DSS, the Watch Lieutenant, downtown - everyone wants everything ten minutes ago so that more paperwork can be generated and everyone in the chain of command can look important.

This came down just this week:
  • Please let the troops know that a judicial order was entered yesterday granting access to the PERSONAL CELL PHONES of ALL officers on the scene of the Paul ONeil shooting.

    Let me be clear: access was granted for the ENTIRE PHONE, not just for cell phone records. In addition there was no restriction placed regarding time parameters to include the time up to and just after the incident. Basically, if so ordered, the officer must turn over the phone and all its contents including pictures, texts, etc.

    Tell the officers to make notifications over the air or on a department cell phone or landline. There should no longer be a need for speed.
This isn't the first time cell phones have been subpoenaed in police shootings - the baseball bat shooting in 011 resulted in some embarrassing messages being revealed that were sent TO, not BY the officers.

This is ridiculous. We need a Search Warrant to go through a jagoff's phone, but ours is fair game just because it happened to be on the scene? No Reasonable Articulable Suspicion? No Probable Cause? No Warrant? What if we texted a lawyer? The spouse? Those are privileged communications.

We've stated this many times - police are not above the law, but we aren't under it either, and this seems to be a complete overreach on the part of a single judge regarding something that (in this political climate) may turn into a criminal proceeding. Not acceptable.

First up, the FOP and the PBPA ought to be filing injunctions against this immediately.

Second, no one should be making any sort of notifications from any scene. If the DSS or the Lieutenant need info, they can come to the scene and get it or they can wait until the paper car gets to the station.

Third, since we're all going to be checking out body cameras shortly, we should check out a Department issued cell phone. That way, all the pertinent communications are on a government owned device and can be archived in existence with Department regulations - like Hillary kept track of all her e-mails.

We'd like an iPhone 6 or better.

UPDATE: They're grabbing private e-mails too:

    The binding opinion last week by Democratic Attorney General Lisa Madigan follows quickly on a May Cook County Circuit Court ruling that Chicago Mayor Rahm Emanuel's emails about separate issues aren't automatically exempt from disclosure even though sent on private devices.
These are your personal e-mails, so that racy joke you thought was so funny? Discoverable. That sexist picture you e-mail blasted all over the place? Discoverable. That hot date you were describing to someone? Yeah, discoverable, too. And every automatic notification or mailing list you get from the gun companies, the dating sites and social media - which opens another can of worms.

Your electronic life has just become an open book to the government and to plaintiff attorneys. You only get a pass if your last name is "Clinton."

And that email you listed with the department, get another and don't use it in conjunction with anything related to the department. Time to create two different lives, one for the department and one for yourself and family.

So when your sergeant is calling you a jagillion times telling you who to notify, and the Lt. is calling, wanting info so he can make his notifications, let your phone go to voice mail. Don't answer it. When you're at the hospital and they want an update on the offender, have them send a car to ask you, because your radio isn't going to work in there. The only call you should make is to FOP. Get someone out there FOR YOU. Fuck the bosses, fuck the notifications, fuck the offender...and if you're the paper car, do it slow and sure. We've all been at scenes where you're getting calls from all kinds of people wanting info. (Sgt. Lt. Desk, Det's, D/C, CPIC, etc....). Let them wait.

Rahm says his personal email is not work product and not available under FOIA requests.

But this court order says both your personal phone and email are part of the investigation and work product.

FOP and PBPA better be standing in front of another judge stopping this or the IPRA, IAD and IG WILL BE DEAN ING

I have been telling Officers for years not to use their personal cell phones to make notifications. Leave the phones in your locker. Use a pay phone or drive into the station, and since a pay phone is hard to find these days take the slow ride into the station. Maybe now they will start listening to this old dog!

I would imagine they would have to prove your cell phone was present and at the scene before they could request a warrant. The department just lost more manpower down in the station making notifications on city land lines....something that the P.O. provided to the dept. as a courtesy.

I think American Citizen rights were just violated. Illegal search and seizure.

City phone ok. Private phone not ok. city body cam ok, private body cam...not allowed?????? if we can have a smartphone, why cant we have our own body camera to film the dealers on the corner and gang activity. Why cant those videos we film be released immediately so that citizens who are not usually exposed to gang crime can actually see what we are up against and vote accordingly. That would be true transparency.

Film the bad guys in action and show the public. Release the E.T. pictures of all the homicide victims..Immediately....I'm a citizen and I demand transparency to see what crimes have occurred in the city and state I pay big taxes. You show police shooting videos which make up much less than 1% of the death that occurs. If the people want to see see something, show them what the bad guys do! How about that angle Scc?

if those are discoverable why not the Offender McDonalds Email, Social media, and other records available to the defense of the victim (J.D.). Also include the family members that get paid out. It does lend to their credibility. Seems like the field is tilted. Where the transparency on the offenders life. Every instance where the police shoot an offender is predicated on the escalating acts of the offender. Slashing car tires, waiving a knife while posturing an aggressive manner, leading officers on high speed chases in stolen cars and driving at them, baseball bats. About the only thing I think ram has said, is we are fetal. That might have been a mistake but it was a good signal to go fetal if you aren't yet.

Judge knows that you are probably not emailing while on the scene. Calls and texts but not emailing so basically this is a witch hunt. They are fishing. I always thought that there had to be some sort of evidence that you were doing something wrong in order for the court to make this kind of decision. They shouldn't be using the courts to do the investigation. The attorneys should be conducting the investigation then bringing some evidence to the judge. Unions should definately fight this. But they won't because the Ade is close to retirement so he won't screw anything up for uis future and the other hack, well I don't see him doing anything either. Hanging us out to dry. Guess I won't be using my cell phone from the scene anymore and I will make it clear on the air. But if anything happens, they will still get my phone if they use this logic. They will say I sent calls, texts, emails after the incident to conspire. Even if it's days after. They will still get it. And if I use a burner phone, they will still want all all my phones and they will get them. Screwed no matter what.

I forgot to mention that just because Lisa Madigan issues an opinion or ruling does not make it law. This is a constitutiional issue and a politician from the Madigan family more likely will not arrive at the correct conclusion. But if Mrs. Clinton is allowed the opportunity to appoint big government Supreme Court justices to that bench, we are in trouble. Citizens will suffer another big government errosion of civil rights and she will continue to skate above the law.

SCC, you have stated many times that officers are not below the law. You are right. They seem to be the unfair TARGETS of the law. If officers have to turn over all private records, why stop there? Include all offenders, witnesses, bosses, all attorneys, all judges, aldermen, the mayor, state and federal representatives, and POTUS records too. THE MEMO clearly says REMAIN FETAL, lest your entire life end up on an autopsy table, with the world scrutinizing it. So if there are no shooting, stops, contacts or etc, the law itself will be invalid. A judge cannot make such a broad judicial order. One, the takings clause of the Constitution says the government cannot take private property without compensation...so if they take it they must pay you. Next, the Constitution also protects against unlawful seizure of ones property. Warrantless seizures, like searches, are presumed a violation unless it falls within an exception. What exception could this possibly fall under? And even if a judge decided to execute a warrant the particularity clause prohibits any such warrant that provides for a blanket taking of ones property. Sorry, the Constitution protects everyone. If someone asks for your personal cell phone just say no and call a lawyer. Sorry political hack judge...I'll take my chances.

Spent sometime doing a few wires, phones, etc. I will give you my opinion.
1. I would never call a city number with my personal cell phone- otherwise, you risk the city from having your number.
2. I would never call another police officer with that phone- if he or she contacts the city- same risk.
3. Going to the scene of a shooting- if your phone is on- a cell tower dump will locate all the "on" cell phones in the area.
4. If you think a throw away phone is completely safe - you are wrong- just get the mudds and tolls on the phone and get the subscribers off that- all of that -you need subpoenas but no real problem. If you have a throw away you will contact wife, friends, girl friends.etc.

"A man is in custody after being accused of firing shots at Chicago police officers and grazing one officer in the face Tuesday night in the Rosemoor neighborhood on the Far South Side, police said.

"The incident started just after 10 p.m. as 22nd District patrol officers investigated a possible carjacking near 103rd Street and Lowe Avenue, according to police.

It will be interesting to see the ACLU's take on this. If fought (and won by the powers-that-be) it could create a scary precedent for not only police officers, government workers etc, but for the public as well.

I remember this issue came up a month or so ago. A commenter weighed in with a comment that went something like this.

Set up a phone number with Google voice. Have all callers calling you call your google voice number, and have your google voice number forwarded to your cell phone. That way, the only thing that ever shows up on your cell phone as a calls received is your google voice number, not the actual callers number.

Supposedly, the reverse is possible as well. When you want to make an outbound call, you call your google voice number and google voice calls the number you wish to speak to. Thus, all outbound calls on your cell phone will only show your google voice number.

And what if they wanted to subpoena your google voice records? Supposedly google voice does not keep records. Supposedly.

I haven't tried any of this because I have no need to, but as a techno geek, I thought it was pretty cool. I'd say its worth looking into to protect your privacy.

I retired in 2015, I always carried a cell phone and never used for any police call I would drive to hospital or station, not my problem how long it took. also never logged on to dept email. If you think they are going to confiscate your phone its well worth losing it and buying a new one. if your sending even personal emails or anything via computers or phones that you wouldn't want read by the public, real easy don't send. if your on Facebook for anything other than communicating with friends and family that live far away then your probably too far gone. In my opinion you shouldn't be on Facebook at all!!!!!

"But the recovery process would soon turn into a nightmare. Clavasquin’s case was dismissed on December 8, 2015, and one day later, he took a court document proving the dismissal to the NYPD property clerk’s office. He was told that the department had classified his possessions as arrest evidence, to give the district attorney the option of considering them in the case. But the district attorney didn’t, and now that the case was over, the classification meant Clavasquin was about to enter a bureaucratic obstacle course.

"Clavasquin needed to get a release from the district attorney’s office stating that his property would no longer be needed for evidence. Over the following three months, he repeatedly called the assistant district attorney assigned to his case, but he neither got a release nor a written explanation of why he was being denied one.

"Then, with the help of an attorney at the Bronx Defenders, a public-defender office that had been representing him since the day after his arrest, Clavasquin sent a formal written request for the district attorney’s release. He got no response.

My STRONG recommendation to all coppers is to get rid of your phone! Have your parents open up the line for you & carry a flip pay as you go fone for work. If you are involved in a shooting immediately say you don't feel well & need to go to the hospital wait for the FOP or your lawyer erase ALL pertinent texts pics etc that need erasing while you are sitting at the hospital because they will go thru everything & subpoena phone records

Old Retired Detective. Back in the day when there was no cell phones etc., when you received a radio call from CW which stated call the office. We called the office from the victim's home, a place of business, a hospital, and if necessary a pay phone. If you do carry a personal phone I would suggest that you don't use the phone for Police Business. I have been off the job of a while but if there is no general order stating you have to have a cell phone and you have to use it in the performance of your duties then I don't believe anyone can have a problem of not using your personal phone. If there is an order whether or not a general order, department special order, or a detective division order then I would copy the order and then take the cost of the phone of your income tax. If you get audited for this deduction, I would show the auditor the order and argue it is a legitimate tax deduction. If a supervisor gives you a oral order then I would requests that the supervisor put that requests in writing. If the supervisor is dumb enough to put that request on paper then I would immediately file a grievance against the supervisor. If the supervisor says he/she will not put the request on paper then disregard the order.

Almost every other police department I know has had phones in their patrol cars for years.

When Terry Hilliard was Superintendent I asked him about this and he said no way was he going to give officers free use of phones in the field because they would abuse this. Rahm and company must still be thinking the same thing.

Unless approved minority vendor can give him a proper kickback at the taxpayers expense.

I have been telling Officers for years not to use their personal cell phones to make notifications. Leave the phones in your locker. Use a pay phone or drive into the station, and since a pay phone is hard to find these days take the slow ride into the station. Maybe now they will start listening to this old dog!

Officers think you are a conspiracy theorist and paranoid when you talk common sense. You how many burbs have unarmed recruits wearing no vest but driving marked cars during their training? I was one of them and other recruits laughed at me when I would put on my vest before dropping the car back at the station (an hour away). The department didn't teach me how to use the light switches, ISPERN or anything else.

A lot of people have been saying this with great confidence and feeling of "ah huh, I got the solution!" Wrong. If you were in possession of the device, it's "evidence." Of course, we aren't afforded due process and protections for our property and privacy, which is insane. However, it this screwed up environment, they will still take the device. Now, if you say, "It's not mine, it's my wife's, I didn't have it" and they find out based on records, GPS, etc., you'll be hit with perjury, misconduct and god knows whatever BS charge. This job is ridiculous and impossible.

Don't give your phones up. This is going to end up before the Supreme Court. If the attorneys have not demonstrated that any sort of public record exists on your phone, they have absolutely no right to go into your phone. Fight this tooth and nail. That judge's order is severely violating the constitutional rights of any officer on the scene that was not using their phone for work purposes. This is the definition of a fishing expedition. I would ask them to articulate what reason they have to believe my phone contains public records related to the case. If not, fuck you. Let's go to court. We can't give up our rights willingly.

A judicial order to turn over evidence is not rare at all. Either side in a criminal case can ask the judge to order evidence to be brought forth. Whatever side wants the evidence just has to convince the judge and they are pretty easy to convince regardless of whether a cop is involved or not.

I was there at the shooting and writing this on a library computer so it won't be traced. Heard they were going to request our phones, well a couple of days ago my phone turned up missing. I made a report out, possibly stolen out of my vehicle or lost. I just hope it turns up so I can turn it in to help this investigation.

All supervisors (sgts. and above) should have Dept. issue cell phones. All official communications should occur on crime scenes only from those phones. The FOP and the PBPA should be united on pushing for this. Many smaller agencies already have cellies for all supervisors. The supervisors wouldn't have to take them home; they could sit in a community charger in the radio room, labelled "10 sector Sgt., 20 sector sgt., 30 sector sgt., Lt., Capt.). I think this will work out just fine, and will take the govt. out of officer's private cell phones.

Were they made in the station and on the zone? Or did we use pay phones? I know it's probably a dumb question I would just like to know because I find it funny that there's a GO that restricts us from using personal electronic devices for duty oriented tasks yet we call dicks, cpic, LT, news affairs with our personal cell phones.

Now that I am a retired OLD guy, I can remember clearly what the "old guys" use to tell us youngsters back in the day....kid don't put nothing on paper that you would want everyone to read...assume whatever you put on paper will be seen by the entire department and media, etc. I guess in this electronic world the same holds true. If you type it, text it email it somewhere its forever. There was a report sometime back that said (cant remember which company google, aol, etc.) that if you type a text or it may have been an email it is visible to the company, even if you delete it before sending. Be smart take advice from those that tell you to use a hospital phone, station phone or something other that your personal phone. save the jokes for the bar don't send or if possible receive them. Be careful but also be fetal.

Getting a " drop" phone from a store will not solve the problem if they really want to know who it is. A cell tower dump identifies all the phones on at a specific time. Turn around and get mudds and tolls on a strange phone, your wife, significant other comes up on the mudds and tolls. Get a court order to Ping your phone and you are identified or if need be, spoof you phone and when you answer , they photo you answering the number called. Not hard if they wish to go to that extreme or if someone in IAD has the knowledge( they did not when I retired).

Use What'sApp for personal text messages. Encrypted up and down stream. Don't discuss department bussines via text, email, or social media, only use department email from the station or voice telephony from land lines.

If CPD wants notifications, do it from the station, or ask a fine upstanding citizen to use their phone.
CPD, if you want timely notifications provide me a department phone.

We went to hospitals and used the police room/private office there, or we went to the station. Rarely a pay phone and those aren't available anymore, anyway. Sometimes we used the land line at the scene, if it was a home or business. (Now, I wouldn't advise doing that.)

My strongest suggestion is you use the dept issued cell phone of the highest ranking officer on the scene, or report to him/her and let THEM make the notifications.

They'll know because they're going to give you a direct order to supply them with documentation and information relative to any and all telephones you have. They will then search the phone and tower pings to determine whether you 'had it with you' that night. Since virtually no police officer relies solely on land lines, this is a no-brainer. If you really didn't have it with you that night, they'll know that. But they will still be searching it for any subsequent exchanges you had with anyone ABOUT the case. And that will include any email accounts you have linked to that phone.
