The other day, we hinted at something hinky in the self-defense shooting. The original shooter was in a hot car, circling the block, opened fire, wounding a private ambulance worker, who returned fire, killing the shooter.

- For 10 years, Michael Arquero built a new life after leaving prison. He changed his name, found a job he loved, married a woman he loved even more, had two sons and settled into a nice home in Avondale away from the streets where he ran with gangs.
But a split-second decision last weekend threatens to tear all that apart.
Arquero, 33, was at a food stand in the Humboldt Park neighborhood on Sept. 9, on an errand for his pregnant wife who had a late-night craving for tacos, according to police and his family. Just before midnight, a Honda Civic circled the 2500 block of West Division Street two or three times before someone inside started shooting, hitting Arquero, according to police and court records.
Arquero fired back, killing the 18-year-old driver, police said. Two plainclothes officers heard the gunfire, pulled up and fired at Arquero, possibly hitting him too, according to police.
So a convicted felon and gangbanger changes his name and ::PRESTO!:: he can pass a background check in Illinois to get a Concealed Carry License? Pardon our French, but what the fuck? Seriously? Someone recognized him and tried to kill him, regardless of his name. And the "tacos after midnight" story is just a little too pat - a hundred toothpicks will get you decent odds he was still banging on the corner after dark.
And the anti-gun crowd will use this as some sort of twisted example of how the system failed, so every other law abiding citizen should be punished for someone who is willing (and abetted by the State) to break the law.

No doubt the POS did not submit his prints for the CCW. With his new name, no record found of any past. He gets a new name, gets a DL with new name, gets a FOID with new name, and gets a CCW permit with new name. I guess on the questionnaire for FOID and CCW will have a new question added, "Have you been known by anyother name(s)?".

Sounds like Governor Ryan's commercial license inspectors were reassigned to the carry permit program?

I was just reading the full story and then the comments on breaking news and decided to check out the concealed carry statute. Unless I missed it, it doesn't make any mention of being a convicted felon in the statute. Obviously to get an FOID Card it asks you if you're a convicted felon, but on the concealed application under the Illinois resident section it does not specifically say "felon," only that you "not prohibited under the Firearm Owner's Identification Card Act or federal law from possessing or receiving a firearm." I feel like in this crooked state not flat out saying "Have you ever been convicted of a felony?" is an out for anybody in this situation.
430 ILCS 66/25
Sec. 25. Qualifications for a license.
The Department shall issue a license to an applicant completing an application in accordance with Section 30 of this Act if the person:
(1) is at least 21 years of age;
(2) has a currently valid Firearm Owner's
Identification Card and at the time of application meets the requirements for the issuance of a Firearm Owner's Identification Card and is not prohibited under the Firearm Owner's Identification Card Act or federal law from possessing or receiving a firearm;
(3) has not been convicted or found guilty in this
State or in any other state of:
(A) a misdemeanor involving the use or threat of
physical force or violence to any person within the 5 years preceding the date of the license application; or
(B) 2 or more violations related to driving
while under the influence of alcohol, other drug or drugs, intoxicating compound or compounds, or any combination thereof, within the 5 years preceding the date of the license application; and
(4) is not the subject of a pending arrest warrant,
prosecution, or proceeding for an offense or action that could lead to disqualification to own or possess a firearm;
(5) has not been in residential or court-ordered
treatment for alcoholism, alcohol detoxification, or drug treatment within the 5 years immediately preceding the date of the license application; and
(6) has completed firearms training and any
education component required under Section 75 of this Act.

From the way the tribune has the story –which is vague– it seems like the guy actually turned himself around, and he carries a gun for protection in Chicago, two things you theoretically endorse.
If the police know something, or have an inkling towards this not being self-defense enough to stand firm on first-degree murder, I'm definitely left confused by what your ideal outcome of this situation would have been? Both men dead?
Also, I've seen a lot of little arguments in the comments in other posts about felony murder. Is that a charge that could be pursued based on him shooting in self defense but carrying illegally?

Don't the fingerprint for concealed carry? Did he change his fingerprints too, or did he scam the connected outfit that does the printing? My daughter was sent to a fingerprint place for her job at CPS during the background check. Same place she would have to go to have her prints taken for her CCL. She asked if the same set of prints could be used for both the job and CCL permit. They said yes, but she would have to pay both fees.
Follow the money, who owns these "approved" outfits? How much do they contribute to the greedy politicians.
Civilian employees who wanted a CCL asked if our department could use the live scan system to print them for their permits. Were told no, they had to go to an state approved vendor. WTF, it's the same system with the prints going through the same data base. Again FOLLOW THE MONEY.

You do not have to be fingerprinted to get a CCL. Doing so is an option that results in the background check coming back faster.

Buy what gets me is his wife. He didn't just NOT mention 'his past' to her. He hid the facts from her that he was a Convicted Felon and Ex-Convict. Fingerprints for Concealed Carry are not mandatory, while they can expedite the application process they are not a requirement. This guy committed a felony on his FOID application, he lied about his conviction and he lied about his alias's. And why didn't he stop shooting when the police arrived?
Could of had his rights reinstated and record expunged...... Just playing devils advocate for those who think this is impossible.... You can get you're right to carry back and get rid of the felony record.....its not easy but it IS doable.

The guy who returned fire is a banger, too. The Spanish Cobras and MLDs have been going at it for months. The "restaurant" is a known gang hang out and there has been gunfire exchanged right there before. As a resident of the area I'm pretty surprised a cop is defending the shithead without knowing the situation. Especially as it makes it sound like the officer (female is who I saw shoot) did something wrong.
Oh and right across from the taco stand is Ald Maldonado's office. Maybe now 12 and 14 will get the officers we've been promised.

Thanks I stand corrected. I thought it was mandatory, so I looked it up and there it was, MOT MANDATORY. My next question why aren't finger printing someone who wants to carry a gun mandatory?
Since when are fingerprints not necessary for Ccw. My Florida permit required them as did Utah. I thought I had to be fingerprinted for Illinois. Am I wrong?
The Trib story was naively written. Kept saying "turned his life around." The Trib fired all of the veteran reporters and brought in these young things. I see them at 26. The shooter has an AGG Batt to Copper conviction. Somebody who touches a cop is a very violent dude. Think about it. Ever been pulled over for a speeder? Does a law abiding or non-violent motorist think for one second about hitting a copper? Hell no. When I am pulled over for my bullshit speeders--I got a lead foot, I am a bit nervous---"what happening" its unsettling...the last thing I think about is confrontation. One commenter noted that misdemeanors can be expunged. No Sir. Only those where a sentence of Supervision is imposed can be expunged. DUIs can never be expunged. CD, (conviction) or Paper can never be expunged. The Governor or President can grant Felony and Misdemeanor Executive clemency for convictions. That is a very long, uncertain, expensive process. It is a long shot at best. A Hearing is held before the Illinois Prisoner Review Board. They then make a recommendation to the Governor. The Governor takes it under advisement. If clemency is granted, those convictions can be expunged. Again, that is a long shot. Hail Mary pass. Usually granted to 35-50 year old who committed a property crime when they were a teenager and now needs a clean record for a good job.

You don't get rid of convictions , unless you are pardoned. He did felony time. No expunging that. An arrest, where you were acquitted, you can expunge. People think they can get anything expunged from their criminal record. Hope you're not the Police.

This (sadly) isn't surprising and brings up a recurring problem: incomplete records from Cook County Circuit Court. Why is that important? Because if dispositions are incomplete or missing on a rap sheet then someone who shouldn't have a gun can get one. Why? Because if a "conviction" isn't reported on the rap sheet disposition, it didn't happen for Brady bill purposes and Cook County Circuit Court is notorious for incomplete, haphazard and missing disposition information. (CPD, by the way, keeps detailed records but they don't show up on Brady bill inquiries.) How does this play out in the real world?
One time a dirtbag with 62 entries on his rap sheet had no reported dispositions although one of the entries was for his arrival at Joliet for a homicide!
In another instance there actually was a Brady bill hit when a guy from Lake County tried to buy a gun in Wisconsin. The Lake County Sheriff's Office did more than just confirm the hit but a commander pulled the restraining order and saw that the mope claimed to his now-ex-wife that he wanted to be the next Timothy McVeigh and take all of them on the road to Glory. So he called Kenosha to bring them up to speed. Kenosha calls the ATF but how does all of this cooperation play out when it gets in the hands of the feds? <>
