And Here's the Test Case

  • Chicago's police oversight agency has cited a veteran officer for more than 60 rule violations, blasting him for repeatedly posting insensitive racial and religious comments on Facebook and promoting violence against police protesters, Muslims and others.
Sixty rule violations? A bunch of people have already noted that if you brought sixty violations to the Desk Sergeant, Watch Operations Lieutenant, Detectives or State's Attorney, you'd be laughed out of the station. But for COPA? Everything is game.
  • In a 95-page report obtained by the Chicago Tribune through an open-records request, the Civilian Office of Police Accountability used unusually strong language to condemn [the officer's] actions, leaving little doubt that it favored his firing even though it publicly declined to give its position.

    In its conclusion to its findings, COPA made clear that it had no faith in [the officer] carrying out “fair and impartial” law enforcement to everyone in Chicago, regardless of their ethnic and sociological backgrounds.
Did you get that? He is being charged with what he may potentially do or not do (no faith in [the officer] carrying out “fair and impartial” law enforcement). That's real left-wing speech suppression type shit right there - shades of "Minority Report." And get this:
  • But COPA, citing legal precedent, said police officers are subject to greater First Amendment restraints than most other citizens.

    Edwin Yohnka, a spokesman for the American Civil Liberties Union of Illinois, said government employees, including police officers, have the right to speak out on issues of public interest, especially when they’re doing so on their private time. But he said certain government employees critical to instilling public trust, such as police officers and teachers, can be disciplined for making statements — even while away from work — if their language undermines that trust.
We'd like to see that legal precedent - United States Supreme Court precedent? Or just one of the oft-overturned Appellate Courts? So now you are less than a citizen if you choose to enter the law enforcement field. How's that for the COPA opinion? And the ACLU supports that - welcome to the new Amerika, courtesy of the left wing socialists.

Now, we will say that reading the entire article, this officer seems to have brushed up against the line that the Department and various other entities have drawn in the sand, Hell, he leapt back and forth across it. Whether by accident or design, we don't know. But he has laid out a perfect textbook case.... to be a test case. As we said before, this has monumental implications to what you are allowed to do, say, or support - on AND off duty.

Im not a lawyer BUt there are several precedent cases which can allow a police dept to fire its employees for this type of thing.

The most recent FOP newsletter even has an article about it, I think on page 15.

First Amendment protections are not absolute and only protect people from being fined or arrested by the government for expressing themselves.

they do not preclude discipline from an employer.

I looked at his page and I dont see too much that I think is offensive.

The Big question is "who gets to decide?"

They fired her for not complying with a directly ordered pee test, I believe. There's the City's 'past practice' problem, hard to overcome, even for commies. Female Black = Protected Class. That said anyone no matter there job should have the same First Amendment rights. For years everyones First Amendment rights have been under attack slowly eroding the intent of our founding Fathers. The Left never stops attacking our rights and trying to stop anyone from speaking the truth if it's not there version the truth. Police Officers are not allowed to serve as a juror in our criminal justice system. Police Officers families are often not allowed to serve on a jury because of their perceived bias. Lori Lighfoot was in charge of OPS, investigating alleged wrongdoing by police. She would regularly appear on tv bashing the police. She headed up the police accountability task force. The report was a complete fabrication and was written to serve her own agenda. I ask you, SCC. How in the world can this police hater be in charge of our police board. She is supposed to be neutral and unbiased. This is clearly not the case. The union needs to ask our mayor these questions. The silent majority needs to step up because this city is not going in the right direction.

People in the private sector do lose their jobs for things they post on social media. But, police officers in Chicago are members of a union and that might change things. It seems that COPA and their investigators have determined, by what they have read that was posted by this officer, find him incapable of performing his duties with fairness. That will be a tough thing to defend for COPA.

Why this would be a COPA Geheime Staatspolizei inquiry?
We know they’re intensely scouring for deviations as well as doling out Fairness in the Community.
Example: Reprimands for active kneeling fisters and civil rights violations for typing banter.

I don’t Facebook so I don’t know what was posted on the guys page but it’s probably true and entirely contained his personal experiences, observances and opinion.
So what.
The Dept has it rules.
The discipline becomes slightly askew depending on the topic.

For me, a PO who can write a page or blog is more likely to come and write my burglary case report (and damn well at that) than a fist raising kneeling militant with a deep rooted falsehood chip on on his shoulder.

What about the two ON DUTY officers in the 006 District IN FULL UNIFORM kneeling with raised fists and posing for a photo with a self proclaimed “black nationalist” who has accused the CPD of blatant racism. They got a slap on the wrist without a 95 page COPA report recommending their termination. This 001st District officer had a bumper sticker on his personal car and posted comments while off duty on his personal social media accounts. COPA wants him fired because, according to them, they have determined that there is without a doubt no way possible he can fairly do his job. Unreal!!!

Police officers are allowed to be on a jury. They are usually excluded by the defense attorney using one of his challenges
If both the prosecution and defense attorney questions a P.O. and doesn’t challenge him, he is seated on the jury
Bottom line is they can sit on a hury

Recently had to give a statement in regards to copa in regards to a CFD member physically restraining a guy into a stair chair. I was in violation of cpd policy cause in copa view cfd violated our use of force policy and as a police officer I should have stepped in and restrained fireman. Now the fireman-talked to him-received zero punishment. I don't know cfd force policy on violent people. But copa seems to want to dictate our policy to a different entity and have them obey it. So if cfd uses force allowed by their department but copa thinks it's excessive the cop will be charged? Very scary their overreach

The sad part of todays department is the fact the department ( actually the political administration of the city) can fire you for just about any reason that they can conjure up. All separation cases go to the city law department for their opinion. But, that does not really matter if the city wants to get rid of you. They will prefer charges, give you a shance to answer the charges, suspend you and send the case before the police board which will fire you if the political forces want you fired. All you can do is appeal to the courts and your chances there are not so good. Posting anything on social media is a risky adventure and that information stays out there forever.

no guarantees on that my friend and I certainly would not want to wager my job on your opinion. And, there will be no payday in the end for this officer even if the courts want a separation dismissed. There have been a number of separation cases overturned and a whole lot more not overturned. And, even if he is reinstated it is another fight to get back pay and for sure you will not get your legal fees from the city which could easily run into the 10's of thousands of dollars. The best course? don't post controversial comments on facebook.

It's interesting that the left defended Bill Clinton's "antics" while in the White House, stating that his private life shouldn't be judged as long as it didn't affect his job performance, which they roundly agreed was wonderful. But the COPA board concluded that those off-duty musings were a clear indicator that the officer COULDN'T perform his duties "fairly and impartially." Huh? They have no real evidence that he DIDN'T perform his duties fairly, but they believe he must not be able to because he stated his dislike of anti-police protesters and general riff-raff?

I say that the man's private life shouldn't be judged as long as it doesn't affect his job performance. Bring in evidence of on the job wrongdoing and then pursue action. Otherwise, stuff it.

Employers can discipline employees for 1st Amendment issues UNLESS that employer is a government entity. COPA, CPD, City of Chicago are government entities.

I was Brian and Eric's partner in 007 and again in 012. Brian, a.k.a. "Meat" just doesn't give two shits. He really doesn't. He had no plans on retiring; I saw him in 001 last summer at the GNR concert. He planned on staying until 63 as he has a young son. I hope he pulls out ok but Brian will be Brian.

Different rules and different punishments for CFD and CPD. Always been that way and always will be

Lori Lighfoot was in charge of OPS, investigating alleged wrongdoing by police. She would regularly appear on tv bashing the police. She headed up the police accountability task force. The report was a complete fabrication and was written to serve her own agenda. I ask you, SCC. How in the world can this police hater be in charge of our police board. She is supposed to be neutral and unbiased. This is clearly not the case.

This COPA is a group of police haters who have a fill in the blank complaint template.prepared for them by ACLU lawyers They go after police who have previous complaints figuring in their biased minds that the Police officer must be fired. They will use the fill in the blank format as long as it works. Rahm took away the final word of the Police Superintendent to over rule the final decision. (taking away all hope for a P.O.)

No precedent set Each case is judged on its own facts and merits. If you have been on the job a few years I’m sure you see double standards and not equal rulings. Guys miss court,one a reprimand, one a day off

I agree with the second poster. There will be no payday for this wiseguy. The legal fees are going to crush him. BH has to fight for his job, fight for back pay, and be represented in 4 additional lawsuits which are apart of the 62 violations. He’s too cocky to request a benefit and not many would offer him one, and after all of this he still cannot keep his mouth shut.
