Fix is In?

  • In a highly unusual move, attorneys for Chicago police Officer Jason Van Dyke want a different judge to decide whether the trial over Laquan McDonald’s shooting should be moved outside Cook County, saying the judge presiding over the hot-button case made up his mind long ago to keep it in Chicago.

    Even though Judge Vincent Gaughan has scheduled a hearing on the issue for early next month, the filing Wednesday by Daniel Herbert, Van Dyke’s lead lawyer, said the judge has made clear his intentions to refuse to move the trial.

    “Any further proceedings would be nothing more than a show, much like a professional wrestling match wherein the outcome has been pre-determined,” Herbert wrote.

    As evidence, Herbert noted that Gaughan set a trial date earlier this month before hearing any substantive arguments about moving the trial — a signal, he contended, that the judge already knows how he will rule.

    The filing also briefly quoted from a sealed transcript of a closed hearing in June — sure to draw the ire of Gaughan, who has taken extraordinary measures to control the release of information in the case.
Given the historical corruption that has riven the Cook County courts and government (Operations Silver Shovel, Incubator, Lantern, Gambat, and Safebet) it's obvious to even the casual observer that a politically charged trial like this is more than likely susceptible to outside "pressures." Gaughan has been overly secretive, perhaps to a fault, but certainly more than what is considered the norm and he probably shouldn't be in the decision loop regarding a change of venue.

It'll be funny watching "Tha' Communerty"
swap ends, bare their fangs and cannibalize
the living shit out of any/all of the above
for "not taking care of this."

Or better still, turn their anger, hatred
and hotted-up aggrievement upon each other
as they've always done.

Hell even daleys dipshit nephew got a change of venue! For anybody that has been to 26/cal in the last year knows that the "honorable" judge has made it quite clear that JVD better take a jury trial. Gee think he might be a little biased and won't be impartial like the law requires him to be?

I think they are risking that they will actually prejudice the judge by doing this. Or they know their client is fucked either way.

Maybe what they are doing is realizing the "fair, unbiased, justice is blind" trial is going to be a railroad job and laying the long term case for appeal and acquittal?

It's almost believable that everything going on with this trial is designed to delay until after the next election cycle. Of course this trial should be moved the Trib was nice enough to include another download of the shooting. A fair trial will never happen in crook county but what does fair have to do with it-it's chicago after all.

Just a side note: The latest shooting in Vegas, the police shot at the offenders 34 times killing one and wounding the other. Shows you can shoot until you believe the threat has ended.

First off, he needs a change if lawyers, I dont know who is paying for Herbert, but he is not the best. He screwed up the lawsuit against the city regarding coppers kids that supposedly failed the psych test. I would go for a bench with Gaughn, he is 75 years old and I bet he retires after the case is over. VanDyke will not be found guilty of murder, maybe involuntary manslaughter

I believe the fix is in to hang JVD and the Machine wants TD 9.5's scalp as well. This will kill two birds with one stone. This is why this judge (small j) is adamant that this trial start before the elections in November. This judge is no friend of the police. I believe he is actually biased against the police. If he hears the case he will find JVD guilty of a lesser charge such as voluntary manslaughter and numerous counts of agg batt. If a crook county jury hears it, they may actually convict on 1st degree murder. JVD's only hope is a change of venue.

Rahm is ready to get this over with.
Sooner the better, riots either way will be over by Labor Day and the voting community will have been paid settlements and the uninterested lakefront taxbase forgets about it.
Then if dragged out any bit longer, Rahm will probably have to schuck around to get out of court all the way through Feb to avoid getting called to the stand along with flip-flop Justified Jugghead.
Can’t have this peoples community court trial looming that long.

Then there’s the ill prepared States Activist KimmFxxxup who wants a boisterous circus to showcase her self perceived outstanding, (never seen) courtroom savvy.
Her stooges are not up to snuff.
I say Gaughan expects a mistep and a mistrial, only then a change of venue is likely.

If career legacies are at stake here, it won’t be an elected Democrat other than Rahm.
With Rahm gone in 2019 with an acquittal likely, a Consent Decree is the only thing that’s going to come out of this.
That’s how to get some legacy attached to your name.

The Chief Judge of Crook County ought to call upon the IL Appellate Court to assign a panel of 3 judges to conduct that hearing and determine if a change of Venue is warranted.

We all know it is, but the Judge sitting in the case ought to recuse himself due to the politically charged nature of this thing. The Chief ought not to touch it either.

Do the ethical thing. Hell, reach out to ANOTHER STATE's Appellate Court and let THEM decide.

Yeah, yeah, precedents, craziness in jurisdiction and all that - but DO THE ETHICAL THING FOR ONCE!

The judge wants JVD to opt for jury trial for 2 major reasons.

1: To give voice to 'The Community '. The activists want to be on the stage that this trial will be.

2: He has probably looked enough at the case to realize that this case is not a slam dunk for conviction. There is no way he wants to say the words that will make him POS#1 to racial rabble rouser crowd. Those words are "Not guilty. " His life would be he'll and in danger.

A change of venue would be great for the judge, allowing him to wash his hands of this case by dumping it on someone else somewhere else.

And the choice of bench or jury trial is the defendant's choice. So expect the community to be pissed.

A Consent Decree for what why do we need a consent decree? American Civil Liberties Union of Illinois and Black Lives Matter Chicago to give input and criticize the proposed order, and those groups can seek to use the courts to enforce the final consent decree.

VOTE NO to every contract offer until this consent decree goes in the garbage!
