Location Location Location

  • A Cook County judge said Friday he will wait until jury selection to determine if a fair jury can be picked for Chicago police Officer Jason Van Dyke, putting off a decision on whether his trial should be moved because of extensive publicity until then.

    The unexpected ruling by Judge Vincent Gaughan came after an all-day hearing at which experts for the defense and prosecution sparred — and lawyers argued — over the issue for nearly six hours.

    The decision suggests that Gaughan would consider moving the trial if he found it impossible to find unbiased jurors when the jury selection is set to begin on Sept. 5, though he expressed confidence Friday that fair-minded jurors would be found.
So the judge is going to attempt to seat a jury for a trial that might not even be held at 26/Cal? We happen to have been born at night, but not last night. This looks like an attempt at some "pre-justification" as in, "Well, we spent all this time picking a jury, so we might as well keep it here."

We're seeing a lot of evidence for a change of venue - and so is the Slum Times amazingly:
  • Van Dyke’s lawyers argue that the veteran cop can’t get a fair trial in Chicago, where dashcam video of Van Dyke firing 16 shots into the 17-year-old McDonald has been seen by more than 70 percent of residents, according to polling by a defense expert who is set to testify Friday. In the poll, 51 percent of those surveyed in Cook County believe Van Dyke is “definitely guilty.” More than two-thirds of those polled by the defense said it would be difficult to convince them Van Dyke is not guilty.
Granted it's a defense expert, but 51% of those who have already forsworn the "innocent until proven guilty" that the Law requires and two-thirds bring "difficult to convince" is worrying to say the least.

The prosecutor doesn't help his case much:
  • Special Prosecutor Joseph McMahon points out that the odds are better of finding 12 unbiased jurors in Cook County, where there are 5.2 million residents — and 3.9 million eligible to serve jurors — than any other county in Illinois. Polling conducted for the prosecution shows 79 percent of potential jurors say that while they know about the case, 45 percent say they don’t know enough about the case to decide a verdict.
45%? That's less than half of the jury pool even admitting to keeping an open mind, and we all know exactly how accurate polling data is, especially with the questions they would have had to ask to even get some sort of response.

Seems like the prosecution is not too confident. It is as if they want to keep the trial in Cook County because they believe their chances of a conviction are better here than there. A change of venue should be granted. It is the fair thing to do.

So they are not having a bench trial? Not yet! That can be decided at the last minute if the jury selection does not appear to be biased. Let’s face it 12 or 1 in Cook County is a tall obstacle. The judge hasn’t ruled favorably once for the defense in any of the pre-trial motions. If he would release all the motions to the public. At least the public would see the legal side of this case. Like what is the City of Chicago’s use of force policy? Is it a piece of clay that gets molded every day?

During the peaceful march to Cubs Park, all the peaceful marchers were chanting "16 shots and a coverup" over and over again while carrying a big sign that read something like "Justice for LaQuan" with VanDyke's picture front and center on the sign.

A fair trial in Cook County/Chicago... I highly doubt it.

Never forget the term "Urban Jury". In the early 90's, there was the Rodney King case, captured on video and perhaps the beginning of what history will someday call the "Video Judgement Era of American Policing". As brutal and ugly as the Rodney King beating appeared in the few seconds shown on video, of a much longer incident; the L.A. cops were conforming with a flawed policy and procedure. In the entire video, the officers were shown to have used various tactics before striking King with their metal batons, as they had been trained to do. Personally I, nor would most of the officers I have worked with, used the amount of force used, especially with metal batons. But, it conformed to their policy at the time to continue to beat until the subject complied. An all White jury agreed, even after the President of the U.S., Bush I, had publicly stated, that he felt it was Excessive Force. After being found Not Guilty, by a jury of their Peers, the cops were taken to Federal Court, to an Urban Jury. The Urban Jury was dominated by African Americans, one of whom it was discovered post-trial, actually was raised by her Black Panther father! The Urban Jury had no trouble in finding the officers Guilty. Those cops went to prison, and that included the Sergeant, who never touched King, but was held accountable because he was on the scene and did not stop his subordinates. So, if ANYONE, and I mean ANYONE THINKS JASON CAN GET A FAIR TRIAL, IN COOK COUNTY; THAT PERSON, INCLUDING THE JUDGE, SHOULD BE URINE TESTED! Come to think of it, All Jurors, Judges and Politicians should be Urine Tested, especially if they think Cook County is Normal, for American Justice! Baby "G"

Yes, and if the trial is held in Cook County, you can expect the jury to be sequestered and massive demonstrations daily around the court house. I believe that the political class in this town wants the officer to be convicted as they fear civil unrest on the eve of a city election for mayor. Too bad this trial can't be moved out of state. There is no way that the county will be able to seat an unbiased black person on that jury.

I do not like officer VD. I do not like people who shoot individual in the back where there is no imminent threat. I am old school, forgive me. I know precisely how dangerous knife is, my body knows. But still,in my opinion,that was not a situation where VD had to shoot. Opposite to shooting of Augustus. Suspect running away, reaching for a weapon, police squad with people inside in front of him. Fully justified. Thank you, officer for excellent job protecting people from criminals.
Now, back to VD. As I said I am not a fan. And will never be. But this officer deserves a fair trial like everybody else. In Cook County the trial might not be fair.
I do believe in Justice System. After all, what we have left? And I believe in Judge who will sentence him. But I also believe in power of public opinion pressure. Nobody is perfect, everybody is human. Our brains work in mysterious ways. That is why officer Van Dyke's trial should be moved out of Cook County.

...judge is forcing Herbert’s hand in picking either jury trial or bench. Judge knows once jury selection starts you can not go back and it’s a sure fire way to keep trial in Cropk Coubty. But, it’s also an old tactic (that Judge G would know) to ensure a successful appeal by the Defense for a new trial. Remember people (or folks) - chess, not checkers.

Situations like this are the reason change of venue. Couldn’t be a better example, but looks like it’s not going to happen
As far as being not too confident, isn’t the reason. All prosecutors want to have their case heard in a jurisdiction where they have a better chance of convictuon

Everyone is forgetting a little detail that was mentioned in the papers early on when JVD got indicted.

A Cook County Police Officer (who was interviewed by the FBI and there is radio transmission to back this up) responded to the scene and arrived just after the shots were fired. The CC PO stated to the FBI that when he arrived on scene that he made eye contact with LQ and that LQ raised his head and that the PO stated to LQ that to lie still that medical help was on the way. CC PO continued to say that he observed LQ expire before his own eyes.

Sounds like a text book use of force to stop the threat.

No legal basis to charge with 1st degree murder

That's if this guy's version of events ever sees the inside of a court room because I know that he didn't get called in front of the Grand Jury.

Miscarriage of justice. No way can this guy get a fair trial. It’s impossible. If this was a real county, the defense would have a judge decide the verdict. The law is on the side of JVD. The full unedited video is on the side of JVD. But this judge has basically told the defense to have a jury trial. Meaning he doesn’t have the balls to do the legally correct thing and if he has to make the decision it won’t be good for JVD. Ask any ASA you know why this isn’t a bench trial. They will either shrug their shoulders or tell you the judge made that decision by implying multiple times that the defense needs a jury trial. Sad!

Regardless of where the trial is held, Van Dyke is facing an uphill battle. This is one of those cases which will require nothing less than the defendant taking the stand to counter the evidence against him.

Certainly there is the presumption of innocence, but whether you've seen it 100 times or never seen it once, that dash cam recording is going to be hard to overcome, especially considering that none of his fellow officers who had been following McDonald for some time felt the need up to that point to draw their weapon and fire on him.

Van Dyke pulled up in his vehicle, and with very little hesitation hopped out, pulled his weapon and fired it 16 times.

Good luck defending that, and I'm not cop hater. One of my cousin's husband is a top criminal defense attorney who argues most of his cases at Leighton, even he said it meets the criteria for a murder charge and probably will result in a conviction.

Its too bad the bosses in charge did not handle this incident with integrity when it happened. Its a bad shooting, no matter how you slice it, its a bad shooting. The family was going to get paid off no matter what, and if handled differently, Van Dyke may have still had a job. Not now, not with the coverup, he is losing his job, losing his pension, and going to jail. So go ahead and give him the change of venue.

Not a drew peterson fan but am still appalled by the hearsay law they passed just to find him guilty. Can't believe it hasn't been challenged and taken off the books by now. The ability to to confront someone bearing witness against you, is as fundamental to law, as it gets.

You could not be more wrong. You do not like the optics, but leave your emotions out of it. By law, it was a good shoot. There was no illegal conduct. If allowed to continue his hopped-up, armed, mini-crime spree, the offender would have endangered members of the public and other officers. If he harmed or killed you or one of yours a block after he was allowed to continue, you or your family would be wondering aloud why he was not taken down before he encountered you or a member of your family. And, you or the family would be suing the city.

Recruits wear their shoes everyday to and from the academy everyday. They run in them, do push ups, sit ups etc. the shoes they buy are usually the cheapest ones from the uniform stores. By the time they are ready for graduation their shoes look like shit. They get scuffed up and sometimes are pretty much falling apart. The family was going to get paid off no matter what, and if handled differently, Van Dyke may have still had a job. Laquan was high on PCP running around with a knife slashed Police vehicle tires with women Officers inside in fear of their life refusing commands to drop the knife. Remember the woman Officer who had her head bashed in the pavement repeatedly by someone high on PCP whatever happened to her disability?

Not a drew peterson fan but am still appalled by the hearsay law they passed just to find him guilty. Can't believe it hasn't been challenged and taken off the books by now. The ability to to confront someone bearing witness against you, is as fundamental to law, as it gets.

Gaughn knows that this will be a bench trial and Van Dyke would be stupid to request a jury. Everyone knows this is just a facade to try and force a mistrial or win an appeal down the line. It’s all a show to get to an appeal because he will be found guilty of multiple counts of agg battery but not murder.

Gaughn will never convict him of murder. If at worst an involuntary manslaughter charge. Gaughn doesnt care about offending anyone. He is going to retire after this trial. Only sticking around to do the right thing. He has many police friends.

It being obvious that a good majority of eligible jurors would jump at the chance to convict a cop so they could improve their street cred, there is one thing the defense lawyers can do. As the jury picking process begins, defense lawyers should request from the county the records showing if a potential juror was ever notified of jury duty in the past and if that person showed up or simply ignored the notice. If the potential juror showed up on the appointed date, were they picked or did they pull out their laundry list of excuses as to why they could not serve? Remember, everything in court is put on record. Even at jury picking. If they ignored the notice and then the second " HEY! We mean it! You better show up or else!"notice, what was done to that person? Did the county go through with the threats of fines and/or jail time or did they too ignore the situation and do nothing? I mean, if the Cook County State Attorney can't (or won"t) follow their own rules or laws, how does that reflect on their being fair and even handed in picking potential jurors?

Notice the extreme silence of the news media the children were sexually abused some more raped but I guess that was acceptable because not one of the assholes in charge have been fired charged criminally prosecuted they all probably are getting big raises that is what the mayor wants sickening what is happened to the children!The Democrats talk about the children of the illegal invaders worrying about them in the city of Chicago but yet this happens and none of them are speaking out about it I guess they don’t care about children many that are citizens that are being abused in this manner!

The question is this. If Laquan was such a dangerous threat, why didn't any of those officers already on the scene shoot and kill him? Why didn't those scared "in fear of their life" female officers inside their car shoot Laquan when he was slashing their tires? If all of those officers were in fear of their lives and in fear of others lives, why didn't any one of them shoot Laquan to stop the threat? Why did it take Van Dyke to drive up in the middle of all those police cars, jump out and shoot Laquan 16 times? Were all of those other officers on scene so afraid that it took the the courageous Van Dyke to arrive on the scene and save the day by shooting Laquan?

I am not trying to be a smart ass, please know that. These are some of the questions that need to be answered when reviewing the totality of circumstances. Shooting someone is the last resort if you have no other options, or after exhausting all other options. Are we trying to say Van Dyke had no other options?

The prosecution would be better served by going along with a change of venue. Otherwise there is at least some chance of after-the-fact the defense claiming an unfair trial. A good defense lawyer can get a juror to admit to just about anything if the question is phrase the right way.

If he does have many police friends then it would be appropriate for him to recuse himself.
