Deliberations Continue
Closing arguments and jury instructions progressed faster than a lot of people had predicted. The possibility of a Friday verdict and a full weekend of protests across Chicago is a distinct possibility.

UPDATE: Gaughan was kind of a dick today. Instead of holding a closed hearing regarding threats made against the defendant's daughter, he lambasted him in public and on camera. You'd think that a judge who has been living with part of McCarthy's command staff for at least the past decade would have attempted to appear impartial.

As Judge Gaughan was preparing to release the jurors on for deliberations VanDyke was a few minutes late in arriving back to the court explaining that one of his daughters had been threatened. He was admonished and told he better provide proof or the judge will either raise or revoke his bond. Now think how many times you have been sitting in court while a judge is in his chambers chatting or playing the stock market. Or when attorneys don't show up and the judge says, oh lets pass this case until the lawyer gets here while you just sit there even longer. Or when the defendants walk in an hour late after they were BFW earlier in the call and the judge doesn't even take them into custody or their bond. I can think of hundreds of times this has occured in my time on the job. This Gaughan appears to be pompous and arrogant. So you tell VanDyke your late, end of story. That's all VanDyke needs at this time, more pressure.

There were numerous calls yesterday to the FOP concerning the officers placed on the 12 hour days .Two were late in the day and they were ; 1.) three police being assigned to the 12 th District foot patrol placed in a three man cage car and 2.) in the 003rd District the Commander addressing roll calls and telling officers they could not wear black gloves or have their batons in their hands .Both of these were addressed immediately . A phone call was immediately placed to MLAS and this was stopped . Fop cannot address situations unless they are aware of it . Do not place yourself in jeopardy by riding in a locked cage car . If a Conmander or a Lieutenant threatens you call immediately ! Be safe out there

Dumb question. Will there be deliberations over the weekend? If no verdict is reached on Friday do they wait until Tuesday?

My friend’s father is part of Gaughan’s annual Mexico trip. Here’s what’s going on with this senile judge. He knows that he screwed up by not recusing himself from this very high profile case because he lives with former commander Linda Flores. And he didn’t because it would have called into question all his other criminal cases. Even though Judge Evans said that he’d never had a PO defendant so it was fine. So Gaughan has felt that he has to be a dick to Van Dyke to show that he’s not showing favoritism, because that would call into question his decision not to recuse himself.
So, maybe when the conviction comes down - and it will, folks - there might be a good basis for it being overturned on appeal.

Could be two reasons. One couldn’t qualify as a expert witness and two didn’t he say while questioned during a campaign rally when asked about McDonald say he stripped him after seeing the video. Might have backfired on the defense. Also judge might have thought it was irrelevant what the bosses thought as they might be biased

Tac and gangs from all over the North and West side on from 1100-2300 just sitting at Belmont and Western hanging out, no big deal easy money. But come Sunday the marathon hours are 0400-2300. Wear their blues during the marathon and change back into their bdu's and report back to Belmont/Western after the event. In my humble opinion, how the police command staff views or judges an incident has no real bearing on how the legal system views that same incident. It is irrelevant. In the same vein, the legal system can state your actions are within the law, but the department can fire you for employment violations.

My question of the day is why defense did not call any brass that signed off as good shooting. That would have been interesting to say The least. They could have all been called as hostile witnesses. This is the weekend where Chicago turns into Detroit forever.
To have a trial at all is to give them an excuse to riot. The decision to have a trial was either deliberately malicious or stupid. They will riot because they have periodically rioted for decades, and their benefits have increased for decades -
actually a pretty effective evolutionary strategy.
For the rioting, looting, angry mob that sees the police.. Why not have the national guard deployed instead of CPD? I hope there isn't a vindictive plan by an ousted Mayor. If things get ugly, CPD may have to retreat and the call for the national guard may have to be made. With regard to JVD returning late, the judge is either really stupid or was just trying to again be a pompous, dick. When Herbert said the school, obviously he meant the staff, the administrators, not the school building. Who the hell wouldn't know that. Then he said you're not making any sense. He could have said, you mean the staff, give me a name. May be he should retire if he couldn't grasp what Herbert meant. And why wasn't it done in chambers. Perhaps because he likes a bit of theater and to play the tough guy judge. Gaughan is an arrogant asshat.
Van Dyke was very emotional, explaining he was late returning to court because his daughters were threatened at school. Judge Gaughan demanded more information to determine if the threat was credible or else he was thinking of revoking bail.

The judge decided to let it go and didn't revoke bail. It's unclear if the students making the threats were ever tracked down.

No one within the police department, including the super, has any say in whether this is a crime or not. The higher ups of the PD are only authorized to determine if an action was in accordance with police department rules and regulations.
Whether an action is in accordance with those rules and regulations is not relevant to whether it is a crime or not. By the rules of evidence, the judge is only allowed to permit relevant testimony.

At 2:30 PM Alderman Arena gave an interview on Channel 7. He criticized the FOP and related that a young man was killed (McDonald) and a police officer (Van Dyke) would have reconcile himself with the consequences. He did not say that had McDonald showed up at his house he would have called the police and probably reminded the dispatcher of his position.
Remember what the prosecutor said “you could just stayed in your car”.

What a railroad job on officer Van Dyke! Compitialation to the threat of rioting influenced this verdict. How can being not guilty of official misconduct and being found guilty of second degee murder( as last minute charge suggested by the judge ) be fair? 16 counts of aggravated battery?
What is that? There is no aggravated battery after he is dead. Which shot was the second degree murder? Jesus what a fucking mess of judicial incompetence by the judge. He was not impartial! Clearly he was not. He demonstrated that numerous times by treating Van Dyke harshly in front of the jury on numerous occasions. O J got more respect and he was clearly guilty. Van Dyke was found guilty under the threat of rioting. There was no justice for Van Dyke. Justice was not done. Weak leadership in Chicago. The threat of another Chicago fire is no excuse for lack of a fair trial.

Judge Gaughan was bad news all around. Fix was in. He's a violent drunk. there's plenty of stories in his background growing up back in the day around DePaul shooting up an apartment, getting in bar fights all the time -- a two-fisted drinker & black out drunk. all the stories are true. and when he was in traffic court he used to take care of all his buddies from the old neighborhood. yeah I know he's a combat purple heart Vietnam vet, blah blah blah... He's still dirty like everything else around here...Gaughan should have been recused because of his domestic partnership & the fact he worked in the public defender's office and there should have been a change of venue cuz of all the pretrial publicity & there's no way that this cook county jury was going to vote impartially because they were scared to death. And most of the jury should have been struck for cause. Gaughan let them sit. and the bosses who approve the shooting should have been called to testify and All the Rules of Evidence stunk. fix was in from day one. this was all pre-determined by the hierarchy of the Cook County political corruption system. Rules of Evidence decisions were bad and not allowing for the bosses to be called after they signed off on the shooting was a sham. I think Herbert and the defense team overall were terrible they should have never called JVD to the stand to testify: that was a big big big mistake. Seven hour deliberation, they decided before they even heard the case and now they will go after the Detective and 2 patrolman. Somehow no politicians or exempts will be culpable. If you are still policing you need peer counseling.

Mistrial should be declared. Jurors couldn’t wait to get on tv and state that acquittal was never on the table? He was never, at any point in the process, presumed innocent by the jury. Jurors also stated how proud they were to serve on the jury, in other words proud to convict a police officer while they believed all along was guilty. They lied on their questionnaires when asked if they could be impartial in order to convict a cop. Also, seems incongruent to be not guilty of official misconduct but guilty of 16 counts of Agg batt. Change of venue and new trial is in order.

They said the reason they did not convict him of 1st deg murder is because they believed he was was in immediate danger and he was in fear of his life. Yet they convicted him anyway. Anyone see a problem with that??? They also said that the didn't convict for official misconduct be he was allowed to carry a gun and had the authority to use it in a situation like this. If that is what the jury believes then his conviction should be overturned by the Judge Immediately.

Now that the verdict is done I think we can speak our mind. If our mayor would have kept his nose out of this and let it play out as normal Mr. VanDyke would not be going thru this. It took Detectives three days to find some one to claim his ass. There was no justice done today. Its like the old song. The Night Chicago Died. My wife and I are putting the house up tomorrow
I work in the burbs and have worked in a few different towns on different sides of the city and bordering the city. I know guys empathize for JVD and feel like it could be them too. I don't understand how many of you think that was a good shoot. I'm 2nd generation police with childhood friends on the job as well as colleagues of course. These are good, family men and fair and honest people. None of them are shady or screwing around on their wives etc. Not one, in the city or burbs, has expressed to me they thought this was a good shoot. I really don't see accuracy in what most of you are articulating. I work somewhere where we are not afraid to get left out in the cold on a shooting etc. Just like Cicero defended their officer, many of the burbs are still like that. But if you did this..what JVD did, the bosses in any of the half decent places would never sign off on it. The way the state's attorney does her own thing and doesn't follow ILCS is also the way you guys think about a lot of stuff, in a way only respective to Chicago that would not hold up in any other dept or county. I prayed for JVDs safety in IDOC today. The look on his face made me feel horrible but he was guilty that day. I told my wife Laquan was most likely headed to IDOC or being a shooting vic eventually but that had nothing to do with that moment he was shot. I call the community out when they're wrong. I call cops out when they're wrong. He was wrong, like it or not.

My thoughts exactly. If the Blow-z broad trying to derail the Supreme Court nominee can have 300+K raised for her through that money donation site, Van Dykes family deserves the same.
