Judge Not Accountable
- Cook County Judge Joseph Claps was acquitted Tuesday of a misdemeanor gun charge by another judge who said prosecutors failed to prove the object dropped by Claps in a courthouse lobby was, in fact, a firearm.
Claps held his hand to his face, then wiped away tears as Will County Judge Edward Burmila announced his acquittal following a brief bench trial in the branch courthouse in west suburban Maywood. Burmila had been brought in to preside over the case due to Claps’ working relationships with other Cook County judges.
Prosecutors played surveillance footage appearing to show a gun falling out of Claps’ jacket and onto the floor of the lobby of the Leighton Criminal Court Building in early July.
Two Cook County sheriff’s deputies testified Tuesday they were in the lobby when it happened and said the object was, in fact, a gun.
In ruling from the bench, Burmila, though, said he “can’t believe” the deputies didn’t immediately seize the weapon under those circumstances.
How long has Burmila been a part and parcel of the Chicago/Cook County Machine? The sheriffs most certainly recognized the dropped object as a gun.
They also most certainly recognized Claps as a judge.

Burmila must have crook county roots. He knew just what to do. And, he did it without hesitation or batting an eye. It is the judicial code of silence. Claps' is surely grateful. Now, let's all go forward and forget all about this unfortunate situation. Oh, and don't forget, the police are the problem.

*Printing the city stickers cost is around $10.00 per sticker so this goofy idea will cost taxpayers more in long run, but yet when people buy a "2 year sticker" that is 1 sticker costing $10.00 to print total they get zero discount which saves the city and her office money.

I worked with Joe Claps at the SAO when assigned there as an investigator. Years ago on murdered on duty cop. He is a good guy guy an prosecution minded. 3 offensive are still locked up (or dead).

Clap's attorney, Breen, makes the statement that we don't know if it was loaded. You will now see questions asked of you in use of force situations of the like as, "Did you know the gun was loaded ?" or something to that affect. Because we never know for sure until recovered, you will have to wait to be shot at in order to defend yours or someone else's life against death or great bodily harm. Way to go counselor, you just put a lot of blood on your hands. Remember, the police are the problem.

You guys really want this judge convicted? He has a valid FOID and Concleaed Carry Permit. If I was Judge at 26th Street you bet your ass I’d carry a gun in and out of court. This is also the legally right verdict. The item that fell out of his coat was not recovered, so you can’t prove it was an actual firearm. The Deputies testified it looked like a real gun, but they never recovered it. Deputies did nothing wrong. They thought judges could carry guns into building, then went and asked supervisor. We all know it was a gun, but in a court of law that can’t be proven without the actual gun or firearm evidence like expended cartridge cases or fired bullets. Sorry, it simply can’t.

Judicial courtesy has always been there sometimes for good, sometimes for bad. Years ago in Coral Gables Florida a federal judge and his wife wife were out shopping. One of the two was wearing a Rolex wrist watch. Two miscreants, commonly called Rolex bandits, followed them home and assaulted and robbed them in their driveway. It was like watching the Keystone Cops afterwards. The U. S. Marshall's, FBI and Metro Dade Police were tripping over each other looking for these idiots. They were found in under a week. The were charged under state law. As I recall a judge in Dade County gave them 17 to 18 years a piece. If that were you or me it would have been 17 to 18 months.
Clapps was facing a class B Misdemeamor. Big deal. Shouldn't even be newsworthy. Now the idiot that arrested him without any evidence got something to worry about. This outcome was a total no brainer.

Just a reminder, Tom Breen and Joe Claps were phenomenal ASAs back in the 80s and 90s. I personally lost all respect for claps when he found a sgt. from 006 guilty of rape when it was nothing more than conduct unbecoming... FACT, so unless you were there for all of it do not argue with me... tyi

Fuck them! They do not deserve to carry. They expect everyone else to rely on the law alone to protect them. Why should they be any different? If they wanted to carry they should have taken the test and worked this fucked up job. Or they should pay the money and go through the grease to conceal carry just like other citizens do.
There are gun lockers in CCB for law enforcement. Don't see why they wouldn't let the judge lock his weapon in there.
