And Speaking of OT

BIG contract violation this weekend:
  • Section 23.6 — Overtime for Pre-Planned Events

The following procedures will apply in case of events which will require the cancellation of days off and for which the Department has received a minimum of 21 days' prior notice. In those units which have been designated to provide personnel, seniority will be the dominant factor in the selection of Officers required to work their regular days off, provided that the Officer to be selected possesses the necessary skill or special qualifications to perform the duties required. The Employer shall seek volunteers on the basis of seniority from among those qualified Officers in said unit. If there are insufficient qualified volunteers, the Employer shall select Officers on the basis of reverse seniority, provided that the Employer may assign probationary officers without regard to seniority
And who got screwed?
  • Detectives are in uniform and 3rd watch had RDO’s canceled to be sent downtown. Thanks for the last minute heads up Eddie and Lori. Fucking assholes.
So when is the FOP going to address this? The Department does this every fucking year, throwing wrenches into family plans with far less than 21 days - Memorial Day happens every single year. It is possible to plan ahead for it, years in advance in fact.

The FOP really needs to get double time or double-time-and-one-half like the trades do. Try to get a city electrician on a Sunday or a holiday weekend - you're looking at triple time in some cases. Make the City plan in advance instead of screwing over people who get the holiday off maybe once every three-to-five years depending on the day off rotation.

FOP response is why should you care. You are being paid time and a half. They don't want to rock the boat because how are they to get a nice cushy job after their term is up. Our union is a complete joke. They allow the city to walk all over us. And since the precedence is set the city will continue doing this to us on holidays.

Excellent point! Our lives do not revolve around this job (correction...well most of us) The FOP needs to make the city really feel the pain for canceling days off. This is something that is now the norm every time it gets warm out. Make them think twice before they spend a fortune screwing over policemen that haven’t had Memorial Day off in several years because of the city’s bullshit. Double time sounds like a good way to start. They keep saying that the dept is at full strength then why do they need to force officers to work their days off?! ☠️

It’s really simple...They could care less about the police officers and their families. Another reoccurring example of this is constantly working without a contract for years each and every time it expires. OUR ENTIRE FUCKING CAREERS! Then throw in the neglected earned and contributed pension fund. They don’t show one once of caring EVER! No go get em guys

So file the Grievance.

Make it a Step 3. Back your Steward into a corner and make him/her do the paper.

And then, if FOP fails to follow up on it....Walk your butt over to the Labor Board and File against the City And the Local.

And don't back Down there, file a complaint with the International. They can come in and File the current leadership, ban them from FOP for life and run the Local until they decide the local can run itself.

Lol on planning years in advance. It reminds me of the holiday shoppers and how the media will be out on December 24th interviewing shoppers who waited until the last minute. It always cracks up like they found out about a forgotten birthday (literally) the day before. So on that note fellow coppers, Christmas is on the 25th of December. Start shopping now. No excuses.

The union is aware of this!

Several years ago I was the unlucky one the Department decided to pull this emergency crap on.
With 18 years on job I closed my mouth and did the detail which amounted to me standing on a corner watching foot traffic!

When I went back to my unit I filed to grievance which took almost one year to be settled.
City violated the contract and had to pay the overtime and due to seniority being violated they paid penalty since they allowed others with less seniority to take elective time off while I was detailed out.

The best was they the detail fell across my RDO and I was notified just 18 hours prior to the detail.
Again for a regular holiday where the heat of the weather and large crowds cause the 5th floor to loose bowel movements!
And then they assign me on a detail location where no one but officers appeared!

You have to follow the orders!

But Document the entire detail!
When were you notified by who and made this notification,
Get all work sheets and with all elective time off of your unit and watch!

I took time on the payout and banked it for retirement what a check this will be?
City is stupid when it comes to these events and FOP does nothing, and when you file grievance,
The FOP will try to talk you out of this action!

Do not be foolish

Isn’t that why you get a duty availability check? It is suppose to compensate you for things like this.

5/24/2019 06:21:00 AM
Anonymous Anonymous said...

We get duty availability in lieu of double time /premium payfor nights and weekend hours. The FOP sold out the guy that actually work the crappy hours many many contracts ago. Paying it this way the city gets off cheap.

If the department doesn’t give you 21 a day notice for the older planned event you are more than welcome to grieve It. You will win! City don’t care because then they gotta pay you overtime which they already are. Contract has no actual punishment. For the city for violating the contract.

If you are in training. You are not detailed and days off canceled our by seniority from your unit which is still where you are from. You can grieve it, you too will eventually win. And you reward will be compensated at time and half, which the city is already paying you.

Maybe this makes an argument that real labor lawyers should actually be negotiating our contracts since we are getting taken to the cleaners at corner.

FOP should be filing an unfair labor practice against the city since they blatantly violate the contact time in and Time again knowing that they don’t get punished for it.

There ought to be a punishment and substantial reward for the violations. It’s the only way to stop the city from doing it. Maybe fine the boss that is found in violation of the contract the amount it costs the city. Suspend them without pay to cover the violations. Maybe they will start to think twice and run their orders last some real attorneys to make sure they don’t violate the contract.

There is compensation for having your holiday canceled in the Contract

Anyone who has their Monday canceled needs to submit a slip citing Section 11.2(C) Compensation for Holidays (page 20 of the contract) for the below listed credited hours:

8 hour schedule equals 20 hours comp time plus 4 hours money or comp time
8.5 hour schedule equals 21.25 hours comp time plus 4.25 hours money or comp time
10 hour schedule equals 25 hours comp time plus 5 hours money or comp time

THIS IS ONLY FOR THOSE WHO HAD THEIR DAY OFF CANCELED. IF YOU VOLUNTEERED TO WORK ON MONDAY YOU ARE ONLY MAKING TIME AND A HALF

Additionally, pay attention to see if you are working 6th or 7th consecutive days from Sunday through Saturday next week if you had your Sunday and Monday canceled as well.

AGAIN, THESE DAYS HAD TO BE CANCELED, NOT YOU VOLUNTERRING TO WORK THEM.

For example, If you are in DOG 64 and have both your Sunday and Monday canceled you will earn time and a half when working your regular shift (6th day in a row) on Friday the 31st. Submit a slip citing Section 20.3 – Sixth and Seventh Day Work (page 29 of the contract)

Pay attention when submitting your online slips to make sure you are credited the correct amount of hours! The Department might not have set up the system to automatically credit you with these hours to take in to account for contract violations.

Remember, per Section 9.2 Procedures, Steps, and Time Limits for Standard Grievances (page 12 of the contract), you only have 7 working days to file a grievance. If you are not properly compensated for the above days you need to make sure you file your grievance within the correct time frame

Fuck off company man. Why only 3rd watch? Why not days and midnights? That is a problem. Also I can’t ever remember a time detectives had a weekend cancelled just because it’s a holiday weekend. The comment at 4:02AM is correct and I'ld like to add to it. If you are unhappy of this contractual flaw and you are mad you have to work, then get creative with your own type of work action without being negligent and giving the public what they want at the same time.

ie, drive safely to your call without violating any IVC codes, don't endanger civilians by racing lights and sirens. (unless a PO needs help). Unexpected stomach problems which cause you to remain in the "Rest"room. Uniform gets damages while working, make sure your uniform adjustment receives the attention it deserves and that it is properly serviceable no matter if it takes the entire tour. Have your rebuttals ready for those snowflakes who dare to tell you to "Do your job" when they become victim due to their own stupidity. Rebut them and ask them to explain what your job is. Then explain the Department's new "Motto and Vision" order that just came out.

Holy shit you are dumb. Reading contract bylaws is definitely not your thing. Let me help you out there dummy - when a UNIT is provided to produce manpower consisting of RDO personnel, the UNIT first has to accept volunteers to work their RDO (based on seniority), and if the number of volunteers don’t satisfy the required amount of personnel, then the UNIT is to cancel RDO’s based on reverse seniority. Nothing about any specific watch exists in the bylaw. No wonder you haven’t passed any promotional exams.

This is an ongoing issue, expressed many times to FOP for several years in a row. And no results ever!!!!!!!!!!! They respond to inquiries about this and after 24 hours after the holiday, its all forgotten about. No follow up and no grievances, nothing. This has been going on since they realized they could use cops forced working their RDO's since the Cubs championship. After the city realized they got away with it, now every damn holiday, they do this. Canceling an RDO off for a annual holiday with guys who have 20+ years on this job, with a billion PPOs running around is a shame. Wonder why cops are so bitter and pissed off, well this is one of the big contributing factor. 20+ year veteran forced to work RDO's on holidays that are PRE PLANNED EVENTS, GIMME A F- ING BREAK. F.O.P. is useless, they have known in writing and in-person about this exact situation and do NOTHING, Bye bye Kevin, won't be voting for you or anyone else in your cabinet next election

This is an example of where our job is different from all of the other government jobs. When our days off are cancelled, or we’re denied the right to use our earned time off and we miss the ability to spend the weekend away with our families, that’s where our job is different. I realized when I took this job that these sorts of things were going to happen, but you know what, the reason I still took the job was because I knew at the end of the rainbow was a pension. So when some asshole says “I don’t have a pension in the private sector,” all I can do is laugh. Is your boss telling you two days before you’re scheduled to leave town that your days off and time are cancelled. He should be the person calling my wife to tell her and the kids they’re leaving town alone.

I agree with everyone that our "union" has proven to be completely incompetent. There have been many suggestions to become part of a different union and cut ties with the fop. However, Rule 54 in the CPD rules and regulations states that the following would be a violation:

"Joining or retaining membership in, or soliciting other members to join any labor organization whose membership is not exclusively limited to full time law enforcement officers. It is provided that this rule will not apply to civilian members nor to membership in any labor organization in connection with, and relating solely to, approved secondary employment of sworn members."

So they've got us over a barrel, and our "union" knows it. Perhaps the suggestion to seek help from the state lodge in expressing zero confidence in lodge 7 should be a real push from members. Now more than ever we need a strong, reliable, group that has no other purpose than to have our backs and protect our rights. Anyone can write a "strongly worded letter" that the media and politicians use to wipe their asses. We have no contract, no communication, union meetings that literally just consist of retirees and active members yelling at each other about who knows more about the job, grievances that sit for YEARS unanswered, no consistency in information between various board members etc., etc., etc. When is enough going to be enough?

I’m in my 30th year and can’t leave because I came on young , not 55 yet. I take a full summer furlo and if they try to limit my days I want to take off or cancel my RDOs I hit the medical. That simple , I’m done with the CPD I’m only here for the insurance....

If EVERY Detective in the 3rd watch had their day off cancelled, there is no contract violation abc there was no need to seek volunteers by reverse seniority. As for having to wear a uniform, cry me a River. Civilian dress is not subject to a grievance. Use some of that OT check and buy a couple uniforms that fit.

Ladies and Gentlemen, this one has merit written all over him.

Better to remain silent and be thought a fool than to speak out and remove all doubt.

I think he's right, merit or not.

Isn’t that why you get a duty availability check? It is suppose to compensate you for things like this.

Riccio is the problem. He is hell bent on showing who's boss by being an asshole. He likes to see people jump for him by doing last minute crap. He is a jerk in the highest form. Plus his people tell others complain and his payback is a bitch. Controlling stupid dick.

The headquarters officers and sergeants work the street every weekend. They are all in either Fri/Sat or Sat/Sun same thing though First Deputy can't give notice until last minute as to where they are going and when. Hard to tell if Riccio an incompetent dick or just a dick. He has surrounded himself with inexperienced relatives and idiots so hard to tell.

This whole holiday weekend ot/canceled rdo's is pointless. The crime may stay down and when I say down, I mean "only". 14 murders and 45 shot. Guess what? Next weekend, staffing will return to normal and the same shit heads who took the weekend off will be back to their nonsense and it will be a headline splash of 20+ killed and 50+ shot.

Duty Availability check, as I understand it, is for police officers to be available, even if off duty, for an emergency ( 911, terrorist attacks on a large scale, something like that). There are emergencies, but the holidays are at the same time every year. I don't know why they don't ask for volunteers. They should open it up citywide, for off duty coppers to volunteer to work time and a half. I would have. I am on furlo, and many others would sign up. I could not even get overtime in my district.

Hey SCC: didn't Lori the Lioness claim that she would be out on patrol this weekend? So far, haven't heard anything about it on the media. Maybe her bodyguards talked her out of it. However, it would be interesting to see a modern day "Charge of the Light Brigade."

Guess what snowflake. Officers with less then about 4 years DO NOT get duty availability {thank you FOP for blowing that one} And those are the ones who get screwed the most

Anyone assigned to the transportation detail who was sent by reverse seniority that was taken off of the 3Rd watch file a grievance. The contract reads that they must take officers from the UNIT by reverse seniority NO where does it allow 3rd watch only. File that grievance ASAP make the department pay
