From Groot, believe it or not. Anyone here ever worked the lockup?

  • Backers of a proposed ordinance that would guarantee arrested people prompt access to an attorney say a counterproposal from Mayor Lori Lightfoot could undermine the effort.

    Sponsored by Ald. Leslie Hairston (5th), the proposal would require Chicago police to allow detained people to use a phone within one hour of their arrest to contact family and an attorney.

    The ordinance is backed by the Cook County Public Defender’s Office; legal groups, including the National Lawyers Guild; civil rights advocates like First Defense Legal Aid; and more than 200,000 other individuals and organizations that signed an open letter asking for Lightfoot’s support.

The dozens of times we helped out in the lockup, there hasn't been a single instance of anyone being denied a phone call, usually within forty-five minutes of arrest, depending on the speed of the officer typing the arrest report. It just doesn't happen anymore. Someone actually got Groot to listen to reality.

Guess who the politicians are trotting out for this?

  • Hairston invoked the example of former Police Cmdr. Jon Burge, whose notorious crew of officers tortured hundreds of Black men into giving false confessions between the ’70s and ’90s. Many of those confessions were later overturned.

Eeeeek! Jon Burge! By the way, many more of those confessions stood up to multiple reviews and recantations were proven to be manufactured. Burge was suspended in 1991 - twenty-nine years ago, and fired in 1993. There pretty much isn't an officer or detective around that even crossed paths with Burge any more, let alone worked for him - under one hundred for sure.

This is a solution in search of a problem that doesn't exist in any meaningful numbers.

I already know the answer to this is no, but I'll ask anyway: Did they look into how many arrestees actually end up calling a lawyer, or even ask to call a lawyer? Almost no one asks for a lawyer, and even fewer actually call one, despite being given several phone calls. Most don't need a lawyer, unless they're facing pretty serious charges. Nowadays, anyone actually needing a lawyer would most likely be having their interrogation recorded, so any requests for a lawyer would be recorded. Basically, very few request or call lawyers, and those who do aren't denied their right to speak with one. Just another attempt to make the police look like the bad guys, despite no evidence of any wrongdoing.

O.k., prisoners are given a phone call after they are printed/photographed provided they are not so aggressive it's impossible.
They are given a phone call every time they are moved to a different facility.
It's all on video and documented in the computer log.
Everything's exactly by the book now... tough luck shysters.

Some districts, they are picky/ shaky about arrests/ paperwork, inventories, etc it could be longer for an arrested to get to use a phone. And of course, ' chest pains' so to the hospital the arrestee goes.

From arrest to phone call in 45 mins? I can’t see it. Take a DUI arrest for example. They take hours to process and driver waits in a cell with no access to a phone. Eventually they’re granted a phone call but it’s after being printed. And that won’t happen until I’m ready to submit the arrest report. Which is consistently 45 minutes before checkoff.

Most all of the arrests that I made,I would give the arrestee access to his or her cell phone until they hit the lockup.Like a baby with a pacifier it would keep them quiet.Most arrestees do not know any phone numbers to call without their cellphones anyway.

Worked for Burge when he was the commander of the real Area Three (39th & California). I've been retired for ten years now. Doubt that there is anyone left who still worked for Jon. Never saw any of the B.S. that Carol Marin and the rest of the leftist media promulgated. And yes, I worked in the Violent Crimes unit.

Let'em use a recording phone like is used in the prison. They might use the call to tip someone to destroy evidence or get out of town before the cops get there. Not just what the criminal says but what the person they call says might provide information detectives could find useful. Things like, "don't worry, I threw the gun up on the roof of the apartment building where my girlfriend used to live. The cops will never find it! I'm gonna go hide out with my cousin in Gary. Don't say nothin to the cops".

Yeah, you're entitled to a phone call. But there's a PROCESS to be followed when you're arrested for violating the law. When we get to the point in the process that we know who you are (or have at least captured identifying information about you), and the next step is to let you make a call, yeah, you can make one.

But if you don't like being told what to do, and when to do it, then here's a fucking tip: DON'T ENGAGE IN CRIMINAL BEHAVIOR, because CRIMINALS get told what to do and when to do it by the Police, Guards, Judges, etc.

It's called "Consequences of Your Actions" - musta missed that lesson in CPS huh?

I was assigned as a new recruit in the early 1980’s to a district in
Area 2. From Bosses to Patrolmen both Black & White I was told
essences the following: Kid if you’re shot or killed while working or
off, Burge and his Dicks won’t rest till it’s avenged & justice is done
for your family.

There has never been a barrier for do-gooder attorneys to hang out at the districts, on their own dime, and represent arrestees upon arrival at the district. They just want to put the burden on the police to make a call, and not them having to wait around until 3 am for some total shit stroke to spit in their face (or launch a fresh ejaculation al'a county) and tell them to "fuck off." This is total bullshit promulgated by the Coif's. Like they're the legal maytag repairman on call.....

This is a lot of balderdash from our Council Clods. Having worked all over in a city wide unit bringing prisoners into lockups and being a desk sergeant for many years supervising lockup/keepers I have some comments. Lockup personnel have to spend more time with the prisoner than the arresting officer. Many times it’s the entire tour. So it is incumbent on them to get the prisoner processed as quickly as possible, and accurately and into a cell so the prisoner cannot cause more problems on the floor. The lockup people did not have an arrest interaction with the prisoner so it’s a calmer situation. Although there can still be surprise attacks.

I have never seen a prisoner refused a phone call. Some prisoners are screaming for the call as soon as they enter and keep it up. Of course it comes in time after searching, getting information, printing & photo,extra inventory. Then comes the phone call. We had log books for the time and number that the prisoner called. Those lockup people let them make extra calls just to make sure they got a hold of someone because once you put the prisoner in the cell you don’t let them out to cause an incident. I know there will be comments about the lockup people but they are just like you, some are at postal speed, some are fast, some are happy some are cranky!

My suggestion to these alderpersons who some are sitting on their dead asses instead of going to City Hall for the last 8 months and instead of listening to the permanent grievance class, is to get out in the police stations in the lockups, do some ride alongs and see for yourselves. You are supposed to represent all Chicagoans. How can you oversee the police if you listen to the socialists all the time on how things should function. The police department is the only profession that everyone else thinks they can run it better. How can you tell a chef how to prepare a banquet if you have no idea on what it entails? If you don’t see, let’s say, how a high rise building is built and what goes into constructing it how can you make decisions and laws governing it? I’am a big believer in performing a job or occupation before supervising or overseeing it.
At least listen to the other side. The Mayoral Administration and the Council are the blind leading the stupid and evil segments of the popuation.

Don't give Lightfoot any credit. This phone call ordinance doesn't matter as there is a much bigger picture regarding detainees. She has given lawyers an office at the Jisc. Now the kids get a free attorney that the taxpayers are paying for. These are not public defenders. They are social justice lawyers from a firm called LCLC. This will expand, most likely at the areas first for both juveniles and adults. Remember these are private attorneys paid for out of the city budget. There is $36 million allocated for anti-violence in the 2021 budget (up from $26 million in 2020) and this is what some of the money will be used for. These attorneys work with counselors who then also get paid for trying to help the arrestees. The counselors are the catch to make it fall under anti-violence so the lawyers can get paid. So your arrestees not only talk to a lawyer but a counselor also. And they will get a phone call, that's why this ordinance is dead in the water. Most of this will occur before an officer can start the paperwork. Right now it's in a pilot program at the Jisc.

Just look at that 17 year old from Illinois who went to Kenosha WI to protect businesses from rampaging BLM/Antifa mobs - he had a convicted child molester trying to kill him with a gun (or was the convicted child molester the one smashing his head in with the skate board). Don't we want good young men like this to be able to call a lawyer or family member?

If I recall, up until the ‘90’s arrestees had to use a pay phone in the lockup (change machine broke again). Then again most feral in the lockup were too violent to even sit for a mugshot which was taken before that phone call. Most of the time they just refused and only now 30 years later it becomes an issue worthy of an ordinance ????

But let’s get real here.
Who actually knows anyone’s phone number(s) these days? Land lines? C’mon man.
Anyone that is arrested these days of challenging and difficult times, has a crowd of their ilk or a cousin acting up in close proximity U-Tubing, TixToxing, Instantgraming, AssFaceBooking each other when tusselin’ Boo the active resistor finally gets handcuffed, transported and in many cases has a following going into the District rising a ruckus.

Sounds like bullshit. Having a Pubic Defender in-house, 22 district magistrates, assistant magistrates and a bloated staff...yeah, that’s doable. Just give up CAPS Office space, move in Public Friends of the CookCo, problem solved. Or put pay phones back in the lockup and have the arrestee call collect, that’s called a throwback old school approach.

Oh, phone calls are so 2020. They’ll need a whole new improved virtual zoom-zoom televised system just like the one Larri LightFührer uses to conduct city business for 15 minutes a day, 2-3 times a week on since city hall has been closed since March. CookCo courts uses virtual i bond hearing on this too. Let’s just bypass Dist lockup altogether and send everything to 26th and Cal...or Stop Locking up the Feral.

Hmmmm....can a zoom virtual meeting be streamed while sitting on a booster seat in the back of a black SUV parked at the Village Crossing shopping center in Skokie during working hours?

The problem here is actually that everyone who never knew the late Jon Burge feels entitled to be critical of him, and that includes some of your postings. He was my Lieutenant in the old 012th District 40 years ago, and I was assigned to the lockup some nights when he was the acting W/C. Very few Watch Commanders checked the L/U as much to ascertain that the prisoners had been checked every 15 minutes, got their phone calls, and were fed. We had to log everything, and he would check that too. He was the same way on the street as 1290, and I never saw him sandbag anybody. He received a record number of positive letters to the court upon being convicted, and not just from Police Officers, although I am proud to say I was one the writers. The Federal Judge who sentenced him took note of the outpouring of public support, and stated for the record she did not like to jail someone with so many life accomplishments. I will always respect his memory, and finally...a Merry Christmas to all my sisters and brothers still out there keeping us retirees safe. Thanks for what you are doing, and take care of yourselves at all times.

How about job creation to address the chronic unemployment in her community?

BY JOVE!, This is so important for the City Council to dick around discussing police procedure that has been functioning for years. It is so much more important than the scores of people getting shot and/or killed, carjacked, sexually assaulted, burglarized etc. Hairston reminds me of Congresswoman “Mad” Maxine Waters of California.

And remember these counselors and lawyers are not neutral parties. Anything they can do to "help" the youth and get them out of trouble they will. Advise CR numbers on the arresting Officers. Arrestee's can't just call the public defenders office. A court hearing has to be held with the judge determining that the defendant is indigent, then the PD is assigned the case by a judge. A good defense attorney wants a retainer and papers signed prior to getting involved with representing the arrestee. other wise they would all be in the poor house. They all know how hard it is to collect for the services rendered. A smart attorney wants a preliminary hearing and a bond set. He then prepares papers to have the bond money assigned to him for his services. I don't know how they can even stay in business with the no cash bond system today.

Unless they can reach a family member with some means who will arrange for an attorney's services it ani't gonna happen, and it's not the fault of the police.

I was a detective sergeant at a crime scene where Leslie Hairston showed up and attempted to enter the crime scene. It got a little heated but she never got in. Got my ass chewed out by the commander later that day. One of the best times in the "D"!

Coming to Cook County, magistrate's. Just b.s lawyers working full time for county. 2 for every area, 24/7, 140 K @ year. Total number 40. You get arrested, Misdemeanor or Felony, the new magistrate will set bond within two hours of time of arrest. No ASA, just a short hearing off of an arrest report. Arrestee has option to be present or not.
The jail will be a museum in 5 years. These new officers of the court will give a new meaning to ghost payrollers'. B+Never in old Cook county. P.O.' and dick's job got easier.
People that will say NEVER ! Watch and see by mid January.
Magistrate will carry change for large bills. $55.00 (D) bonds are coming, arrestees post cash of $5.50 to walk.

OK - here is how the order will read, trust me on this: When a subject is placed under arrest and transported to a district station or secure police facility for processing he/she/they will be provided with the opportunity to telephone, either by use of a wireless device or a device that is wired, within 60 minutes of being placed in custody. The arresting officer will inform the subject that he/she/they can telephone an individual of their choice either by use of their personal cellular device, a department provided cellular device, or a department provided "land-line" telephone. The arresting officer will document the notification to the arrestee by recording the verbal exchange via department issued body-worn camera and will insert the date/time of the notification in the narrative portion of the arrest report. If the arrestee is not promptly transported to a secure department facility, such as a hospital or other non-secure facility, the officer will ensure that the location of initial transport is recorded on the arrest report and all other required reports. The arresting officer will ensure that the notification is provided to the arrestee upon his/her/they arrival at a secure department facility within 60 minutes of arrival at the secure department facility and documented as noted above.
Once again, trust me, it's for sure coming.
