A new class action lawsuit alleges Walmart’s use of criminal background checks to vet former employees of a third-party logistics company had a disparate impact on Black workers.
Plaintiffs Mark Balentine and Laseant Sardin, who are Black and have criminal records, say they worked for years at a Walmart distribution center in Elwood, Illinois, through a contract with Schneider Logistics.
In 2019, Walmart ended its contract with Schneider and took over the distribution center, offering jobs to the Schneider employees who reapplied.
Balentine and Sardin were initially offered positions with Walmart, but those offers were revoked after the company conducted criminal background checks, the Walmart discrimination lawsuit states.
The plaintiffs say they were not hired because of their criminal records, even though they had been successfully performing the same jobs for years.
Well, it seems obvious that Walmart has different standards for their employees. Walmart has an obligation to it's shareholders to increase the value of the company and one of the ways they do that is eliminating a possible danger to the bottom line. They're not obligated to employ persons who have proven themselves untrustworthy in the past.
Before you know it people will expect the government to force religious bakers to make to conduct business with persons who the bakers think act immorally.

Everything seems to negatively impact a certain community, in this case African Americans, because they failed to have a moral compass, failed to follow state, and/or local ordinances.
If they did the crime and did their time and hence went straight, then they deserve a second chance to be productive members of society. If on the other hand they have continual open or closed arrests for criminal conduct, always stepping outside the bounds of civil constraints, then they don’t deserve the chance that they seem to think is owed to them.
Fuck ‘em!
Walmart is in the business of operating a safe, profitable company, ensuring its products are not damaged or be absconded from the premises. Walmart’s prime directive is not social engineering.
You will complain if they go to the streets to do criminal things. They should be able to work and have an opportunity to change their lives around.
Trump needs to eliminate disparate impact theory from the courts. You can prove anything under it because it eliminates underlying causes.

Companies can maintain policies not to hire individuals with criminal records, provided the policy is applied consistently and does not disproportionately impact protected groups, such as racial minorities, which might violate anti-discrimination laws. The claim the individuals make that were they were employed by the prior company and performed ok is nice but beside the point. Why does this confuse some people?

Lawyer play both sides of the issue. If people or folks with verified criminal convictions are not hired, lawyers fabricate discrimination and cite some sort of Title of the Civil Rights law. Throw in E.E.O.C. lawyers stirring the pot to keep all them scummy lawyers in business. If a company allows someone with a criminal history to be employed and an act of violence occurs, lawyers step in and question the deep pocket company's hiring and vetting practices. Either scenario gets litigated and the law profession cashes in with common sense law.
If the case goes to trial the respondent's attorney should ask if these people ever participated in a looting.
I believe WalMart requires their employees to be bonded and the bonding company won’t insure people who have criminal records. These guys just need to get jobs where they don’t have to be bonded. WalMart should win this lawsuit so I hope they don’t cave and settle.
Walmart has the right to screen employees.
That being said if these two had been decent employees perhaps Walmart should have cut them a break.

Also, they're both currently/formerly involved with a group called Warehouse Workers for Justice. The organization conducts protests, strikes, petitions, and lawsuits to organize warehouse employees.
This guy reported his car “stolen” 33 fuckin times just to avoid paying parking tickets! Did it seriously taken that many times before someone caught on to what he was doing?! I remember him from traffic court. Kind of ironic how the one thing he loved doing (writing tickets) is what brought him down….
100% correct. The lawsuit is NOT based on the felony convictions. Or even Walmarts hiring policy. It’s based on the DESPERATE IMPACT. I’m not certain Walmart could prevail in their home state, Arkansas. They sure as fuck can’t win in Illinois.

CPD has hired persons that have been convicted of manslaughter and later on in their career have been sent t prison by the feds for crimes.
Because laws, standards, and policies are inherently racist to them, no matter how they are applied.
Nope, you can't cut them a break. Because some dipshit will find out about 'the break' that someone else got which they didn't, and then they'll sue. So no breaks for anyone.
