A federal judge has refused to dismiss a whistleblower lawsuit filed by a former Markham police officer who claims she was fired after reporting that the city’s police chief ordered her to release a convicted murderer she arrested after allegedly finding a loaded handgun in his car during a traffic stop.
The ruling allows former Markham patrol officer Kayla Heller to continue pursuing claims that Police Chief Jack Genius and the City of Markham retaliated against her after she reported the incident to the Cook County State’s Attorney’s Office and the Illinois State Police.
The lawsuit stems from an incident first reported by CWB Chicago in December 2025, when we revealed that Heller had been fired shortly after we asked Genius why he ordered her to release convicted felon and current U.S. Senate candidate Tyrone Muhammad without charges.
In a 14-page order issued Tuesday, U.S. District Judge Franklin Valderrama denied the defendants’ request to throw out the lawsuit, finding that Heller had presented enough of a case for her claims to move forward to discovery.
You think CPD is political, these small towns are thousands of times worse. We would hope she scores a few million dollars, but it's Markham, which is always teetering on the brink of insolvency anyway.
But she could get damages against Genius since he's obviously acting outside of his governmental authority here. Maybe he has a nice house.

As someone who worked for a couple of suburban Depts before CPD this statement is 100 percent true. Ive seen it where the chief hates someone and makes their life miserable. At least with CPD you have multiple districts to bid to.

I have a somewhat similar story. I was brand new to CPD and still on my PPO status. There was a shooting and the offender was caught with a firearm and of course he had a lengthy record. The offender was being processed. The officer's call the gun desk and they find out that the gun belongs to an officer in that same district! The offender's girlfriend came to the district and talked to the desk sergeant privately.
She then went to the watch commander's office. They gave the gun back to her. This was my introduction to how corrupt the CPD is.
I hope she wins and frikin markham has to pay out the nose!!!
Naw, Genius doesn't have a nice house, typical Markham dump. You should Google him. Quite a storied history, including several firings as a P/O, Chief, etc. Markham, Harvey's little sister.
You would think a police chief would want the scumbag out of his area. He should have visited him in jail and told him to be out of town by sundown. The guy is an obvious criminal, just like the one the feds busted dealing the other day after he was let off 3 times by the Illinois "justice" system.
There has to be something in that shithole worth something. Well, maybe not.
I find this hard to believe. If the gun desk was notified that means an inventory number was generated for the gun. So what happened to the inventory and the gun desk notification. Was the CCSAO contacted for felony charges? None of this makes sense.
Markham has always been a train wreck.

ALL Police Agencies within Cook County are corrupt to one extent or another, and to a certain extent all in collusion together.
Happened here a long, long time ago. Park District Chief Ed Kelly-a distant cousin-had a bust out kid. One day up in 024 the kid is sitting in a restaurant and a handgun is spotted in his waistband. The police are called and Kelly’s kid is locked-up for the then misdemeanor charge of UUW. In short order the “phone calls” are being made and then Capt. Walsh releases him over the vehement protestations of the field lieutenant Crosset Hamilton. Hamilton could be sort of a rabble rouser at times and starts beating the drums over Kelly’s release. Lt. Hamilton, a north sider gets dumped to 006, or was it 004, and goes the media. The story breaks and it’s just another embarrassment for CPD.
How about changing the chief with obstruction?

So what happened when the offender goes to trial and the state cant produce the weapon…so the offender is in jail but they gave a potential attempt murder weapon back to him via his girlfriend….how do you explain no weapon to the states attorney….

Yep. I also started in the burbs before CPD. Department of 50-ish. Your done if any single person in your chain of command dislikes you. They will make your life miserable. Here at CPD I have yet to see any PO’s being f- with for being disliked. They’re just ignored, at most. Change districts and it’s a fresh slate. In the burbs it’s fake smiles, always “yes sir”, and you’ll toe the line like a junior officer in the military pleasing his superiors, union or not.

The Rev. Michael Pfleger has been removed from his ministry at St. Sabina Church as the Archdiocese of Chicago investigates a claim of child sexual abuse from more than 30 years ago.
It’s the fifth decades-old accusation against the South Side priest in four years. Pfleger was cleared of the other accusations.
And Lt. Crosset Hamilton’s kid was the head of the Popes street gang and was a killer and Crosset was always going to bat for him. Crosset had no business being offended by this move.
Kayla is good people from a good family. Her dad was a suburban firefighter (RIP Fred) and mom a CFD paramedic. They were/are a great Mt Greenwood Family. I would take Kayla over the the Markham Chief 100 times out of a 100.

That officer was nothing but professional during that stop. Any department would be glad to have her.
Hopefully, this PPO's lawsuit gets Genius shown the door.
