Judge v Prosecutor

  • A longtime Cook County judge and a top prosecutor repeatedly shouted at each other Monday at a tense hearing over whether a pregnant woman should have been jailed without bail for more than a month this summer.

    "I have every right to hold her," said Judge Nicholas Ford, a former prosecutor known for imposing tough sentences.

    "You do not!" countered First Assistant State's Attorney Eric Sussman, his voice raised.

    At times, the argument grew so heated that the two talked over each other, making their comments nearly unintelligible, as Karen Padilla stood nearby with her 3-week-old daughter strapped on her chest in a carrier.
We going to have to side with the judge on this one. If you miss multiple court dates, the judge has an actual duty to make sure you don't miss another one. And if that means custody, then you kind of have to stick around. There aren't any "time outs" because you're pregnant or anything. There's a perfectly good hospital on the grounds of Cook County Jail, and if that doesn't meet an individual's exacting standards, one solution is to stop being a criminal and missing court dates.

Sussman is a political animal trying to keep his position by carrying out the orders of his elected boss, which is pretty much "Release everyone!" and we don't really agree with that.

I would be surprised by Eric Sussman's actions if it weren't for the fact it took place in a Cook County court building. Anyone who has been on the job long enough knows these judges lost control of their courts along time ago. There was a time when Eric would be sitting at home saying well it was a nice job while it lasted. Now, he's walking around like a pimp who just bitch slapped his girl in public and showed everyone who's boss.

You win Preckwinkle, I refuse to employ any Cook County employee. But don't worry Rahm, I still answer all my calls and insist on everyone getting paper. Like it was said before Foxxx. You'll have the highest murder / Agg. Bat. statistics but on the bright side you'll also have the lowest conviction or incarceration rate.

Now I'm off to Dupage County for gas, smokes and a case of coke.

Here is why I disagree. And again, this is a open debate. I can see if everyone and every judge followed the same rules, but this is America, this is Cook County and it clearly does not happen. When I read about violent felons getting electronic monitoring despite being caught with illegal weapons, when I read about DUI offenders getting probation, clearly there is room for sympathy. Garnish her wages when she works or if on any social program do that as well. If people were simply arrested for everything on the books that is against the law, the jail would be full.

Citizen reader: Contempt of court, he should have been locked up for a couple of days and a disciplinary complaint filed with the S/A office. But of course that would mean nothing because of the lack of discipline in that office. Shouting at the Judge. Evans should have that Judge in conference for allowing the Court to have been disrupted in the manner SCC reports. Can you imagine what would have happened to me or one of you cops had we behaved like that? Why does this attorney get special treatment? I know, its a Crook County Court. Say no more.

Sussman is dismantling the States Attorneys Office. It's the master plan of Foxx and Preckwinkle. Many of the good prosecutors have quit, retired or will be leaving. Foxx is destroying the culture of the Office. Sussman is a rat. He hates the police. When he was an Ausa he was hated by his colleagues. Things are going to get worse.

The prosecutor argued that it was barbaric locking this woman up and forcing her to have her baby while in jail. I'm sure that when she went into labor, there were attempts being made to either get her to the hospital in the jail or take her to an actual hospital. But nature goes by her own rules and waits for no mere mortals, so the baby was born in a jail cell.

And speaking of baby, why hasn't anyone mentioned the fact that she wasn't pregnant at the time of the initial arrest? The warrant for her missed court date was issued in Feb 2016 and she gave birth in late July or early Aug of 2017.

With Eric Sussman as First Assistant, he has gone around preaching to the ASAs that this office is too focused on victims of crime that that we should worry about the defendants too because they are also "the People". He is no prosecutor - like his boss Kim Foxx, and her boss Toni Preckwinkle - he is a wolf in sheeps clothing. Their mission is to wear a name tag that says "State's Attorney" while really acting as a public defender. How many times have we seen Kim Foxx stand up and shout out for the victims of crime? ZERO. The only time you hear her speak is when she is announcing some new initiative designed to benefit the criminal defendant. They are seeking to permanently alter the system so that it can never again be used to deliver justice to the criminals of Chicago. They also know that their time could be limited. Given big boss Preckwinkle's big mistake of stepping in it with the soda tax, she is now politically vulnerable and may not be around for much longer. If the the Kim Foxx/Eric Sussman saboteurs of the justice system want to permanently hobble the system so that it will be incapable of holding criminals accountable for their vicious bad acts, they had better act fast before the public really catches on. The exodus from the State's Attorney's Office is at rates that have never been seen before. It's sad and only serves to destabilize and, ultimately destroy, this city and county (even more than it already has been decimated).

I don't comment much on the blog , but I know this Judge . Judge ford is a friend to the police ! Ask any working policeman , past or present . For all the people who question his stance , ask yourself this .... if you, a policeman or woman were in the same position as the offender , do you think you would be getting any favors ? Do you think in this day and climate you would get consideration ? Prosecutors and lawyers trying to make a name for themselves , or even a judge trying to " show " they don't look the other way . In this case with only knowing a brief scenario of the case , we can't sit here and judge . All I can say is if you follow the rules and not break the law , you don't end up in court or jail . Also if you follow the rules once the legal process starts and your crime is shop lifting or driving offenses , you usually don't end up in jail . People feel that they only need to follow the rules when it suits them. Sorry for the short rant , but enough is enough everyone needs to take responsibility for their own actions ! This woman not showing up for court time after time was her CHOICE !

Stay safe everyone and no matter what WATCH each other's backs , we are all we have out there !

I would call that a good start on the right track to a new beginning for the city, county, and state. If you want something more to bitch about, see how many middle class prisoners don't get bond on lesser offenses.
Myself I say screw them all, stop breaking the laws and you wont risk incarceration. Hey now isn't that a novel idea. The fact that a few years ago the prisons were full and overcrowded just proved one thing, there are too many bad people and we need more prisons. Not this bizarre democrat world we are being forced to live in because????? Oh that's right we need to punish the tax paying public for expecting to be equally protected under the law. We also need to teach the cops a lesson on how they should be tolerant and gentle with these multiple offender P.O.S.'s who plague the city, county, and state.

"Indeed I do, Counselor. Now SIT DOWN AND SHUT UP or I'll hold you in Contempt. This is MY courtroom, not yours, and I and I alone rule on Matters of Law in my Courtroom. If you don't agree, you're free to appeal. Moreover, you're to represent The People, not the Defendant, so do your job or I'll report you to the ARDC."

If he kept flapping his lips, he'd be in a cell for the next few months.

She was arrested while driving a car, in violation of the judges probation order. She had previously been arrested for no drivers license. So does the judge just ignore his probation order and does she just continue to drive. There used to be laws in Cook County and to get probation you had to abide by the rules set forth in your probation. Now you have to just ignore them, don't report to the probation officer and when you get arrested, no need for a lawyer or a public defender. You have the ASA defending you

Judge Ford is one of a few still left (could be the last) at 26th that impressed a me when he was as an ASA and I was new on the job back in the 80's.

ASA's are the latest of political pawns.
Don't do the crime if you can't do the time is all that is being suggested when they get their first court appearance (per offense) and SOL.
But folks don't listen, they don't have to when they have Prosecutors defending them.
I don't think the Public Defender even expected that.

What do we have left of respect in this world if a prosecutor is yelling at a judge?

Here's a news flash genius, she didn't show up for court. She violated probation. She continues to drive even on camera. She knew she had a warrant but wouldn't turn herself in and take care of it at a time that wouldn't have put her in the clink when she was close to childbirth.

I don't think the gun offenders should get EM, but I can assure you judge ford is not giving it to them. However the idiot with the gun is more likely to kill some other scumbag than you. The bitch who continues to drive, refuse to accept consequences and flaunt her disobedience on camera is much more likely to PLOW INTO YOU OR YOUR LOVED ONES because she has liberals like you that think as long as her BS doesn't affect you everything is ok.

PS, filling the jail and then not enforcing the law does not reduce crime. There is plenty of room at 26th Street for criminals. They shut down buildings to cut costs. The jail is not full of retail theft offenders and weed smokers. That is a myth, a lie. The liberal judges give these clowns EM because they are never held accountable for their judgements. Oh, and those costs that they saved, you are paying them when burglars break into your car and house and garage and you have to pay your deductible. You get your insurance raised. You pay more at the store to make up for retail theft. It doesn't come from a magic money tree somewhere. The corporations and insurance companies don't absorb the loss. We pay it.

Damn, if I ever appear in court I'm going to ask the Cook County State's Attorney to assign me a prosecutor as my counsel.

I've never heard of a prosecutor zealously defending a defendant in court. I guess the times are changing.

Nicolas Ford was the Judge in my Traffic court key Waaayyyy back...He was always fair to the police, and smiled when he said hello to you. He was fair in contested cases and sided with the officers. He was a very gentle judge and must have been really pissed to have to yell like that. I am on his side 100 percent.

Remember his name and know that he is one of the good ones.

Interesting and scary posts. If everyone were to be arrested for every law in the book, the jail is packed solid. I do not recall seeing these same comments about a feral mongrel dog and forced operations on the white doctor who after a Xmas party had a felony DUI and got probation, or Daley's nephew killing someone, his friends and family lying, files lost, millions spent on a special investigation, then a unique escort to jail. Nothing like that. This is what the fights are for all over the country. Equality, not selective prosecution. Looks like that day will never come. I can see if she was violent or causing mayhem. Just pay a fine and go home. WTF man.

What does it say when the #2 Prosecutor in the Cook County State's Attorneys office goes to court and argues for the release of a defendant and begins yelling over a sitting judge, all for a defendant who:

1. stole cash from her employer

2. received "second chance" probation, whatever the hell that mumbo jumbo shit it.

3. did NOTHING to satisfy her conditions of probation for over 500 days didnt show up for court and continued driving on a suspended license (a crime which this office chooses to ignore, public safety be dammed, safety of the taxpayer be damned)

IF YOU ARE ON PROBATION YOU DO NOT HAVE TO DO SHIT, YOU DONT HAVE TO PAY, THE WHOLE THING IS A BIG JOKE as long as you have old boy Sussman in your corner with the media on speed dial.

Agree with you 1000% I did not give out my cell phone number to the states attorneys office I always gave them the number to the area, in fact I got into a argument with an ASA who was pissed that I didn't give him my cell phone number and I told him to go fuck himself, needless to say I didn't get anymore notifications for that case ( like I really cared anyway).

Just so you guys know, they keep a database with officers contact numbers and it is shared within the states attorneys office (and possibly outside of their office)

This is the "new new". It would be nice if the people of Cook County woke up and realized what they did by elected Kim Foxx and her crew. They are all public defender/Loevy & Loevy types. As a matter of fact, some of them, Katie Hill for example, most recently worked at Loevy and Loevy before Foxx brought them into the CCSAO. Their only mission is to completely decimate the CCSAO and the criminal justice system's ability to hold guilty people accountable for bad acts.

I wonder how that would turn out if someone went in and started yelling and disregarding her lawful orders or decision. Well I guess in Cook County it doesn't matter, everybody does whatever they want, laws be damned. Look at the examples set by Mayor Emanuel, President Preckwinkle, States Attorney Foxx, Sheriff Dartt, and Superintendent Johnson, pick and choose which local, state, federal laws they want to enforce and those they don't like, just make up new ones. What did you think was going to happen? They will all be reelected and others reappointed, it's the Chicago way!

Let's not get carried away about the ASA's I agree things have drastically changed, but a year or so ago my son was a victim of a serious crime. We went to trial and the two prosecutors were top notch. They went out of their way and were very accommodating to make the best of a terrible situation They were verylpful as was a woman from their victim assistance program. As far as the cell number, we exchanged cell phone numbers which worked out well. Instead of me waiting until they finished their call, I could call their cell and they returned the call shortly. Them having my cell worked out as on several occasions as you all know the trial was continued at the last minute. Once they called in the evening about the continuance and once in the morning prior to us leaving for 26th and Cal saving us trips to court.
I can't say enough about how we were treated and hopefully there are still of those ASA's around. I would mention their names or initials but I don't believe it would be in their best interest or e

We were checking dates for a continuance once and a friend of mine told the state, when asked for her cell phone, she didn't have one. The room was full of people on the same case and one of the things she is known for is being on the phone.Not sure if she forgot that she just was texting in his face or not but we were rolling. State got the point however and didn't challenge her.

It's progressively more and more shocking to see how little the law actually means in Crook County. I guess I'm naive, but I used to believe things like, "violating probation is a crime" and, "if you skip court, you'll catch a warrant and get locked up." Obviously stealing isn't a crime in Cook any more and a driver's license is a suggestion and not a requirement.

I wonder how much she would have had to have done for the prosecution to try to jail her. GTA? Agg bat? Probably not, and who knows, maybe not even for murder. Paying taxes in Cook County literally subsidizes criminality. Foxx should be in jail for what's she's doing, it's obscene.
