Wow - We Must Be Psychic

Or psychotic. It is frightening to think we might be channeling Fran and Frank, but when we posted the previous thread, we had no idea our two favorite reporters were going to have an article in today's sun-times covering the same subject. We published at 2330 or so and post dated it to be today's opening item.

Anyway, the article quotes the FOP website as saying their lawyers have advised against legal action at this time, but will instead be "addressing the agencies responsible for ensuring the proper enabling procedures." We're not sure if this means the State or the State police or local jurisdictions or what, but the issue itself seems to be generating a lot of interest. It's obviously an anti-gun stance by the mayor who is accustomed to running his fief without federal interference, but we're thinking that is going to change shortly.

After the City of Chicago sends out all those letters to retired coppers warning them not to carry a weapon.. I would like to send out a letter to all of them . . .

I am retired.
I never intended to "register or announce" my right to carry a weapon to the city after retirement.

My retired friends are of the same opinion. We have a right to defend
life. We aren't stupid, it only took 30 years of abuse to understand we are survivors in a political bin of ineptitude. When the time comes to defend we shall.

It's the same right that the gang bangers get when they shoot at another gangbanger in "Self Defense" and walk every day in this city.

Why move? Why run? The federal Govt. has enacted a law that allow retired Police Officers to carry weapons. The City of Chicago ala Daley has purposely put up obstacles and barriers in order to circumvent a right given to these citizensto bear arms........SOOOOOO
what should happen now is what LIBERALS do?
All federal funding to the City of Chicago, should be suspended until the City come into compliances...Remember in the past when certain city entities fail short of compliances to Federal Laws/mandates....also lets make THE ACLU work for us....a particular defined group of people are being deny a right given to them by Federal law it might be a leap of fate, but it seems discriminatory at the very least. especially when other municipalities and States have complied and without these made up Daley type concerns....Could you just imagine THE ACLU representing the rights of Retired Cops from chicago Makes You Want To Holler!!!!!

This sounds like its in need of a test case. We need a retiree to volunteer to be arrested for carrying, and a police officer and supervisor willing to arrent a willing volunteer.

Bring the media along for the show, and let the city say that someone is carrying in violation of city law, when federal law supercedes city law and specifies that the city will permit retirees under specified conditions. When it goes to court, let the city try and make a case that a retiree's rights are not protected under Federal law. Get the best, sanest, most clean-cut retiree we can to do this as a test case.

And for all of this, bring an emergency motion in Federal court to restrain the city from enforcing the gun ordinance against retirees until they bring themselves in compliance with federal law.

If y'all want, I'll contact the NRA. I'm out here in Virginia where they are based, and I can almost guarantee they will take an interest in this.

I am so glad I spent the last 22 years working for this fucked up ass city. Now I can retire with an under funded pension, no medical insurace and dont have the right to defend myself and my family against the shit heads the City insisted I take off the streets.

The Mayor and his Lawyers have decided they know better the the Federal Gov. and the Congress regarding this issue.

I was told the The Mayor and his Lawyers are drafting an New Ord. that would require you to turn in your weapons or provide proof the you have legaly sold your weapons through a lic. gun dealer to someone out side the city within 30 days of the day you retire. You will not be able to collect your pension until these requirements are completed.

The Mayor has also said the City and CC States Attorney will fully prosecute any and all retired Officers who do not comply and are caught with thier weapons. This may include search warrants on retired officers homes.

I agree, unless its done to set up a voluntary test case. If someone volunteers to be arrested for concealed carry as a retiree, PLEASE DO NOT JUDGE OR RETALIATE IN ANY WAY AGAINST the arresting officer or supervisor.

I would expect this to play out as a retiree walking into his old station and turning himself in with the media in tow. This will be resolved and the the nation (and the rest of Illinois) will call for Daley's head even more if allow it to play out.

If it happens involuntarily though, I'd join the lynch mob. I'm just saying, if the "test" case presents himself to you, please play along and carry out the arrest.

Though I would beg you not to cuff or otherwise restrain a retiree during processing for a televised circus event like this.

I'm fairly confident we will be seeing this soon, now that its garnering attention. Anyone contact the NRA yet?

Sorry to burst your bubble, but the ACLU believes in the Bill of Rights and defends them zealously.....except the 2nd one. When was the last time the ACLU fought a 2nd amendment fight? Never, that's when.

H.B. 218 is an entitlement, not a right, so ACLU won't back us. The NRA or LEAA may, but they may wish to add a reciprocity to their efforts for the 35 states that have concealed carry.

To keep this a law enforcement issue, we need to call our legislatures and state senators. I'd say call your congressman, but they mostly voted against the bill in the first place.

It's OK to ignore the law and not arrest a retired copper. I don't know any who would. Even the biggest dog would leave a retired copper alone (is that cuz they have empathy or because they're to lazy? Another day for that question)

Carrying is one thing, but if a retiree needs to USE his weapon, then we get into the shit. Now it's out in the open and discretion is no longer an option.

The King needs to stop this bullshit and have respect for the retirees. Draft a policy of what constitutes "good standing" and get it moving. Then certify the retirees. Don't be a shithead Mr. Mayor. Police did their duty now do yours.

It wouldn't shock me that Daley would want to mandate the surrender of firearms by coppers. Remember, according to city ordinance, the mayor has the right to refuse to register any firearm.

If he wanted to, he could refuse to re-register any coppers gun and require them to be moved out of the city or surrendered. NYC did this with "assault weapons" years ago. They used the gun registration roles to confiscate previously legal weapons. Would Daley do it here? I wouldn't put it past him.

On the + side though, he couldn't stop your pension without a change in the state pension laws. Regardless of any city ordinance, state law trumps any bullshit he may try.

Would this also mean the mayor will give up his armed bodyguards? How about if he retires, will he have a squad of coppers following him around, or parked outside his house?

I just read my copy of the form that we retirees mailed to the Personnel Division. Check this out.

Daley and Mecklenburg substituted "PSYCHOLOGICALLY UNFIT FOR DUTY" instead of "MENTAL INSTABILITY" as the law actually reads.

While it doesn't affect me, this proves that we are dealing with rattlesnakes who are trying to twist Federal law.

I don't know much about this law except what I have read here but since it is a federal law and you have retired in good standing with the CPD couldn't you go to some Suburban Depts range and qualify. I'm sure some suburb could make some money by charging a nominal fee and we get to qualify. Just cut Daley out of the process. Once you qualify I don't know how you could be stopped from carrying off duty. Just a thought.

ticket slow downs don't work the only job action that got anykind of notice was a ticket blitz. In 1972 no one got a pass except po's and their families. Every moving violation was cited, no wink winks for business illegal parking. Robert Dowlut is the General Counsel for the NRA. He's seen this blog and they are looking at ways to deal with this right now.

Taking a pinch is a really bad idea. The same thing can be resolved in a civil court throgh a declatory judgement action without handcuff, bail and of course a criminal record.

The criminal record should be non-existent after the Federal judge gets involved.

But for a good conservative retired Republican there is one excellent benefit. You will be creating a statewide and national uproar, and it will fall squarely on the head of Mayor McKickback.

Outside of Chicago and Cook County, this state and this nation (as a whole) are pro-permitted-concealed-carry for everyone, so you better believe even the temporary arrest of a retired copper for carrying concealed, as allowed under Federal law, will be used to great effect against the Dumbocrats.

We need a candidate, PO or not, who cares about this city and not just his friends, his race, his pocketbook, or his potential for future votes.

If Harold was alive today, I'd give him 110%. He was the last mayor who actually cared about this city and its people as a whole. Not saying in any way he was perfect, but I just want to see as a starting point that someone running actually cares.

Did someone mention decertifying the FOP? A few of us made the very same move a few years ago only to have our asses handed to us. Think that decerting is a good idea? Wait for the midnight phone calls threatening your spouse and kids then tell me how you feel. Most of us at one point or another have been given time for each and every perceived miscue since. I currently have over 20 days suspension since that fiasco. One of us is even 30 pending at this point. It's funny how many times you can be "randomly" piss tested in a one month span. Here's another clue for you, no other bargaining representative is going to give you their full cooperation in decerting the FOP. It's all a matter of politics as to why you won't get money or people to help in the decert process. The Mayor doesn't want it. Call Sean Smoot at the PBPA and tell him what you want to do. He'll give you a few petition sheets and some pins but thats the extent of it.

We lost control of this union when "Moneybags" Bill Nolan sold us out to King Richie. It will NEVER be about what we want, but only what the 5th floor wants.

Been there, done that, got the PBPA pin and threw it out.

Public Act 79-652 requires any peace officer in Illinois to complete mandatory firearms training. This includes alderman.

Think the State's Attorney would approve UUW charges against an alderman who didn't have that training while carrying a gun? Naaaaa

The city is just stalling on H.R. 218. Daley is using the "in good standing" and "mental instability" drivel to put implementation of federal law on the back burner for as long as we let him get away with it.

As a retired PO, give me a form, subject to legal review, and I'll indemnify the city for any potential liability.

Through FOP, the NRA, federal agencies, et al, we've got to ride herd on these devious and perpetual procrastinators. They are shameless and incorrigible.

Certainly, the FOP National Lodge can light a fire under their arrogant asses.

Join the NRA. Get a friend to join the NRA. They have the legal assets and funds to straighten out outlaws like Daley. NRA has done wonders in San Fran., NYC and WI where there is now a concealed carry law for civilians.

Life Member of NRA since 1986.....member since 1982.

Won't always be a copper, but will always be a gun owner. NRA is the only organizatin that looks out for the rights of gun owners. Don't buy into the claptrap bullshit from Brady & Company.
