Small Problem Becomes BIG Problem

Quite a few people we know have gotten tickets they don't deserve. Even we've gotten one or two. We're we wrong? Sure, some of the time. Were the ticket writers wrong? Sure, some of the time. Everyone is wrong sometimes. Sometimes you get away with it, sometimes not. And when you get caught, you try to reason with the ticket writer or you suck it up and pay the fine. If you're a real glutton for punishment, you go through the appeals process which is so stacked against you, it almost makes sense to pay the fine.

We weren't at the scene. We didn't read any of the reports. As far as we can tell, we don't know any of the players. All we have to go on are this blog (which isn't always the most accurate source of information) and the media (which are always going to portray police in a bad light). You see our dilemma?

If the Officer was using his personal car to respond to some call for service, then the traffic aide is completely in the wrong and ought to have non-suited the ticket. We know there are cops that work Loop Traffic and use their own cars to get to their posts just like there are foot and school officers who take personal cars to their posts. We've always wondered what happens if you wreck your own car or have it damaged by offenders (or have it ticketed) when you aren't using a city owned vehicle. Is the city covering it?

If the Officer wasn't using it for a call for service, but rather shopping or whatever, than he is wrong. If they can't reason with the aide or a supervisor (police or traffic aide), go through the appeals or pay the fine. Arresting someone seems a bit extreme. You want to get revenge? Turnabout. See all those cars with the M&M wrapper in the front window parked illegally around the Loop? Hmm.

Just our opinion. We're willing to listen to other options if you've got them.

Well there can be a major problem with using your own personal car while on duty, someone should look up the rule(s) for this. That nonsense on the Northside was totally unnecessary...No one wanted to give an inch, everybody was right, everybody thought they were enpowered to do what they did.

Meter maids use those little computers to write tickets, right? So they are unable to non-suit them?

But TMA's use books like ours. Parkers are by far the easiest paper to "make a mistake" on and thereby invalidate them.

Do the TMA's really want to start this type of animosity?

The latest development is that Ms. Fegan (the TMA supervisor arrested by the officer who received the citation) has retained Craig Tobin (attorney at law) and appears to be on her way to filing a lawsuit. The defendants/respondents have not been identified. I'm surprised and astounded that a police officer (with approximately 25 years experience)is not aware of the department's policy regarding traffic (personal issue & parking) citations: Only an exempt member or commanding officer can approve the non-suit request. (But then I know some cops with 30 years on the job who don't know the difference between a "commander" and a "commanding officer" (the latter is not exempt rank.)) They just know he's the boss! The officer who received the citation could have prepared a request for non-suit of citation form and taken it and the ticket to his commander for non-suit. But we all know why he didn't do that: Because his commander would have told him to pay it (which he should have done in the first place)!! Instead the officer decided to stick the ticket in the face of the TMA supervisor who correctly told the officer, "I don't have the authority to non-suit a ticket." The officer will pay for that ticket: So much more than he expected!!

The General Order on Handling Prisoners in Need of Medical Treatment requires same sex guards so the female officers were correct. On the other hand, they should have gone to the hospital and relieved you in a timely manner and then requested to be relieved.

According to orders, the desk is supposed to watch a juvenile until the Youth Officer arrives...3 hours later (because they have too much work). Do they? NO.

After writing a TVB, the desk is supposed to take control of the person. The PO is not supposed to have to sit there and wait until the TVB is written. Does that happen? NO.

And on and on.

We all know that those female "officers" did not have a grand desire to follow General Orders...they were looking for a way out of an undesirable situation at the expense of other officers.

That's my two cents. Now quit quoting the seldom followed General Orders.

The TMA who is 5'02" 140 lbs, joined Traffic Mgmt. 3 mth's ago and is a supervisor, like what overnight and has been with city in another yet unknown prior capacity is screaming: Kidnap, Agg Batt and cruel and brutal detainment chrg's. along with sprained wrist. www.suntimes.com this is a must read. Copper's name given and she alleged their were 4 other officer's. Seems Ms Fegen has had prior issue's with police, article does not lay what they were.

If I remember correctly, and of course I may be wrong. If you are assigned to a foot post you are not entitled to a Dept car. Furthermore I believe you are not supposed to take your personal car and if you do the dept will not cover your car. You are supposed to use public transportation because we ride for free.

The column in yesterday's Tribune was John Kass at his very best. Read "Quiet guys lifts the lid off hiring machine" (of da mare).

The federal witness, Jack ("the Quiet Guy") Drumgould and his description of Daley's "Office of Governmental Affairs" (aka PATRONAGE), Robert Sorich, et al could just as easily apply to the CPD's "selection process" for exempts and other "merit" promotees.

I loved the part where the City Council keeps coming up with preposterous proposals about the evils of foie gras, barking dogs and street signs honoring cop killers while they ignore billions of taxpayer dollars going out the back door of City Hall on truck hiring, asphalt and Daley's pet projects.

Meanwhile, the electorate is either clueless or terminally apathetic. Just as long as the garbage is picked up and the winter streets are shoveled, your typical Chicago voter would elect Satan himself.

Kudos to Mr. Kass.

You missed the point of Drumgoulds testimony if you think it would only apply to merit and exempt picks on this department. His point is that no one gets hired or promoted without clout. Get it, 'no one'. Not just some and not others, but nobody.
So if you were to put it in context with the rest of the city except for enty level police officers (they need to hire about 500 a year and they can't have a felony record) about everything else this city does it illegitmate.

How many times did you hear "I'm not writing parkers so Daley can put in more flower pots..wraught iron...ect" Go ahead, turn in your ticket books Daley can hire 2 TMA's for the price of one copper. And get them to write tickets to pay their own salary. Whats next "I don't do movers" okay then they will buy more photo vans (and man them with civilians) I don't want to move bodies...okay we'll give a contract to a civilian company. Its called the privatization of the chicago police department and we only have ourselves to blame. All of this means LESS COPPERS. We used to be at 13,500 where are we now??? The problem is that coppers know that the city will not lay off coppers but what they are not seeing is that they are not replacing coppers either. Remember its coppers who respond to your 10-1 not civilians. If you don't do the work the city will replace you with a civilian hack who will.

I ran the numbers the other day. You can too in CLEAR! Use the pay codes for CAPT., LT., Sgt., Det. and P.O. you will see that we still have about 13,00 on the payroll. This 9000 nuber people are coming up with is bull. Now all we need to do is get all these personell out of "spots" and other hiding places and on the street.

The 10,000 number is not "bull".

Run just the code for Patrolman, 9161, and you will see that the number is no where near 13,500.

If you add the detectives, special unit officers, Sgts, Lt's, etc. then you may come up close to 13,000 +.

The point is that we used to have more Patrolmen on the job than we have now and we are still expected to do the same amount of work with less people.

Last week I was downtown, paid six bucks to park for two hours.

Put the little ticket in the window of my car.

Expired at 1:59 p.m.

At 1:55 p.m. I was at the machine attempting to pay for another thirty minutes.

Machine closest to my car would not print tickets.

Went to the next closest.

Paid for an hour.

Got back to my car at 2:01 p.m.

Guess what was on my windshield.

A ticket written at 2:00 p.m.

Ont the ticket was a note "Payment expired at 1:59 p.m."

I saw three tma standing in front of the Corner Bakery.

Went up to them and asked which one was Williams?

"Lady" replied that it was her.

I told her that she pulled a cheap shot writing a ticket the second payment expired.

I said with the machines scattered every block, they should give people a five minute grace period.

She said "It's a legal ticket, I did not break the law".

I said "Yes it's legal, but it is cheap".

Then I said that in over 20 years I have never done something so cheap to a citizen (O.K. maybe I did a long time ago).

She said "Why don't you have stickers on your car"?

I stated "I pay for parking, I am not looking for a favor, just don't be cheap".

She then again replied that it is a legal ticket.

I said have a nice day, and walked away dizzy.



Bout a week later in front of Corner Bakery I saw a car, with TMA vest on dash board parked in a tow zone.

Called 311.

Got the event number.

Bout twenty minutes later there was a banana on it (For those of you old enough to remember).

So price of parking:

$6.00

Cost of ticket:

$50.00

Pleasure of seeing three TMAs sitting in restaurant, knowing that there was a ticket on their car outside that I was responsible for:

Priceless.



If you see a TMA car illegally parked.

Call it in.

I wasn't there but my gut reaction, and my money, would be that the TMA over-reacted and escalated the entire incident. It would be in line with their character and temperament.
Overall I think the TMA program is a waste of money. It is the WIC program for the 21st century.

Rue, while I agree that she likely bore a lot of responsibility, I can't agree completely with your guess for two reasons:

1.) These are Police Officers. 3 of 4 Chicago Police Officers know better than to get goaded into THIS kind of insanity. You've seen Police Officers de-escalate far, far worse situations. The longer you've been on, the more you've seen this.

2.) What in the world would she have to gain. Legitimately, she's been on that job for 3 months. You would have to be NUTS to start doing things outside of your authority with 3 months on any job. She didn't have a personal stake in it either if she didn't write the ticket.

My guess is that there is no way it was 4 officers at fault here. Its waaay more likely that one guy helped escalate it and was thought highly enough that the other 3 figured he must have a good reason if he is that pissed.

All in all, I feel bad for 3 of 4. Don't know which 3 of 4, but it sounds like 1 guy put the other 3 into the trick bag with this.

And if the one guy really has 26 years on, than I'd just rack it up to him having a really bad day. That is, unless he has a history of having really bad days.

Apparently she prior had run-in's with police. She also said the wagon had another prisoner who the officer's yanked out just to put her in.

One thing is true in all this, their short. She mentioned the officer was tall, no weight but her's was given 5'02" 140 lbs. How did his knee's get banged up?

Last week I was downtown, paid six bucks to park for two hours.

Put the little ticket in the window of my car.

Expired at 1:59 p.m.

At 1:55 p.m. I was at the machine attempting to pay for another thirty minutes.

Machine closest to my car would not print tickets.

Went to the next closest.

Paid for an hour.

Got back to my car at 2:01 p.m.

Guess what was on my windshield.

A ticket written at 2:00 p.m.

Ont the ticket was a note "Payment expired at 1:59 p.m."

I saw three tma standing in front of the Corner Bakery.

Went up to them and asked which one was Williams?

"Lady" replied that it was her.

I told her that she pulled a cheap shot writing a ticket the second payment expired.

I said with the machines scattered every block, they should give people a five minute grace period.

She said "It's a legal ticket, I did not break the law".

I said "Yes it's legal, but it is cheap".

Then I said that in over 20 years I have never done something so cheap to a citizen (O.K. maybe I did a long time ago).

She said "Why don't you have stickers on your car"?

I stated "I pay for parking, I am not looking for a favor, just don't be cheap".

She then again replied that it is a legal ticket.

I said have a nice day, and walked away dizzy.



Bout a week later in front of Corner Bakery I saw a car, with TMA vest on dash board parked in a tow zone.

Called 311.

Got the event number.

Bout twenty minutes later there was a banana on it (For those of you old enough to remember).

So price of parking:

$6.00

Cost of ticket:

$50.00

Pleasure of seeing three TMAs sitting in restaurant, knowing that there was a ticket on their car outside that I was responsible for:

Priceless.



If you see a TMA car illegally parked.

Call it in.

NOTE from an old traffic man, when we worked out of the Kraft building, the Dept. of Revenue was upstairs, the Meter Readers had just got those new computer ticket printers and were writing all the coppers around the Kraft Bldg.

A mini war insued and the police were ticketing and towing all the cars of the Revenue supervisors who would dump their private cars around the building at checkoff time.

This stopped within 8 hrs! Revenue and traffic aids were told to lay off the Kraft Bldg. and 18 and find other places to write their quotas.

Many of those Revenue people and traffic aides had phony messinger service signs to park in loading zones, fake handicapped permits, to park for free all day on a meter, the old orange vest on the windshield, mover books that they took out of the trash cans from officers who were to lazy to take them home and dispose of accordingly and a host of other tricks to avoid paying for parking.

And those tickets were non suited, YES non suited. A supervisor from Revenue told us that they could be non-suited as long as it was done before their shift was over, and they were not downloaded into the main computer, once downloaded it would be too late and impossible to pull them out of the system.

Once again, use common sense when your dealing with these people, the power of the pen is awesome.

If they get you, it may take days, weeks or months, but revenge is sweet brother!

police officers complained when the hire started to hire civilian dispatchers and call takers now you complain about the city hiring tma's, I guess there isn't enuf real police work for you to do, You know how stupid you all must have looked like on michigan avenue arresting a traffic aide fr jay walking while she was on duty doing her job I guess next time you're speeding to a job you'l get a ticket for speeding and reckless drving. That cop should be fired, better yet reassign him to the 10th or 11th district on third watch and let him so some real police work
