Aldercreatures Above the Law?

Confirm? Deny?
  • True story! On Friday, a 023 district 2nd watch officer wrote Alderman Tom Tunney a traffic ticket for using his cellphone while driving. The officer is a softball, but I applaud his zero tolerance enforcement. Commander 023 received notice of this and demanded that the Alderman's DL be returned to his residence. Cmdr. Yami was very upset and this officer will now be shipped to midnights due to enforcing the law against a connected person.
Hmmm.

UPDATE: Thought to be a tall tale. You may use this as an open post to abuse aldercreature Dixon who, as we confirmed, took an officer off of Beat 1014 against the wishes of the community for political payback.

I love it when a plan comes together. All people seem to complain about in the Sun-Times are people talking on the cell phone and the police not writing any tickets. Now the police write a violator and the violator uses his clout to get out of the ticket. Main stream media does not pick to run with the story, because it obviously puts the politician in a bad light and presents the police as doing his job. No news in that. The city that works and is clout free, Daley told us so.

I work in 023 and actually here is how it went down. The officer wrote the Alderman a ticket for using his cell phone. The alderman never dropped his name or title to get out of the ticket (a practice I am very sure EVERY CPD cop practices). He merely stated he needed his license and wished to post a cash bond. The officer obliged and once he got to the desk he was informed who he had written. The Alderman was not upset, and the officer was a bit embarrassed that he "jeopardized his current position." The Alderman posted his bond and walked away with his license. "Yami" was not even in the building. No one was besides themselves as SCC has stated. No one has been threatened of losing his or her current watch. This is a typical media exageration(yes SCC, you ARE the media) and will, in due time, be proven FALSE as I was standing not 10 feet away from the entire interaction. In fact, most in 023 enjoyed the comic relief (including the alderman). So, yes, SCC, you ARE typical media. Attempting to brew up a firestorm makes you no different from CNN, NBC, ABC or even the reverends! No one was angry as you insist. No one is at risk at going to mids. But being that you know that is the biggest reaction you can drum up from this crowd, I guess you are just following suit. PO H will be just fine and not because of you. But rather because eventhough city officials, and even bosses get undue slander at the hands of SCC, in the real world things really do just work out. Get a life and atleast TRY to be honest.

VERY IMPORTANT!!!

FYI Boys and Girls...

Several 010th District officers left Duggan's on Halsted two nights ago and as they walked to the parkinglot a man walked up and asked them a question. The question was "hey, you guys have been drinking for 3 hrs. and your also the police- Are you guys getting into your cars and going to drive now?"

The P.O.s also noticed the microphone the reporter was holding and then the ABC 7 news truck parked on Halsted. Im sure they P.O.'s were shocked but handled it by replying...that
while yes they were coming from Duggans but No they were not going to drive they were going to Taco King for some food. The P.O.s then WALKED to taco king and ate slowly!

It appears the media is probably doing an "exclusive report" on P.O.s drinking in bars. Please watch your backs.

Saturday night/Sunday morning an undercover news crew was filming Dugans on Halsted. They were filming people drinking, leaving the bar, and if they got into cars, how they drove off.

Be aware they are out there trying to stir up more shit!!

The I-Bond was delivered to the aldermans office and his license returned. The alderman told the officer, you don't want to do this and you do not know what you are doing, after the officer had already written the ticket. I also heard somewhere that in a previous comments alderman tunney had admitted to being one of those people that used his cell while driving and encouraged officers to write the citation. I sincerily hope that the law will be equal for all and that the alderman will step up and pay his fine. We trust those that represent us to be honest and follow the rules. I think a public apology is in order.

But SCC, like everything else its probably is your fault (not)because you did not italicize the post for simpletons like 12:12 AM to make them realize you did not write it. Friend, you have some real issue if you think ANYTHING other than highly about John Graeber. You must not work, becasue any cop that works knows that he is the real deal. No, I'm not JG, no I do not work for him, I worked WITH him and I know.

He is what the merit selection process should turn up - great coppers. Not political, backstabbing, phone call having, no knowledge having, no experience having clout babies.

She has made enemies of the police, a bad start in any political career. Hope it is a short career. It seems she used her $300,000 city office allowance
to convert her home to her aldermanic office. The she wants angry constituents arrested for making their protests heard in her home/office.

My suggestion, Dannye is well liked by the people there; he should move in and run as Alderman of that ward.

Some people can do almost anything and drive. Some people cannot drive at all.

But unless it causes, or almost causes an accident, or some other factor like being a known gangbanger I would not write that ticket. I would feel real pimpy writing that violation as I drove my squad car, while using my radio, punching in plates on my PDT, drinking my coffee, looking for bad guys and yes, talking on my cell phone.

If you haven't heard, we are going to finally get, limited use, GPS cell phones to use in the field.

That rumor about coppers leaving duggans is true. Heard it from a detective who knows one of the coppers. Apparently they work in 002 had 2 on the end and went out for a couple after work. they walk out of duggans and are approached by ch 2 news who go on to ask if they plan on driving home? Coppers were caught off guard but called w/c who sent a car to pick them up. If true, great job by that boss. The media is out of control. Be careful, they want us all to go down

He is probably one of the best bosses I have seen since I been here(10yrs) and I dont work for the man. he is straight up guy and never an asshole to any blue shirts. I think you are a reasonably intelligent, articulate person (cop) who has some well-defined bitches about the way the police are portrayed. I guess my question is this - what should a normal citizen think and/or do when there is so much negative pub? I think much of it is probably way overdone, but, at 70 years old, I believe 'where there's smoke...'. Particularly disturbing are the incidents regarding the cops in taverns. Why should we not feel threatened when we are approached by the police?

Cpt Graeber was AWESOME to work for. Really knows how to take care of people. Haven't worked for him in years, but cannot imagine that he changed one bit. Deserving of any promotion that came his way....would make a fantastic top cop....

Who is ever saying that Tunney came into 023 Desk and posted a bond has to be Yami or one of his CAPS people. Here is the 100% truth. Tunney received the ticket during the day shift. Tunney calls the Commander 023 to advise him of what had occured. Commander Gary calls the 3rd watch desk Sgt and orders him to hand deliver Ald Tunney's license back to his residence. Tunney never stepped foot into 023 on Friday. I don't know if he even posted a bond to get his DL back. I don't know if Tunney was being hostile but, he at least reached out to Gary for some advise and/or special treatment. I can't believe people would try and cover up for Gary , he wouldn't do it for you.

John as a district officer did a great job he is now and always was "The real police" hope he makes 1st deputy then at least have someone in that spot who knows how to talk to officers! but it looks like jimmy keating will get it due to his major daley clout!

I personally was the subject of channel 7's malicious attempts to screw over officers they have undercover teams who are mostly college interns who are promised if they get a story they are offered a job at the station! They have an open contract with enterprise rent a car same as iad and ops that allows them to use a different vehicle at will and you need a court order for enterprise to tell you who rented said vehicle! Be very careful with the media snakes chuck goudie and his ilk will do anything to take away your jobs! They also are able to run plates to get your home address so follow the state law that allows you to register your private vehicles to the station address at least try to keep these idiots from waiting by your home to "surpise you"!

off topic- we are dealing in a new era of policing,the media can not wait to cut are throats at every turn. we are the punching bag of every minister,aldercreature,and every other community activist and plus in every district we are undermanned and we do not have the basic equipment to do our jobs properly i.e. no working pdts. i really believe that we need to become united and start being there for each other. this blog is good in many areas but unfortunately a lot of times on this blog we treat each other just as bad as the thugs do on the street. at the district level,lets end the petty infighting with each other and lets become a family again. a lot of people talk crap about the old time police but back then they knew how to be a family. a example i remember in the news in 1992,the 10-1 fundraiser for jon burge. on that night 5000 officers packed the plumbers hall,showed their support even with tv cameras and media protests. unfortunately today that unity is nonexistent. a lot of individuals were working the night on roosevelt/mozart the night that banger got shot. i have a thought to ponder. when we were getting pelted with rocks and bottles and all hell broke loose,did anyone think,i do not like this officer so i do not want this officer helping or i do not like this officer etc,etc,. the only thing anyone thought of was we all need to stick together to be safe and all that other stuff did not matter. we united and we were a family even for a moment. to my fellow officers in blue,be safe,this too shall pass,and lets be good to each other and take care of each other because at the end of the day all we have is each other.

010th dist alum Danny Ward has been there done that on the northside of 010 for more years than I have o the job. If some pimmpy aldercreature is mad becase danny doesnt cowtow to all her wishes and takes retribution she will find out Danny is very popular with the citizens that are decent hard working folks out there(yes there are plenty). Danny might not play the dope game anymore but he is a damn good street cop and someone you want there when the sh*t hits the fan and the block is up for grabs.

Alderman Tunney is a class act. His family owned a few restaurants and was always good the police. I have met him and his sister a number of times, both before and after he was elected, at police functions. The family donated food to these functions and even hosted one that I am aware of. Again, he is a class act and a friend to the police. Not the type of person who would drop a name nor would he seek vengence for such an incident.

Why is that the nobody in the NEW SFG has the balls to post the secret SOS FAX list of names of the officers dumped to the districts...your old partners?
I mean you ask these SFG people about it and they look like they are going bawl over it. They know it was unfair.

Just the facts:

-- Ald Tunney did not protest the ticket to the officer or hassle him in anyway...if you don't believe me, just ask the person at City Hall that he was talking to at the time.

-- When he got to his office, he did call the 023 Cmdr and ask him why, when there is a manpower shortage and there are some pretty serious crimes being commited in 023 (rapes and assaults) that are going unsolved, officers are stopping cars solely for a ticket for talking on a cell phone. Not an unfair question.

-- He did not ask to have his DL brought to his office, the Cmdr did that on his own using a Sgt. as his messenger boy. He signed for it and considered the incident to be in the past.

-- He never asked for or expected any negative action would be taken against the officer and was not happy when he heard (according to a blogger on SCC) that might have been the case. He's probably made that clear to 023 Cmdr by now.

Tom's been a good friend of this cop's family for 20+ years and I know for a fact that he has only the highest respect for working police officers. He's a friend, not a foe, so don't turn this into something it's not.

To the poster besmurching the intent of SCC, the moderator of this site, as has been previously pointed out, the post was, I also believe, in the spirit of a man who once said, "Trust but verify". I once pulled over an alderman years ago. Once I found out he was an alderman (back then and maybe even now, Alderman had badges like the police, their star number being their ward) I told him to be more careful and have a nice day. The alderman handed me his business card and said, if ever needed anything, give him a call. A few weeks later I called and asked for two new garbage cans (back when the garbage cans were 55 gallon metal drums). I also reminded him I was the cop who pulled him over and gave him a break. The alderman asked me my address and when I told him, the alderman said, sorry that's not my ward and hung up.

If anyone cares to read the law, there is an exemption to the cell phone law to agents of the city in the course of their duties (Aldermen, Commanders, Fire Chiefs etc.) So the ticket is no good anyway..

Kudos to Capt. Carroll, midnight W/C in 012,for getting those coppers out of harm's way at Dugan's, he's a great boss who put together a great group of midnight officers. He doesn't preach numbers at roll call, his concern is that we all go home to our families safe and in one piece in the morning. It's enjoyable coming to work on midnights. We're a tired group but we are in good spirits. He's a boss who can dish out a joke and take a joke. Never seen him raise his voice. Not the bit vindictive. Several times he and his sergeants pow-wowwed in a closed door session to get someone out of a fucked up situation, whether it was a midnight guy, 3rd watch guy, a tact guy or an outside unit guy. By the end of the tour, everything was resolved with the copper out of harm's way.

"We have time in the middle of the day to pull over a person for use of a cell," Tunney said. "I will probably frame [the ticket] to let my constituents know that [police] actually do stop people."

Tunney said he has paid his $50 fine and is contemplating getting "a better headset when I am driving because I made a mistake."

The list doesn't effect anyone other then those on it.

The people "dumped" served in SOS at the departments will. SOS was a non-bid unit. No more SOS then see ya, no reason needed.

As for SWAT, that too is a non-bid unit.

The magic number of nine got a few guys launched from SWAT a while back. I think the SWAT guys launched was just a byproduct that 35th street bundled into the elimination of SOS. Now there are openings for who ever.

The people that would sue don't need the list, they can compile it by talking to each other.

-- When he got to his office, he did call the 023 Cmdr and ask him why, when there is a manpower shortage and there are some pretty serious crimes being commited in 023 (rapes and assaults) that are going unsolved, officers are stopping cars solely for a ticket for talking on a cell phone. Not an unfair question.

So an Alderman knows we have a manpower shortage? If he knows this why did he and his fellow alderman pass a BS law such as the talking on the cell phone while driving? And are we, according to him, to look the other way when we see a violation because there may be a more serious crime occurring?
Maybe he should be asked that with all the important things going on in the city why do the alderman pass stupid laws like the cell phone while driving law? Not an unfair question.

Back in 1991 as a ppo I was assigned Buckingham Fountain while detailed to traffic during the summer. My instructions were to keep tourists from illegally parking at or near the fountain in violation of no parking signs to keep the flow of traffic moving. Well there was a car illegally parked at the fountain with only a female in the passenger seat. I asked her to move her vehicle or get ticketed, she informed me she could not move the vehicle becuase her husband had the keys. I wrote the vehicle a parker and continued my assignment when several minutes later a male black approached me and asked me if I was the officer who wrote him a ticket, I said yes and he proceeded to say " Son Do You Know Who I am?" I said no. He said Im Alderman XXXXX XXXXXX(Hint: he is the alderman for the 015 district)I said Sorry but I dont play politics and don not even know who my alderman is, He became furious and demanded my supervisor. My supervisor at the time was an salty old timer in the KMA club. I was very nervous being a PPO and I thought I was going to lose my job. The sgt. asked my side of the story first and then went and spoke with the Ald.,he went into a rant on why the police were harrassing citizens and tourists wanting to see the fountain and how he writes the ordinances of the city. The sgt. then tells the Ald. you should know better then, there are no parking signs posted everywhere and if he feels the signs are unjust to change the ordinances,that the ticket stands. This really pissed off the Ald. and he demanded the star # of the sgt. and threaten to have his stripes. The sgt. kool and calmly gave him his name and star #. He then turned to me and asked me for mine, empowered by the sgt. I also kool and calmly gave him mine. He proceeded to a payphone by the fountain and made a phone call.I for sure thought I was in big trouble since I was still on probation, the sgt. basically told me the Ald. was an asshat and not to worry he would take the heat if the Ald. would make a stink. The Ald. must of just got the ticket non-suited because I never heard another word of the incident and the sgt. remained a supervisor in the trafffic unit.
Sixteen years later I still dont play politics and wouldnt know this Tuney from a regular Joe and dont give a phuck and would probably write him also.

Just read it. Perhaps you should too:

(a) Except as provided by subsection (b) of this section, no person shall drive a motor vehicle while using a mobile, cellular, analog wireless or digital telephone.

(b) The provisions of the ordinance shall not apply to:

(1) Law enforcement officers and operators of emergency vehicles, when on duty and acting in their official capabilities.

(2) Persons using a telephone with a "hands free" device allowing the driver to talk into and listen to the other party without the use of hands.

(3) Persons using a telephone to call 911 telephone numbers or other emergency telephone numbers to contact public safety forces.

(4) Person using a telephone while maintaining a motor vehicle in a stationary parked position, and not in gear.

(c) Any person who violates subsection (a) of this section shall be subject to a fine of $75.00, provided however, that if a violation occurs at the time of a traffic accident, the driver may be subject to an additional fine not to exceed $200.00.

as for dugans. i'm 6'3" pushing 280 these days. i have maybe 3 beers max in a 1 hour time frame. thats with a full stomach from eating a monster lunch before check off. i continue to munch on the pop corn from the pop corn machine in which rats often dance and after 3 hours and maybe a 12 pack max, i drive home. i'm not even buzzed in the least. how the fuck are you going to drop judgement on me? Fuck you, i went out for some beers and grub with some co-workers/friends to talk about all the bullshit we just had to deal with at work. Fuck you, for jumping the gun and passing judgement on me and my partners.

This was on fox news this morning. It says the Alderman received a special favor because the officer personally gave him back his license when normally citizens would not get it until they go to court. You guys can never win-no matter what the media tries to show you bending the laws. I admire all of you who are no longer allowed to police without being under a microscope. Be safe!

Interesting blog...I am not in the Police Department, but know both the Commander and the Alderman. I have had nothing but positive experiences with both. Although I'm sure Alderman have put their foot in their mouth (or ass, as it were)such as this case about chasing more important things (I cringed when I read that), I do not know where the hostility comes from regarding the Police vs. aldermen. I can only recall a few instances where one did not back the police fully- the Natarus incident over dogs and this. Speaking as a civilian, I don't get it. I don't remember the alderman going nuts over the bartender getting her ass kicked or even the Burge mess. Just curious where it comes from...

Kudos to Capt. Carroll, midnight W/C in 012,for getting those coppers out of harm's way at Dugan's, he's a great boss who put together a great group of midnight officers. He doesn't preach numbers at roll call, his concern is that we all go home to our families safe and in one piece in the morning. It's enjoyable coming to work on midnights. We're a tired group but we are in good spirits. He's a boss who can dish out a joke and take a joke. Never seen him raise his voice. Not the bit vindictive. Several times he and his sergeants pow-wowwed in a closed door session to get someone out of a fucked up situation, whether it was a midnight guy, 3rd watch guy, a tact guy or an outside unit guy. By the end of the tour, everything was resolved with the copper out of harm's way.

I really thought the post in the blue area was the real deal that a p/o was there at the desk to set the record straight. According to the slum-times this wasn't the case. Jag-balls had his DL delivered to him along with signing an I-bond book. WTF!!!

yeah...right after all of the people on the watch with less seniority that him are moved. if he is a bid spot, he is safe. read your contract. if he is a 20 % spot...then he can be moved, but, would the commander want the news getting wind of a retaliatory move for doing your job ? probably not !

If the alderman did not want any special treatment then he should have just mailed his check instead of bringing it to the attention of the commander.
What he did was bring up the issue without asking outright for a favor but unspoken political practice prevailed. All people in positions of power know how it is done and has always been done when politicians are involved.

It's obvious the press is reading this blog. I believe this is where the story was picked up? Anyway, watch what you say- or make it a private blog if you want to talk in confidence.
Free speach is awesome, but most of us are old enough to understand what comes around goes around. The public is a royal pain in the ass to deal with- any city worker knows this. Some of us don't have to worry about getting shot in the process, but you know what I mean. Anyway, I'm just saying it would be wise not to drop names as this is now a very public forum. The last sun-times story opened this blog as wide as a west side whore. Many are reading it. I think it's great to see what officers are saying but just remember- some of these press SOB's are smarter than you and will make us all pay. Just a word from the (hopefully) wise.
