- A class action lawsuit will be filed tomorrow against the City of Chicago, Mayor Richard Daley, and various police officers.
Chicago police officers have been arresting and ticketing thousands of innocent civilians for violating the cell phone ban (which prohibits using a cell phone while driving) to the tune of millions of dollars accrued to City coffers, under a law that has never been properly enacted.
The law (625 ILCS 5/11207) requires the City to put up signs to inform drivers that they may not speak on their cell phone while they are driving. There are no signs. The City has certified that it has failed to put up signs. Therefore, every single arrest in this regard has been illegal. All money received by the City through tickets that its officers have issued has been illegally secured.
We're just wondering where does the line start? That budget hole is about to get a whole bunch bigger. Anyone know if this lawyer feels like taking on the red light cameras that have been ruled illegal in just about every single state where the citizens challenge them?

Sad thing is, when all is said and done they will blame the police dept. again and the alderdicks that came up with this ordinance will walk away clean. The racism we as white Police Officers in the city have to put up with is terrible. The racism I see every day is unbearable. I have to say, as a fourth generation Chicago native and third generation Police Officer, that black people are the biggest bigots and haters of any race known to mankind. Everybody OWES them. Some of the black Police you deal with every day are worse than the citizens(in terms of prejudice and hate).I hope to max out and retire one day, but the ill will and malice that black citizens and fellow Officers have put on me make me wonder if I can stick it out. I hope one day black people wake up and realize that the world doesn't owe them. They need to fend for themselves and stop hating so much!

Uhh... you my lad sound kind of soft! 1st, stop listening to pa & grandpa's war stories about all the ass kicking they did in the ghetto back in the "good old days." 2nd, either quit or grow a thicker skin. Nobody OWES you anything, let alone respect... you should have been a fireman if you CRAVE respect so much but that is an issue you have to resolve yourself. 3rd, you should be mature enough to now realize that racist assholes are a fact of life on and off the job and bigots come in every color and stripe. Stop making blanket generalizations and keep your chin up. 4th, have you taken stock of how you relate and interact with those citizens who do not look like you or share your customs or mores? Look in the mirror, the culprit could be you. Come to work, do your job as best you can and have some integrity about it. Take nothing that isn't your's (make sure your partner is on the same page as well), come home and have a clear conscience. Is this job a bitch sometimes? Hell yes it is. But whatever color we may be, I still believe that for the most part, Chicago Police Officers are overwhelmingly some of the most decent and courageous people I've come to know but we're still a cross section of society so some who do not belong in the brotherhood do manage to slip in and we all pay the price for their actions. 5th & lastly, not to belittle your personal experiences but if you REALLY want to have something to compare your experiences to, talk to some old time minority officers. Not these new jacks but the gentlemen who broke in on the job during the 1940's, 50's and early 60's when the racism you complain about was out loud and in your face... what you complain about is nothing compared to what they went through. Some years ago, I remember a late deputy chief related a story of directing traffic downtown as a rookie in the late 1940's when he was approached by several m/2's who challenged him, saying "what are you doing n!&&@r, this is a job a white man should have." He responded that he was directing traffic, blew his whistle and signaled for traffic to move. The challengers not wanting to be hit, moved along. The moral? You can't take the bullshit on this job and the bullshit that goes with it too personally. It'll eat you up, as it is 'tis the season when too many officers contemplate taking their own lives (and along with those who have had their lives taken), which is the greatest tragedy of all. Sorry for the long post office, I'm not flaming you but trying to get you to have a little bit different perspective, (i.e. a teaching moment as I would tell my former students). Yeah, sure, he won one big case about 10 years back (of course, his press releases never mentioned that his co-counsel was Jon (Andy Dick) Loevy).
He loses a whole lot more than he wins. Check out the Shanicqua Suber case out in PA ( a woman miscarried supposedly due to police brutality). He got his ass kicked and his associate sued by the plaintiff.
He's the same goof who filed something like 20 cases against the Blue Island PD back in '04. A big @$$ press conference, no money won after the fact.

This is typical of how the city does business. If there was no challange they would have gotten away with it. They do the same B.S. on the police Department. routinly violate department directives ( B.I.S ) and the law

Yes the signs are posted at all 4 corners of the intersection, but only cameras at two.
to: 12/19, 12:43 am....not sure about this, but I think that in other jurisdictions, the red light camera systems have been ruled "illegal" (or unconstitutional, if you will) because the government levies a fine against the vehicle owner, when the vehicle crosses the intersection against the red light (and who knows anyway if the vehicle got stuck in the intersection as the result of heavy traffic, another issue), but the argument goes like this: how can the government fine a vehicle owner for the use of his/her vehicle if there is no evidence that the vehicle owner was actually operating the vehicle at the time of the violation? (and there is a big diference between parking violations and violations which involve the movement of vehicles)....
The suburbanites and out-towners have no knowledge of this law. Let's face it, it is unfair! I hope the lawyer wins this one. Next time, he can go after Ed Burke for opening up his mouth on the red light cameras be used to raise revenue. Unfortunately for Ed, there's caselaw that clearly states that tickets CANNOT be used to raise revenue. Time to get the refund desk open!

I'm not a lawyer (Thank God, but I do play one on TV), but couldn't the city argue that the massive media coverage of the law constitutes proper notice?

it's the nature of the job lad...from the first day long ago when someone had latent itch across their ass and thought "hmmm, this swampy mud hole needs a constabulary." police officers have bitched and complained about the public, politics, bosses and yes each other. i'll pose you a loopy hypothetical, who's to say who has/had it worse than anyone else? i see that you seem to harbor some resentment about something, well so does the next guy...it's all relative i guess. no one really has exclusive rights to tell the tale of woe (cue the violins). most of us have had hard knocks on this job, some more than others; but on a personal note it pains me when i see an "us versus them" sentiment within the department. it's not good and it leads to resentment which diminishes the mutual respect we should have for each other. i'm not saying 8900 men and women can love each other in the fraternal way, impossible considering the number of "interesting" personalities but damn it we should respect each other and realize it is a two way street. so remember, a lot of this job is endurance and cyclical in nature, things go from sugar to shit very easily. oh, and stop worrying about what the other guy is getting/doing, you're responsible for YOU! someone could be saying the same about you, but you don't care do ya? do the right thing, do a good job and be proud.
And that goes for the rest of you officers as well... gotta go, ajax & comet (bullmastiffs) want to take their "paw-paw" on patrol...

Seems to me the 'no cruising' ordinance is/was the same way. To write someone that ticket, you have/had to give them a written warning first. I dont think Chicago ever had written warning ticket books. Another law that should be challenged.

"Innocent civilians"? What a bizarre phrase to use. All the people cops deal with are "civilians", including the crooks. And these "civilians" weren't innocent. Maybe the city screwed up enforcement, that doesn't mean these yahoos weren't yakking while driving. It's like the anti-death penalty list of "innocent men": many acquitted on technicalities, or found not guilty in a second trial after witnesses recanted, or had their death sentences (but not convictions) overturned - not (as they would have you believe) proven factually innocent.

Whatever the outcome of this law, the distracting behavior is getting worse. Friday coming home from work some car was driving 20 mph in rush hour, had everyone backed up behind her. When I finally got around her she's trying to text message while driving! Talking on the phone was bad enough, but you have to be a real asshole to try and text. I mean, can't it wait?

I'm white, and every day I ride in a beat car with a different officer I hear negative remarks made about people they are looking out from the windows of our squad car who they don't even know. If we are that negative about "them", do you think maybe some people in a position to hire "them" are as well? I agree, some people are definitely getting over playing the race card, maybe even PO B.K. in the deuce, don't even consider for a moment that some people out there who aren't white aren't getting the shaft.
Personally I don't see the City bellying up on this law. it was publicized, the media reported on it, and it's been on the books for (I believe) over 2 years. The City was under no obligation to place up signs informing the public. Ignorance of the law is no excuse. No hang up and drive!!
SCC, I can't even believe you would post the crap that ignoramus submitted earlier in this section thread (19Dec, 3:05AM). I would say that ALL OF US, AS POLICE OFFICERS, experience racism. But whites are not the only ones who experience it. Many times, black officers are also subjected to racism. Some of it is subtle, most of it is obvious. In some Districts, black officers still are not allowed to work beat cars in certain sectors. Going over to answer calls in certain sections of the city, black officers continue to this day to have the same citizens who call police slam the doors in our faces. We also face racism from our own. White officers sometimes show up on the scene of a hostile incident and suddenly , the whole thing is over.
Many a black man knows he can catch a serious case for injuring a white officer, but they have no qualms about verbally disrespecting up and challenging our authority daily. In some neighborhoods, black officers get even LESS respect than the white officers do. And sometimes we ARE put in the middle. Would you like to know how many white officers I've personally observed make a bad situation WORSE by calling someone the "N" word on the street, when things were already tense? Guess who has to clean that shit up when the 'hood goes up? You're right, WE do. And then we have to go right back out there and ride in a car with these same rednecks, which hurts OUR credibility on our beats. SCC, you need to do a better job of screening crap like what got through on the 19th. And my message to the white officer who wrote that shit is, if you feel black racism is so bad, then QUIT.
There are plenty of lily white PDs out there to sell your services to. I've had to put up with quite a bit of racism during my 18 years of service, much of it being spouted by the likes of you in my beat car, counting on me to hold back the angry mob you stir up with your hateful stares and words, or back up your "version of events" when your unchecked mouth creates yet another "incident" that others had to get hurt while cleaning up for you.
