Because it happened in Niles and not Chicago. Lil' Dick doesn't run that town, so he has no say in how they run their police department. Besides, they probably decided there's a better chance of getting a conviction for 2 counts of simple battery than agg battery.
With that said, after the ASA gets ahold of Gerry's complete previous history, I'd bet next months pay that when he goes to court, they upgrade the charges to felonies.

Later, a goof was stopped in either 010 or 012, stopping people, pretending to be the police. We're lucky this guy didn't rob, rape or kill anyone.
