Follow Up Post
It seems a can of worms has been opened up. We're doing this follow up to address some of the comments, clarify some of our positions and make a few points.
First up, either you believe us or you don't. We related the story exactly as it was told to us. We didn't choose to use the word "indicted." That was told to us. We specified in the post that we didn't know the purpose of the proposed change. Neither did our source, but they felt strongly enough about it to bring it to our attention. We trust them. They trust us.
Second, a number of people have been speculating in the comments about the purpose of removing the Department from shooting investigations and eliminating the Round Table process completely. Some are interesting. Some are way out there. Some are beyond unbelievable. Here's the thing - we have certain contract protections, certain processes that have been in place for years. If you want to restructure the methods in place, wouldn't it make sense to have the FOP contribute to the changes? To get the rank and file involved? Maybe, oh we don't know, EXPLAIN what the hell you're trying to accomplish?
Evidently, J-Fed is taking a page from all the bosses and the Administration that doesn't take input or suggestions or pay any attention to contracts and such. They want that adversarial relationship intact and fuck all you little people.
To those people saying it can only help to have people in front of a Grand Jury and get their stories nailed down so when they recant, the State can go after them we ask the following:

- When has the State gone after anyone who lied on a sworn affidavit? We'll give you a hint - it's less than once. Don't expect them to go after anyone who lies in front of a Grand Jury.
- Shooting on a Friday night, Grand Jury doesn't meet until Monday. CPD detectives are required to tell witnesses that they aren't under arrest and can leave at any time. How many people are going to stick around all weekend just so they won't be influenced by friends, relatives and "reverends" looking for the big payout?
- In front of a Grand Jury, who asks the initial questions? Answer - the State. What about the accused? Answer - they aren't present. How are the questions phrased? Answer - in a form that usually requires a single word answer and that answer is usually "yes" so as not to fuck up the indictments. Now let's say that there is a shooting that is the tiniest bit questionable. How are those questions going to be asked in front of the Grand Jury...a Cook County Grand Jury, mind you.
Sorry for not believing the current Department leadership. Sorry for not walking into this crap blindfolded. Sorry for not trusting the political machine to be looking out for our best interests and the best interests of our fellow officers. But trust is earned and so far, nothing verbalized, written or demonstrated by J-Fed and his people has merited even the tiniest iota of trust.

This is a big deal. We cannot let the grand jury decide our fate. Keep it administrative and only if a crime was committed by the officer then should a criminal investigation be initiated. Don't let a jury of Cook County police hating residents or a state's attorney with something to prove touch the case.

Moral: do it right from the outset, don't lie no matter how tempting it might be to "embellish" things just a bit. Live with the truth or else the lies will hang you.

I could get my dog indicted by the Grand Jury. Lots of people talking have probely never had to go before the Grand Jury during the course of an investigation. There is no reason for this except to screw cops.
Well that's a bit better. At least a few people may go off and seek the truth behind the actual process.
Boiling the purpose down to it's essence:
The ASA HAS to be seeking charges against the officer if anything is taken to a GJ for an indictment. If the ASA is seeking charges against an officer, something in the circumstance gives them reasonable suspicion that a crime has been committed. Otherwise, if the ASA was attempting to take every shooting event and try to present the event as a crime the the very next day, they'd be opening themselves up to a mess of problems shortly thereafter.
No matter what the FedFuck thinks, even if the SA want's out of the round table to preserve their neutrality, every shooting case cannot be turned into a crime until proven innocent by a GJ.
To that end, and attaching a note to a similar post to which I haven't seen the actual memo, if Jfuck thinks every copper arrested for anything has to goto an ASA for felony review, then from now on anyone who locks up ANY CITY RELATED EMPLOYEE FOR ANY REASON should be calling felony review on them as well, and get the name of the ASA and put it on the report that the charge was denied. When the WC asks why you called the ASA, let 'em know they're a City employee as you are and, since you haven't been told the criteria for why a PO case has to goto felony review you will do it with all City employees. BTW, when you lock up a city employee, you ARE calling the inspector general's office correct?

Just as the suburb of Palatine wants to secede from C(r)ook Co. to Lake Co., what would occur if all of Cook Co. north of say North Avenue wanted to secede from Stroger and the City of Chicago and form a separate county? This might seem like a silly question but if a P.O. knows a grand jury is going to vote on a true or not bill preceeding a shooting, shouldn't that be advance warning that anything the officer says or writes can be held against him / her?
Don't we still have the protection of the 5th Amm. and the right to NOT answer for fear of self incrimination?
If so , a P.O. should be advised in writing by the fraternal organization of that fact. Also they should advise any officer involved in any shooting to say and write nothing without a lawyer present.
These warnings must be clear and without ambiguity, for example, not written in legalese and not mixing administrative rules with rules of law.
The P.O. deserve the exact same protections as the criminals.

Today is May 1, 2008.
As of 0001 on May 1 everyone should report any death they believe to be a homicide to SCC.
This notification should include the number of victims(no names), address that the body(s) were found, and cause of death.
This will allow SCC to track the number of homicides and we will then be able to compare same with what the Department releases on a friday in June.
We will then be able to see if the Department is manipulating the figures as many believe.

A grand jury exists to indict - nothing else. This isn't a Coroner's Inquest or a Senate Committee subpoenaing everyone under the sun. The entire process is built in the prosecution's favor. What do you think will be the SAO's practice on a police related shooting with real heat, officer justified, but all the revs are screaming. Between the SAO and JODY THE JAG, the attitude will be go for an indictment, the court will acquit the PO based upon law and fact. Meanwhile the PO goes through months of hell, just like the guys in NY. In this scenario don't you think that after an aquittal JODY THE JAG will run to his fed buddies and seek a Federal indictment for violation of civil rights. All this to surely get the "street heat" off the administration.

Friends there is a cop out there , I wont use his name or unit because he is an angry man and on this blog it would turn into pages of he said she said about this guy.However like him or hate him he was being f@#$ed with by his supervisors. He worked with fop and his own lawyer documented everything and dropped paper on supervisors. Long story short he won the supervisors got dumped out of unit and he walked away with big money. and now the bosses are so afraid of him they dont even look at him. In fact, from the "Grand Juror Handbook", it states,
The Grand Jury has a dual function:
"1. determines that a person should be charged or prosecuted for a criminal act..."
and
"2. protects the innocent from unfounded accusation... when there is insufficient evidence..."
Like I said it's a small error but true.
The omission of part two is an important consideration in law.
More importantly is the trouble the CPD might face in today's climate of vengeful juries.
I can't imagine, after seeing after action reporting nation wide, cheering for O.J. , hearing the chants,(It's our turn now), and seeing A.Sharpton threaten the City of New York and it's "white justice" , ever coming up with a responsible and fair jury selection.
The black community primarily but not exclusively, lies repetitively by omission. Witnesses rarely come forward. (specifically in homicide investigations)
Gang bangers have been shown historically to flood investigators with erroneous information if it serves the cause of their gang or implies police misconduct. Usually their lies are so off base they are easy to invalidate. But, some still get through.
Is J-fool actually going to tell the rank and file he trusts this base of witness trash over a man or woman trying to enforce the laws of society?

You guys need to realize how much exact power you have. We are constantly on the news and the ones being fucked with by news rules and laws. Why is that? because we are soft and care if a tax paying joe gets arrested.
I say we start arresting EVERYBODY! Doctors, nurses,firefighters(heroes ha ha), lawyers,judges,teachers,ASA's,reverends,and polititians.
We ball know that we extend too much dicretion and courtesy when we come into contact with these indiviual. I see none of them speaking out in support for us. I am glad that Lake County Deputy dui'd that Chief Judge, it shows that these cituations occurr more the the citizens and media knows about.
I for one will not risk anything anymore unlesss you are a fellow p.o.. Make a notification to felony review and state their occupation stating you feel they are a risk to the community.

Officrs might disagree with FOP but I remember life without any union. White shirts treated blus shirts worse than today. Clout absolutely ruled and exempts were gods. We fought hard for any union and I am soo happy to have FOP representing us and protecting our rights. Other agencies turned to teamsters out of desperation. There is a possibility that the intent is to investigate the death of the offender primary and secondary would be the officer's actions if the death was derermined unjustified.

They obviously don't know what the round table is for, it is to inform all the parties (WC, ASA, IPRA, bosses, FOP etc) of the status of the investigation as of that point in time. The round table in and of itself DOES NOT COVER UP anything, if someone thinks it does, they have not attended any.

New Admin fax out today signed by J-Fed himself "correcting" or should I say "clarifying" the previous fax signed by the 1st Dep. about Felony Review and arrested PO's.
Nothing's changed. GO 93-03 still stands. Felony review will be called for all CPD members charged with a felony. Ops Cmd will be notified for any arrest.
UPDATE: The Felony Review Notification order has been rescinded effective 1 May 2008.
Notice AMFN#081843 reads:
"The arrest of a police officer will NOT automatically be referred to Felony Review absent the factors contained in General Order 99-03, "Felony Review by Cook County State's Attorney". Pursuant to existing directives, felony charges will only be sought when the elements of a felony crime exist."

Officrs might disagree with FOP but I remember life without any union. White shirts treated blus shirts worse than today. Clout absolutely ruled and exempts were gods. We fought hard for any union and I am soo happy to have FOP representing us and protecting our rights. Other agencies turned to teamsters out of desperation. I agree with you to a point...but why is the original poster a dickhead? I received this pic in my email from at least 5 other coppers, every email led me to believe that the holes in the windshield were made from the AK. I even remember people here talking about the grouping and such... This is the first I heard of those holes coming from inside.
Don't be afraid of the truth. That is what jams up so many coppers...we do the right thing, then are afraid we are going to be in trouble and lie about it, then really end up in trouble for lying. Vicious circle. Vicious and stupid.

Judging by the low number of ballots that were submitted and the attendance at the general meetings it seems a bit hipocritical to complain about the FOP. Maybe they do suck but they can only get away with what we let them. Start attending meetings and become active in the FOP meetings.

So far; over the years, I've (w/ my partner)arrested a guy who claimed he was going to be a future lawyer that was selling cocaine from his apt in the 8th dist, a reverend with weed in the 6th dist. That one was funny, he was trying to eat the loose weed and gagged on it. Everytime he coughed more flew out of his mouth on to his fat belly,
a nurse buying heroin near madison and homan, a cdt (city disable transport) driver buying heroin in the dearborn homes, a city employee or 2 and a cook county employee. These were all arrests that were felonies, except the reverend. That was just for fun. The guy was a jagoff. They were all unapologetic and begged to be let go. To me, they all acted like the regular joe shithead and these were supposed to be "professionals"(?) They all blaimed the cops and not themselves.
