Tort Reform Please

  • A trained nurse, Rachelle Jackson immediately ran toward the sound of the crash. A Chicago police car had collided with another vehicle and was starting to smoke, two officers still inside. Fearing an explosion, she quickly pulled one officer from the passenger side. She never imagined her act of kindness nearly six years ago would land her in jail for more than 10 months on charges that she robbed, battered and disarmed a peace officer.

    Jackson filed a lawsuit, and on Thursday a federal jury found against the city and several Chicago police officers, awarding Jackson $7.7 million for false arrest, malicious prosecution, coercive questioning and intentional infliction of emotional distress.
Following two days in the CPD lockup, she signed an allegedly false confession and spent ten months in county. For this she gets $7.7 million? Where's the sense of proportion? Sorry to seem unsympathetic, but if we knew that we were completely innocent, there isn't a force on earth that would get us to sign any piece of paper - and she's not even alleging torture. She was hungry for two days and "threatened."

$7.7 million? Come on.

Herein lies the problem. Our system for filing a complaint against officers is complete bullshit. Anyone can claim any officer did anything and not only is there an investigation but if it is found you were not even working that complaint stays in your file. Then some supervisors like Dana and Puddin Pop will dump 200 officers based on an arbitrary number of complaints in an officers file regardless what the final outcome was. THIS SYSTEM SUCKS AND SOMETHING NEEDS TO BE DONE! GOT THAT F.O.P.!!!!!

I've almost been killed twice on this job and I didn't get shit. One time the guy got SWAP and the other time the guy got I small two year sentence. If it was the other way around I would be getting 20 or 30 years. No ribbons or anything lol those were saved for SOS and other paper jumpers. Just remember out there, don't let your family down by having them see you in pain from injuries or law suits. If this City wants to cry about money they should shut the fuck up and observe the new streets of hell.

Police Thursday were investigating letters containing an unknown but harmless powdery substance that were sent to about half a dozen elected officials, including Chicago aldermen.

The letters arrived Thursday afternoon, and Chicago Fire Department personnel were called to test a powdery material inside them, spokesman Larry Langford said. The calls came from offices at the Daley Center, 50 W. Washington St., as well as several aldermanic offices, he said.

"In each case, the substance turned out to be absolutely benign," Langford said. He said the substance was turned over to police.

Maybe, just maybe, the usual suspects ran towards the police car with predictable results, police getting robbed and disarmed. We know how much police are loved in some 'hoods.

Then nursey comes along and gets snatched up in error. Could happen, maybe.

Who knows this case? Were the officers alert through and after the accident? Was a weapon or proceeds recovered from this woman? Were there other vultures taking shit from those officers?

There is not enough information in the short blurb on this blog to offer an educated opinion. She might have been telling the truth, she might be lying, who knows? We all know the police never lie or fabricate. I only say that after being the police here for 25 years. What's the real story here?

There must be some additional information! If not, the line was definately crossed and the critics need to shut up! If this nurse assisted in saving the life, or lives of two officers, for what conscionable reason was she arrested? Were ego's involved? On the surface, she should have been commended! But if this is exactly as described, whomever made the decision to arrest her should hold their head down in disgustable shame...and any awarded amount of money should not be given additional 'sound-bites' for this stupid police decision!

can anyone confirm that she was arrested because she held the officers arms back after the officer was semi-conscious from being struck by a speeding car and the officer then had her weapon stolen from the opportunist mutts in the neighborhood because her arms were held by the arrestee ???

Is this the true part of the story no one will tell in the papers???

Make sure you actually read the post next time before you make your ridiculous comment. They didn't settle. The City chose to go to trial...and unfortunately the outcome was not good. You must be one of those know-it-alls who always rags on Corp Counsel and has probably never been sued once. It's getting old.

Not enough info to make a difinitive judgement, but here's a take from a CFD medic....

I've been on the scene of several accidents involving police officers (CPD and otherwise). If the copper is conscious and able, I request that they remove their duty belt.(It's really uncomfortable to lay on a backboard with it on) I clear the weapon and give it to supervisor (CPD or CFD). Same goes for the occasional security guard.

On more than one occasion I've encountered officers with a severe enough head injury that the first thing they do is to reach for their weapon.

For me disarming an officer is a matter of my safety.

I, too, have had the local citizenry rummaging through cars while working on patients...

IF its the incident I'm thinking of, I was there that night. Occurred near Fuller park area, the area where a couple kids sitting in a car were shot of by Mickey Cobras a few years back and then Chief of Patrol, I believe, was quoted in the papers and on TV calling the offenders "savages." This incident occurred as described by the POs. Weapon was recovered same night from savage thugs who took it with the help of the F/1 (who I'm sure is only a CNA and not a nurse.) Unf%$ckingbelievable!!

Who knows what really happened in the confession room. SAhe could have signed because someone promised her it would be all over ans she would be released if she did. She could have signed without ever reading. Who knows. It is all a matter of conjecture at this point.

What I'm curious about, though, is why they even suspected her in the first place? Did they find the gun on her or another personal item from the officers? Did one of the officers snap out of the daze and see her try to take the gun? If it comes down to she was just simply standing there and the gun was gone, that is a pretty BS reason to hold her for over two days until she happened to confess.

Got this from a very close source.
Female and male run up to crashed police vehicle with two female officers inside. Driver and passenger probably knocked heads in broadside accident when hit, so both are dazed. Driver pinned behind wheel, passenger exits to help partner.
Male tells the "plaintiff" hold her and get her shit. Plaintiff tries to get her star, struggle insues with "plaintiff" holding passenger officer in a full nelson hold while male reaches into vehicle and TAKES driver's weapon. He flees, hides gun, tells play uncle where gun is. Play uncle gets nabbed and gun recovered later. The male returns to scene to see what happened to female who could not get away with arrival of the calvary. CITIZEN WITNESSES quietly let the police know who they actually have as a witness is the female offender. She is pinched for battery on scene. The male gets pointed out and grabbed for disarming, vehicular invasion et al. Guy caught with gun pleads out. Male found not guilty on technicality because element of vehicular invasion is entering by force and it is unknown if window broke in accident or by offender.
Female also found not guilty...how I am a little unclear. At any rate "plaintiff gave confession to ASA...was fed was allowed use of washroom..blah blah blah. She was offered 75000 and said no...then we upped it...she said no...7.9 mil.

there are some interesting articles out on the net about false confessions.

it turns out that commonly used police interrogation methods result in false confessions pretty regularly. it seems like the very methods that encourage the bad guys to confess sometimes convince those who are not the bad guys to also confess.

its a strange area of human nature.

For all of you that are unfamiliar with the case, its amazing to me, somemone that was, after having sat in federal court for 8 days and listen to the piece of shit attorneys liken us to the russian military and refer to us as inhumane garbage, that even some police would still take her side and ask questions of the police involved.
Let's clarify a few things first. These so called heroes of the neighborhood held Brogan in a full nelson head lock while other pieces of shit disarmed her unconscious partner. The plaintiff after first claimimg to be a hero was later implicated by a witness as the individual in question holding Brogan in the full nelson headlock. This witness, later recanted his entire statement at 26th street and to make a long story short, it was thrown out.
Next, a states attorney from felony review took a handwritten and signed statement from this plaintiff as well as a polaroid picture of the full nelson used on Brogan which was all evidence!! And while we are on the topics of handwritten statements, let's also talk about the one the witness wrote along with and signed with that same states attorney. This same witness who yes, recanted his story like the piece of shit he is.
Oh by the way, the police who u second guess, on scene that night, not only got the scumbag who took the officer's gun, but also arrested the uncle of that same piece of shit trying to sell it at a nearby factory for dope money!!

The problem is we have so many people who lie on this job, about everything. They can't write a truthful report or make a truthful statement about anything. When an officer is by the book and tells the truth, as myself, a lot of the other officers think you are soft or a rat. Honesty & integrity is not looked highly upon by a lot or rank & file officers & supervisors. It's looked at as a weakness which is really sad. I've been here 10 years and all of you know what I'm talking about. This is why I never wanted to go to a tact/gang team or a lot of other units, because good integrity and honesty is not one of their prerequisites. This lawsuit verdict is a prime example of what the public thinks about the truthfulness of chicago cops. We all have allowed the liars to take control and ruin this department. And we all suffer because nobody believes us anymore.

So i guess to sum up---This so called hero, now 8 million dollars richer, was identified helping in the disarming of an injured officer and we still got guys second guessing the police---God i hate this fucking job! It's nobody's fault but these piece of shit witnesses that later recanted, mind you after giving handwritten statements to an ASA at felony review!
Don't sit here at 2 in the morning and second guess what happened that night!! I have been on this god forsaken job awhile and seen some stupid things done by P/o's--hell i've done them i'm sure! But noone is to blame accept the garbage on the street that night. I hope the media is reading this too!!! You have taken all that is good from being the police and killed it.

The real story is, KV and KB were driving to 43/Wallace to get some lunch, get broadsided at 43/Princeton by some jag who ran the stop sign. Police car is spun so that it comes to rest facing north bound on Princeton. KV is completely unconscious (and is actually off the job now because of this accident, that's how bad her head trauma was). An actual concerned citizen does come to their help and sprays a fire extinguisher on the hood of the squad car. Now here's where the "nurse" comes into play. She along with two other accomplices drag KB out of the car using a half nelson and proceed to disarm her and take her star, as well as KV's duty weapon. KB is dragged up onto the front steps of the house located on the northeast corner of 43/Princeton. Now, during all of this she never lost consciousness, now to all of you naysayers I only know this because this is what she told us, but she was able to radio for assistance. I along with alot of 007th and 009th district guys show up to this situation. Now numerous people on scene told us what happened, and no this "nurse" was not just picked up because she showed up later, she was picked up because she is scum and tried, and succeeded to disarm two helpless Chicago Police Officers. If this lady truely is a nurse, i hope there is a special place in Hell reserved for her, because not only did she go against whatever oath she swore to help people in distress, now she is taking our tax money for being scum. And to 2:36 AM, GFY. You weren't there, so you don't know what kind of scum you're talking about. This "nurse" should be spending the rest of her life incarcerated, not collecting 7.9 million from the city. Yeah that's right, it isn't 7.7. The paper got it wrong. If I'm remembering right both officers guns were taken and one of their stars was taken. All of these were recovered that same night through some excellent interviewing and all three offenders were able to be identified and locked up

This broad had no business putting a injured P.O. in a full nelson.... newspapers need to hire P.O.s to get real story . This is BSSSSSSSSS. Newspaper reporters suck at getting the truth. Seems everyone that has responded so far takes the media at what is in print as the truth. Far from it. Public, wake up... these are your tax dollars. Get the reports through the freedom of information act, listen to the calls to 911. Stop believing every cop is a liar. The media is influencing our citizens and ruining our city. Prospective.. take a mixed ethnic population of 8,000-13,000 people in a given geographic area.. How many folks would get arrested yearly ? Compare to a police population. Folks wake up, you need us. Sounds like she held the alert/oriented officer while the altered po was robbed by the man. If she were really any type of medical professional she would have triaged the two victims and went to the aid of the unresponsive po first.

Years ago, my partner and I responded to a radio call of "fight in the alley" in a quiet industrial area off of Grand avenue in the 013 district...what we rode in on was a gang fight between rival motorcycle gangs with
50-60 participants...we called for back-up...when I told these assholes to get going; I was immediately attacked by 5 or 6 guys, beating me, a uniformed CPD officer,with a chain, fists, and feet...they ripped my shirt, w/star off my back...same with my partner only he was hurt with baseball bats...I fired my secondary weapon 3 times (never reported)...
when the calvary arrived with my SGT..we were rescued...and ordered to LEAVE THE AREA...we both got the summer off, IOD...per advice of SGT, secondary weapon disappeared...guess what...those motorcycle gang assholes, never sued the City or us...

The problem is we have so many people who lie on this job, about everything. They can't write a truthful report or make a truthful statement about anything. When an officer is by the book and tells the truth, as myself, a lot of the other officers think you are soft or a rat. Honesty & integrity is not looked highly upon by a lot or rank & file officers & supervisors. It's looked at as a weakness which is really sad. I've been here 10 years and all of you know what I'm talking about. This is why I never wanted to go to a tact/gang team or a lot of other units, because good integrity and honesty is not one of their prerequisites. This lawsuit verdict is a prime example of what the public thinks about the truthfulness of chicago cops. We all have allowed the liars to take control and ruin this department. And we all suffer because nobody believes us anymore.

This woman took nursing classes for one semester and flunked out. To be more accurate, she was enrolled in "nursing classes" for one semester and flunked out. She confessed, and several eyewitnesses gave statements implicating her. She gets charged after all this takes place. 10 months later the eyewitnesses all flip in court and she says she was forced to sign a confession. You can't win. Two police officers are injured pretty seriously and robbed. Don't you think the police would want to arrest the offender. Why on earth would the police "frame" someone. If one of our own gets hurt, what good is arresting the wrong person? We want the right person arrested. There is absolutely no motive whatsoever to arrest just anyone. Our motive is to arrest the right person.
