City Council Give Away $$$

We covered this in a committee hearing last month, now it was in front of the whole City Council.
  • The Chicago City Council today agreed to pay $2.25 million to the family of a 14-year-old home invader fatally shot in the back by an off-duty police officer in 2002.

    Ald. Ed Burke (14th) said it would be better to pay the settlement to the family of Juan Salazar than risk going before a jury, which could decide that the city should pay even more.

    But four aldermen – Brian Doherty (41st), Eugene Schulter (47th), Mary Ann Smith (48th) and Bernard Stone (50th) opposed settling the case.

$2.25 million to a dead criminal and the City crying poor over our contract.

Shulter is one of the better alderman. Has a Pro Police attitude and sends e-mails out to local residents urging them to cooperate with police and explaining that what we do is good. He like all alderman have negative points and loyalty to the daley machine, but is a lot better than than bitch alderman a little east of him (shuster) or something like that.

What's even worse than the City crying poor while showering this piece of shit's family with a couple of million is the message it sends to every other motherfucker who comtemplates burglarizing/invading a home that may or may not have a copper residing there.

This is just further reinforcement that we are second class citizens that will be punished (whether directly or indirectly) for protecting what we've worked hard to attain.

What should be reinforced by this latest exhibit of the City's spinelessness and contempt of the police is the working copper's conditioned response of "Fuck You, Daley, you ain't gettin' shit in the way of revenue generation from us".

Daley needs all of us pacified before April to help secure his Olympic quest. Please keep this latest kick-in-the-balls fresh in your mind when the proposed contract is being force-fed to us by our useless FOP with their canned disclaimer of "an arbitrator won't do any better".

Can the City sue the family for services supplied for this 14 year old. Police, paramedic, hospital, was this after curfew?, etc.....nickle an dime them to death as they do us to recover the $. Maybe the city should impose a tax on City Lottery winners. Everytime a family member who benefits from this is arrested, there should be a fee.

I e-mailed Ald. Ginger Rugai (19th) and asked how she voted, or why she did not vote NO, and she replied that she is head of another commitee which had other business the day they took the vote, so she was not present. Don't they ALL need to vote on a settlement??? Don't know if it's true, or BS??

Huh? If the family was awarded even more at a trial then there would not be any settlement. If they were awarded more it means they won at trial. When there is a settlement, the trial is ends without a judgement.

I heard the vote was 30 for the payout and only these other 4 aldermen with the balls to vote against it. The remaining aldermen were either not present or just abstained. Good for Mary Anne Smith. I heard she was the first one to stand in opposition to it.

If a your child takes your car and crashes resulting in death or injury to someone, who gets sued? The parents right?

Maybe if this POS Police Department fired the psycho, murdering POS, formerly known as PO Rafael Balbontin, we wouldn't be on the hook for yet another one of his ridiculous, out-of-control, mental meltdowns.

This POS should have never been hired, should have been fired shortly after he was hired, and should have been fired after numerous incidents where he proved he did not have any capacity to act rationally under even the most minute amount of stress.

The POS former PO is a total disgrace that killed his children's mother right in front of them. But, even before that, there were a whole host of incidents on and off duty that should have demanded he at least be fired if not jailed. As if attacking home invaders by firing his gun with so much irrational cowardice that he shot his own father in the process, wasn't enough to get him fired, the department waited until he killed his wife.

May he rest in hell after serving the remainer of his life in a cage.

This isnt a secret! I am involved in my 3rd lawsuit all of which are completely BS stories created by felons! Yet the city finds it easier to settle than to fight these cases. I have been told every single time i go to corp counsel that
"hey its not that we dont believe that you guys are innocent of these accusations, its strictly economics.If the city feels it can settle for less and in turn not risk losing more in a jury they will setlle." 2 of the 3 lawsuits I am involved in are slam dunk cases to ANY common sense jury in America. Now I understand common sense doesnt prevail in crook county however these are FEDERAL cases so the jury pool is open to residents of dupage, will, lake, etc... people that MAY have common sense. Im soo tired of the city making US look like the assholes and raising taxes and paying convicted felons simply for being arrested. Sure some of these people have their cases dropped in court but again ITS CROOK county, anyone that has walked into a courtroom can tell you that almost everything gets thrown out here. So now i can be sued for false arrest because the case was tossed? Its the CRook county way and a fucked up city we live in

Anyone who says they don't have a problem with thh way Lt(PK) is running the unit is a fool. This guy doesn't have your back and is only there to hopefully get a promotion out of it. IT shows in how he is running his half of the unit. HE is a spineless, scared shitless leader who doesn't want to take any heat from the higher ups.

If P.O's would have heard his speech on New Years Eve they would have went bizerko. "Not everyone with a gun is a bad guy an New Years Eve. Just because someone is drunk and wants to fire off rounds into the air doesn't mean they are a dangerous criminal! " WTF OVER! "We don't want to be known as the Mobile Assasination Force"

That speech put a ton of his officers in jepordy had they adheared to that. Nothing like putting any doubt whatsoever in P.O.s minds right before they hit the street. Those with very little time on the street may have hesitatted a split second after hearing that.

LT PK is out for only himself and that is the sad fact. It is a damn shame as this unit has a great potential. The Commander is top notch. HE IS THER FOR THE P.O.'s THAT WORK FOR HIM. He is truly a good boss and others should take after him. He has a lot in store for the unit and has some great visions. Things under him have moved rapidly. More than any other boss I have ever worked for. He has been straight up on his word from Day 1. He tells it like it is. If he can't get it donme he will tell you.

The LT on the other hand is scared of his own shadow and is going to get someone hurt. As long as he is there things will continue to be held up. He is not a leader and it shows in his roll calls. No speaking skills whatsoever. He has already left P.O's in the dark. And as long as he is there you can count on never seeing the workouts on the clock like promised at the interviews. Than He is opposed to them 100%, but yet they want you to pass the power test 3 times a year and wear all this specialized gear.
He obviously has never done any kind of specialized training in those haz-mat suits or carrying any type of gear. All this training they want to give us takes its toll on your body. WE all got moved to DOG# 2 because that was his DOG. Never mind F"n the rest of us over the holidays who already had plans.

Some of the SGT's are what are holding the unit together. And yup you already know there are at least 2 that are shaky as shit!(FH and JH) Most still look out for their people and know what it takes to have a team operate smoothly. Yet the LT is all over them. Thank the good heavens the SGt's still run their teams otherwise the unit would have half the bodies it has. PK would have ran over half of them out with his no balls lack of leadership.

Because of other issues concerning the officer, this was a case we were better off walking away from. That being said there are a lot of suits we should fight and don't simply because of the costs to litigate and the possiblity of losing even a larger amount of money

He did testify at the first trial that would have cost the City over $4 mil, but for this settlement ... I guess he did not sound that credible trying to explain the placement of his shell casings.

I saw Burke at a recent police funeral and he wore a badge around his neck on a chain. I couldn't get close enough to see if it was a police badge or an alderman's badge. Even if he is still on leave of absence he should not get a police badge, you have to turn that in. That is, I would have to turn it in, maybe not Burke.

The rules are different for the connected, you all should know that. their excrement has a different odor I am told, not as strong as we common mother fuckers.

I agree. I'm a citizen and what this cop did to his family has little to do with the city awarding criminals OUR money. That's a separate issue entirely. The point is that someone (cop or no cop) defends their home with lethal force, which is WELL WITHIN THE LAW, and somehow our city is paying out MILLIONS.

That says to me that we reward criminal behavior. What's the incentive to not rob, steal, and kill? It's not like us ordinary citizens are armed - by and large anyway. These people are animals. They understand one thing, and one thing only, and that's physical punishment. Whether that's the threat of death, severe pain, or death itself will depend on the situation.
If I was in the situation, I'd have done the same thing, although I was told by a cop friend of mine a long time ago to never shoot someone in the back - even on your property. He said you can do whatever to keep them inside or get them to turn around, but to absolutely never shoot someone in the back. It's a technicality.

invade home = death. I wish more people thought that way.

It has become painfully obvious to me that this mayor would rather make these payouts, than allow the lawyers and their damn depositions to poke around in city 'business' (ie corruption). Once a deposition gets going, it can snake anywhere and bad things can happen, (eg Jon Burge).

By paying off this kids' family, no one will be asking embarrassing questions about police firearm practices and training or police manpower or other dirty secrets that Daley wants kept away from public scrutiny. The International Olympic Committee may have an interest in this, because if they knew the truth, bye bye 2016 Chicago Olympic Games. I'm pulling for Buenas Aires!!!

This was the P.O. who said that the guys tried to kick in the door on his fathers house and then the P.O. chased him down the block, shooting him in the back. Sorry SCC. Usually agree with You but this time I have to aggree with the negative Balbontin comments.

Lets just say I know from first hand experience that balbontin completely lacked credibility. Even before he murdered his wife, an obvious tragedy, the guy was transparently psycho. Don't know what happened during the home invasion, but I can say with total certainty, having seen Balbontin on the street, that he did not belong in uniform with a gun. He was a liability to others in his district, citizens and officers, and was one of the most glaring examples of the need to revamp the FTO program so as to give FTOs real authority in the evaluation and if necessary termination process. What the city attorneys realized, correctly I believe, is that in the case of Rafeal Balobontin, they just had to settle. Can you imagine if the case had gone to trial and Balbontin appearred in a yellow IDOC jumpsuit.

I am not a lawyer, but I seem to remember a famous Supreme Court decision that changed use of force for ALL police. I remember having to be retrained because of this decision. Some of the younger officers may not know or remember this case.

It was Tennessee vs Garner, occurered in the 70's and decided in 1985, where a 14 year old burglarized a home, and when confronted ran away. The memphis copper shot him in the back as he was jumping a neighbors fence to escape. At treial the copper was asked why he shot him and he said "because if he made it over the fence he would have escaped"

The Supreme Court decided that since the officer or no one was in danger at that time, a fleeing offender could not be shot in the back.

The balbontin case sounds exactly the same, he shot the kid while the kid running outside. I think a bleeding heart could have awarded a lot more. And Balbontin as our #1 witness???

I think the coppers family should now countersue for the stress caysed to them from that incident,

I guess I'll interupt now and call BULLSHIT!!! Schulter is THE BITCH. Just ask the 019th Dist. He calls and cries and bitches all the time to the desk and w/c. He treats coppers like they were sworn in to serve HIM.

Like with many clout people, his kid is a little jagball who wants to be the police, but he wants to start at about the rank of Lieutenant(shades of Ed Kelly and his spawn, as I recall). He looks down his nose at everyone else.

I saw Burke at a recent police funeral and he wore a badge around his neck on a chain. I couldn't get close enough to see if it was a police badge or an alderman's badge. Even if he is still on leave of absence he should not get a police badge, you have to turn that in. That is, I would have to turn it in, maybe not Burke.

The rules are different for the connected, you all should know that. their excrement has a different odor I am told, not as strong as we common mother fuckers.

There is a difference in our case if my understanding is correct. This little felon was armed and this was a home invasion. If our victim/policeman made his presence known as the police in an attempt to arrest him then he could shoot him anywhere he wants. Armed with a weapon in an attempt to escape, he's dead meat. Who's to say that killing this little asshole didnt push this copper over the edge. Its not a natural thing taking a life. As far as this copper being a little off before this incident, I know a lot of coppers that I have thought were a little off, but they were good policemen. I agree with scc, whatever happened after this incident should not count.

OT: MSF DETAILS per request in another post

Anyone who says they don't have a problem with thh way Lt(PK) is running the unit is a fool. This guy doesn't have your back and is only there to hopefully get a promotion out of it. IT shows in how he is running his half of the unit. HE is a spineless, scared shitless leader who doesn't want to take any heat from the higher ups.

If P.O's would have heard his speech on New Years Eve they would have went bizerko. "Not everyone with a gun is a bad guy an New Years Eve. Just because someone is drunk and wants to fire off rounds into the air doesn't mean they are a dangerous criminal! " WTF OVER! "We don't want to be known as the Mobile Assasination Force"

That speech put a ton of his officers in jepordy had they adheared to that. Nothing like putting any doubt whatsoever in P.O.s minds right before they hit the street. Those with very little time on the street may have hesitatted a split second after hearing that.

LT PK is out for only himself and that is the sad fact. It is a damn shame as this unit has a great potential. The Commander is top notch. HE IS THER FOR THE P.O.'s THAT WORK FOR HIM. He is truly a good boss and others should take after him. He has a lot in store for the unit and has some great visions. Things under him have moved rapidly. More than any other boss I have ever worked for. He has been straight up on his word from Day 1. He tells it like it is. If he can't get it donme he will tell you.

The LT on the other hand is scared of his own shadow and is going to get someone hurt. As long as he is there things will continue to be held up. He is not a leader and it shows in his roll calls. No speaking skills whatsoever. He has already left P.O's in the dark. And as long as he is there you can count on never seeing the workouts on the clock like promised at the interviews. Than He is opposed to them 100%, but yet they want you to pass the power test 3 times a year and wear all this specialized gear.
He obviously has never done any kind of specialized training in those haz-mat suits or carrying any type of gear. All this training they want to give us takes its toll on your body. WE all got moved to DOG# 2 because that was his DOG. Never mind F"n the rest of us over the holidays who already had plans.

Some of the SGT's are what are holding the unit together. And yup you already know there are at least 2 that are shaky as shit!(FH and JH) Most still look out for their people and know what it takes to have a team operate smoothly. Yet the LT is all over them. Thank the good heavens the SGt's still run their teams otherwise the unit would have half the bodies it has. PK would have ran over half of them out with his no balls lack of leadership.

maybe the articulation wasn't up to par. if the could have made a case that the officer, in his heart, believed that the little asshole may have done this again within a relatively short period of time, this shooting would be okay. there was a training video with matt tobias as the speaker made about 3-4 years ago about an instance similar to this scenario.

We support the process you idiot. The process must be followed to expel these predators and disgraces to the badge from our midst. If someone circumvents the process for political reasons, then that ought to be pointed out. But the process should remain in place for all the persons who end up going through it at some point.

If you can't tell the difference between supporting the rights of the accused (especially the wrongly accused) over supporting the actions of the accused, then you're truly lost.

It is the PROCESS that protects the worst sick-in-the-head-fucks who call themselves police at the expense of the rest of us who actually are police. Lost battons, no hat, dirty shoes, missed court, that's what this department is concerned with. That's the easy stuff. Those are checkmarks that let the inspector go home after two hours.

Felon with forty arrests says you stold the money you inventoried, Pookey with ten battery convictions says you shouldn't have hit him back after he punched you. Those are the "on-going" investigations this department engages in. Why? Because it's easy. It can go on forever. They can pick who they gig and who they don't. They can give big penalties to guys on the outside and slaps on the wrists to guys on the inside. They can keep the "investigations" going forever and it'll look like they're working. Those fools at IAD and IPRA are not working. They're home before their first cup of coffee gets cold.

The PROCESS puts it on the street cop. It's his job to root out the few nutjobs the department hired. Not the Sergeant, not the Lieutenant, not the Captain, not the Commander, not the Area Deputy, not the Area Chief, not the Assistant Deputy Supt., not the Superintendant. It's not their job. It's yours. Along with finding Boo Boo's pack and chasing today's baby's daddy out the house, it's also your job to "out" the few punks on this job. How? Tell someone? Who? And why should we? When the fuck did it become our job?

Make one commander responsible for any one of those idiots and the few rotten apples on this department would all be at call back tommorrow.

Then, who do the juries blame for our scandals? The thin blue line. It's our fault. Not the ten levels of over-paid supervision. It's not their fault. The jury thinks we protected them, it's our fault. We're all liars and enablers. We're just as bad as the worst psychos amoung us. It's all bullshit, but its making lawyers rich.

And every comment on this blog that supports one of these punks when they couldn't be more in the wrong, just stokes the fire that is making all these personal injury lawyers rich.

If someone's screwed by this department who doesn't deserve it, I'm all for the benefit and the public cries of injustice. When a long-time thug masquerading as a cop gets the short end of the justice stick, tough! Clap your hands and move on. Don't be afraid to post comments that call a spade a spade.

The citizens deserve the Balbotin fine. They deserve more fines. They've let the management of this department do nothing for too long.
