Update to Previous Post
The Inevitable Lawsuit can be found at the embedded link or just page down two days. In it, we posted the following:
- Here's where a real superintendent would ignore the "we don't comment on pending litigation" BS and go to town on this deranged segment of society that seeks a payout because they raised an asshole who managed to get killed while being an asshole.
Well here's the opportunity. According to an e-mail we received, a 16-year-old was charged with Homicide Monday. After being advised of his rights, with his guardian present and on video, he admitted the following:
- being an accomplice of the dead Rakeem Nance,
- that Nance was given a gun by another individual,
- that Nance and a third individual were carrying guns during a home invasion,
- and admitted he saw Nance running with a gun in his hand when police arrived on the scene.
That kind of blows momma's lawsuit out of the water, doesn't it? And gives Corp Counsel an almost airtight case. They might actually have a 50% chance of winning this one.

SCC, I'm surprised at you. They still won't win.
You can't expect a bunch of slugs admitted to U of I on clout, and then admitted to law school on clout and then given jobs on clout after graduating at the bottom of every class to actually do the job they are supposed to do.
I mean, they'll show up to work most of the time, and to political events all of the time, but to expect them to go to court and WIN? Come OOOHN, now.
Expecting them to steal for the Machine, now that's an entirely different story.

That would be true, IF winning this one was their goal.
Since settling is often the goal set by the 5th floor miscreant, ie., 'legal' payoffs to those whose 'services' are rendered behind closed doors, the outcome of this particular case will reveal the nature of the cc's actions.
50% chance...? maybe 10% at most.
This is very easy to explain.
1. The law firms talk to the Daley administration.
2. They tell the Machine how much they want.
3. The machine agrees on condition:
A. The lawsuit must be handled
by a connected law firm.
B. Tickets must be sold and
donations made to the right
people
C. Connected people must be
allowed to appoint friends/
family members to positions
in the firm
D. All involved parties will
provide soldiers/workers for
the machine.
The City knows how much will be paid.
The city does not care how much is paid. It doesn't matter, it does not come out of the machine's pockett, just blame the Police, raise taxes and make some MONEY !!!!!!!!

No sireeeebob...she ran right out and retained Cochran, Cherry, Givens, Smith & Montgomery L.L.C. That's right. Jonny Cochran of O.J. fame, lives on at the helm of this "if it's white, it ain't right" band of hate mongers. By the time they're done, they'll have every little old grey-haired grandma on the jury convinced that it wasn't some gun-toting home invader the po-leese shot but Emmet Till himself being chased by red-necked, good ole boy sheriffs deputies and the Klan.
Oh, yeah....and the "Montgomery" on the masthead belongs to the former City of Chicago Corporation Counsel James Montgomery. That's right....the CITY'S attorney. Isn't there some conflict-of-interest shit going on here? So when he picks up the phone and asks one of his "eyes and ears" in the CC's office, he doesn't get an inside peek at the trial ACC's notes? Puh-leeeeeeeese.
From the dealer on the corner to the Earl Strayhorns and Gene Pinchams on the bench, it's all about the Ghetto Lottery.
And I'll even betcha that if you look closely enough, you'll find that Mama was steered towards this firm by someone with an insiders perspective from the 24th Ward, Regular Democratic Organization or something like that. Another scheme to supply money to the underground economy that keeps the drugs flowing, 24" rims turning and big screen TVs blasting in the 'hood.
Obama won't support Tort Reforms and wants EVERYONE to share in the "health care reforms." In the words of Darth Vader: "The circle is complete!"
And after the shithead's momma and lawyer get through promising the other little shithead kid a couple thousand bucks from the lawsuit the kid will pull the ever growing popular jailhouse scam of "I recant", sorry. Pay me.

And Mr. james Montgomery, former Corp Counsel, Chief Corp Counsel, is next door neighbor, like right next door, to Barack Obama.
If anyone could shake the money tree it is James Montgomery.
But what about the larger picture, we are running out of up and coming rappers, what are we to do for young thugs mumbling in your face gang bullshit? There may come a rapper shortage!
Daley's people will settle this case too. If the City doesn't pay, Daleys hand picked liars make $0.00, it also means that shortshanks misses an "under the table" payday.

It appears that they failed to conduct due diligence prior to rushing to the court house and have left themselves open to being sanctioned!
The Corp Council has many of the problems the CPD has. Their staff has been reduced and they were undermanned before the tidal wave of lawsuits.
Top of the class? Who knows? The ones I have dealt with were pretty good, but most were brand new. They have the same problem that the A.S.A.s have. When the new guy gets enough experience, he runs off to a law firm and goes to the 'Dark Side'.
People are people, for the most part they suck. They vote for the guy they think will slip them a little. They take care of themselves as much as possible. The are very few legit, good people out there. When you find one, make sure you let him know.
Are you kidding? If the kid came back from the dead and confessed his sins, his accomplises did the same, the police could prove beyond a reasonable doubt and there was video to prove the entire story; they would still settle out of court for fear of missing something.
Too bad they don't control our contracts. We'd be millionares!

You don't actually believe that, do you? What possible reason does the Mayor have to give away tax money. Pocketing it himself, I can understand, but giving it away to the ghetto people? I think you give him too much credit. This is the worst criminal elected official in the history of the U S, not Robin Hood!

When the Officers involved in this shooting go out and find their own Attorney, who would go after the estate, fillers of false suit's and the City then you can say you did something. You say Mom doesent have anything, Her attorney does go after him each and every time,
Once they lose a case and no pay out on these false charges one would think that an Attorney would think twice before filling knowing that an Officer is going to fight and posible win,
I.E. At $10.00 an Officer that X13,000 Officers is $130,000,00 a year for a retainer to have someone to call when needed. ($10.00 a year is nothing). Just an example, do anything, but do it.
Hire an Attorney now to fight these charges and go after these people.

The fargin bean counters never looked beyond the immediate, they have, as they have all over Crook County with other municipalities, created a new business in ambulance chasing attorney's and that’s to file nuisance suits. In some cases there worth little work and big pay off's.

The bottom line is that the corp counsels are not your friend if you are a cop. They are the ones that try to fire you and represent the Supt. at the Police Board.
And speaking of that: WEISS showing his lack of common sense and direction in signing off on more 30 pendings today. Does he not read the files when they get to his office. Is Kirby the real Supt? Good luck you guys-hope the board is str8 up with you since your own dept fucked you.
We are our own worst enemy when it comes to winning lawsuits, cops changing their storys and not showing up to get prepped when their ass's aren't on the line. Last year I was at the court and a copper waiting to testify was wearing his camoflauge BDU's, he was a witness, I asked my lawyer if he was supposed to dress like that, the lawyer told me that they asked him to wear caual dress and he said "This is what I wear, if they don't like it to bad" now I know that we can do what ever we want but thats what Lovey counts on. Our lawyers also listen to us during the initial meetings and decide after meeting with some of the knuckleheads we work with how they will act on the stand. Just play the game.
Once again, as they approach that "magic number" that being the 'minimum' starting fee for the outside attorneys to begin to defend this case, the Corp Counsel will make an offer, regardless of the lack of evidence 'below' that amount to settle the case, out-of-court.
In their litigious minds they saved...a few thousand dollars for not paying the outside law firm on this no brain winner BUT technically there was a judgment vs. the officer. No matter what the stipulations of the settlement are, if there was a next time for the same officer, however bullshit again, the attorney could bring up the fact that there was a settlement by the city(freedom of info act) for a shooting by this member, thereby prejudicing a judge or jury in any subsequent cases.
So while they ONLY save the city a few thousand dollars to settle out of court they ruin another copper for life.

3. How much of the settlement amount do you 'really' think finds it's way back into the coffers of the political machine's campaign funding?
