Good News on the Gun Front

Looks like Chicago is going to join the United States of America finally. The Sun Times:
  • The U.S. Supreme Court’s decision Wednesday to hear a challenge to Chicago’s strictest-in-the-nation handgun ban likely means the other holster is ready to fall on the ban, advocates on both sides of the issue seemed to agree Wednesday.

    “A year from now there will not be a Chicago handgun ban,” said Alan Gura, the attorney representing the gun owners fighting the ban.

    The high court’s five-member conservative majority last year threw out Washington, D.C.’s gun ban in the District of Columbia v. Heller case, but stopped short of invalidating the rest of the country’s handgun bans because that case dealt with federal bans, not local ones.

  • By agreeing to hear a challenge to Chicago's sweeping ban on handguns, the U.S. Supreme Court set the stage Wednesday for a historic ruling on gun rights.

    At issue is whether state and local gun-control ordinances can be struck down as violating the "right to keep and bear arms" cited in the Second Amendment. A high court ruling on the city's 27-year-old ban, which could come by summer, could open the door to legal challenges of various gun control measures nationwide.

    Chicago gun rights advocates applauded the court's decision, saying that it gave them a good chance of overturning the ban, which they argue gives criminals an advantage over other citizens. They say that lifting the ban would help reduce violence on city streets and allow citizens to protect themselves in their homes.
Luckily, Daley says the city is broke, so he shouldn't be able to mount much of a defense at the Supreme Court next year. Right? We mean, he wouldn't possibly think of wasting taxpayer money on a losing proposition like this, would he? Everything is tied up in the Olympic bid, right?

We eagerly await the lies and fictions that are to be put forth by Shortshanks and his sycophants about "streets being more dangerous," "rivers of blood," and other such popular fictions that have been disproven in 48 other states that have handgun ownership. We also look forward to citizens helping to reduce the street crime rates.

Why?
Because if my understanding of the case is correct, there's no way we can lose regardless of how it's decided.
Chicago argues that the 2nd Amendment applies only to federal land, and not to the states. Ergo, the concept of "incorporation" via the 14th Amendment is null and void.
McDonald argues that the 2nd Amendment does apply as "incorporation" vis-a-vis the 14th Amendment is valid.
If McDonald wins, further affirmation is granted to Heller and the unconstitutionality of banning firearms.
If Chicago wins, SCOTUS is saying that the "incorporation" clause of the 14th Amendment is invalidated (I would argue - by the 10th Amendment) and therefore a precedent is set which further separates state governments from federal government control.

As an amendment to my previous statement: I don't understand all of the issues in play, so I may have spoken too soon. I'm actually conflicted about this case because, if my understanding of it IS in fact completely correct, then their win(the city) would set a substantial precedent which can be used in the future to further affirm state law sovereignty from the federal government on ANYTHING –– not just firearms(though from witnessing the bang up job these political hacks are doing this may not be a good thing, in this case at least)
A widening rift of the separation between federal and state powers if Chicago wins. As much as I dislike the thought of the city winning this, what they're arguing is essentially the ideals of the founding fathers as established under Article IV and Amendment X to the Constitution.
Like I said, I'm conflicted.

The kingdom of shortshanks knows no law other than their own. The Supremes may overturn Chicago's current ban but I would expect another more "creative" effort to be forthcoming...guns are legal but bullets are against the law

Isn't shooting sports an Olympic event? How can this event be held in the Chicago 2016 Olympics if there is still a gun ban in place here?

Where is the proposed venue for the Olympic Shooting events? Altgeld Gardens? The West Side? Which CPS Public School will host this?

Anyone remember the Bassmaster Classic held in Chicago around 9 years ago? Some good old boys were pre-fishing in their Bass boat in a waterway close to Altgeld Gardens when they came under fire from the shore. I hear they got the hell out of town quick and took a pass on that year's classic.

Maybe in the 2016 Olympics Shooting Events the shooters could contend with return fire. That would sure make it interesting.

Amen to that Brother (Or Sister). I also have let many a law abiding citizen go on their way with their gun. Some may say they are breaking city Ordinance. I always thought I was following a Higher authority, the 2nd amendment.

I feel the same way about our sanctuary city rule.

To answer a question from 6:28, The Aurora Sportsmen's Club is in negotiations to be the venue should Chicago get the olympics. The thought is to get the benefit for sportsmen after the olympics are long gone and have the improved shooting facility rather than just have a shooting range build and torn back down after the Olympics.

But with the SCOTUS case pending and if won, citizens should demand that the City builds a facility that all law abiding Chicagoans have access to to learn firearms accuracy unlike the normal spray and pray from gang bangers.

Yes, the handgun ban was only for the uninformed and the people with no clout. I recall that around 1998 the female sergeant in charge of gun registration was caught forging registrations for her family. She was forced to resign, but not until she was promoted to lieutenant. This officer was telling people that if she goes down she will take others with her and hinted that many connected people had their registrations backdated so they could have a handgun. Now, move forward to 2009 and Ald. Mell wanted a special ordinance so he could protect his gun collection that he forgot to register.

Even after the ban is overturned, Daley will try to implement as many restrictions as possible on handgun ownership, just like D.C. has done in the wake of Heller:

"It took $833.69, a total of 15 hours 50 minutes, four trips to the Metropolitan Police Department, two background checks, a set of fingerprints, a five-hour class and a 20-question multiple-choice exam...I had to allow the District government to fire my gun before I did so its ballistics could be recorded."

Scalia may vote with the City. Scalia is a staunch conservative, and believes in the 2nd Amendment, as well as states' rights. He has stood for states' rights when the Federal government has tried to take away rights, and will likely stand by states' rights even when Illinois (Chicago) is trying to take away a right. It will be a bad result from a man with good principles.

THe 14th Amendment violates the spirit of the Constitution completely. No one sees that? All you great thinkers out there?
THe framers insisted on the Bill of Rights in order to limit the powers of the FEDERAL GOVERNMENT in 1789. Then in the 1860's the 14th Amendment is adopted by possibly the worst president in our history, Lincoln. He violated the COnstitution at will he did. Now the 14th Amendment magically makes the STATES subservient to the Federal Constitution. That's not good. That's not good at all. Guns being legal is great, but it is a state issue, governed by the will of the people of that state. That's States' Rights. That's what we want.

Legal or not, I have NEVER nor will ever arrest somebody based soley on an unregistered firearm. "You have a handgun in your house sir?" "You have a valid FOID card in your possession sir?" "Have a nice day sir." Any officer that does arrest somebody based soley on this "unconstitutional city ordinence" should sit on a plunger in the bathtub.

I lucked out and the UUW was SOL'ed. But, because the FTR "conviction" on the same docket ticket keeps me from clearing my name.
