Look! Judge Follows the Law

A judge follows the law, exactly as it's written, and somehow, this is news:
  • A Cook County judge today dismissed the indictment against Chicago Police Officer John Haleas, the officer accused of writing numerous false drunken driving tickets.

    Judge James Obbish ruled that prosecutors improperly used statements given by Haleas to Internal Affairs investigators looking into misconduct charges against him. A U.S. Supreme Court case prohibits statements from administrative disciplinary proceedings from being used against officers in criminal cases.

    Haleas was charged in March 2008 with four counts of perjury, four counts of official misconduct and two counts of obstructing justice. He was stripped of his police powers.

Garrity carries the day. Just because you are a police officer, you are not below the law. You are entitled to each and every protection provided to an American citizen in the same circumstances regarding alleged criminal conduct. Adminstrative discipline is another matter.

This part is typical Cook County State's Attorney though:

  • In his ruling, Obbish noted that the internal affairs investigator involved in the case and the assistant state's attorney in charge of seeking the indictment gave differing versions of how Haleas' statement was handled during the investigation. An internal affairs sergeant said he informed then-Assistant State's Attorney David Navarro of the statement, which Haleas had no choice but to give in the internal probe of allegations he was making false DUI arrests.

    But Navarro said he had carefully kept any information about the statement out of his case file in order to not taint the criminal investigation, according to Obbish. However, Obbish said he had no way to verify that claim because the state's attorney's office lost the file.

This is what happens when you have political hacks pretending to be lawyers. We suppose the file was "lost" when someone smarter than the ASA running the case realized the report contained more evidence of prosecutorial misconduct than of police wrongdoing, so it's easier to lose the case on a motion. It keeps the ambitious ASA politically "clean."

And this, more than anything, should have put a complete end to ASA ride-alongs.

Alavarez seems to be incompetent...the felony review unit is questionable, at best...anyone know why, and still, only two Illinois counties (Cook being one of them) still use a felony review unit?...can anyone return justice to Illinois citizens?

Has IAD ever been able to put together a successful case? Everytime they conduct an investigation they seem to look like they never did this stuff before.

I try to get it across to all the new Officers..... Beware of ASA's..... they are lawyers!!! Everyone of them will hang you in a second to try to make a name for themselves and move up in their world. DO NOT LOSE YOUR SENSE around them, never cut corners and always DO IT BY THE BOOK-EVERYTIME!

The same day Haleas was cut loose by Judge Obbish and the Tribune ran an article about lax enforcement of the traffic laws resulting in the death of a pedestrian, the idiots at ABC Chicago ran a story in which it was suggested that another PO be prosecuted for enforcing the DUI laws. The ABC story focused on Off. Fiorito in 023 and claims he has wrongfully charged people with DUI and given false testimony in court. Another witch hunt just like the BS with Haleas and Parker. The public and the press are schizophrenic. On one hand they bemoan the lack of punishment of those who flaunt the traffic laws, on the other hand, they seek to prosecute POs who attempt to enforce the law. Ladies and gentlemen, you have a thankless, dangerous job. Stay safe.

Thank you for noticing.

The media are cowards and do not like to 'go after' people who will fight back. That's why they won't write about the corruption in the Daley administration because they all know he will come after them.

The police, on the other hand, who are virtually prohibited from talking to the media or from defending themselves outside of a courtroom are the perfect fodder for their criticism.

It also doesn't help any to have a police union who is more worried about their next golf outing or selling crap from their gift shop than standing up for the victimized officers and being vocal about the media's biased reporting. But, I guess when you're in bed with the mayor, you have to do what you're told. What does it cost to buy your silence anyway, FOP?

IAD cannot put a case together because most, but not all of the sergeants and lieutenants assigned there are connected, minortity, double merit promotees like West-Givens, Cochran, et al. I know a few sharp guys who took the spot because they deperately needed a second car at home; however, their presence hardly serve to balance out the morons that make up the bulk of the supervisors assigned there.

Let's not go that far.

Please remember that this moron was racking up DUI's for the sole purpose of getting awards. Then, he takes ASAs on a ride along and lies on his reports.

He will get fired. He should get fired. And had a qualified criminal prosecuter handled his case, he very likely would have gone to prison.

Don't forget that the feds may show up at his door one day to finish this job.

These recent DUI disgraces all have one thing in common. The coppers wanted to win accolades. They undoubtedly put away a lot of drunks, but they almost certainly used bullshit to hook up a good number of working people in their quest to be #1 DUI moron.

I've seen these DUI freaks on my occassional trip to traffic court. They had one more thing in common. They were all soft in the head.

Had these idiots just done their job, they would have made plenty of money in court and they'd still have a job, but that just wasn't enough for them. What they wanted was special attention.

And now they got it, along with the rest of us.

Parker? PARKER?? What "BS" are you talking about? He is a lying, racist sandbagger. Why do you think he resigned when faced with accusations of serious misconduct backed by videotaped evidence from his own squadcar mounted dash cam? Because the cookie-cutter narratives of his DUI reports didn't match what was recorded in stop after stop. He got away with it for years. Without video evidence backing up the claims that he was putting cases on people, it would have only continued until he retired. Traffic Section is so much more peaceful with him gone. No more bogus CRs filed against officers or supervisors he didn't like. No more anonymous letters.

Yesterday, it was pointed out how a POLITICAL PROMOTION during these rough economy times, R. Hamilton, assigned to the Academy, was mysteriously promoted (not by service rank, solely in salary), cost the taxpayers of Chicago $11,106.00 per year. This political promotion was generated by Mike Masters.

In terms of dollars that POLITICAL PROMOTION has been nothing compared to Keating. Keating has been promoted, again not by service rank nor passing a promotional examination, solely based on his relationship with the Mayor. The same Mayor that wants us to take 24 unpaid furlough days. Keating is the service rank of a Sergeant, yet his rank of Deputy Chief costs the city $55,000per year.

It’s ironic that when a working copper gets sued, the media points out what this Officer has cost “the residents of Chicago”. The media attempts to force this Officer off the job. Well, Keating received Commander’s pay for long times at the Mayor’s detail while the rank of a Sergeant.

These Two political promotions cost the “residents of Chicago” $66,186.00 per year. Further, a fair estimate is that Keating’s political promotions have cost the “the residents of Chicago” over a Half of a MILLION Dollars thus far.

IAD is, was, and probably always will be a haven for those with the clout and influence to get a transfer to that unit. Straight days, weekends off ( usually) and for many a take home car is a big draw. Competence as an investigtor, fairness and resistance from political or department presure has never been a criteria. Most of the investigators ( patrol officers or sergeants) have never been good or decorated street coppers. They really have a strange twist to their thinking. Cover-up has always been a routine and going after people whom the powers-to-be wanted screwed happens more than you think.

As to the content of correspondence:


1. ALWAYS remember that ALL incoming correspondence is subject to being inspected and read by BOP staff.

2. HARDCOVER books MUST BE shipped from their purchased source, ie., a business and an invoice included within the shipping package. This also includes magazines, newspapers, periodicals, etc.

3. SOFTCOVER books may come from any source.

4. There is an official limit of 5 books being possessed by an inmate at any given time. Rarely enforced, but you never know. Thus, sending more than 5 books in one shipment may result in that shipment being refused.

5. The content of reading materials must not include images of weaponry, nor of 'explicit sexual content'. 'Explicit sexual content' is commonly determined by the judgment of the individual BOP employee assigned to inspect incoming correspondence at the time of it's reception. Both males and females are employed by the BOP. This policy generally applies only to images, not to textual content.

6. If anything mailed is rejected, the sender should receive, with the returned item(s), a form explaining the reason(s) for said rejection.

7. ANY content deemed to relate to violence, sexual depravity, criminal activity and, in any manner, implying anything to do with 'escape', will be noticed. (this for those who haven't got a clue)


8. Keep in mind that inside, 'good will' goes a long way, so, a particular book on a particular subject may not be of interest to Bill, but may be helpful in sowing what seeds of 'good will' can be sown.

They train us poorly and them are surprised at what happens with a poorly trained police force. Then they treat us like children.

In 019 the sergeants now have to accompany each and every PO out to their squad car and inspect the GPS device for tampering and inspect the in car cameras and microphones. Every day, now this is the drill. And oh, by the way, go write tickets, make arrests and be aggressive because they have our backs.
