CVS Lawsuit
The father of a shoplifting suspect allegedly strangled to death by a CVS employee as an off-duty Cook County Sheriff’s officer stood yards away filed a wrongful death lawsuit Wednesday against the convenience store.
Michael A. Johnson claims a CVS manager strangled his son, Anthony Kyser, while attempting to arrest him for shoplifting, according to a suit filed in Cook County Circuit Court.
The suit claims the manager assaulted and battered Kyser, and the store is responsible for the manager’s actions.
The eight-count suit, which also claims false imprisonment, is seeking more than $400,000 from Highland Park CVS and the unidentified manager.

I think it's kind of funny that daddy filed suit before the ex-wife could! ha ha
Lawsuits are completely out of control in this City. Don't know what the rest of the Country is like, but Loevey and Loevey ( and similar vermin )seem to have this shithole City by the short and curly's!
Did anyone notice the name of the LT that kept giving out out inaccurate information about the off duty sheriff? First the sheriff wasn't there. Then she was but didn't have her gun out. Then she had her gun out but didn't point it at anyone. Was this none other than Phil clones old pet Sgt from headquarters? Thanks for another incompetent boss Phil. Your legacy lives on.
How big a part of this guy's life do you think his father was before this?

And so goes the life cycle of the typical ghetto-dweller.
Much akin to the life cycle of a horsefly, it began as a maggot, owing it's very existence to the lifeblood it drained from unwilling hosts.
This process continued until it developed into adulthood; a grown insect that thrived on living around shit while it's only life goal was being a biting aggravation to those that didn't want to be bothered by it.
Downtime is spent mindlessly buzzing around in warm weather, while becoming semi-dormant and lethargic in cooler temperatures. Doing nothing productive while being a perpetual nuisance is the only destiny for these two parallel creatures.
And then, when nature deems it necessary, these flies are "swatted", temporarily suspending the misery they cause others. That is until the next batch of larvae are spawned.
And the cycle continues...
I know people who work at CVS stores. It says right it in the company manual:
"Managers and employees shall not use deadly force including decapitation, strangleholds or disembowelment to detain shoplifters. Employees shall call the local police who are the professionals and are properly trained to employ these methods.”
Yes my son the "ex-barber " who learned his trade in prison, and had it not been for his crack addiction been able to ply his trade somewhere, despite the fact that I nor his "ex-wife" would allow him in our homes because he kept ,smoking ... I meanstealin ....I mean borrowing things.,was just about to turn his life around, were it not for that evil man . Sure my son stole some stuff ,punched him in the face and continued to fight with three men in an attempt to break free! but that don't mean that he deserved to be choked to death ! That nice county sheriff lady shoulda shot him in the head like any other rabid animal run wild !"
PEOPLE YOU KNOW HE WAS A THIEF! HE CONTRIBUTED NOTHING,I REPEAT NOTHING TO SOCIETY SAVE A STATISTIC AND A COUPLE OF LICENSE PLATES AND NOW YOU WANT TO CANNONIZE HIM? WHERE DID HE LAY HIS HEAD AT NIGHT? I BET NOT IN ANY OF YOUR HOMES ,BUT I KNOW THAT YOU'LL BE LOOKING FORWARD TO A PERCENTAGE OF THE CHECK THAT YOU HOPE TO OBTAIN FROM HIS DEATH.
IF DA HALO DON'T FIT ,YOU FULLA .....
What is unique about this story is the shoplifter's father is available; different name of course.

CVS GOES MMA OR WWF WITH NO TAP
Some people are just better off dead. This POS is one of them.I bet he once said to his loving mother,"momma, some day I'm gonna make you rich".
His family never loved him more than they do now.
And all these years we just thought he was a worthless P.O.S. Just goes to show how wrong we can be in our judgment calls. Hopefully, if they score big in the law suit, the family will be wise enough to put the money in a trust so that they can remain on welfare. I mean, why mess up that family legacy that they've (and the Democrats) worked so hard to perfect over the generations!
His family never loved him more than they do now.

Classic line and so true. I believe the CVS employee was defendeing himself. The shoplifter attacked him first.
CVS should sue the family that unleashed this animal on them and the lawyer involved. This situation is such a one way street. Any scumbag lawyer can get a family member to file a BS lawsuit on the original victim, but where is the blowback for the BS lawsuit? There is none, so the scumbag lawyers continue to victimize the victims.
I think these lawyers are the lowest form of life. They are worse than the criminals they represent.
Some news report I saw from the alley where dog died had his EX-WIFE there and she is boo hooing without a single tear falling, talking bout how dog wasn't a bad person and he was a good man and a good father . . . yeah, sooo good that she divorced his dumb ass!
First thing I thought is how can an EX-WIFE sue and try to get $$$ from CVS? Looks like dad beat her to the punch/lawsuit!
Only 400,000? Get a new lawyer
Between all of the scumbag lawyers vying to get their mugs on TV, and all of the frivolous lawsuits that get plenty of play in the media, the public has been trained and conditioned to race to Dewey, Cheatem & Howe LLC to be the first on their block to file for wrongful death.
The Daley Crime Family is highly responsible for this for handing out million$ every time a lawyer even points at the City and claims liability!

AWESOME job of waxing poetic here on the condition of ghetto life! This piece of Stephan King-esque prose could be worthy of a Pulitzer!!!
It's been what, 5 days? Don't grieve for your lost son or anything...
Street Justice, you gotta fucking love it. One message to those who doesn't wanna end up in jail or worse,
" Thou shall not STEAL"
And to those family members who are suing, fucking shame on all of you. We all know that you NEVER cared for the POS until he died and thought about making money out of it.
Put me on that civil lawsuit jury and I will make sure this bust outs family gets not even a penny!
The life you lead is the way you bleed!
Once a thief, always a thief to the bitter end even in death!
This man did not deserve to die. He was stealing tooth paste and deodorant for goodness sake!
Can't you see he was just about to take that MAJOR leap into turning his life around?
TOOTH PASTE AND DEODORANT, PEOPLE ! ! !
He obviously had a BIG job interview coming up that he didn't want to jeopardize due to poor hygiene. He must have been on the short list for the President's job at UIC or maybe for the CEO spot at Metra that was recently vacated.
But NO! All of you narrow minded, negative thinking, criminal bashing dweebs out there can't wait to kick a man when he's down. Why must you always speak badly of our soulless ghetto brothers?
Just live and let live and let all of his spawn and family tree and boinkin bitches get their money. After all, they earned it ! ! !
NY fights just about every law suit resulting in a lot of lawyers not taking on cases for fear of losing and not getting paid via a pay out.
Hey 5/13/2010 12:56:00 AM, you believe everything you read in the paper? Or is that only when they misrepresent the words of someone against whom you've got an axe to grind? Then the "Scum-times" become paragons of journalistic integrity and pillars of veracity?
If you dislike someone, fine, have at it. But be fair and consistent (unlike the media). Otherwise you look like a petty fool.
I like how the exwife is so concerned and outraged. My ex would be jumping for joy that I was permanently gone.
How big a part of this guy's life do you think his father was before this?

My question exactly. I'd be willing to bet the answer is somewhere b/w "slim to none."
"Managers and employees shall not use deadly force including decapitation, strangleholds or disembowelment to detain shoplifters. Employees shall call the local police who are the professionals and are properly trained to employ these methods.”
Gee, I must have missed the DECAPTITAION AND DISEMBOWELMENT class sign up on ELearning.
Another winner of the ghetto lottery.
the jury should reward the father.....a tube of toothpaste.
This POS shoplifter got what he deserved. But this stupid ass CVS manager should get charged. I am sorry, but too often, store employees want to play "cops and robbers" without knowing what the end consequences will be.
If a thief runs out of the store with stolen merchandise, then so be it. Multi billion dollar retail corporations like CVS have insurance to guard against such losses. Plus, it is their store policy not to physically hold or even chase shop lifters.
This CVS manager wanted to take matters in his own hands, now let him suffer the consequences. Even we can't choke offenders out unless we can justify it.
Ex-wife isn't next of kin...she can't file a suit.

I'm sorry but didn't they have chilruns together?
Besides, maybe not for wrongful death, but how about for emotional distress, or . . . or . . . or maybe ruining her weekend!
Sheriff Tom Dart & his spokesman (Patterson) stated that the Correctional Deputy at the CVS scene is not authorized to take law enforcement action. Does that mean she is not deputized??
If she is not deputized and has no Law Enforcement authority, why is she holding a gun at the scene?
Dart (Patterson) added that she did not violate any Sheriffs department policies.
Ok, is she deputized or not. If not, she should be charged with UUW.
If she is authorized to carry, Dart is obviously trying to separate the Sheriffs office as far as possible from law suits which he is getting regardless.
Dart only cares about puppies and prostitutes. Keep him out of the city...
"This CVS manager wanted to take matters in his own hands, now let him suffer the consequences. Even we can't choke offenders out unless we can justify it"
Getting killed is an occupationalo hazard of being a low life scumbag thief.
Let the Jury decide who was right.
That being said, if he violated company policies knowing he wasn't supposed to act, he probably will get fired.

An apology is owed...to the maggot.

Yeah, there has been a paradigm shift in retailing, from customer satisfaction to customer compliance with "policies," even those that are thought up on the spur of the moment by, say, some rent-a-guard who doesn't even really work for the firm.
Shopping has now become an unpleasant adversarial relationship, with trick evaporating receipts, impossible conditions to get rebates or sale prices, etc. I couldn't even get a $2.49 refund from a supermarket after they cheated me by double-scanning an item because of (nonexistent) "policy."
It's obvious, with all of their guards, cameras, and mirrors, that every place I walk into considers me a possible thief. It's become even more obvious, with all the double-scans, overrings, prices that scan higher than the ones on the shelf tags, "mistakes" and so forth at the register -- that are always, always, ALWAYS in the store's favor -- that the store itself is an ongoing criminal enterprise stealing hundreds or thousands of dollars a day from its customers.
You ALL lost my trust a long time ago; I never take my eyes off what you're doing either, and half the time I'm at the customer service desk getting your f__kups corrected before I can leave.
And you say this "manager" ran out of the store and strangled someone? Mr. Rules here broke his employer's own set of rules and policies -- and quite possibly criminal law.
Probably the same bastard who doesn't want to give you an extra plastic bag when you need it. Hang him.
When did CVS start incorporating BraziLian Jujitsu? CVS has good benefits too...
But wait, the forgotten, police hating , Black Panther Bobby Rush has to put in his two cents. Mr. Let's get a cop killer a street sign says the store manager should be charged with murder! What a joke!
How many of his voters commit murders and other felonies every day of the week? The bottom line is that this cancer to society who the Scum Times says was down on his luck ( who gives a fuck) walked into a CVS and decided to take what wasn't his and paid the ultimate price.
Now, for all you liberal fucks who claim he had to b/c society didn't give him enough, he was taking toothpaste not food for his family!!
No one condones the mans death, but who is more responsible for it than him? He was a drug abusing scum and now pookie momma and everyone else that knew him wants a piece of the good ol' "Chicago Ghetto Lottery". Oh, and for good measure let's spice up the lawsuit with an off duty copper!
I am so sick and fucking tired of no one telling it like it is and just realizing that this is noone's fault but this asshole and the poor life decisions he made! It's not mine, yours or the goddamn police's fault.
This city and county make me sick with all that these parasites that call themselves lawyers are allowed to get away with. If it's not beds for fucking felons to sleep on, it's people that rape, steal and kill having more rights tha those who enforce the law!
some of the comments are disgusting, but not surprising.

Not surprising because we see this every day. Thieves and low lives ruining what should be a Utopian society. Everyone is equal and able to do anything or be anything they want in this society, if they work for it. I know Jesse Jackson and his ilk say differently, but they mislead people for their own reasons.
People choose to be lowlifes. They choose to be lazy and steal from you and me and ruin what can be Nirvana. It really is as simple as that. Your sympathy is misplaced.
This is hard on many levels. Shooting some one for a dog pissing on the grass does not seem like it is worth a human life.
Then again, if you have no rights to your property, what are you?
I'm sympathetic to the old guy with pride in his home. Communities need that sort of guy. I served in the Marines from 75-79 so I've got a strong sense of semper fi for the guy.
Now I ask you that patrol the area, if the guy called the police about some gang banger mommy daddy type with a dog burning piss holes in the gents property, would you have done anything?
If reality was that the guy was on his own, I'd vote to acquit if on the jury.

No one's denying what he might have done was wrong: allegedly stuffing crayons and toothpaste into his pockets and shoplifting.
But the fact that Anthony Kyser was killed after he was caught, and allegedly choked by a store employee -- with an off-duty sheriff's officer watching it happen -- continues to hit a nerve.
CBS 2's Kristyn Hartman reports.

WOW! Maybe we should hold a benefit for this guy.

What a peculiar attitude. It's not like your family doesn't shop at the same places. What are you trying to say? Real men don't complain about being ripped off? Ha.
I can't figure these weirdos who scoff when I lock my door -- "You're paranoid" -- but who have three locks, a Rottweiler, and an "ADT" sign in the lawn at their place. It's a type. Had this one down cold years ago. I just laugh.

Yeah, this CVS guy reminds me of the Walgreens manager who was selling spoiled canned food -- I mean the ends of the cans bulging out like hemispheres, about to burst. Bastard told me to mind my own business when I politely pointed out the problem; took the Board of Health to get that mess off the shelves.
On top of that, the next time I go in the store, he's going wild, pointing me out to everyone. "Here comes the city! Here comes the city!" Some people just will not let s__t drop. OK.
The next time I go in, of course, he has gone the way of the bad cans. I wonder what he does today...maybe he's with CVS, huh?
I've seen some real corkers; always watch for the R.Ph who is sweating, babbling, hands shaking, and explodes when faced with some small transaction. After all, he's the one back there with all that stuff all day long...
...and don't get me started on this insane "Pharmacy Aide" business they started in this state; 16 years old and a GED will get you back there with all that stuff all day long...
It's too weird, man. Too weird.
