Senior Kills Home Invader
- There's another report of a senior citizen using a gun to fight back agains thugs. This time, one of the alleged thugs was killed.Authorities say Frank T. Obrochta, 45, of Melrose Park and Franko Martinelli, 32, of the 2200 block of West Erie, Chicago, broke into a Ukrainian Village home on the 2100 block of West Huron at about 11 p.m. Monday.The 79-year-old man who lived in the house confronted the pair. He was maced and punched. The victim was able to grab a gun he kept in the home and he shot and killed Martinelli.Obrachta was caught soon after and he is now charged with home invasion and murder during the commission of a felony.

The Sun Times passed this off as a random shooting of some sort. We didn't see any Tribune coverage, but we may have missed it. It sure seems like the media is down playing another instance of self-defense though.

A man shot and critically wounded a teen who was breaking into this home while other teens waited outside in the getaway car. He woke up to find a shithead standing in his room, grabbed his weapon and shot him. Now the awesome part is , the law down there says the DA is allowed to charge the shitheads friends with murder NOT THE SHOOTER, if the kid dies. According to Florida Statutes 782.04 (3)(e), murder can be charged "when a person is killed in the perpetration of, or in the attempt to perpetrate any burglary." Now someone down there knows how to write the laws.

Probably won't hear a thing in the papers, because God forbid you protect yourself, in your own home! Franko went to confront the grandson--I've heard diff. versions of what happened. Supposedly someone else in the house fired the shots, and kilt FM and shot the other on the porch, but it really doesn't matter, because Franko Martinelli was a class "A" shithead who was a menace to society. I say good riddance and too bad the other one isn't dead too.
Continuing beef with the grandson over a party earlier, not as romantic a story as it sounds on the surface, but great that the shitbird FM is gone for good. Hope the other one bites it too.

When somebody gets "punched and maced", it's NOT a property crime.
It was covered in one of yesterdays papers. Wasn't a huge story but they did cover it.
We need more of these stories to get these thugs to start thinking twice before choosing to invade someone's home.

Checked GOOGLE. No MSM covered the fact that perp Franko Martinelli was killed in a home invasion. No details were provided other than two men were shot, one fatally. No mention of the 79-year-old vic and the circumstances.
The media wouldn't want to embarrass our hoplophobic mayor and his obsession against the Second Amendment.

I'm sorry, but I find it absolutely incredible that an active Police Officer would not know that this is part of Illinois Law. It is in fact used fairly regularly, even here in Cook County.

I believe he was implying that if more shitheads start getting shot while doing burglaries, thefts, etc..then future burglaries, thefts, etc will not occur due to pookie being scared that he'll get shot. Thus, property crimes will NOT go up.

About 5-6 years ago, at a pool hall, late at night, on 16th St in the 10th District, two assholes walk in and announce a hold up.
Asshole #1 fires a shot into the ceiling. This pool hall is a senior citizens hangout and an off duty 50-something copper pulls his 5-shot belly gun from I don't know where and returns fire.
BANG!-click-click-BANG!-click-click-click-click. Both Assholes flee for their lives and thank God no one was seriously hurt.
The officer's little revolver was so filthy and full of lint and gunk that it failed at the moment it was needed.
The point is that a revolver is MORE RELIABLE than a semi-auto, but, please, you still must keep it clean and oiled. So, revolver or semi-auto, invest a little time and a couple of bucks in maintenance.
And yes, I do carry a revolver and have carried a variety of automatics.
There was a Community meeting with the 36th Ward Alderman, John Rice, who was appointed to replace William J. P. Banks.
He was proud to say that he help the Mayor pass the, "strongest gun laws in the country."
He very surprised when the citizens/homeowner/voters there turned on him and said all you did was keep us from owning guns to defend our homes.
The people there were not as stupid as he would have hoped. There is a 25th District Sergeant running in that race. Who is he and let's hear about him.

Glocks do jam. There is no such thing as an auto pistol that doesn't jam. There are some that do it less than others, but an auto pistol jams. You might be able to spray and pray better with a 17+1 9mm, plastic monstrosity, but 6 rounds of 357 magnum, or 6 rounds of 44 magnum will do the trick on 2 or 3 offenders, provided you take the time to practice with your handgun.

Uh, I don't think there is any debate as to whether this was a homicide or not. If you shoot someone, it's a homicide. The question is whether or not it was justifiable.
This isn't a new path here. Plenty of cases of shitheads getting robbed and acting in an otherwise justifiable act of self-defense but usually stemming as a result of their shitheaddery. How it's handled usually depends on the workload of the DA. Usually, they get the felon/gun beef either way, but in this case, I'm sure the guy would rather be dealing with that than the other possible outcome.
Honestly, given what's classified a felonies these days, I am not a fan of lifetime prohibition against gun rights. There should be a process- either proactive or procedural- for people to recover the right to defend themselves. You cannot argue self defense is an innate right of man right up there with breathing air but then deny it for the duration of someones life for non-violent offenses.
Violent shitheads, OK. Some guy with a non-violent crime 40 years ago? This should not prohibit him from defending his home or going hunting with his grandkid, presuming he's been living a clean life since that time.

TO all, all of these people both the 79 yr old man and his son are as guilty as the offenders. They are all scumbags yet, this doesn't stop hurting their families for their loss. This was a business dispute no doubt about it since they were all up to no good. The truth is Karma is a bitch and what goes around comes around. THis always happens to those that are up to no good, if they don't get caught they get killed by their own people...
