Part Time Residency?

  • When Rahm Emanuel originally filed his 2009 Illinois tax return, he indicated he was only a “part-year resident’’ of the state that year, since he had moved to Washington D.C. to serve as President Obama’s chief of staff.

    But after he decided to return to Chicago to run for mayor this fall -- and after several people challenged whether he was eligible to run based on the fact that he hadn't lived in the city for a full-year prior to the Feb. 2 election -- he filed an amended return, according to the Chicago Sun-Times.

"Part-year resident"? If that's not such a big deal, then why file the amended return? Why not just stand by your position and explain it as government service the same way military service is usually described? Why all this secrecy and amended returns and crap? It makes what could be a minor problem seem very suspicious.

He'll win at the BoE, but I really think the Appellate Court or the State Supreme Court will bounce him.

Did he buy City Stickers? If he kept his cars with Illinois plates, registered at the house on Hermitage, he needed a city sticker for each one. The city doesn't buy my excuse that one of my cars is out of state with my kid in Grad School, they just want the money.

I don't understand, seeing how there was such a sweeping anger against the Democrats in the last election, why at least ONE decent, hard working Republican did not toss their name into the mayoral race.

Right now, looking at the choices we have to vote for, we're in trouble. As usual, it's going to boil down to the lesser of the evils. Most of these people I won't even consider voting for, and, for me at least, the last man standing will be either Rahm or Chico. Neither one does anything for me!

Now, had there been at least an alternative Republican on the ballot, there might have been history made in February. Maybe they were all just afraid the Crime Family would rub them out before they could take office.

SCC - You're correct that part time resident isn't a big deal. I'm a computer geek, I contracted in Ohio a couple years ago for most of the year. I spent M-Th or F every week there (in a hotel), weekends at home. I was paid in OH and paid income tax there. Since my residence was IL, I had to file a part-time resident form in both states. In OH, it was so that I didn't pay OH tax on income I didn't earn there. In IL, it was to take the tax paid to OH as a credit against my IL taxes (OH taxes were higher, so I didn't pay any IL tax on the income earned there).

Had he just left it alone, it's pretty easy to explain in court (he was taking a perfectly legal tax credit to not pay both DC and IL income tax on the same money).

So, on this tax thing alone, it doesn't say much. Nobody would have questioned my residence on that. Of course, I was here nearly every weekend and didn't rent out my house. Those pieces are a problem for him, not this.

State to offer sales tax amnesty for online shoppers

SPRINGFIELD -- The state of Illinois wants residents to pay sales taxes on all of the gifts they buy. Online shoppers, this means you.

Illinoisans can often dodge sales taxes by shopping online, but the state is hoping to collect on those taxes next year by offering a sales tax amnesty.

A new law allows people who didn't pay sales tax on items bought online, through the mail or over the phone between June 20, 2004, and the end of 2010 to pay what they owe without penalty. The tax amnesty runs from Jan. 1 through Oct. 15.

Department of Revenue spokeswoman Sue Hofer tells the (Springfield) State Journal-Register that Illinois also plans to offer a more detailed worksheet on state income tax return forms to get taxpayers to pay up.

This situation keeps getting compared to military. Ok im a Marine from Chicago living in California, and I am a ILLINOIS RESIDENT! I do not pay any taxes or fees in California, even when I bought my car I got Cali plates and charged a lower "out of state resident" fee. I do not file Illinois taxes because illinois does not tax military members. All other Marines in my unit file taxes in their home state. Matter of fact the base tax office keeps tax forms for every state. We also all vote in our home states even when I'm not deployed just sitting in Cali I get a absentee ballot. Which is the reason why politicians dont give a shit about the military vote cause our vote is spread throughout the country. We get this because we are sworn military personnel that are moved by the government for the government.

How that translates to Rahm taking a job at the White House I dont know. If he was a sworn elected official like the President who takes an oath which is very similary to the military officer oath (actually the V-Presidents is exactly the same) Than I would go yeah hes a Illinois resident! But he is just a guy like any other guy who took a job out of state!

California Marine again: My second car has Illinois plates, every year I call the Illinois DMV and they actually have a specific phone line for this, and they send me my renewel forms to my cali address. They also make me get a smog check done in Cali and fax it to Illinois before they do. As for the City sticker well sorry guys but if my car isnt in Illinois then Chicgao PD cant ticket me :-)! Does Rahm go thru all this?

In response to the 1st post, YES you can be a part time resident. I was for the last 14 years on the job. Just be sure that you go to your city house after work before heading out and make sure that you return there, put on your uniform there, and then report to work from there. See? That's easy, isn't it. You just need to have the place to go to and the balls to do so. Go for it!

Once again it's the exact wording of the law that provides the answer. 1) you must be a resident of chicago(check) 2) you must live in the city for one year prior to feb 2(problem)

I am not an Emmanuel hater, however when he made the statement in last march that he would run for mayor, but not against Daley, that was the time for him to get his ducks in a row. He knew that it was a possibility that he would run. He could have bought a city sticker on time. He knew he could be coming back to town. He could have notified his tennants that they may have to leave. He knew in enough time to enroll his kids in school in Chicago. Rahm Emmanuel did none of this until the last minute and should be ruled Iniligible to run for mayor in 2011.

If he is ruled eligible can I then become a part time resident until caught? Can I have a second residence out of state while renting my primary? Can I not purchase a city sticker until it suits me? Can I file taxes out of state and then amend them as my mood or legal status suits me?

As a Chicago police officer I like those options better. So I say to you Mr Emmanuel a hearty Fuck off, I hope you win!!!!

It has been established by the courts that the employer can require the employee to live within the city, but cannot require the family to live in the city. your wife and kids can live anywhere they want. And, you can, on your days off, also live anywhere you want. That is, if you have enough money to aford two places. On your work days, you have to sleep in the city. Chicago is the only city in the state that has a law to protect itself from collective barginning regarding residency. Maybe now that law will change, I wonder how Quinn feels about this law that only pertain to Chicago? Change this law and you might end the residency requirement.

There are quite a few Chicago/Cook County Employees fired over residency requirements that according to the Employer, employees living "part-time" at the girlfriends suburban domicile. These were grieved and lost by greivants and are on union records. Could be quite a settlement when the city will have to re-define "residency".
Now, I'll check the Assesors Office and see which Candidates filed a homeowners exemptions and/or "ammended" their filings.

Someone asked if he took a homeowners exemption last year and the answer is NO he did not take one for 2010 but he did in previous years.

Also someone wondered if he was off the ballot if Chico would be able to pick up the slack. I believe the answer to that is Chico could win this in Feb if Rahm isn't on the ballot. _hico will be his main competition once this all gets into full swing.

It's my understanding Rahm and his wife Amy did not pay property tax on the house on the 4200 Block of Hermitage when they actually lived in it. His wife allegedly uses or claims to use the home for non-for profit and therefore is tax exempt. Anyone confirm this?

When it comes to the city sticker, any resident who owns and OPERATES a vehicle within the city limits must have a sticker. If the vehicle doesn't hit the city limits, it doesn't require one. Read the MCC.

Knew a cop who went through the residency issue about twelve years ago. He was told sleeping 3 nights per week in your documented Chicago residence qualified you as living in the city.

Don't know any recent rulings though.

I spoke to someone from the State of Illinois Department of Revenue today. They are coming after people, the whole state on this one.

The State sees this is lost revenue and they will make some high profile enforcements of regular people who will get fucked in their enforcement attempts. Others will then get scared/intimidated/forced into self compliance to send in something.

The real fight is to get the large internet retail sellers to begin charging Illinois sales tax and sending it to the state.

Look for other states to join Illinois in the lawsuits against large internet sellers like Amazon. They already did it against online tobacco sellers. And won.

There are 18 million people in Illinois. If they get $250 each from 4 million of them they get $1 billion of found tax money. Plus a new revenue stream going forward and they knock any advantage internet shopping has over brick and mortar stores.

This is no joke, this isn't going to go away. IL Dept of Revenue has been working on this for quite a while.

The initial reaction will be "let them try to collect something." Then a few people will fail to pay those tax bills, get liens slapped on them, have their credit effected and then lots of people will be frightened into compliance.

The usual people will pay and the usual people will not pay.

The State of Illinois will sue online retailers for their sales records going back to June 20, 2004.

The State of Illinois will win.

The the State of Illinois will calculate what people owe and send out tax bills just like overdue Illinois Income Taxes.

Some people will just burn the bills.

Some will get Illinois tax liens slapped on them.

Many will hear about this and begin complying. Many will not comply and will face the same enforcement action from the Department of Revenue that is already used for any other past due taxes.

After more enforcement action in the news more will comply.

Large internet companies will be sued into collecting Illinois' (and other states) sales taxes.

The party will largely be over for internet shopping.

I will retire, move away and get therapy to try and forget I ever lived in Illinois.

Even though Rahm has a big lead in early polls, I would say that his campaign appears to be in trouble down the road. Issues like this, and the silliness that's come out of his mouth regarding school education issues here in Chicago tell me the man is seriously out of touch with what's been going on here. It's one thing to want the job (and the power that will go with it) badly, it's quite another to be up to speed on exactly what the problems are, and what it will take to solve them. I don't see Emanuel as being up to the job, regardless of how much money he's able to raise for his campaign or how many celebrities he'll be able to get to shill for him here.

If Rahm is allowed to run, then any city worker, Police Officer or Fireman can by a house in the suburbs and live there, and rent out his Chicago house and still be considered a Chicago resident. Rahm will set the precedent.

OK, pal, Rahm was not working at a city job and living in the burbs, so forget about that reasoning. It may work for you but it's not reality.

I also remember something I learned somewhere along the way through my illustrious career that said something like it's not the LETTER of the law but the SPIRIT of which the law was intended that is important. For this residency challenge, certainly the SPIRIT or INTENT of the law would be to prevent people who are outsiders and/or non-Chicagoans from sliding into town right before an election and taking over, perhaps due to popularity or some other welcome trait. For example, if Donald Trump showed up and registered to run for mayor, he just might win because many believe he could whip this city into shape like a reality show (they might be right! The regular Crime Family politicians don't want those people coming in and marking territory on Crime Family turf. Remember their mantra: "We don't want nobody that nobody sent".

As much as I dislike Rahm, I think this residency issue is more of a parlor trick by another candidate or two to muddy up Rahm in the eyes of the voters. We all knew that he wanted to be mayor. He said so on April 20th, 2009... http://blogs.abcnews.com/politicalpunch/2010

Illinois already requires people to pay the equivalent of Illinois sales tax as a "use tax" for purchases made out of state for items meant to be used in the State of Illinois.

Here is the relevant part of Dept. of Revenue form PIO-36.

"Do you owe use tax?"
• Did you buy goods outside Illinois to use or consume in Illinois?
• Would they have been taxable in Illinois?
• If you bought goods within the United States, did you pay less sales tax than you would have paid in Illinois?
If you answered “yes” to these questions, you may owe Illinois Use Tax.

What is use tax?
Use tax is a form of sales tax designed to distribute the tax burden fairly among consumers and assure fair competition between
in-state and out-of-state businesses. In general, states that impose sales taxes also have complementary use taxes on the privilege of using goods within their borders. This tax applies to individuals, businesses, and organizations.

Illinois law requires you to pay tax at Illinois rates on purchases you make for use or consumption in Illinois
• when you buy goods from businesses located outside Illinois and bring them into Illinois or
• when you have the goods delivered to you from businesses located outside Illinois.

Illinois residents are supposed to self-report this tax on form ST-44 and include the payment. Few do, mostly companies who cannot get away with not doing it.

Now Illinois will go after individuals and expect individuals to pay this "use tax" and file form ST-44.

Amazon has argued that they do not have a sales presence in many states, like Illinois, and thus don't have to collect the tax or force their customers to pay. That leaves the burden on individuals to pay their own "use tax" and report same on ST-44.

Illinois claims that Amazon pays fees to online sellers in Illinois and this constitutes a sales presence. The courts will settle this one.

In the mean time, Illinois Dept. of Revenue will try to scare people into self reporting and filing form ST-44 and of course include a check.

If a PO had a home outside the city and his family lived there but used an apartment in the city as his residence and he got caught by IAD,IAD would base his real residence on where his "QUALITY OF LIFE" is.That would be the home where his family stays(outside the city).
If Barrys boy wins this case I think We can All move outside the city and we'll have a very good case when IAD knocks on our door.

Issues like this, and the silliness that's come out of his mouth regarding school education issues here in Chicago tell me the man is seriously out of touch with what's been going on here. It's one thing to want the job (and the power that will go with it) badly, it's quite another to be up to speed on exactly what the problems are, and what it will take to solve them. I don't see Emanuel as being up to the job, regardless of how much money he's able to raise for his campaign or how many celebrities he'll be able to get to shill for him here.

He owns a home in Chicago that he rents out.
He pays property taxes in Chicago and Cook County.
He has a car that he drives when he comes to visit that he purchases a city sticker for.

Here's what pisses me off. As a cop I can't buy a house in Barrington and have an apartment in Chicago to maintain rsidency but this tool can. He hasn't lived in Chicago since the Clinton administration. He's been in DC the whole time. If residency doesn't apply in this case it shouldn't apply to cops and firemen either.

It's my understanding Rahm and his wife Amy did not pay property tax on the house on the 4200 Block of Hermitage when they actually lived in it. His wife allegedly uses or claims to use the home for non-for profit and therefore is tax exempt. Anyone confirm this?

Non-for-profit? Just like that goof who tried to excape taxes in a north shore burb by saying his wife worships in their home and is set up like a church???? I believe a judge found him liable to pay hundresds of thousands of back taxes.
