Not Guilty

Once again, a Cook County jury stuns and amazes onlookers:
  • A not guilty verdict on all counts!
    Every officer in that courtroom was blown away. Every States Attorney was blown away. The pro- defense judge was blown away when she read the verdict.
    The cop shooter admits to buying the gun off the street for 100dollars, shooting the gun numerous times, impeached himself countless times and was found not guilty. He goes free by a cook county jury. In my 19 years on this job I have never seen anything like this. He is a self admitted GD who will be free tonight. This is insanity.
We are flabbergasted.

It's not unbelievable to me, Cook County Juries are the ones who were not able to get out of jury duty. They could give a fuck, if someone is guilty or innocent. Just because this mutt is guilty as sin, and everyone is stunned by the verdict, doesn't mean anything. The fact remains that a MUTT is free to go, he will do it again that's a give me. Nothing will change until the public will once again as they did in the late 20's and 30's. They will get so fed up with crime, that they will demand that Law Enforcement take control, and use any means necessary to do it!!!!

Ok Supe..if you're worried about police legitimacy amongst the public, then look at prosecutorial legitimacy amongst the police. So why would I risk my livelyhood and family's future on a 'Bronx' jury? The answer is I will never go that extra step and I hope it leads to the victimization of many do-gooder liberals. I am beyond words right now. I sat through the trail all week, and heard all the testimony. I cant believe the jury would believe the SO-CALLED family members and the defendants testimny over the officers. It pains me to think that in this day an age it is OK to shoot a PO when they are entering. Think about all this when your supervisors announce in roll call that Stupidintendent McStake wants more activity to satisfy the "CompStat"/"Broken Windows" approach to policing. Keep giving your all while you're simultaneously vilified for doing what it takes to protect an ignorant and unappreciative public from themselves and those they champion.

The department needs to address this! I was there in the courtroom. This is unacceptable. This was the most one sided trial I have ever seen. Unfathomable that a NOT Guilty verdict was returned. The evidence was there. End of story. My heart goes out to the two policemen who were shot. Every policeman in this city has to question the work that we do daily.

I was there that day. I responded to a call of Officers Down 10-1, 10-1, 10-1!!!
I will never forget seeing DO on the hood of a car with his whole leg red with blood from the knee down. I remember hearing SM was shot ten seconds later, I remember thinking where is the ambulance?
I remember DO's very pregnant wife with tears streaming down her face at Christ Hospital.
These guys deserve better than that!!!
that team does hundreds of SW's in the worst areas of the city every year. I have asked their help with my teams warrants.
Someone asked what were the facts of the case?
They scream Search Warrant, no response, they force entry. They find a locked door- they attempt to kick it open then they both get shot through the door by the GD coward who has a boatload of CRACK in his bedroom. OH Yeah, and they shot back like sixty times and somehow the Gods of Roseland shielded him. I wish I heard about court earlier because I would have been there. UNREAL! I feel sick.

It is finally happening after 60 plus years of liberal, progressive excuse making for the criminal element, the jury pool has been completely tainted. Now, due to the media's publicity campaigns against the police and their promoting the propaganda put out by the revs and pinhead professors, average jurors believe that convicted felons are more credible than sworn police officers. The law and common sense have been turned on their heads. Suspicion is reserved for the testimony of police officers only. A GD and his family are believed even though they are caught in numerous lies and impeached during their testimony. As someone who has tried cases involving the police, I have observed the slow but steady erosion of respect for the law and law enforcement which is brought on by the continuous daily liberal drumbeat that the police are the problem not the criminals. The cant is taken up by the liberal professors who inculcate those biases in their students. The idea that police are incredible is upheld by liberal judges who exclude evidence and testimony in police trials solely on their own prejudice against the officers. In this case it is my understanding that the defendant's membership in GD was not allowed to be mentioned.
It would seem that the easy way out would be for the police to say forget it and not do the job they are sworn to do. However, coming from a police family and having been involved in law enforcement in one capacity or another for over forty years, I know the type of individuals who become police officers and why they do it. It's certainly not for the money or glamor and it is no longer for the respect. It is because the person drawn to be a police officer truly believes in the right of the people to life, liberty and the pursuit of happiness without interference by the criminal element. It is a sense of fairness and honor that draws people into the thin blue line. The idea that citizens have to fear for their lives and property due to a group of people who reject the laws and mores of society is abhorrent to those who would be police officers. It is inconceivable to those who are sworn to serve that a city can become captive to people who have no respect for themselves, their fellow man or the laws that govern us all.
So, despite the obstacles placed in their way by foolish people who live in one ivory tower or another, the majority of the thin blue line will soldier on and do their job to protect the vulnerable from the criminal beasts. They will do it because it is in their natures to do the right thing.
And for that, as a private citizen, I am very grateful.

I'm not sure if this exists in Cook County; I doubt it.

A judge may, in some jurisdictions and in some types of cases set aside a jury verdict (called JNOV in most jurisdictions).

While the standards may vary, JNOV usually arises when the judge finds that the jury has ruled against the weight of the evidence, i.e. that no reasonable jury could have ruled in that favor appropriately looking at the evidence.

This is different than a mistrial because in a JNOV a judge may actually enter a new verdict, not merely dismiss the proceedings.

SCC, this isn't going to be popular (if anyone even notices) but I have to say the same thing about this that I said about Casey Anthony: we have juries and a presumption of innocence for a reason, and one reason is that they insulate the justice system from the passion of people who are rightly furious that someone has been taken from them.

Before I start howling for blood over this case, I'd like to know why it's so outrageous. Several commenters here say they were in the courtroom; surely one or more of them could write up a more detailed account of how the trial proceeded and what the evidence was. I know you would post it. Then people like me would have a better idea what's going on.

Maybe I'm going out on a limb here, and not being an attorney puts me at a considerable disadvantage. I also admit to not being in attendance during the trial and have only limited information posted by SCC to go on. But I was under the impression that the judge has the lattitude and the responsiblity to nullify the finding of a jury if he/she determines that the verdict was not reached properly as a matter of law, but rather some other factor outside of the facts of the trial, i.e., the jury harbored an obvious dislike of the victim (the wounded police officers, the Chicago Police Department), or they were obviously intimidated by the presence of the GD's, or in some other way the verdict was reached by the jury based on factors not germaine to the trial. I think they call it a "directed verdict" and it supercedes/ignores the finding of a tainted jury. How about one of our juris doctor members taking a stab at this? I was just wondering . . .

Solid, hard-working people from decent neighborhoods are the ones who take themselves out of the jury selection process by telling judges in open court that there is no way they can be fair in a particular case. If that happens enough during a jury selection, you eventually will end up with 12 lumps of shit in the jury box.

That's why you get verdicts like this one. 20 years ago, people actually wanted to serve. Today? Forget it.

Had I known this trial was up I would have at least stopped by. I work in Five and remember this one like it happened yesterday. Not Guilty? This was one of those calls you hear and you can't get there fast enough. I know DG and BM from when they were on a team here. Their team was and is constantly in the 5th Dist hitting Sw's. Not guilty? He had a gun and shot 2 cops during a SW. Not guilty? He is a GD. Sorry for those who don't know what that is- gangster disciple. Not Guilty? Where is the media on this?something feels really wrong here. Did the GDs threaten the jury? Was someone paid? Something is not right.

Why this verdict? First, police are lambasted eveyday in the papers, radio and TV. Every little thing a cop does wrong is front page news. Second, the police dept. does nothing about this bad media light. Oh, the FOP is now using Camden but he only shows up at a police shooting and at least tells the truth. My question is this. Don't we have a News Affairs unit? What are they doing other than cutting and pasting news blurbs on their page in ICLEAR? We need a Publis Affairs unit, one that gets out the truth about police work, tells the true facts of an incident, and broadens the public image of a professional and hard working police force. Every time a benefit is thrown for someone needy it should be in the press. Good arrests and solid police investigations should be front page. Stories about personal achievements by cops should be a daily press release. We do nothing of the sort mentioned above and we wonder why a jury won't trust or believe what a cop says? Blame the top. That's where it starts.

This is stirring terrible memories of when Kevin Dean was found Not Guilty of murdering Officer James Camp (021). The jury actually found Dean guilty of disarming Camp, but they somehow concluded the gun may have accidentally discharged. The prick defense lawyer argued Camp shot himself in the face. Still can't get that terribly unjust verdict out of my head.

My thoughts are with these officers during this hard time. The sad fact is that once it's in a jury's hands...the bad guy sometimes gets away with it.

And after watching how the last jury was picked that I was a candidate for, its a batlle of wits between States Attorney and defense attorney. This county and state stink. I'm sure some of them will give their reasoning. Could be some had a different opinion but were afraid of others on the jury. Lets find out and lay the blame where it belongs.

In private mining, fatal work injuries rose 74 percent to 172 in 2010 from 99 a year earlier, the agency's figures showed.

Fatality rates for mining rose to 19.9 in 2010 from 12.4 in 2009 per 100,000 full-time equivalent workers.

The Deepwater Horizon oil rig off the Gulf coast, licensed to British Petroleum, exploded and killed 11 workers last April, causing the largest accidental oil spill into an ocean in history.

Also last April, an explosion at the Upper Big Branch coal Mine in West Virginia owned by Massey Energy Co killed 29 miners.

The police profession was not far behind mining as a dangerous occupation, with the number of fatalities increasing by 40 percent to 134 last year from 96 in 2009.

The credibility of CPD is not real high with much of the public at large and even lower with some segments of the public.

This is what happens when credibility is stretched. It is not about whether it is fair, or right, or legal, or anything. it just is, and that credibility gap needs to be addressed or this kind of thing will happen more and more.


I don't know how to address it. I freely admit that. But it will not get better on its own, and denying the problem will not help either.

We must always remember that most of the rest of the country is not like this. There is sanity in other places away from the Daley Crime Family machine. Juries in "normal" society would have locked this savage up for life. Just remember that once you reach retirement you can move out of this hell hole and return to civilization where things actually make sense.

I get the anger and frustration, but it sure is hard to tell people how cops deserve their pensions and pay when half of the comments on here are about not doing any work and how the citizens are on their own. Think about that when you are nothing about a 2% raise and fighting for your pension.

I think most people understand the venting. It is hard for police to accept the verdict, for obvious reasons.

This kind of crap happens. Who knows whether the jury was intimidated, or just hates cops, or was confused by the evidence, or had a bad day, or if it was just not a good case to begin with, or 100 other reasons it might have gone down this way. Sometimes a jury just does not like the state's attorney or really likes the defense attorney.

Guilty go free now and then and sometimes the innocent get put away. It just happens.

Why are we doing pro active police work in this cesspool? I'm a supervisor with 25 yrs on and cannot understand putting our lives at risk for the segment of the population that hates us. I work in a heavily populated "city worker" district and will go above and beyond for them and of course my fellow Police Officers. Other than that, I could care less. All I ask of the troops is handle your jobs and BACK EACH OTHER UP! If a fellow Officer calls for help, drop everything and haul your ass over to help out. If an Officer with 30 yrs on doesn't feel like jumping out and chasing a thug who just broke and ran for unknown reasons, I DON'T CARE! If that same Officer doesn't show up when a fellow Officer needs help, I have a major problem with that.
I know some will shoot back at me for my opinion but I don't want ANY Officers losing their lives or their jobs or thousands of dollars out of their pockets for the scumbags that would rather see us dead. I'm aware there are many, many people who are on our side and I really appreciate them and those that post supportive comments on this blog. But there's a huge majority that hates us, and I can't see wasting our time to give them any service.
Before anyone wants to bash me thinking I'm Monday morning quarterbacking the Officers from this search warrant, I AM NOT! I personally know several of these Officers and they are phenomenal Police Officers. I just wish more Officers could see that the city will hang you out to dry in a minute.

This tactic (jury trial)works for the shitheads more than you/we think and their attorneys know it.

Sore subject of course for all of us and yes its tough to go on and continue to execute like the job demands. We just have to I guess.

However those that choose to constantly "flirt" with disaster by executing search warrants and not using SWAT or even putting their hands on dude excessively or whatever P/O's do to get the "stats" are more succeptible to outcomes like this...

I think one of the comments was right in that this was the Second or even Third String A.S.A.s on this case that probably let too many gangbanger and gangbanger relatives on that jury.

NOW WHAT TO DO:

FOP should call everyone involved on the CPD side together for lunch on Sunday or breakfast Monday morning latest. Then early afternoon on Monday march everyone into the U.S. Attorney's office on Dearborn Street. Bring the case documents with them and politely but vey firmly demand that this case be prosecuted federally.

If possible, and why not, have a warrant issued immediately before this (fill in the blank) can get organized and flee and we have to go looking far and wide for him.

The average jury pool consists of middle-age/white suburbanites. I see it everyday. How? Because that's where I work. Juries are unpredictable, as messed up as it is. Unless the state polled the jury (which they have the right to do), no one will ever know why they returned a verdict of "not guilty". And to the individual to asked about a directed verdict. Whichever side is asking for it, must do so after presenting their case and before it goes to the jury. Rarely is it granted.

After about an hour of arguing they FINALLY got it!!!! Civilians do not KNOW what we know, they don't KNOW because they are not the police, they do not KNOW because they are only reading, and not living and breathing what coppers go through.

I went to jury duty in maywood about six months ago. Scary people in the room. I sat in the corner as far away as I could from most. Unbelievable. One women kept repeating the same actions, got up 20 times, cleaned out her purse, could not sit still for the hr. we were there. And that was just one I described.

Great attitude. So the cops should just give up? Should teachers in these communities give up too? I would like to think that most cops took the job to help people and try to make a difference. Believe it or not, there are a few decent people left in these communities who deserve protection. Just like the kids who, despite growing up around this nonsense, want and deserve to get an education and get out of there. We have jobs to do and we need to do them, despite the odds against us.

I am disgusted by this verdict. But what pisses me off more is the lack of support from the higher ups. When an officer is shot, it is the JOB of the Cheif, the Mayor and/or the Governor to make it to the trial and show, that the community they represent, are behind the police when something like this occurs.
Mayor 4 fingers , you should have been there. Sup. McCarthy, your drunkin ass should also have been there, instead of at Pfather Pflamers parish empowering these pukes. Mayor and Sup. , you are a disgrace.

Two officers shot and the guy walks because the jury finds him not guilty and last week a jury finds two officers guilty of false arrst and shooting a dog during a valid search warrant and awards family 333,000. The writing is definitely on the wall folks. PEOPLE DON'T BELIEVE THE POLICE!!

the reality is that people at large think the police should play by the same rules everyone else has to play by. they are willing to give some dispensation now and then, but mostly they expect the rules to be abided by.

the idea of rules that only apply to police is part of the problem.

a few of those rules are necessary but mostly they aren't, and that problem needs to be addressed as part of an overall attempt to improve the credibility of police in general.

a lot harder in a city that is run by criminals, and a lot of the public sees the police department as being a big part of what sustains those criminals. seeing as it is at least partially true, it is hard to refute.

i don't have a workable answer. maybe there isn't one.

I was there for the verdict. The state requested that the jury be polled. They all said the not guilty verdicts were theirs. The explanantion I can see is that they believed when shithead fired the gun he did not know it was the police. The officer was shot in he leg that kicked through the lower part of the locked door.
