"Fast and Furious" Debacle
So what does it say about the "Fast and Furious" scandal that the sitting Chief of the Criminal Investigations Division of the US Attorneys Office in Arizona announces he will be taking the Fifth Amendment when appearing before Congress? It means a bunch of people may be going to prison for letting over 2,000 guns "walk" over the border to Mexican drug cartels:
The chief of the Criminal Division of the U.S. Attorney’s Office in Arizona is refusing to testify before Congress regarding Operation Fast and Furious, the federal gun-running scandal that sent U.S. weapons to Mexico.
Patrick J. Cunningham informed the House Oversight Committee late Thursday through his attorney that he will use the Fifth Amendment protection.
Cunningham was ordered Wednesday to appear before Chairman Darrell Issa and the House Oversight Committee regarding his role in the operation that sent more than 2,000 guns to the Sinaloa Cartel. Guns from the failed operation were found at the murder scene of Border Agent Brian Terry.
The letter from Cunningham’s Washington DC attorney stunned congressional staff. Last week, Cunningham, the second highest ranking U.S. Attorney in Arizona, was scheduled to appear before Issa‘s committee voluntarily. Then, he declined and Issa issued a subpoena.

The State of Arizona is looking into prosecuting those involved. Go Arizona!!!! The DOJ under Holder allowed these weapons to be sold to the drug cartels as a way to justify further gun control restrictions in the U.S.(until someone started blowing the whistle) sounds like TREASON to me.

And the Mexican Government is planning to sue the U.S. Government over the deaths and injuries on their side of the Border. Yet the Press does little or nothing to bring this SCANDAL to the public's attention. Interesting.......First, in 2009, there were statements by the Obama administration that American guns were being smuggled across the border and sold to the cartels. Thus, the safety of regular mexicans was being jeopardized by the American constitution. Then the NRA and other groups called BS and pointed out that the cartels were using fully automatic weapons and grenade launchers, neither of which are readily available to average Americans. The Obama administration then began pushing for the U.N. To pass the small arms treaty and for the senate to ratify said treaty. This was a way for Obama to outlaw private ownership of guns while bypassing the house of representatives. Fortunately, an ATF agent blew the whistle on fast and furious and the administration has been running damage control since.

The short answer is: technically you can but you will lose your job.
If you plead the fifth they can order you to answer questions. Supposedly, If you answer questions under orders, you can not be prosecuted for the information you provide; however, the Department can use it in administrative proceedings. This means the Department can discipline you to the fullest extend for breaking Department rules. There have been occasions during which State's Attorneys have attempted to use statememnts given under order for criminal prosecutions. SCC has blogged at lenght regarding these matters. Of course they can, if they feel the testimony they will give may incriminate them in criminal conduct. I would hope that is not the case when you they testify about cases they work on.
