Punitive Damages

  • To settle a wrongful-conviction lawsuit against the Chicago police, the city recently agreed to pay Harold Hill $1.25 million.

    What never became public was that, to reach the settlement late last year, two detectives in the case that sent Hill to prison for 12 years for a rape and murder he insisted he did not commit agreed to contribute, too. It was not much next to the total settlement — $7,500 each — yet it apparently meant something to Hill.

Without a doubt, the bottom feeders use this tactic to pressure the City over certain issues. And the City knows that as punitive damages start to stack up...you get the idea.

The article closes with this amusing aside:

  • As for Hill, he will not be able to spend his money in the outside world — at least not for some time. After he was cleared of the Morgan murder and released from prison, he was arrested on unrelated armed robbery charges and was convicted. He is serving a 27-year prison sentence.
He wins over a million, plus punitive damages and is still doing 27 years for another armed robbery. Must have missed that "turning his life around" window somewhere along the line. Unless he's looking to sue the police for this one, too.

Signed complaints. A couple contact cards here and there. Maybe, if someone really pisses me off, a parker, though I don't enjoy bringing revenue in for the City. Call me whatever you wish, but that's what I've resorted to. I call it intelligent self preservation in a predominately communist run City. Fuck this place! Watch out for each other!

can the victim(s) of the new armed robbery sue him for the pain and suffering he caused them--- give the vic(s) the 1.25 million and suspend the 15,000 the coppers are supposed to pay this shitbag....

I wonder if the victim of the attempted robbery could still sue this jagoff for their emotional scarring when jagbag tried robbing them?....wouldn't that be some sort of poetic justice? Or better yet, maybe he fought with the police at some point in time and they can sue him for their injuries.

I am sure Mr. Hill's family will enjoy spending his ill gotten gains for him. After the lawyers take their cut he probably only has some chump change left. Any of these assholes who get caught up in these investigations and arrest are low lifes anyway. If they didn't do the crime they got sent away for think about how many crimes they did and never got caught.

There's a cure for this. It's called DOING NOTHING PROACTIVE. 1st & 16th is all you need to know, folks.

Not saying that you can't get jammed up for just answering your calls, but the law of averages is on your side when you don't stIck your neck out - especially for unappreciative savages.

I'll save the "real police" in my bones for those that truly deserve it, and it AIN'T the ghetto bastards.

Fuck this job. Fuck this administration. Fuck Rahm Emanuel. Fuck the Aldercreatures. Fuck the non-contributing ghetto jagoffs and Sanctuary City transplants.

this is just my humble opinion but, if he can't spend it due to his lengthy prison term, than he shouldn't get the money. What a waste to have all that money and not be able to spend it.

Wow just read that the CANELLA BILL is up for hearing in congress somewhere today. The bill would force those non impoverish criminal to pay for their own stay in prison......got to love it...if it passes

Um, maybe I read that wrong, but doesn't it say that the detectives admitted guilt in framing the guy the first time around? If so, why in the hell should FOP pay for them? The job is hard enough without this kind of shit!

This is just the beginning for these detectives and others who were assigned to Old Area 3 under Burge.
Federal Grand Jury expanding their search from Area 2 Detectives to Old Area 3Detectives who worked for Burge in the late '80's - early '90's, one by one they are being called down to testify at the federal building about their duties, responsibilities and different cases they were involved in under Burge.
Majority of the detectives involved are retired or dead... Just a couple still on the job - including the two involved here.
WTF.... VOTE REPUBLICAN.......

Ha! Good to hear that scumbag can't enjoy his ghetto lottery winnings! Figures he ended up back in jail for another felony- these harvard laureates that cry victim and innocent when they are implicated in serious crimes are no stranger to the criminal justice system. They have had many encounters with police and courts and have done many misdeeds in their "innocent" past. You don't go from "honor roll student" to "murderer,burglar,robber, rapist" overnight folks. And considering he got convicted here, he really must have f*kd up because these judges give these mutts a pass at every turn in crook county.

This is why I only make an arrest on a signed complaint, with witnesses and with full probable cause (not wishy washy "he said and I said and I finna wanna sign a complaint to get him arrested"). Officers, use your fucking head. This could happen to anyone.

Physical ID is the least certain evidence around. I'm sure the Dicks didn't testify that they saw this crime committed yet once again the little guys get screwed. They are doing this so all their cases aren't compromised. That's my guess but I'm no genius. great price to pay literally to protect and serve. Is there an award for this? Just askin'.

Be careful with the fund raiser idea. Punitave damages are rewarded to punish. If the money comes from some fund the officers are not punished. The ass hole judge might make them pay twice. Dont advertise such things

Obvious this paying punitive damages to scumbags will only get worse. Best thing to do if you are working the job is to lay low. You can still answer your calls and fill out the paper work. If an arrest is called for make it. Get signed complaints. As for proactive aggressive police work that is a thing of the past. This culure we live in now forgives criminal conduct. If you don't chase anyone, don't beat anyone, and just do your job you should be ok. It is hard not to "fight" crime but what is the government telling you. Be the real police and you will pay the price. Fuck that bullshit!

For all of those calling this punitive damages, it technically is not. I know because I speak from experience. These are contributions by the detectives to help settle the case so that the City does not take it to trial and risk "actual" punitive damages in a 5-6 figure damage amount.
The City in agreeing to settle the case extort the officers as they did to me a few years ago and hang the realistic fear of allowing you to fight it out in court and face the aforesaid risk "if you don't contribute to the settlement." The City attorneys openly tell you that if you don't contribute, they will let the case go to trial and you will be on the hook for the punitive damage amounts. Believe me, it's pure extortion.

This is more common than many know. There are plenty of cases as such. I tried to file a grievance after I was forced to pay money. I cited the indemnification clause, but then financial secretary, Tim Fallon, rejected it due to its timeliness. The City has set a precedent in these "contribution" amounts and it needs to be fought by the FOP. I brought this up before and received no attention. Hopefully the FOP will look in to it this time and file a grievance on behalf of the Detectives.

First of all the FOP or anybody else is PROHIBITED from paying the punitive damages. Illinois law prohibits it, thats why they call it punitive= punishment!!!!

And read the article dumb ass the names are right in the Trib article.

The FOP also has a fiduciary responsobility, if they pay one officers punitive damages which they cant then dont you think tht every attorney will then start including the FOP in the suits.
