Abbate Civil Trial

  • Now, almost six years later, bartender Karolina Obrycka's lawsuit against Abbate and the city of Chicago is set to go to trial on Monday in federal court. While the videotaped beating remains the emotional center of the case, the trial will turn on whether Abbate, other officers and higher-level police officials engaged in a cover-up to try to protect the veteran officer and keep the damaging video from public exposure.
This thing has reeked since day one.  No one has ever admitted to, let alone investigated, how Abbate got through the hiring process with his background.  Any of a dozen red flags should have kept him off the job. Then his behavior from day one should have gotten him suspended and facing 30-pending on numerous occasions.  Nothing though.  A career rife with cover-ups, excuses and passing the buck.

Now the entire Department is on trial and the City is fighting so taxpayers (of which every cop is a part of) don't have to pay for this asshole's off-duty bullshit.  Quite frankly, we hope the City gets clear of this one, because if you think it's miserable now, just wait if the City has to pay for off-duty shit.

  • Obrycka's lawyers said that another bartender, Patti Chiriboga, a friend of Abbate's, warned the officer's girlfriend the day of the beating about the damaging nature of the videotape. Abbate and his police partner made some 150 phone calls to other officers and detectives in the hours after the beating, according to court records.
One-hundred fifty calls?  Dude knows he has problems.
  • That same evening, Gary Ortiz, another Abbate friend and city employee, went to the bar to ask Obrycka not to press charges, according to the lawsuit. Ortiz relayed that Abbate had offered to pay for Obrycka's medical bills and time off work if she did not complain to the department or file a lawsuit, her lawyers contend. Obrycka declined the offer. According to court records, the city has conceded that Ortiz's action was an attempted bribe.
Duh. Does that guy still have a job?
  • In a conversation secretly tape-recorded by the bar's owner, Martin Kolodziej, Chiriboga allegedly explained how a desperate Abbate had angrily threatened her to help conceal the beating, even making a veiled reference about her brother at one point.

    "He goes, 'Believe me what I tell you.' He said, 'Your life, everybody in the (expletive) bar — this is, this is — I'm backed against the wall,'" a transcript quoted Chiriboga as saying. "'I don't give a (expletive). I did, I did that to Karolina,' he said, 'but I want the tape. I want the (expletive) tape.'


    "He calls me — he tells me, 'Do you love your brother?'"


    In the same conversation, Chiriboga told Kolodziej that Abbate threatened to falsify charges or plant evidence if necessary.


    "You tell Martin to get rid of that tape or there's gonna be people getting DUIs," she quoted Abbate as telling her, according to the transcript. "You might be driving with a pound of (expletive) cocaine on you." 
This isn't some "code of silence" or "blue wall" or whatever the media wants to portray it as.  This is a desperate drunk who finally realized he went far over any line previously passed and that a video was going to sink not only his career, but a bunch of people's lives and maybe even his ass in jail.  Too bad it didn't sink his enablers that got him on the job.

We haven't met one cop yet who didn't think Abbate shouldn't be fired.  Not one.  And we've been through a number of districts these past 6 years.  We also have met dozens who think he never should have been hired and are disgusted with the process that got him past his record into the ranks of the CPD.  That's what ought to be on trial - the process and the circumvention of safeguards that should have prevented this jackass from ever having a badge.

    What was in his background where he shouldn't have been hired?

    I've heard he was an asshole, so why anyone would try to help him is beyond me.

    If, and it's a big if, there's any good that came out of this, it's to use this asshole's behavior as a learning experience--99% of us didn't need to learn it in the first place, but those of you who want to get drunk and act the fool--well, don't pull an Abbate!

    Why he didn't go to jail is beyond me.

    He worked in the same district I worked, for a while. He was a thief and a drunk. The bosses knew this. Still they did nothing except transfer him to another district. That's how it works, they refused to deal with the problem, they made it some other district's problem. Now they will pay. The guy was no good from day one.

Hell when you look at the video,, it looks rough, she might have lost a few hairs, but none of the blows were really dead on, and a cooler doors are insulated. MILLIONS of dollars in city settlement can buy the 2 of them an island paradise. The "bribery", the 150 calls.(really??) just makes in more convincing.

    I was assigned, notice I didn't say worked, with Tony in 020 on the 3rd watch. He and his knucklehead partner, JB, were the types that nobody backed up and they backed nobody else up. They were hated and shunned.

    I hope this trial brings out just who his juice is and how this juice covered Tony for years.

    They should investigete how he got on the job, who protected him in the academy, and even better, once he was on the street, who took care of the CR's he allegedly gererated.

    In total agreement that Abbate and his ilk falsely stain the vast majority of the Department. They get clouted into jobs, get protected by their sponsors, and until that whole system is made public and some higher-ups lose their jobs and pensions, nothing will change.

    But I have to point out that civilians perceive a Blue Line because sometimes it sure looks like one. When Abbate showed up for his criminal court dates back in 2007, cops let him go in and out the back door of court, and used squad cars while on duty to keep the media away from him. If that's not the Blue Line in action, I don't know what is.

    Please go and vote, hopefully for Romney. Early voting starts today and runs through November 3. You can vote at any early voting location, all you need is your government issued ID. Its a lot faster this way and you can do it while at work. A lot of coppers, for what ever reason have their head up their ass and seem to believe that Obama has it locked up.     If you think the process is to blame, you're just as bad as the dems. It is the fault of one stupid ass drunk. He may not have been a drunk prior to screening before job offer. If he was, unless he shows up drunk, how hard should the process be? What should be done different? You want people to follow possible recruits around?

    First, as he stated an examination of the entire clouted hiring process needs to be done both regarding the specifics of this case and in general. Because of a prior DUI Abbate was not eligible under CPD rules to be hired when he was. Those rules became more like suggestions in his case. A mild suggestion, apparently.

    Second, there needs to be a foolproof method of dealing with problem officers. Something that is insulated from the power of the clout. It would help if problem officers or just burned out officers could be sent on "sabbatical" to other city departments.

    Sometimes good cops just get burned out on the day to day vileness they encounter. Let them take a year or two off and trim trees for the city while staying on the police payroll. Keep them in a "reserve" status so they can be put to use during "emergencies" like NATO or the upcoming Mormon riots if Romney loses.

    A city laborer who actually shows up to work makes about the same money as a blueshirt. It would be a "win win" for the city, the department and the individual officers who take advantage of it.

    I spent a few summers cutting grass and trimming trees and they are nice mindless gigs. You go to work, you sweat, you go home, shower, and take a nap. Nice.

    Also the pension system needs to change. I don't claim to understand the ins and outs of it as it seems to have been developed by twisted Keebler elves and Monty Python accountants, but cops should be able to qualify for retirement before 20 years.

    Say a guy has 12 years on and is burned out he should be able to leave, get another city job and eventually draw a pension.

    So endeth the lesson

    I was in 11 when Anthony was there working the wagon on third watch. The person who did the most to shield Anthony was beat 1130 Sgt. He always made sure Anthony didnt drive the days he came to work "under the weather". Or he switched his assignment to lockup keeper. Or he downed the only wagon on third watch on hospital details so Anthony could dry out a bit. He occasionally had Anthony driven home by one on duty guy while his partner drove Anthonys personal car home. When the guys he worked with on the wagon had had enough and bailed on him and kept the wagon, that same Sgt put Anthony on the park car 99 free to do what he did unchecked. So if you want to know who and how he was "protected" after he got on, start with some of his immediate supervisors in 11. The bosses in 11 didnt fuck with him for a reason. Anyone care to take a guess why? Can you say birds of a feather? Can you say Anthony did plumming work for alot of these bosses? Can you say they drank together and went bowling together?

    Sad to say that because Rahm told the city that he would hire 500 new cops this year, HR is pushing bodies through the system. The entire process took 2 months for my neighbor to get hired, and there is much more to go through now than when I got on 27 years ago. And this kid is an rotten ahole. Unfortunately, I wasnt interviewed about the kid's character. Makes me assume that we got a lot more shit coming on the job if the city is moving this quick to make Rahm look good.

    Every alleged threat came out of Abbate's mouth or one of his friends. Not any CPD officers except him at the time. When you take a report and the alleged offender is not around how would you know the offender is the police. Just because someone says so. Abbatte was a J.O when he worked in 011, a do nothing fuck. The only cover up here was the one Abatte tried. Hopefully the jury find him liable and not the city.

    That's the thing about Background Investigations on Cop applicants- if you screw up a murder investigation a murderer gets off.

    If you screw up a background on a police applicant (or if he gets "juiced" onto the job by his clout) we get stuck with some psycho nutjob for the next 30 years.

    There are too many good officers within CPD whose reputations suffer because of the incompetent slackers who simply get into CPD because they know someone. Heck, for every Abbate, there are 10 more slackers being placed into Sgt positions because of who they know. I know so many great cops but I realize the damage CPD rank has caused by hiring unqualified people. It is really quite a shame.

    ehhh, maybe not. Since you're here politicking for Emanuel's new strategy of putting light duty people on the "rat patrol" payroll let's take a stab at it shall we?

    #1. Sure, staying on a working payroll while you have a problem that keeps you from your regular job is great. But we're not talking about a customer service job. We're talking about someone who carries a gun and enforces the law for a living. Emanuel knows full well that creating the alternative job of "peasant rat catcher" is demeaning to someone who's previously held a job upholding the law. So, arbitrarily determinging who's "burned out" and making them a rat catcher is designed to cause that person emotional stress and make them quit, rather than work as a rat baiter.

    2. Your reference to "foolproof" and "clout proof" is naive at best and borders on Emanuel white collar criminal. There IS no foolproof ANYTHING in politics, and policing IS politics pure and simple. Police are no longer used for the purpose the law intends but rather as political pawns to extract votes or money or to enrich those who've already promised votes or money. Therefore, there never will be a "cloutless" process in dealing with people who're stressed out.

    3. Your view of our pension is childish, uninformed and naive. Our pension exists as it does because we gave up contractual raises for years. That was the City's way to defer giving us a raise. So the pension was set up as it is now because the POLITICIANS decided to con us into NOT taking raises in lieu of PENSION provisions over the long term. So we bought it, years ago. And we've lived by it, for two decades minimum. We ALL came on this job assuming, and calculating that our final days would end as planned, with the pensions we came on with.     Anyone remember PO Kevin M. Of 019? Over 100 brutality complaints, at least 5 years of suspension time, threatened a sgt at work, threatened to blow up a Lt's house to his face at the desk, many lawsuits, countless other beefs yet people including a Lt from personnel and the current XO of 019 spoke up for this lout and helped him keep his job.     That Abbate was allowed to walk through the court building, through the station, and out the back, WAS AT THE REQUEST OF THE COURT SGT (Cook County), and not CPD. CPD allowed it due to the media circus, and Abbate was still a cop at the time, so he was allowed to be in those areas of the building.
    This was a crowd control issue, and nothing more.

That's where all Police Officers park when going to court. Abatte was a Police Offier at the time, no one in 025 knew him so he parked there as everyone does. As a matter of fact he walked in the back door, past the desk and into court. NO ONE knew who he was or what he looked like.

    Squad cars used to block the newsmedia you say? They were all over the place, acting obnoxious and trying to get into that back parking lot. Are we supposed to allow them back their because they want a money shot for the noon news? Are we to allow them back their so that they can film other Officers and their cars, some of whom are undercover? Do they have a RIGHT to go wherever unfettered because they want to?

    The newsmedia were allowed inside the station and the front parking lot that day. They were upset because they wanted access to the rest of the station and the rear parking lot and were not allowed back there due to opsec considerations. Abatte was allowed to go out the back door of the courtroom per the instructions of the judge,then through 025 station and into the rear parking lot AS ALL OFF DUTY POLICE OFFICERS ARE ALLOWED TO DO when attending court. There was no coverup. We didn't know Abatte, didn't know that he had a court date and would not have protected him had we known. Stop believing what the MSM tells you all the time. Use your head. We hate Abatte more than you do. We realize what he has done to this Department and have to live with it everyday!

    C'mon--no one stands up to the fat fuck because it's a neighborhood bar where everyone knows he's a cop and that he'll kick your ass and get away with it. So you leave and go somewhere else to watch the ballgame, or you just stay as far away from him as you can. Or you're a badge-sniffer (the cop groupie equivalent of guys who like to hang around athletes, jock-sniffers) who gets off on being a cop's drinking buddy even if that cop is such an asshole that his assholery is visible from the International Space Station.

That is, in fact, exactly the issue that is being contested. That is the only issue any of us in 025 care about.
    PM and JK (who drafted the GOCR)are not only good coppers, they are good people. Two of the nicest guys you will come across on this job. And they are legit. They are not hard chargers anymore, but they know what they are doing. If their GOCR does not relate that the offender was a cop, and they state during the follow-up investigations that no one ever told them that the offender was a cop...THEN THEY WERE NEVER TOLD THE OFFENDER WAS A COP.
    Yes, I have a bias. I have known them a very long time, and have worked with them. If there were ever two officers that deserve the benefit of the doubt, in a "he said - she said" situation, it is these two officers.

    Initial reports shouldn't include conjecture, such as 'I think he was a cop'. The responding officers make the initial report. It's up to the det's to do the follow-up and the 'final report.'

    Unless of course, the case was blown off by CMO. If the citizens knew how badly they're getting short-changed on service, they'd be appalled. Det's don't have time to do ANY follow-up. It's called being assigned more cases than it's humanly possible to handle--and being told by bosses to get rid of cases ASAP. Suspend everything.

You do know that when you are stripped or suspended they take your star and police powers away, that means you are not the police during that time frame. It didn't matter because we didn't know him or even really what he looked like. On that day when he went to court, he was simply another off duty copper who parked in the back,walked through the station and into court. It wasn't until later on that we learned he was there. Are we to question every copper that does that to see if he/she is stripped?
    Bill, the MSM and now her attorney allege this vast conspiracy took place at 025. And they can get away with that assertion because the average citizen doesn't know that Abatte didn't work in 025. They don't understand that coppers from every district in Area Five which includes 014,015,016,017 and 025 all go to court at Area Five. Hundreds if not a couple of thousand coppers. Most of whom don't know each other. I worked in 025 and yet I probably know about five other coppers that work in other districts within Area Five. In order to have a conspiracy to protect or hide someome from something or somebody, a small but important part of the conspiracy is that you know who or what that person being protected looks like don't you think? And as far as Abatte being protected by allowing him to walk out the rear door of the courtroom, that decision was made by the judge due to the media frenzy that was going on in front of the courtroom.

    The bottom line is none of us at the desk that day knew Abatte or what he looked like. There was no conspiracy or "blue wall" to protect him. That conspiracy exists only in the mind of the plaintiff and her attorneys because if the can't allege some sort of misbehavior by the police/city, then they cannot hope for a huge award because it's very doubtful that Abatte has millions to give away as a settlement like the city does.

    The other men in the video look to intercede, yet they appear to either know he's a cop, and are hesitant to get involved, or just plain intimidated.
    WE ALL also know that this could of taken a different turn.
    Let's say there were no cameras.., and a good samaritan jumps up to stop a douche bag from pummeling a bartender, and it that course, Abatte shoots and kills the good samaritan.
    With no witnesses, he will claim self defense. He'll then threaten the bartender to be silent, as he did he as well.
    So here comes some reality...,
    This retired copper may just be sitting there
    ( with my .357 snubby ), and when I intercede in stopping some douche bag I don't know from violently pummeling some female bartender, and he pulls his weapon out, I'll drop him like a bad habit!

    All she had to do was go to the phone and dial 911, but no, she decided to physically handle the situation.

    It was her mistake, but even so, if you look very close, he never connects.

    I guarantee he was stripped at that time, he was arrested and charged by IAD, standard operating procedure, and then sent to call back awaiting his prelim hearing. I doubt he arrived at court that day wearing his uniform becaquse then he'd be in even deeper shit. So the only way he could have gotten in past the desk crew is with a phony star or more likely a lack of observation by the desk crew. You can blame that mistake on the desk for not being attentive to security, or blame the station design for making it somewhat difficult to keep things secure. Either way, its a good thing that a disgruntled cop or worse still a terrorist hasn't exploited this yet and killed and maimed a bunch of us.

    I never thought this was a conspiracy to protect him, I thought it was an effort by the police and the courts to keep order and at worst I though it was a "fuck you" to the media for killing us on this incident. I'm no fan of the arrogant liberal media.
