Thorough Investigation

Remember that Vanecko investigation?  How thorough it was and how all the bases were covered?  How there wasn't even the hint of a political bent to the investigation?  Guess what turned up after 8 years?
  • Security surveillance video has turned up showing David Koschman a few hours before his drunken 2004 encounter with Richard J. “R.J.” Vanecko, the nephew of then-Mayor Richard M. Daley who’s charged with killing the 21-year-old Mount Prospect man, sources told the Chicago Sun-Times.

    Last year, Ronald E. Yawger — originally the lead detective on Koschman’s homicide case — told the Sun-Times he was unaware any video existed. And the Chicago Police Department denied the newspaper’s request for video in March 2011 without explanation, neither confirming nor denying whether the police ever sought or found any tapes.

    But now sources say investigators for special prosecutor Dan K. Webb have obtained a video showing Koschman and four of his friends entering and leaving a Division Street bar in the Rush Street nightlife district.
But this was "handled" appropriately at the time.  Give us a fucking break.  This is going to drag a whole bunch of people through the wringer.

    Well, some of Cline's Merit picks and Command selections suddenly make sense. Oops!

    Personally, I liked the guy, but every single merit promotion he made, especially the sergeants, have been absolute disasters!!! Completely useless deadweight in every good unit left. So many, many screw ups and cover ups because of these incompetent people taking up spots that need qualified supervisors/investigators. Instead, we have years of absolute dogs getting away with ghost pay rolling, company cars and gross incompetence. Thanks for your legacy Phil. Time to pay the piper.

    I never had clout.I was a court whore and worked special.I bought property.a whole bunch of it.my clout is my pension and over 20 properties that I have.I made it a point to have more than any dirty Ass exempt.I wanted to fuck the city for a pension that's why I stayed.and now I'm delighted to see the vanecko crew sweating.....yes sir sir.

There is no video of the incident just a video from 3-4 hrs before which really has zero bearing n the case except to establish what everyone knows already, the kid who died was out drinking. Where's the big story? Monday morning qb, should the detectives have gotten video of the ihop where he had breakfast the morning before c'mon realize the truth no cover ups by the detectives, I have no clue about the gold stars but I know the detectives DID NOT cover this up.     This isn't a cover up; it was handled by Area 3 detectives. You could have had six sober, independent witnesses, the incident caught on seventeen camera angles and on-viewed by a policeman, and it still may have been shot down. The real question is: was this another case of ineptitude or laziness, that still persists in Area 3 today?

    Yawger better be the first one to take the free bus ticket from the special prosecutor or the Feds, whoever ends up with this case, or he's going to be the first one thrown under it.

    I'm guessing the outcome of any investigation will be that no one at the top will face any consequences, just the ones at the bottom who took orders from the top.

    Hopefully Yawger is in Hawaii or something.

    Just goes to show you, shit you might have done years ago can come back to haunt you in the worst way. I'm not saying he did anything wrong--just by doing your job, if someone raises questions years later, you're still in the buses headlights.

    Another job hazard we all face.

    Good luck to all the coppers who had their name on any paper---but if they WERE involved in any kind of coverup, F*ck you. Although I do understand the pressure to do what you're told--and exactly where do you go if you're pressured to do something? Corrupt IAD?     Electronic records do not disappear.On the face they can appear to say one thing but in the bowels they always remain of themainframe.

    Every time a report is submitted to CLEAR/CHRIS in preliminary it is saved forever and when it is brought up and reviewed and modified both versions remain along with the id# of the individual who brought it up.

    I would guess that the exempt members who had knowledge of this investigation and oversaw same will be sweating.

    Commander Chasen is the individual who should start sweating as his id# should be all over these reports and he can give those up above him.

    But those who know Cline can easily believe that he was the individual calling the shots!

    Cline gave us the policies that led to:
    Weems
    SOS-Finnegan
    Abbate
    Koschman
    002-Narcotcs
    Jefferson Tap

    His policies led to CPD being led by the likes of Weis and McCarthy owith the alternative being taken over , such as DOJ just did to Oakland PD.

    Perjury is a felony, conviction of a felony could lead to the lose of one's pension. All involved should recall this.

    From a troll: CPD has the most difficult and dangerous job in the city and you do not get enough support. But as a citizen I would recommend that you never compromise your moral character, what you know is right and what you know is wrong when some shithead tells you or you find out he or she is connected to some asshole politican or otherwise infludential person looking to be not held accountable for their actions. This character and duty of a law officer is what makes each of you different from people like me. It is easy for me to sit here and type it I know. But this Vanecko case is really a most agregious violation of the duty of any law officer. And I suspect Yawger is just a bit player here, given a part he never wanted. This case brings a stink to the command of the CPD, the Mayors office, the SA office and the court system. And folks, it will stink all of the above again, now as a number of people try to figure out what to do next. My suggestion, assemble a case and get his narrow behind charged and lets see what a jury decides. If he takes a bench trial, let us just see who is the Judge. But in any case, there needs to be justice for this kid and his mother. He did not just fall to his death from a curb.

    Seriously? You do know the lead detective claims he was unaware of the existence of any video and the Department refused an FOIA request by the media? And then Webb finds video within 3 hours of the manslaughter? Howe many other videos might be out there waiting to expose the piss-poor investigation? How is that going to play in Peoria? Or in front of a federal jury from Peoria? You do know that Federal juries are drawn from all over the midwest, right?

    And Koschman didn't die drinking - he died from a punch, a willful action that caused harm. And everyone else who was there denied knowing who threw the punch for weeks. And files disappeared. And excuses were made, not by the suspect, but by investigating parties including the States Attorneys office.

    Try wrapping your head around this one - a hearing 8 years ago would probably cleared Vanecko of wrongdoing and he would have gotten probation for manslaughter or battery or something else based on who he is. But this desperate effort to hide shit for what was a couple of drunks pushing and shoving and punching makes everything look suspicious, even sinister.

    If you can't see that the Department is going to get hammered (once again) for the actions of the clouted and their political masters, then you're blind. Willfully so.

    I actually kind of feel bad for the guys who had to investigate this thing. They were in a tough position, no doubt getting heat from above to find some way not to charge this guy because of who he was related to.

    Very, very few people have the stomach or the capability to stand up to that kind of pressure, even normally decent and honorable people. I am not saying there should be no negative consequences for their actions if they did something inappropriate, but what they might well have done is very understandable.

    They will probably get thrown to the lions in a public spectacle to save others. That is the way these things usually go. The guys up the food chain almost always skate.

    Old Retired Guy Here: I very much agree with the comments regarding the Chicago Media. Where were they eight years ago ? Did you ever see the movie "Call Northside 777" ? What happened to News Paper Reporters of that caliber ? We have some that sit at a desk, and type up sarcastic editorial's. I can do that.     This has to be the most accurate post in this section. The Sergeants rarely get screwed in the D Unit, but I can assure you the Detectives will be put through the ringer. One thing I really hope is that the second Detective J.G.comes out of this alright, he is a righteous guy and would never cover up for Daley or anybody else for that metter.

    Everyone involved in the cover up deserves what they get. The unfortunate ones will be the unclouted CPD and not the elected officials or exempts that knew about it.

    What gets me is the people he was with that witnessed the whole thing,the one I forget her name, the one who's dad was the big construction guy. I hope when she tucks her kids in at night she thinks of David's mother, of how she was denied any consolation the truth (even if no one was convicted) would have provided I hope this keeps her up nights. What kind of people are these, they're well educated brought up with so many advantages and just become so amoral.

You could have had six sober, independent witnesses, the incident caught on seventeen camera angles and on-viewed by a policeman, and it still may have been shot down. The real question is: was this another case of ineptitude or laziness, that still persists in Area 3 today?

    Ronald E. Yawger was one of the best, most hard working police officers/detectives that I have ever had the pleasure of knowing. I cannot even begin to list the great police work that he did in his over thirty years of outstanding life risking service to the citizens of Chicago.

    He did not do anything wrong because he could not do anything wrong. He is not the charging authority.

    Let me explain it to all you jagoffs out there ready to throw some innocent detectives under a bus.

    Read the blurb that I have attached from "CPD Special Order S06-03 Felony Review by Cook County State's Attorney"
    {The States Attorney’s Felony Review Unit alone has the authority to approve homicide charges; or, in cases involving juveniles, homicide charges or any lesser charge arising from the same occurrence.}

    The case was presented to the States Attorney's Office for charging, it was not approved simple as that. The CPD cannot charge or override any of homicide related statutes.

    If some ASA wants to argue that they "continued" the case rather than outright rejecting it remember the ASA has its own private detective division - State Attorney's Investigators and they can and have used them in the past to do whatever private witch hunts that the SA wanted.

    This case was stopped at the State Attorney's office pure and simple.

    Lastly I will point that in my almost thirty years of experiences in Cook County this type of case would NEVER had been charged unless there was a political or police connection.

    Mutual combatants released without charging, happens like ten times a month in Cook County.

    God Bless you Ronnie and all the other Area Three Detectives involved in this nonsense.

    This type of heat directed at Homicide Detectives is the main reason that I am know working for another government entity.

    I hope the Feds can recover all the phone calls that were made when CPD found out who the suspect was. Hopefully the Feds were already recording Daley on something else when this broke.

    But THINK. This case will be heard at 26 California. Daley and the Democratic party put in Chief Judge Tim Evans. The same people put in Cook County State's Attorney Anita Alvarez who did nothing to bring charges in this case. (Can you imagine the results if an off-duty, drunk 6'03, 250 lb, police officer punched the poor kid?) Almost all the judges there have some allegiance to the Daley Machine. Do you think RJ will get a fair trial? Fair in the sense that justice will be served? Or that the interests of the Daley family will be served?

    I wonder if RJ's name will be on one of those kiosks that list all the defendant's names, will he be allowed to slip in and out through the back door at 26 Cal, will the assigned judge be notoriously incompetent or be a judge who favors defendants?

    I hope Webb can file a change of venue seeing as how almost all the relevant people to this case at 26 Cal have some connection to the Daleys and possibly to the people behind the alleged coverup.

    After twenty years on this job I think this case is a blessing in disguise. This might be the case that broke the up the relationship between the Chicago Police Department and City Hall.Finally maybe the State Government and Federal Government will realize that City Hall has TOO much power and control over its Police Department. That the Chicago Police Department needs to be run independantly from the Mayor in particually and City Hall.I beleive but could be wrong, St. Louis Police Department was once like CPD in where the Mayor had total control of the Police Department in order to aide in his/her political agenda. After several scandals, the control and influence was taken away from the Mayor and given to the State Legislature. They now pick the Police Chief and conrtol its annual budget.During his/her contract the Police Chief runs the department the way he/she believes best serve the citizens of St,Louis, not the Mayor or City Council. Past Mayors of St.Louis have tried to get back control of thier Police Department but have had no luck. I beleive this is a perfect example of why the Chicago Police Department needs to run indepentantly fron the Mayor and City Hall. If anyone believes that Scumbag Mayor Daley didnt call the Superintendant of Police to impeed or make this case go away I have a beautiful 3 acre, 6 bedroom, 4 washroom mansion to sell you on the westside of Chicago for $150,000.
    It is time for an indepentdant body to select the next Police Superintendant. A Superintendant who will answer to no one at city hall while his/her contract is valid. Imagine a police department being able to investigate aldermen, write westside/southside churches parking tickets on sundays without fear of losing your beat car, no more political clout bosses making political decisions and policies, only the best qualified and best test scoring members become bosses,no more aldermans being able to call District Commanders being able to call and get whatever they want, and finally a police force that doesnt have to worry about political repercussions just for doing their job.     It just amazes me how alleged Police Officers rely on their facts from "what they heard".

    I've followed the stories in the paper, I see where the Detective who actually conducted the investigation didn't get this case until roughly three weeks after it happened. I've seen the line-up photos and I read that Darrin O'Brien was at the Area for the investigation. Are you guys aware of how Vanecko came to be identified?

    Sure, Felony Review should have approved the case and let the court adjucidate it. They didn't. Dont blame the Police.

    But what makes me sick is the tone of comments on this blog when Mette was in the news. Mette was right and unfortunately in this case, so was Vanecko.

    OK, we would all like to see Vanecko, any Vanecko get hammered for what they have done to us, our finances and who they are related to. Maybe the cops and the A.S.A. were right not to charge Vanecko because of the facts of the case and not for who he is related to.

    Think for a moment, we only see the fresh sparkling face of Koschman in the photo they always put up just like they always put up the photo of Tryvon Martin or any other gangbanger that gets offed. But what was he really like that night, was he the drunken aggressor?

    Remember that CPD cop in Iowa who was followed by some drunk until he had to deck him with one punch, it was wrong that the officer got into trouble over that.

    Haven't you ever seen a pip-squeak with alcohol inflated ego and balls try to pick a fight with a man-mountain that you know was virtual suicide. I had to lockup a filthy skinny drunk one time who tried to start a fight with a former Mr. Olympia. I should have gotten the Life Saving ribbon for that.

    I wasn't there and I haven't read the reports. I just think that the cops in this case may have done the right thing from the get-go.

    With all the heat I suppose it will have to get into court to really find out.

    Um, charge him with the misdemeanor? Go for the override? Continue the investigation instead of filing it and leaving is as "open" for 7 years. How about those options?

    Just watched the 60 Minutes piece. I wrote some notes on what I thought they would say and checked them off:

    -well dressed, now, no thug clothes - check

    -soft selling previous arrests as "minor" (all youths in Chicago have an arrest record, don't they?)- check

    -crying mama - check

    -drag Burge into it regardless if he was involved-check

    -misrepresent Burge's conviction - check

    -ernest female Northwestern law student (one that wasn't used as a "treat" for convict interviews, that's still a problem) - check

    -former ASA (now a criminal attorney and part of the problem, but gets paid alot of money) who regrets his work - check

    I lost my voice yelling at the TV. I was off on the obligatory white guy that was "wrongfully convicted", but I guess Manning is back in the joint.

    He got caught waiting to torture and murder some working guy. He even bought and flat and built the torture chamber in it. Was he still working for one of those "wrongfully convicted" attorneys?

    The politicalization of the police department lays exactly at the feet of Richard M Daley. It began with the elimination of the Civil Service rank of Captain. For a few lousy bucks the old Captains sold out their rank and all rights to that rank for Captains in the future, never to be Captains.

    Previously a Captain was a Captain for life, he could not be demoted. Civil Service rank, they could and frequently did tell Commanders to go shit in their hands. Commanders could be dumped, wherever a Captain went they were still a Captain.

    That was the beginning of the end of all pretenses of fairness in promotions for even though the occasional exam was rigged or some answers were leaked, rank up to Captain was absolute. (except for detective)

    Since then it has been all downhill.

    And it only cost Richie a few thousand lousy bucks to buy each Captain off. For shame Captains, for shame.

    No cover up by anyone, just another example of some lawyers over at the ASA's office doing political favors again. Some of the ASAs are great! Others are completely clueless, very poor lawyers and horrible prosecutors. This was obviously some favor done for political reason, it too apparent not to be, but it rest completely at the ASAs office. The Dpeartment and the coppers involved shouldn't be tagged for that. The Dets had limited evidence to work woth, and some of the offender's family and frields who were less than forthcoming-- or truthful. They hod behind the protection of lawyers before they were even called in. Hmmm, why would a witness laywer up? This should have been a grand jury case from the onset. They can't hide behind a lawyer when they are given immunity. The dets knew who the witnesse were and who the involved were. Immunity at the GJ would have been the key to the truth or they would then face perjury. They couldn't have protected him then or suffer the results themselves. The balme is solely with the State Atty's office!

    I'm not a cop or lawyer but there are enough inconsistiencies here to investigate more then what was investigated.

    I'm a citizen, life-long, and this clusterfark doesn't make me think less of the rank-and-file CPD overall or even the Investigators involved in this cover-up if that's what it proves-out to be.

    CPD may well likely have been put in a very bad position given the Chicago Way. Careers, kids in college, etc...doesn't make it right if it was a cover-up but I can empathize with the box the "merit less" were in, at the time.

    But, once in a blue moon the evil mechanics of how Daley and his ilk ran things gets exposed and some come forward & then there is a price to be paid by those who shouldn't have done the things that were done, when they didn't have to do what they did; and then there is a price to be paid by the collateral victims down the pecking order that participated because they were between a rock and a hard place.

    I think this is going to be investigated properly and people who are in-the-know, who have lived with this and have had it eating them up inside will come forth.

    And, it's going to shine a brighter light on how despicable those at the top that set this in motion are.

    All I know about this case is what I read in the media. It does look pretty shabby for the detectives and prosecutors. But as a private investigator and former homicide detective I can say that many of the criminal cases I take on today indicate shabby police investigations, poor reporting and when felony charges are approved, a complete cessation of the investigation leaving many good things to be investigated. i know the area dicks are busy, very busy, at least many of them, but honestly, way too many of these investigations are poor excuses. Prosecutors, judges and defense attorneys just do not think much of them. I think the detective division needs a make-over. When you see how things are done in other cities and compare them with Chicago, you will see what I mean.

    It will be very difficult to prove any favoritism in this case and whether or not things such as charging was done correctly or improperly simple because of no witnesses or good witnesses and no video of the actual incident,this will be a tough one,so my guess is nobody will take any heat and the court will let Vanecko go with a slap on this wrist. time will tell!

    Just watched the 60 Minutes piece. I wrote some notes on what I thought they would say and checked them off:

    -well dressed, now, no thug clothes - check (What did you expect -- and how do you know they were thug clothes the rest of the time? Another item you have no idea about -- check)

    -soft selling previous arrests as "minor" (all youths in Chicago have an arrest record, don't they?)- check (do you have information that they were not? and it is a fact that most black youths in tough neighborhoods do have records -- another fact, check)

    -crying mama - check (well, seeing as her son was locked up for years for something he didn't so, I think she's entitled to a little cry, and it is part of the pathos of the story. part of what happened)

    -drag Burge into it regardless if he was involved-check (well, we're talking about the chicago police and he is the granddaddy of false confessions and torture so, yeah, he's going to get mentioned because he's part of the story which is about more than just these cases)

    -misrepresent Burge's conviction - check -- (I wasn't paying that close attention, not sure how it was "misrepresented" but who cares, if he was convicted for lying about it, just as bad)

    -ernest female Northwestern law student (one that wasn't used as a "treat" for convict interviews, that's still a problem) - check (still a problem, really, I doubt that...seems like what she said was true, she looked at the confessions together and they smelled, just like this whole case)

    -former ASA (now a criminal attorney and part of the problem, but gets paid alot of money) who regrets his work - check (what's he supposed to do, be happy he prosecuted innocent people? we'd be a lot better off if he had won the primary four years ago)

    I lost my voice yelling at the TV. I was off on the obligatory white guy that was "wrongfully convicted", but I guess Manning is back in the joint. (your yelling is misdirected)

    He got caught waiting to torture and murder some working guy. He even bought and flat and built the torture chamber in it. Was he still working for one of those "wrongfully convicted" attorneys? (don't know what you're talking about)

    Yep. It's all the Police Department's fault for putting those poor innocent young men in jail. (no, and I don't think that was the tenor of the piece. The state's attorney's office came under a lot of fire, deservedly so, led by Anita, who thinks it's plausible that the DNA got into the victim when the person walked by the crime scene later and had sex with the dead body, give me a break)

    There are many very good and dedicated detectives in the CPD, but, lets face facts,there are also way too many who be chased out of those units or held to a higher standard. More training perhaps ? Supervisors who actually supervise an investigation instead of just a perfunctory signing of reports? Take the clout out of merit promotions to detectives and actually promnote qualified individuals? It dseems each investigation depends on the individual motivations and professionalism of the detective assigned and not a standard set by the department. You just cant defend what has happened in the detective division and the overall quality of work that has been coming out of that division. What they are not short of is excuses.

    Cod of silence ? Preferred and preferential treatment ? You bet your ass there is. I worked in internal affairs for 4 years and I saw what was happening. And, it works both ways. If they do not like you they will work very hard to find something to screw you over or manufacture something just so you will dangle in the wind for a while. Don't kid yourself, it happens. Many of the investigators are ethical and honest, but there are a few who are not or who have a very jaded view on life. And, of course, when the file goes into the advocates office anything can happen before it makes its way around the department.

    Not just a poor homicide clearance rate, but a poor clearance rate in anything the detective division does. They might be understaffed, but come on, you can do better. First get rid of the majority of merit dicks, then assign every officer who holds the title of detective to an actual detecting job, no administrative assignments or academy assignments etc. Then, start demoting those who have not done a damn thing in years.

    The case is presented to the States Attorney for approval. Guess what-NO IDENTIFICATION, NO CONFESSION, NO INDEPENDENT WITNESSES, NO VIDEO, NO PHYSICAL EVIDENCE, NO LINEUP IDENTIFICATION ANY OF THE WITNESSES = STATES ATTORNEYS REFUSE TO CHARGE OBVIOSLY!!!!
    For you uninformed, do nothing, never made a felony arrest, excuse for coppers: There is no override for a murder decision by the States Attorneys Office.

    As I said previously, a lot of detectives have come forward and defended this entire investigation as one of the premier crime investigations of the century. But, lets wait and see what the special grand jury has to say about this. All I can tell you is right now no one is on the side of the police in this matter. On its face the entire matter was given a very short investigation. Yawger, dont know him as I am retired. But, I do know one thing, no one ever canvassed the area where the incident occurred to look for witnesses and to inquire if video existed. And, why did it take so long to even investigate this matter ? When someone dies the public demands a very through investigation as a life was lost. If this was your family member you would not be so cold in your comments.

    There was no cover up by any of the detectives. What police officer wouldn't want to lock up a member of the Daley clan. If not Daley or his dick head son. Witnesses came in and were not able to identify the offender. What else could they do? Supervisors today are incapable of handling situations properly. The only thing they know how to do is fling shit at someone. To actually know how to handle a situation would require one to actually know the ins and out of a job.
