Again, Why Was He Out?

  • A brother and sister and a second man have been charged in connection with the robbery of a store and the shooting of the owner’s brother when he tried to chase them on the Southwest Side last month.

    Jose Guerra, 19, his sister, Gabriela Contreras, 21, and Estevan Rosario, 17, were charged with armed robbery with a firearm and aggravated battery with a firearm in the December attacks after tactical officers caught Guerra with a gun on Sunday, authorities said.

  • The victim was taken to Mount Sinai Hospital in critical condition after having been shot in the head. He remains in a vegetative state today, prosecutors said.;
So he's a murder as soon as they pull the plug. And how could this whole thing have been prevented?
  • At the time of his arrest, Guerra was on parole in a 2010 robbery for which he was sentenced to 6 years in prison, but for which he was released on parole in December 2011, according to state Department of Corrections records.
That isn't 85% of a sentence, that isn't even day-for-day credit. He's out in ONE YEAR for a SIX YEAR SENTENCE, and now someone is going to be dead because of it. How many times did we cover this last year alone? Two? Three times? And that's only the ones we know about. How many more are there? Dozens? Hundreds?

Democrats can't bear to see their voters behind bars, and society is paying an unholy price for it.

It's a $$ thing, let 'em out early, and don't say a word, hope that the media can't connect the dots between the early release of the zeros and the havoc they leave in their wake.

It may not account for all of it, but keep in mind "time served" in CCJ on these. It can be 6 mos. to a year or more real easy on a repeat felony, 2+ years on a killing.

Hey SCC any idea whats going on with the hiring processes? I know of 3 people that have applied for CPD and just received an email stating that they did not show up to their P.O.W.E.R test when they were never notified. Whats going on? I am sure this is not the first time this has happened.

But there is good news right around the corner. Despite the fact Gov. Quinn has closed TAMMS and another prison, he states the current jail facilities are over crowded. To help ease the burden, he plans on releasing more prisoners early like the fiasco a few years ago. Only this time he promises to look more closely at the convicts he releases. I guess he admitted he didn't look at all last time.

He was incarcerated for 17 months total between county and state.

24% of his sentenced served for aggravated robbery.

This is by far the main problem for law enforcement. How can these bosses and the citizens expect any of us to keep fighting the good fight when the people who we arrest and prosecute get out early. In this case the offender got the equivalent of county time for a Class A misdemeanor. Here's a start to ending all of this lawlessness Chicago has been experiencing. Lock these motherfuckers up for 100% of their sentence. This would include everything from a Class 4 felony all the way to up to murder. Maybe then the criminals of this city ,county and state won't be so quick to committ a crime. This story is fucking sickening to me.

Releasing killers back into society after serving a minimal sentence is like letting a rabid dog out of his cage after a timeout. These parole boards and judges should be accountable with their jobs if one of their paroled felons commits a crime within a certain period of time.

I am hearing the same thing. Another class in the end of January or February. I guess they are still short Sgt's. They had a large number that retired.

SCC, I disagree with the poster at 12:22 AM. I think it's mostly political. It is the democrats who harp about how much money it costs to keep criminals incarcerated. They refuse to consider how much more society is harmed when murderers, rapists and thieves are free to carry on their depredations. They also feel that criminals are underdogs who've gotten a bad break from society and need to be given a second chance. Only it's now become unlimited chances. I couldn't hazard a guess how many rap sheets I've read for people arrested one hundred times or more.

As for as former Gov. Ryan, he was a complete RINO. During that election I actually voted for the democrat, Glenn Poshard, because he was more conservative. Poshard got no support from Daley and Madigan because he wouldn't kiss their asses, Ryan was more than happy to pucker up.

My answer to overcrowded prisons is to have the inmates work in shifts. Sleep in shifts, do everything in shifts.
If there is two to a cell, make it three in a cell. On of the inmates will always be working.

I know the thought of getting caught and going to jail use to be terrifying but now a days it is a vacation. TV, health care, good food, juice machines in the common area.
Enforce the laws that are on the books, don't rack your brain trying to come up with ways to regulate guns because when you do, the only people that it will affect is the law abiding citizen that bought legally, registered legally, and takes responsibility for securing that weapon in a place where children can't have access to it. Bad guys are not going to give up their weapons, just the good guys.

They notify you via email. Yahoo sends in unrecognized addresses to spam folder. So it just may there.

Not writing tickets for MR in Belmont. His career has advanced shockingly far. He doesn't need tix from me. I did however issue a personal service citation cuz I thought the Lt was a decent guy(I'll B stabbed in the back by him sooner rather then later)and it has been awhile. The person thanked me for the PSC and said "We were doing a good job." I wanted to make that disappear so bad, but we'll see eachother again. If the judge asks me anything my memory of a routine traffic stop might be cloudy in roughly 30 days.

Transfer to 11, everyone is happy there. See ya!

Here's a crazy solution, cutback on some social programs ( like abused welfare) and throw a crap load of more money at the prison system, build more and hire more guards. Then prosecute even the smallest case properly and keep these savages in prison for their complete term.
You can justify cutbacks by stating that most of the imprisoned would have been leaching off a program so it's a wash and you keep them off the streets. I know some libs feelings would be hurt but these are desperate times that need only logical measures. They would cry that only the poor and minorities would be targeted with this act, NO just criminals would be targeted. In addition to public safety, you would also employ construction workers to build these prisons and employees to operate and secure them. It's a win win situation and if the judicial system would jump on board it would work.

A news story states that the state will try early release again because the jails are over crowded. Crime will increase because criminals will know they will only have to stay in jail for a few days or weeks and as they have been bragging, a few weeks in jail for a few million is a good deal.

i am not surprised at this at all. this isn't just a political thing though. it has to do with money, however, they still need to be called out on this because it endangers everyone. the assholes who allow these early releases should still be called out because you know they'd call out the competition if the tables were turned. overall, this is just another tragic story that could've been easily avoided if people did their job from the beginning all the way to the end. typical shitcago and its corrupt politicians.

these tragic stories are perfect examples of what needs to be logged and remembered come voting time. it is plain and simple that anyone could see how our money has been mishandled for years. i understand it costs a lot of money to house these scum in our prisons, but then leave that money available since the crime is going up, since they make chicago a sanctuary city, and since these scum are constant repeat offenders. i bet if they were to carry out there full sentences or at least federal percent of it then we could see an actual reduction in crime.

That whole process is really screwed up. They use email to notify candidates so tell your friends to look in their spam or junk mail folder. The City of Chicago, through Human Resources Director Tracy Ladner, is too cheap to send out a letter to confirm major employment notifications and instead uses email.

No joke, if they missed something due to the incompetency of the city and their email crap go hire a lawyer and sue.

This is a monumental waste of City resources just to save the cost of stamps. The City spends tons vetting candidates for police officer and then can't be bothered to send out a regular or certified letter to notify candidates of the next phase of the process. Unreal.

It costs mucho $$$$ to do the testing and background investigation necessary to get a person on that hire list and then to waste it by shortsighted stupidity by refusing to buy an envelope and stamp is, sad to say, situation normal for the City of Chicago.

Incorrect. Custody date 7-16-10, Paroled 12-21-11. 6-13-11 is only when he arrived in IDOC. He likely got credit for pretrial jail time from 7-16-10 to 6-13-11. He served 1 year 5 months as SCC reported. Even with "Good time" credit, that's only half of his sentence. Illinois is Pathetic.

Not a cop. But a eyewitness to this madness. Nephew got picked up for a 10 year old warrant while getting his rap sheet. Come to find out, his lazy probation officer did not process it correctly. Nephew was arrested at 1pm on a Friday. Cops said not their fault we must arrest him. Fine, I am expecting to pay a minor bond and take him home. He has not been in trouble for 10 years, zero arrests, working, and on the straight and narrow. No bond the judge screams the next morning. He does not get out of county for two fucking weeks. In the meantime, because he needs meds, he was taken to the ER while in lockup in leg irons and shackles. Leg irons and shackles are you kidding me? The system is pitting the law abiding citizen against police to create this madness. After a week he did receive an apology from the SA but that did him no good. Just to let you guys know how fucked this system is but then again that is why this blog is great at times.

But last week, the authorities said, Mr. Ratliff, 32, ended up on the wrong end of a gun. The police in northeast Georgia found him dead at his office on Jan. 3, shot once in the head. He was surrounded by several guns, but not the one that killed him. The Georgia Bureau of Investigation is treating it as a homicide.

Ratliff was known as an outspoken gun advocate. In a message posted to Twitter on Aug 11, 2012, he wrote: "I went to the movies with my pistol in my pocket the whole time I was praying that somebody would try to pull a Batman!"

Probably not going to happen until the current class of detectives graduate which is suppose to be 2nd week of Feb. The academy is full of recruits and the detectives class, so no room for Sgt's. There will be another class of detectives this year too.

It makes sense to get rid of Sgt rank and create a corparal rank for less money . Assign Sgts as district station supervisor , Lts as district and unit commanders and maybe cpd will be able to continue paying our pensions .
XO rank should be Capt pay but assigned as area deputy , etc.

Yes we do...and it is not a joke. The guy is an absolute computer pro and has come up with a whole system to make videos from crime scenes available to the officers in 008. He gets called out by all the detective divisions to work on big cases and track down video from the neighborhoods where things happen. MC is an asset to this department doing something that most of us can't or things that the inept people from Homan Square won't. This was one of McNaughton's things that he broght from 016 with him...and it is working out well. Got to give him this one.

I am not a Rhodes Scholar but I do know how to cut the number of Homicides in half in Cook County. Farm out all the Cook County Judges and States Attorneys to Lake, McHenery, Kane, Dupage and Will Counties and bring the Judges and States Attorneys from these counties to Cook. Our neighboring county Dupage, did not experience 1 Homicide all of last year because the States Attorney prosecutes the law to the fullest extent allowable and the Judges sentence the convicted to the fullest extent of the law. The judges from Dupage and the surrounding counties also do not let violent criminals back out on bond only to wreak more havoc or possibly death. This alone, I believe, would cut the number of Homicides by 20%.
Start conducting judicial reviews to ensure that judges are following sentencing guidelines and bail guidelines. Start looking at the way things are done in Dupage County. Start a legislative movement for truth in sentencing so offenders do 85% of their sentence instead of the brief “time out” that they are given in Cook County. If that is not enough of a deterrent start looking at tougher sentences for your voters. If you need to build more prisons then build them instead of closing them or selling them to the federal government. Also get a study going that tracks the violent crimes committed by all the violent prisoners released early under Governor Quinn.
Is it possibly that the legislators, the governor, Mayor Emmanuel, Eric Holder and president Obama are trying to push the carnage (murders and shootings) to an all-time high, sacrificing the countless murder and shooting victims and the pain and hardship inflicted on their families to further their agenda, the abolishment of the second amendment? It is time that you start representing the people that pay your salary rather than the people who make Cook County deadlier than Afghanistan.

Im not a fan of McNutty in 008. In fact he has destroyed the district. An entire watch has laid down and he is making fast enemies with the other two watches. However the "video Guy" thing has actually worked in 008. Not stopping crime obviously but it has had great success in catching a lot of people that otherwise might not have been caught atleast as soon as they were.

SCC, you might want to consider that you yourself are a member of the media. You didn't start that way, granted, but the huge audience you have built and the credibility you have earned means that large numbers of Chicagoans and others turn to you regularly to get the straight story on what happened---in other words, the news. Perhaps you might change your frequent (and typically justified) criticism of "the media" to the downtown media---because they are the ones, the elites from Lincoln Park, etc. but who are, frankly, as bought-and-sold as any alderman ever was, and who typically fail (on purpose, mind you) to connect the dots.

As you relate it, this IS nuts, though. I sympathize.

Be careful yelling for this law, that law, people. This motherf__er is a one-size-fits-all arrangement, and that means you if you run afoul of it and don't have money, if you get a crazy judge as above, get caught up in a prosecution go-hard trend, etc.

We have all the laws we need and more, we just live in an upside-down society.

Not a cop. But a eyewitness to this madness. Nephew got picked up for a 10 year old warrant while getting his rap sheet. Come to find out, his lazy probation officer did not process it correctly. Nephew was arrested at 1pm on a Friday. Cops said not their fault we must arrest him. Fine, I am expecting to pay a minor bond and take him home. He has not been in trouble for 10 years, zero arrests, working, and on the straight and narrow. No bond the judge screams the next morning. He does not get out of county for two fucking weeks. In the meantime, because he needs meds, he was taken to the ER while in lockup in leg irons and shackles. Leg irons and shackles are you kidding me? The system is pitting the law abiding citizen against police to create this madness. After a week he did receive an apology from the SA but that did him no good. Just to let you guys know how fucked this system is but then again that is why this blog is great at times.

No day for day has'nt been for at least 10 years
Inmates sentenced for Murders, & Rapes under Class X felonies are to serve 85% of time given

almost everything else cut in 1/2 as soon as Inmate reaches Stateville or Graham reception center to be classified /placed at a penitentiary with an open bed!

so its now 3 years
also good time(few or no disciplinary tickets in a year or less) 6 months off ABE(adult basic education) 45 days for GED substance abuse treatment 45-90 days its VERY CROWDED Gents because of budget cuts, recidivism and the tremendous jobs you guys are doing!

The last test was announced in Sep of 05. The second part results with your rank order were dated 07 Feb 07. The next test hasn't even been officially announced yet.
