Constitution? What Constitution?

Illinois is the breeding ground for so many ignorant politicians. We can't believe any of them passed a civics course.

  • Prosecutors in Chicago are telling state lawmakers they can essentially ignore a federal court ruling and not legalize concealed carry in Illinois.

    The Illinois House on Tuesday held the first of two statewide hearings on how to legally allow people to carry a gun in the state. Illinois is the only state in the nation that bars anyone from carrying a pistol outside their home. In December, the 7th Circuit Court of Appeals said Illinois must change that.

    But Paul Castiglione, policy director for the Cook County State’s Attorney’s office, told lawmakers there is no need for a new law.

    “Only the Illinois Supreme Court can declare a statue from (the legislature) unconstitutional,” Castiglione told lawmakers Tuesday. “I heard (someone) say that after 180 days our UUW (unlawful use of weapon) statute is unconstitutional. Not so.”
Really? And this guy writes policy for Anita? The link above is to the Illinois Carry website and the readers there (who have actually read the Constitution) rip this ass a new one many times over.

And who needs Freedom of Speech?
  • A recently introduced bill in the Illinois state Senate would require anonymous website comment posters to reveal their identities if they want to keep their comments online.

    The bill, called the Internet Posting Removal Act, is sponsored by Illinois state Sen. Ira Silverstein. It states that a “web site administrator upon request shall remove any comments posted on his or her web site by an anonymous poster unless the anonymous poster agrees to attach his or her name to the post and confirms that his or her IP address, legal name, and home address are accurate.”

    The Democratic lawmaker’s bill, which does not ask for or clarify requirements from entities requesting the comment removal, would take effect 90 days after becoming law.

    Pseudonymous and anonymous comments have long been a critical part of U.S. public discourse, though, and the bill may be on shaky legal ground.
"Shaky legal ground" might be the understatement of the year.  Thomas Paine and John Milton are turning over in their graves.

Apparently our legislators have never heard of "Publius" which was the pseudonym/pen name used collectively by Alexander Hamilton, James Madison, and John Jay when they published The Federalist Papers.

The Federalist Papers was a collection of essays which were published by the above named authors which are credited by many with persuading the States to ratify the US Constitution.

If our scumbag legislators were around in those days, Hamilton, Madison, and Jay would not have had the freedom to publish those critical essays under a pen name, and our Constitution might not have been ratified.

Now that Lisa Madigan got shut down on her Federal court appeal regarding conceal carry it would be a good time to call in the National Guard to "help control the Chicago violence" wouldn't it?

The Chicago Trib has already sent up the trial balloon about "calling in the troops to do the job just like they did for hurricane Katrina" -- to see what kind of push back / reaction the city gets.

During Katrina the troops went door to door confiscating weapons "for your own safety"

So yeah. Would not surprise me one bit. If Chicago runs out of appeal options it's time for martial law, curfews, troops in the streets and gun collections.

He mentioned the bust last week of the man from out of state being charged with UUW for having weapons in his trunk returning from the range.

Pointed out how that conflicted with McCarthy's comments that garry is not worried about the FOID carrying gun owners.

Said the city has a history of abuse when it comes to gun ownership instead of dealing in good faith and that the NRA is not going to let it happen again.

NRA asked if it will wait on concealed carry until proper procedures in place to implement, lobbyist says they have already waited.

NRA rep was the last to testify so he's near the end of the video.

Correct. In the 1600's. In England. The country we fought a war of indepence against. I knew him best as a poet and author from high school and college literature classes. His magnum opus was Paradise Lost. But at least you know of the guy and some of what he wrote so perhaps some day we could have what might pass for intelligent conversation. And the Blackhawks just won so all is good in the world, for now.

Your point? It was 100 years later we fought that war. And though we threw off the chains of English monarchy, we maintained a version of courts and government based on English law. Our point was only that anonymous criticism of unjust government has a long a storied tradition, not only in this country, but in the English system itself.

And yes, the Blackhawks made history tonight. We were there.

My only point was that I felt that Milton was much better known as a poet and author than political firebrand. That's all. I was at home in front of my new 50" HDTV for the game. Damn it is good to finally have a TV that allows me to see the damn puck!

Shaky legal grounds, my aSS. It would be a clear infringement of the 1st Amendment. Anonymous speech, like any other is fully protected, unless there is an overiding government interest, and that is unlikely.

Fortunately for those who post comments, ourselves included, neither the State of Illinois, nor any other state, can enforce such a law.

The Internet was deliberately designed to not be under the control of any one authority, company or individual. The Internet is nothing more than a disparate interconnection of private devices, routing equipment and high-speed data circuits.

Since 90% of what takes place on the Internet requires traversing state lines, it is the Federal Government who might have a better chance to set, and potentially enforce, such a law.

Let's use Second City Cop as an example.

I open my browser and enter the Second City Cop URL to call up the site. I am on Comcast, so my Comcast DNS makes a call to one of several locations: downstate Illinois, the mountains outside of Denver, somewhere in Pennsylvania, or somewhere in California to find out who hosts Second City Cop on what servers.

Once the SCC URL is parsed, it may require several additional calls for updated information to locate the actual server. Those calls are probably scattered all over hell's half acre as well: Herndon Virginia; San Diego California; Seattle Washington; and many others.

Once the server is located it might not be a fixed server. In the case of Google or any one of a number vendors, it could be "in the cloud."

Some of the newer cloud servers actually use a processor in one location, memory in another, a data interface [network card] in another and drive space in another. Even those items might be moved around - all without your ever knowing it, while you are looking at the SCC pages.

So, Illinois, along with any other state, can attempt to pass any law they want pertaining to the Internet. Neither the connection, storage, or physical date are probably located within the State. Even if they are, the routing required to access them, even if the URL request originates in the State, probably travels outside the state prior to the date being returned to the caller.

Thus, this is Federal at best - and more than likely, outside the purview of the Illinois lawmakers: which is probably to the benefit of the Internet.

See, the browser, and associated IIS theory, was pretty much invented at the University of Illinois - Urbana Champaign, but the students had the foresight to get the hell out of Illinois before they improved the code. Had they not, Netscape, Google, and Microsoft would have been taxed out of existence prior to becoming successful and their employees would be struggling with pensions which were never funded.

If, as seen here, people can testify anonymously before government bodies -- and if state employees can use their first names only on state-operated web sites, as I have recently seen, not to mention state-licensed pharmacists, social workers, etc. dealing with the public on a first-name-only basis (or no name tag at all), then anonymous writings on privately-operated web logs would definitely seem to be outside of any government purview.

Hey Ira this is an excerpt from a Federal Court case.
In a lengthy and well-reasoned decision, the Tax Court surveyed federal law on whether and when courts can permit litigants to remain anonymous and can seal a case. The Tax Court further noted that the IRS treats whistleblowers as “confidential informants” and that courts frequently protect the identify of informants.
The Tax Court granted the Whistleblower’s request to protect his identity, remain anonymous, and to redact identifying information, noting:

petitioner has demonstrated a risk of harm that far exceeds in severity mere embarrassment or annoyance. The retaliation, professional ostracism, and economic duress which petitioner reasonably fears are, we believe, no less severe than the harm posed to attorneys and doctors suing to enjoin disciplinary proceedings, unsuccessful job applicants suing to protect their reputation, public aid recipients, or Native Americans joining in a lawsuit pitting their personal interests against those of their communities--all cases in which plaintiffs have been allowed to proceed anonymously.

Gov Potatohead says we can't afford to prosecute, punish and imprison the real law breakers(Democrats) of this county but if they keep sending you away i'm going to find a way to let you out early, you know because even convicted felons can now vote in Illinois. However, if you're a law abiding citizen who purchased your guns legally and have them properly registered when the time comes to turn them in and you refuse I will build more prisons to house you lawbreakers. Remember this potatohead and you too Ira. The difference between a chicago and suburban fight is; in a suburban fight there is a lot of mutherf**king going on back and forth without a punch being thrown but in Chicago someone's getting an ass whoopin, just ask Vanecko.
